PZ-2. RANCHO SANCHEZ RV STORAGE Case Number: CPA2013002 Supervisorial District: 4 Owner/Applicant: Rojelio Sanchez Request: Comprehensive plan amendment (CPA) to change the land use designation from Proposed Annexation to Neighborhood Retail Center (CPA case approval is by Resolution, attached) Site Location: Approximately 760’ southeast of 163rd Ave. and 162nd Dr. (in the Surprise area) Site Size: Approximately 5 acres Commission Action: By a vote of 6-0, recommended approval of CPA2013002 subject to conditions ‘a’ – ‘e’ as follows: Provided the following conditions are met: a. Development and use of the site shall comply with the narrative report entitled, “Rancho Sanchez RV Storage”, including all exhibits dated revised August 20, 2013, and stamped received September 5, 2013, except as modified by the following conditions. b. The applicant is proposing to develop RV outdoor storage which, pursuant to the Maricopa County White Tank/Grande Avenue Area Plan, necessitates a change in the land use designation from Proposed Annexation to Neighborhood Retail Center. The proposal by the applicant represents a comprehensive approach to the subject property and will allow the applicant to pursue the proper entitlements pursuant to state law so that they can lawfully operate in unincorporated Maricopa County. This particular proposal is an appropriate plan for the property and is consistent with the overall intention of the comprehensive plan and area plan. However, in the event that the special use permit for this particular proposal is not approved by Maricopa County Board of Supervisors within three (3) years from the date of Board approval of this comprehensive plan amendment, this amendment shall no longer be effective as the planning justification for this comprehensive plan amendment will no longer be present. In such instance, a change of the land use designation from Neighborhood Retail Center to Rural (0-1 d.u./ac.) will occur, and all comprehensive plan land use maps shall be altered to reflect as such, because this represents superior long-range planning by Maricopa County. c. The land use designation of Neighborhood Retail Center approved as part of CPA2013002 shall be subject to the time limits set forth in the subsequent Special Use Permit, and shall change to Rural (0-1 d.u./ac.) land use designation upon Special Use Permit expiration. d. The following Flood Control District condition shall apply: 1. Prior to any future development and approval of a building permit, a Floodplain Use Permit must be obtained from the Floodplain Management and Services Division of the Flood Control District. e. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. e. The owner will obtain approval or receive a final inspection within six (6) months of Board of Supervisors determination of Z2012049 to include the following: 1. The owner shall file for a compliance inspection to determine if site improvements were constructed as established with expired permit B200104675. If the site was developed not in conformance with B200104675, then a new building permit will need to be submitted and receive a final status by Planning. If the applicant fails to acquire either a compliance inspection or building permit, this case will be scheduled for the Board of Supervisors upon recommendation of the Planning and Zoning Commission for consideration of revocation. f. All of the site improvements shall be removed within 60 days of such termination or expiration. k. The owner shall submit a written report outlining the status of the development at the end of five (5) years from the date of approval by the Board of Supervisors. The status report shall be reviewed by staff to determine whether the Special Use Permit remains in compliance with the approved stipulations. l. Amendments to the site plan and narrative report shall be processed as a revised application in accordance with Maricopa County Zoning Ordinance Article 304.9. m. Noncompliance with the conditions of approval will be treated as a violation in accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of approval may be grounds for the Planning and Zoning Commission to take action in accordance with Chapter 3 (Conditional Zoning). n. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. o. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions and stipulations. In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. 50. REVENUE AGREEMENT WITH MARICOPA ASSOCIATION OF GOVERNMENTS FOR THE DESIGN AND CONSTRUCTION OF NORTHERN PARKWAY: DYSART ROAD OVERPASS Approve Revenue Agreement (No. 14-NOR-10-03-E) between Maricopa County (the County), and the Maricopa Association of Governments (MAG) for the design and construction of Northern Parkway: Dysart Road Overpass, Maricopa County Department of Transportation MAG ALCP, Sub-Project #T427. Approval of this request will authorize the acceptance and expenditure of the funds (federal Surface Transportation Program funds), including any monies in excess of the currently estimated amount of $23,356,893.00, if adjusted by MAG for inflation. The purposes of this action are: 1) to be responsible for all project costs and submit invoices to MAG for reimbursement; 2) to be responsible for the completion of all surveys, design, plans and specifications, including contractor selection documents; 3) to conduct contractor selection process(es), award contract(s) for construction pursuant to the applicable laws, and provide necessary construction management and inspections; 4) if necessary, purchase or condemn right of way required for the completion of the Project; 5) be responsible for all utility relocations; and 6) review and approve invoices from its contractors and subcontractors before submitting invoices to MAG and the Arizona Department of Transportation (ADOT). County’s FY 2012-13 indirect cost rate is 8.0%. All costs under this agreement are for capital expenditures which are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. In November 2003, the Maricopa Association of Governments (MAG) approved a Regional Transportation Plan (RTP) consisting of highway and public transit projects, among other projects. Some of the projects are funded through a transportation excise tax, approved by the Maricopa County voters in November 2004. Other projects are funded with federal-aid highway funding, based on their eligibility. MAG is required by law to adopt a program that provides for life cycle management of the funding and programming of the Arterial Life Cycle Program (ALCP), as part of the RTP. MCDOT Sub-Project T427, Northern Parkway: Dysart Road Overpass is included in the MAG RTP ALCP and is eligible for regional funding (federal Surface Transportation Program funds) on a reimbursable basis. Under the approved June 2013 ALCP update, $23,356,893.00, which may be adjusted annually by MAG for inflation, is available for reimbursement of design and construction costs in FY2016 through FY 2018. In the event of the availability of ALCP closeout funds, some of the reimbursement funding could be received earlier than anticipated. The design and construction of this Project will be budgeted in the FY 2015 -2018 Transportation Improvement Program. As the lead agency, the County has submitted the required MAG Project Overview and must also submit a BOS approved Revenue Agreement to MAG for execution. Without this agreement, the County cannot become authorized to receive the ALCP reimbursement funding. Reimbursements will be sent to the County as part of the ALCP.
