In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. 13. ACCEPT FY2013 STATE CRIMINAL ALIEN ASSISTANCE FUNDS Approve acceptance of $1,127,899 Federal FY2013 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-13-075-G-00), on April 24, 2013. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as determined by the Office of Management and Budget, will be stated in the electronic request to drawdown the funds not later than December 2, 2013. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The Sheriff's Office has applied for this formula-based reimbursement on behalf of the County for many years. SCAAP reimburses state and local government agencies a portion of the costs to incarcerate undocumented criminal aliens who are convicted of felony offenses. Indirect costs are not recoverable since the salaries of only staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates are allowable in the calculation. The plan will be valid until superseded by an updated version. The plan will be effective December 1, 2013. There is no cost to the County and no revenue will be generated. This plan is a joint plan that assigns emergency functions to the emergency response organizations of the State of Arizona and the County of Maricopa as delineated within the plan. The "Offsite Emergency Response Plan for Palo Verde Nuclear Generating Station" is based upon U.S. Nuclear Regulatory Commission and Federal Emergency Management Agency guidance to state and local governments, as contained in NUREG-0645 (FEMA-REP-1, Revision 1) "Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants." 41. EMPLOYEE BENEFIT TRUST – BENEFIT HOLIDAY Approve (1) a benefit holiday of Medical Plan related premiums paid to the Maricopa County Employee Benefit Trust Fund by employees for the 12/8/2013 payroll in an amount which is estimated to be $520,821; and (2) a benefit holiday of Medical Plan related premiums paid to the Maricopa County Employee Benefit Trust Fund by County departments for the employer share of premiums for the 12/8/2013 payroll in an amount which is estimated to be $4,709,214. As benefit premiums fluctuate with each payroll, the total rebate will not exceed $5,500,000. The Maricopa County Self-Insured Benefits Board of Trustees has reviewed and recommended approval of this action. The purpose of this premium holiday is to reduce fund balance in the Benefits Trust in excess of recommended reserves as of June 30, 2013, as directed by the FY 2014 Adopted Budget. The premium holiday will eliminate about half of the excess balance. A second premium holiday is planned for later in the fiscal year, and will be brought forward for approval in a subsequent agenda item. The employee premium holiday will be implemented by not charging employees for medical plan related premiums for all employees that have an active “A” status or leave status “L” or “P” at the time of the premium holiday. The employer portion of the premium holiday will be implemented in the same manner as the employee holiday. The benefit premiums involved in this action will be for the following Self-Funded plans: three Medical Plans, one Pharmacy Plan, one Behavioral Health Plan and the three benefit premium incentive programs. This action will reduce Employee Benefit Trust Fund revenues but will not eliminate the Benefit Cost allocation to the departments for the 12/8/2013 pay period. The cost allocation was budgeted to be lower than actual benefit premium charges and thus the departments have already benefited from receiving a discounted cost allocation. (C-39-14-009-2-00)

45. ADDITION OF MODULAR BUILDINGS TO COUNTY FLEET Approve transfer of titles for eight modular buildings from Catholic Charities to the Maricopa County’s Equipment Services fleet. These modular buildings were purchased during the grant periods 1997-2003 with U.S. Department of Health Services (DHS) federal funding and had been titled to the delegate agency (Catholic Charities) at the time of purchase. Federal requirements under 45CFR1309 (.20-.23) require the modular buildings purchased from federal funds be titled in the grantee’s name. Grant Funds from Head Start/Early Head Start program (C-22-13-040-G-00) will be used to pay for maintenance of this equipment. No general funds will be used. As a result of discussions with the regional Office of Head Start (OHS) in October 2012 the department began a review of all modular buildings purchased with DHS grant funds for compliance with property regulations contained in 45CFR1309. This was identified as a common area of non-compliance for Head Start grantees during federal reviews concluded for the federal fiscal year 2012. As a result of this review, Head Start has identified a number of modular buildings require title corrections to be made for our program to comply with the current regulations. To complete this process, vehicle identification numbers (VIN#) on these modular buildings had to be identified and in some cases duplicate titles obtained. Catholic Charities provided assistance in this process. (C-22-14-036-V-00)

66. PUBLIC HEALTH FY2013-14 GRANT BUDGET APPROPRIATION ADJUSTMENTS Approve increases in the appropriated budget for Public Health (860) Public Health Grant Fund (532) Operating (0000) in the amount of $404,167 in revenues and $404,167 in expenditures as identified on the Fiscal Year 2013-2014 Grant Summary Worksheet on file in the Office of the Clerk of the Board and retained in accordance with ASLAPR approved retention schedule. This appropriation adjustment brings MCDPH’s grant budget to the amount of $42,589,926. The appropriation adjustment is necessary because the carry forward amounts of prior year grants and award amounts of new grants differ from the amount approved in the FY 2013-2014 Budget Appropriation. This action is in accord with the action plan developed by the Office of Management and Budget and MCDPH to insure compliance with the Board approved Budgeting for Results Accountability Policy. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The indirect cost rate is 15%, as calculated by the Department of Finance. Most of the grants for FY 2013-2014 allow for indirect cost recovery, as reflected in the funding agreements. The status of the indirect costs for each grant is noted on the Grant Summary Worksheet on file in the Office of the Clerk of the Board and retained in accordance with ASLAPR approved retention schedule.
