It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. 8. POST DECREE OPEN NEGOTIATIONS FEE Pursuant to A.R.S. §11-251.08, convene the scheduled public hearing, to solicit comments and consider the adoption of Post Decree Open Negotiations Fee. Upon Board approval, this item will become effective September 24, 2014. Pursuant to Rule 66(B)(5) of the Arizona Rules of Family Law Procedure, open negotiation is a process of non-confidential negotiations between the parties conducted by a neutral third party (a Conciliator) in an attempt to resolve their dispute. The intent of this rule is to encourage the resolution of family-related cases through an additional non-adversarial dispute resolution process created pursuant to the authority of Rule 68(E) of the Arizona Rules of Family Law Procedure. The fee will be assessed when a request for an open negotiation is sought following dissolution of marriage and a report regarding legal decision making (formerly known as custody) or parenting time is issued for judicial review. Parties will be permitted to request a waiver or deferral of this fee utilizing the process that is established and no party will be precluded from pursuing relief solely due to inability to pay these costs. Upon Board approval, the post decree open negotiation costs will be assessed to each party that requests or is ordered to a post decree open negotiation. Requests for post decree open negotiations are directed to the Court’s Conciliation Services unit with the Family Court Department. When a post decree open negotiation is requested, a Conciliator is scheduled with the parties. Administrative support staff time is expended as is time during the open negotiation and in drafting a report for the court. The final product that is forwarded to the judicial officer for review is a completed parenting plan or the parties position statements depending on the outcome of the conference. None of these costs are currently billed to the parties and current statutes never contemplated this service provided to the parties. Regardless how well-satisfied the parties might be with initial results of their original judgment, many couples become discouraged with the court orders as they apply these directives to daily parenting time, child(ren) exchanges, support, and legal decision making issues. This leads to one or both parents coming back to the Court to seek relief. Authorizing the Post Decree Open Negotiations Fee of $100 per party will provide the Court needed resources for staff time that is expended in preparing reports for the Court. Revenue generated from this fee will be deposited into the Superior Court Special Revenue Fund 259 and used to offset the costs associated Post Decree Open Negotiations. Revenue projections for FY14 will be approximately $45,000; a full year of revenue is projected at $68,000. (C-80-15-001-2-00)

These adjustments will result in a countywide net impact of zero. In the past the Department of Public Health has provided such information to the health clinics and hospitals at no cost. 65. MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS AQ-2014-001-INCORPORATION BY REFERENCE 2013-2014 Pursuant to A.R.S. §49-479(b), set a public hearing for November 5, 2014 to solicit comments and consider the adoption of incorporating federal standards into Maricopa County Air Pollution Control Regulations, Rule 321 (Municipal Solid Waste Landfills), Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Upon Board approval, this item will become effective November 5, 2014. The Maricopa County Air Quality Department (department) is proposing to revise Rules 321, 360, 370, 371, and Appendix G by incorporating federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA): New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2013, to July 1, 2014, in each of the rules and appendix to remain current with federal regulations. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rule or law was proposed and adopted. The department did not receive any public comments during the public comment period. (C-85-15-005-7-00)

F-1. CONSTRUCTION MANAGER AT RISK CONTRACT FOR VINEYARD ROAD FLOOD RETARDING STRUCTURE REHABILITATION PROJECT Authorize the Flood Control District of Maricopa County (District) to issue a Request for Qualifications for Vineyard Road Flood Retarding Structure (FRS) Rehabilitation Construction Manager at Risk Pre-Construction and Construction Services. Authorize the District to award the pre-construction services contract FCD 2014C014 to the selected respondent, and pending negotiation of a mutually acceptable Guaranteed Maximum Price, to award one or more construction services contracts to the selected respondent. The estimated total cost of the contracts is $55,969,500. This is a qualification-based selection in accordance with Maricopa County Procurement Code, Article 5, Paragraph 503(F) and Chapter IV of the Maricopa County Procedures Manual. Vineyard Road FRS is one of three District operated and maintained earthen FRSs located in northwestern Pinal County, east of the Central Arizona Project (CAP) canal and south of Baseline Road. These three FRSs work as a hydraulically connected system, where the impoundment water from all three FRSs discharges to one outlet, the Powerline Floodway. The Powerline, Vineyard Road, and Rittenhouse FRSs Rehabilitation or Replacement Project was a District sponsored planning study which analyzed alternatives and selected a preferred alternative that would; correct the dam deficiencies, maintain the flood control benefits to downstream properties, and comply with NRCS and state dam safety requirements. The selected alternative for Vineyard Road FRS involves raising and rehabilitating the structure. The raising and rehabilitation of the 5-mile long Vineyard Road FRS involves reconstructing two emergency spillway reinforced concrete structures, raising the embankment, constructing a filter for the entire length of the structure, reconstructing the principal outlet, and erosion protection measures. This Agenda Item impacts Supervisorial Districts 1 and 2. (C-69-15-008-5-00)
