14. EXCEPTION TO PLACEMENT IN RANGE FOR COUNTY ATTORNEY SPECIAL ASSISTANT Approve an exception to the placement in range for County Attorney Special Assistant Daniel Seiden to set his entry level salary at $57.69 per hour ($119,995 per year) commensurate with the value Mr. Seiden’s experience brings to Maricopa County. Approval of this exception is retroactive to his date of employment, November 23, 2010. Mr. Seiden plays a vital role in the County Attorney’s executive team and is responsible for relations with the legislature and other governmental entities. 42. DONATION OF TWO MODULAR BUILDINGS TO CATHOLIC CHARITIES NATIVE AMERICAN MINISTRIES Approve the donation of two modular buildings by Catholic Charities to the Catholic Charities Native American Ministries. Catholic Charities is a sub-recipient (delegate agency) to Maricopa County’s federal Head Start grant. The modular buildings were originally purchased by Catholic Charities with Head Start funds and are titled to Catholic Charities. They are currently located at a school site in the Avondale Elementary School District. This action was reviewed and approved by the Head Start Region IX Office, subject to approval by the Board of Supervisors and submission of the Board minutes to the Office of Head Start. Catholic Charities Native American Ministries will move these modular buildings at their cost to the Gila Indian Reservation in Kimatke, Arizona, for use in their programs. No Head Start or County funds will be used in the relocation. It has been determined that donation is the most cost efficient way for the Head Start Program to dispose of the modular buildings, because their current value is less than the cost of the relocation and the actual cost of their disposal would create a negative cost to the Head Start program. Offsetting entries to GMPs 3C, 4 and 6 are being processed in conjunction with this additive change order. This change order will not change the substantial completion date. A-3. ACCEPT GRANTS FOR THE CLERK OF THE SUPERIOR COURT FOR FY 2010-11 Accept FY 2010-11 grants for the Clerk of Superior Court in the amount of $1,834,946. The indirect costs (based upon a rate of 31.7% as calculated by the department of Finance) of $477,335 are not fully recoverable, as reflected in the funding agreements. FY 2010-11 grants allow for $329,157 of recoverable indirect costs and $148,178 of unrecoverable costs. Also, pursuant to A.R.S. 42-17106, approve appropriation adjustment(s) resulting in net increases to revenue and expenditures of $484,666 in the FY 2010-11 Clerk of the Court (160) COSC Grants Fund (216) Operating (0000) budget. Approval of this item will result in an overall grant funds appropriation of $1,834,946 for revenues and expenditures in the Clerk of the Court (160) COSC Grants Fund (216) Operating (0000) budget. Grant revenues are not local revenues for the purpose of constitutional expenditure limitation, and therefore, expenditure of these revenues is not prohibited by the budget law. This request does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S 42-17105. Administrative Order #95-50, approved by Presiding Judge Robert D. Myers on June 29, 1995, adopted for the Judicial Branch a policy for the administration of grant funding. The policy, identical in form and substance to the policy adopted by the Maricopa County Board of Supervisors in June 1995 for all County departments, states that the Presiding Judge (or appropriate designee) will make a presentation of Judicial Branch grants to the Board of Supervisors on an annual basis. A summary of each grant has been prepared in accordance with the provisions of the policy. Copies of the agreements and supporting documents have been provided to the Office of Management and Budget, County Finance, and Legal Departments. (C-16-11-003-G-00)

A-4. CHANGE ORDER #9 TO GILBANE BUILDING COMPANY DESIGN PHASE SERVICES CONTRACT FOR DOWNTOWN COURT TOWER PROJECT Approve Change Order No. 9 to the Gilbane Building Company Design Phase Services Contract No. C-70-08-022-5-00 (FMD-07-041) in an amount not-to-exceed $14,565.00 to add management services for the moving services contract for the Downtown Court Tower Project (No. 3325-07-380). The Downtown Court Tower is located in District 5. Funding is available within the current project budget. Change Order No.9 adds scope to the existing contract to allow for the management of the moving services contract for the Downtown Court Tower Project. When the move management was added to this contract, the moving services were anticipated to be through the current County contract. However, the current moving contractor cannot manage a project of this size. The Downtown Court Tower team has determined that the most effective and efficient method of obtaining a moving service that can manage a project of this magnitude is through a separate procurement by the contractor. This addition in scope covers the procurement and management of the moving service contract. The moving company bidding and award will be made at a later date. (C-70-08-022-5-06)
