All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. f. Development of the site shall be in compliance with all applicable Maricopa County Air Quality rules and regulations. g. Development of the site shall be in conformance with all Federal and State requirements, including but not limited to, Federal Communications Commission (FCC), Federal Aviation Administration (FAA), National Environmental Policy Act (NEPA), and State Historical Preservation Office(SHPO). All of the site improvements shall be removed within 60 days of such termination or expiration. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions and stipulations. In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted.

48. IGA FCD 2012A015 BETWEEN MARICOPA COUNTY AND FLOOD CONTROL DISTRICT FOR FLOOD OPERATIONS AND EMERGENCY RESPONSE TO DAM AND LEVEE SAFETY EVENTS Approve Intergovernmental Agreement (IGA) FCD 2012A015 for flood operations and emergency response to dam and levee safety events between Maricopa County (County) and the Flood Control District of Maricopa County (District). The purpose of this IGA is to identify and define the responsibilities of the County and the District in providing emergency services to the residents of Maricopa County during times of District managed dam or levee related emergencies. This purpose includes complying with responsibilities listed in the Emergency Action Plans to coordinate between the County and the District monitoring of operational conditions and emergency response activities in the event of a flood emergency. Included in this IGA is maintenance of the notification database system. The County through the Maricopa County Department of Emergency Management (MCDEM) will maintain the notification database developed and implemented by the District (at an estimated cost of $50,000). MCDEM is allowed to include non-District notification lists as appropriate to MCDEM emergency operations. MCDEM will fund the cost of annual maintenance of the implemented system and any additional costs associated with the inclusion of any non-District notification lists. District may cost share in the annual maintenance of the notification database system for those costs directly related to EAP implementation (at an estimated annual cost of $6,000). The IGA becomes effective when executed by all parties. The IGA shall expire five years from the date executed by all parties but shall be automatically renewed for additional five year periods unless either Party give twelve months written notice of intent to terminate this Agreement. The District manages 22 dams and more than 30 miles of levees within and without Maricopa County. The District dams are regulated by the Arizona Department of Water Resources (ADWR). Select levees are accredited by the Federal Emergency Management Agency (FEMA). Each regulated dam is required by the ADWR at Arizona Administrative Code (A.A.C.) R12-15-1221 to have a written Emergency Action Plan (EAP). The District relies on MCDEM to provide certain emergency services as set forth in each EAP. MCDEM relies on the District to supply certain data to MCDEM necessary for it to respond. This Agenda Item impacts Supervisorial Districts 1, 2, 3, 4 and 5. (C-15-13-006-M-00)

F-2. AMENDMENT TO IGA FCD 2009A011A WITH THE TOWN OF QUEEN CREEK FOR SONOQUI WASH CHANNELIZATION PROJECT PHASE II Approve IGA FCD 2009A011A Amendment No. 1 for the SONOQUI WASH CHANNELIZATION PROJECT PHASE II (Project [#480]) between the Flood Control District of Maricopa County (District) and the Town of Queen Creek. This IGA amendment is for revising the terms of utility relocation cost reimbursements. The IGA Amendment shall become effective when executed by both parties. The District completed the Queen Creek and Sonoqui Wash Hydraulic Master Plan in 2000 that indicated that the most feasible solution to contain the breakouts from Sonoqui Wash was to increase the conveyance cross-section to contain the 100-year flood flows. The subject Project accomplished the second phase of improvements to the wash and was completed in 2012. Queen Creek was responsible for utility relocations in the second phase. For those utility relocations accomplished by the District, Queen Creek was to reimburse the costs. Due to financial constraints, the District and Queen Creek agree to revise the terms to allow Queen Creek to reimburse the District in installments over several fiscal years extending to FY2017. F-4. IGA BETWEEN MARICOPA COUNTY AND THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY FOR FLOOD OPERATIONS AND EMERGENCY RESPONSE TO DAM AND LEVEE SAFETY EVENTS Approve Intergovernmental Agreement (IGA) FCD 2012A015 for flood operations and emergency response to dam and levee safety events between Maricopa County (County) and the Flood Control District of Maricopa County (District). (C-69-13-025-3-00)

This entire Drainage System includes approximately 19 miles of channel and associated basins from Clearview Boulevard (north of Bell Road) to the Gila River along the proposed SR 303L freeway alignment. In accordance with the original IGA, the District will fund, construct, and maintain the segment of the Drainage System from 250 feet south of Van Buren Street to the Gila River (with a length of 4.6 miles), called the Outfall, while the approximately 14 miles of the Drainage System north of this segment are the responsibility of ADOT. This Agenda Item impacts Supervisorial District 4. (C-69-10-056-3-01)
