20. Contingency DOLLARS TO COMPLY WITH GRAVES V ARPAIO Approve two additional Physicians Assistants (PA's) to support the Graves v Arpaio Fourth Amended Judgment Paragraph 5.a(2): "If the receiving screening indicates a pretrial detainee is suffering from a serious acute or chronic health condition, a physician, physician assistant, or nurse practitioner will conduct a face-to-face examination of the pretrial detainee within 24 hours after the receiving screening. FY2015 costs are estimated at $118,579 (Detention Fund operating). Due to limited contingency funds, all funding in FY2015 is requested from non-operating contingency. Therefore; it will be necessary for the FY2016 Detention Fund Operating budget to fund these expenses on an on-going basis, requiring a threshold adjustment of $203,279 (and also adjusted for any fixed or variable benefit increases from FY 2015 to FY 2016) to the FY 2016 Correctional Health (260) Detention Fund (255) budget threshold. In accordance with A.R.S 42-17106(B), authorize the following amendments to the FY 2016 budget: a) Decrease the expenditure appropriation for the Non Departmental (470) Detention Fund (255) Non-Operating (0001) Contingency (4711) in the line "Unreserved Contingency " by $118,579; b) Increase the expenditure appropriation for Correctional Health (260) Detention Fund (255) Non-Operating (0001) appropriation by $118,579; c) Direct OMB to include an adjustment of $203,279 to the FY 2016 Correctional Health (260) Detention Fund (255) Operating (0000) budget threshold to fund the annualized operating cost associated with this action. These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. This action supports the compliance with Paragraph 5.a(2) of the Graves v Arpaio Fourth Amended Judgment. (C-26-15-003-M-00)

The Rewarding Ideas Merit Award Board met on October 28, 2014, and approved the following recommended employee awards. 22. FEDERAL FISCAL YEAR 2014 EMERGENCY MANAGEMENT PERFORMANCE GRANT (EMPG) Approve and Accept the Federal Fiscal Year 2014 Emergency Management Performance Grant (EMPG) Grant # EMW-2014-EP-000016, CFDA # 97.042, in the amount of $657,866. These grant funds are for Emergency Planning within Maricopa County. The grant award begins on October 1, 2013 and ends on June 30, 2015. The grant allows for full recovery of our indirect costs, or $66,510.00 which may be incurred by the Department of Emergency Management for the administration of this grant. The Maricopa County Department of Finance has calculated the Department of Emergency Management's composite indirect cost rate at 13.50%, or $66,510.00. The recoverable indirect cost of administering this grant is $66,510.00. In addition, approve an increase in revenue and expenditures for Fiscal Year 2015 for Emergency Management Department (150) in the Emergency Management Fund (215) Operating (0000) in the amount of $94,222. The Fiscal Year 2015 budget was approved by the board at $563,644 for this grant. 23. EMPLOYEE BENEFIT TRUST – BENEFIT HOLIDAY Approve a benefit holiday of Medical Plan related premiums paid to the Employee Benefit Trust by employees for the 12/7/2014 payroll in an amount which is estimated to be $475,026 and approve a benefit holiday of Medical Plan related premiums paid to the Employee Benefit Trust by departments for the employer share for the 12/7/2014 payroll in an amount which is estimated to be $4,674,024. As benefit premiums fluctuate with each payroll, the total rebate will not exceed $5,500,000. The funding for this action will be sourced from a reduction of Employee Benefit Trust revenues. The employee rebate will be implemented by not charging employees for medical plan related premiums for all employees that have an active “A” status or leave status of “L” or “P” at the time of the refund. The employer portion of the holiday will be implemented in the same manner as the employee holiday. The Benefit premiums involved in this action will be for the following Self-Funded plans: three Medical Plans, one Pharmacy Plan, one Behavioral Health Plan and the three benefit premium incentive programs. This action will reduce Benefit Trust revenues but will not eliminate the Benefit Cost allocation to the departments for the 12/7/2014 pay period. The cost allocation was budgeted to be lower than actual benefit premium charges and thus the departments have already benefited from receiving a discounted cost allocation. (C-39-15-011-2-00)

24. EXPENDITURE AUTHORITY FOR DUET AND OTHER RELATED VECTOR CONTROL EQUIPMENT AND SUPPLIES Pursuant to A.R.S. § 42-17106, authorize the Office of Management and Budget to reserve expenditure appropriation in an amount not-to-exceed $450,000 in Non-Departmental (470) General Fund (100) Non-Recurring (0001), for the purchase of Duet, a vector control product, electric foggers and additional mosquito control products and directly related supplies. Also, authorize the Office of Management & Budget to transfer FY 2014-15 expenditure appropriation of an amount not-to-exceed $450,000 from Non-Departmental (470) General Fund (100) Non-Recurring (0001) to Environmental Services (880) General Fund (100) Non-Recurring (0001). The transfer will only be made if the Environmental Services Department is unable to cover remaining General Fund expenditures within its current appropriation. Approval of this action will provide funding authority to the Environmental Services Department to purchase the vector control adulticiding chemical, Duet, which is an environmentally friendly and effective vector abatement, electric foggers and additional mosquito control products and directly related supplies. This funding will allow for continued mosquito outbreak control due to unexpected heavy rain storms causing enormous amounts of standing water throughout the County during the months of September and October. The need for an FY 2014-15 budget adjustment will be evaluated based on the timing of additional adulticide being purchased. Previously dispersed larvacides were also washed away during these storms, which makes it necessary to re-treat areas within Maricopa County. The funding would allow the Environmental Services Department to purchase eight (8) totes of Duet, three (3) electric foggers, additional mosquito control products and other directly related supplies. Calendar year to mid-October Environmental Services has received a total of 14,428 mosquito complaints. Last year Environmental Services received a total of 6,189 complaints for the entire fiscal year. Environmental Services has treated 326,568 acres for adult mosquitoes fiscal year to date. Environmental Services treated 194,757 acres total in fiscal year 2014. Fiscal year to date, Environmental Services has incurred 1,126 hours of overtime for fogging. (C-88-15-002-2-00)

78. RESOLUTION APPROVING THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE TOWN OF FLORENCE, INC EDUCATION REVENUE BONDS (ACCEL REFUNDING PROJECT) Adoption of a resolution approving the issuance by The Industrial Development Authority of the Town of Florence, Inc., of not to exceed $3,000,000 of Education Revenue Bonds (ACCEL Refunding Project), this resolution being adopted solely for the purpose of satisfying the requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended. The Industrial Development Authority of the Town of Florence, Inc., proposes to issue its not to exceed $3,000,000 Education Revenue Bonds (ACCEL Refunding Project), Series 2014 (the “Bonds”) to redeem and refund The Industrial Development Authority of the City of Phoenix 501(c)(3) Revenue Bonds (ACCEL Project), Series 2009 (the “Bonds to be Refunded”) outstanding and to pay all or a portion of the costs of issuance of the Bonds. The Bonds to be Refunded were used to finance or refinance the acquisition, construction, renovation, improvement, expansion, equipping and operation of two private nonsectarian school facilities serving special education students ages 5-22 and located at 1430 East Baseline Road in Tempe, Arizona and 2821 West Northern Avenue in Phoenix, Arizona. ACCEL is an Arizona nonprofit corporation designated as a 501(c)(3) corporation under federal law that operates schools and programs for individuals with cognitive, behavioral, and physical challenges by providing educational, therapeutics and vocational programs. ACCEL contracts with over 40 Maricopa County school districts and serves over 300 special needs students and over 40 adults on five sites within Maricopa County. Due to the fact that the financed facilities are located in Maricopa County, Section 147(f) of the Code requires that the issuance of the bonds be approved by the Maricopa County Board of Supervisors, solely for satisfying the requirements of said Section 147(f), this approval being in addition to the regular approvals required by the Florence IDA and the Florence Town Council. The Bonds will be special limited obligations of the Authority and will not be a debt, obligation or liability of Maricopa County. (C-94-15-009-4-00)

79. RESOLUTION APPROVING THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE TOWN OF FLORENCE, INC. REVENUE BONDS (VIRGINIA WELLNESS PROJECT) Adoption of a resolution approving the issuance by The Industrial Development Authority of the Town of Florence, Inc., of not to exceed $5,000,000 of Revenue bonds (Virginia Wellness Project), this resolution being adopted solely for the purpose of satisfying the requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended. The Industrial Development Authority of the Town of Florence, Inc., proposes to issue its not to exceed $5,000,000 Revenue Bonds (Virginia Wellness Project), Series 2014 (the “Bonds”) to finance the costs of (i) acquiring, constructing, and equipping an approximately 38,500 square foot wellness center providing behavioral health services and related land and facilities to be located at 337 E. Virginia Avenue, Phoenix, Arizona 85004, Arizona; (ii) funding any required reserve funds related to the Bonds; and (iii) paying certain issuance expenses related to the Bonds (collectively, the “Project”). The Project will be owned, operated, and/or managed by Virginia Wellness, LLC, an Arizona limited liability corporation, whose sole member is Native American Connections, Inc., an Arizona nonprofit corporation designated as a 501(c)(3) corporation under federal law (“NAC”). NAC provides housing and behavioral health services to urban Indians and non-Indians. NAC seeks to improve the lives of individuals and families through Native American culturally appropriate behavioral health, affordable housing, and community development services. Since 1972, NAC has grown from a small grassroots organization operating one program for Native American men in recovery from substance abuse into one which now owns and operates over 15 sites throughout Central Phoenix offering a continuum of affordable housing and behavioral health services which touch the lives of over 5,000 individuals and families each year. The Project is intended to replace existing behavioral health facilities currently owned and operated by NAC. NAC is a borrower entity with respect to the $5,380,000 The Industrial Development Authority of the County of Maricopa Revenue Bonds (NAC 4520 Project), Series 2012A and Series 2012B.
