5. EMPLOYEE AWARDS FOR THE REWARDING IDEAS PROGRAM Present the following employees awards from the Rewarding Ideas Program: Emelda Dailey, $557, Superior Court: Proposed eliminating the use of pre-stamped envelopes for mailing family court and civil court settlement conference evaluation forms to Alternative Dispute Resolution. This change has deferred the cost of postage to parties/counsel, resulting in an annual tangible savings of $2,784. Leslie Glover, $2,500, Equipment Services: Proposed a change to reduce the installation and maintenance of fire extinguishers in county vehicles. This change reduced the amount of vehicles with fire extinguishers, resulting in an annual tangible savings of $28,000. Gary Heath, $2,500, Sheriff’s Office: Proposed changing the service packaging of peanut butter. The change used the existing equipment, eliminating the need for new equipment, removing production from the bakery, reducing the risk of cross contamination, and using less expensive materials. This resulted in increasing the amount of production and realized a tangible savings of $36,382. (C-20-13-043-M-00)

PZ-1. EAST VALLEY MEN’S CENTER Case Number: CPA2012011 Supervisorial District: 1 Applicant: Beus Gilbert, PLLC Owner: Beus Gilbert, PLLC Request: Comprehensive plan amendment (CPA) to change the land use designation from Rural Development Area to Institutional. CPA case approval is by Resolution. Site Location: Southeast corner of Lehi Rd. and Country Club Dr. (in the Mesa area) Site Size: Approx. 3.17 acres Commission Recommendation: By a vote of 7-0, recommended approval subject to conditions ‘a’ – ‘b’ as follows: Provided the following conditions are met: a. Development and use of this site shall comply with the narrative report entitled, “East Valley Men’s Center”, including all exhibits dated revised April 9, 2013, and stamped received April 9, 2013, except as modified by the following conditions. b. The granting of this change in land use designation of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any condition does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date this Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. The following Drainage Review conditions shall apply: 1. All development and engineering design shall be in conformance with the Drainage Regulation and current engineering policies, standards and best practices at the time of application for construction. 2. In accordance with request from the Maricopa County Sheriff’s Office, the facility shall assure the site has adequate lighting for nighttime security, and nighttime security personnel. No amendment to the SUP site plan will be required for this improvement. i. This Special Use Permit shall expire twenty (20) years from the date of approval by the Board of Supervisors, or upon termination of the use, whichever occurs first. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions and stipulations. In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. If the Board rescinds this DMP and reverts the current land use designations back to Rural (0-1 du/ac), all entitlements associated with this project that were conditional pursuant to the Maricopa County Zoning Ordinance may also be considered by the Board, upon recommendation by the Commission, for reversion to the prior entitlements. In such an event, the comprehensive plan land use map, area plan land use map, and, as applicable, zoning map shall be altered to reflect Board action. d. Goldwater Gunnery Range, and other flight training areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 A.M. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends.” Such notification shall be permanently posted in front of all home sales offices on not less than a 3 foot by 5 foot sign, be permanently posted on the front door of all home sales offices on not less that an 8½ inch by 11 inch sign, be included in all covenants, conditions, and restrictions (CC&Rs) and be included in the public report. x. At the time each residential building permit is issued, two-hundred fifty dollars ($250) per residential unit will be paid by the developer to a park enhancement fund for trails and facilities enhancement and maintenance. The county shall deposit and hold all receipts in the parks special revenue fund for the specific purposes stated above. All interest earned on the fund shall remain an asset of the fund. The assets of this fund are not intended to replace existing county appropriations for similar purposes, but rather are intended as supplemental resources resulting from additional park usage by desert whisper residents. Details regarding this assessment are to be addressed in the development agreement. (C-44-13-107-M-00)

43. ACCEPT ADDITIONAL GRANT FUNDS FROM ASPCA Approve and accept additional grant funds from American Society for the Prevention of Cruelty to Animals (ASPCA) of Harrison, MI, in the amount of $20,200. These grant funds are for participation in the Carroll Petrie Foundation Dog Rescue Project through the ASPCA Community Outreach Program. The term of the grant is from October 31, 2012 through May 31, 2013. This grant is non-renewable. 44. APPROPRIATED BUDGET ADJUSTMENT FOR INTEGRATED CRIMINAL JUSTICE INFORMATION SYSTEM DISASTER RECOVERY Approve an increase in the FY2013-14 appropriated expenditure budget for Integrated Criminal Justice System (421) Detention Fund (255) Non-Recurring, Non-Project (0001) in the amount of $41,500 and approve the decrease of Non Departmental (472) Detention Fund (255) Non-Recurring (0001) General Contingency in the amount of $41,500. The appropriation adjustment is necessary because the carry forward amount for the department’s Disaster Recovery Project differs from the amount approved in the FY2013-14 Budget Appropriation. The approval of this budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. On March 27, 2013, the Board of Supervisors approved agenda item number C-56-13-009-M-00. That agenda item authorized additional funding for the Disaster Recovery/Data Center Relocation Project to ensure that ICJIS production infrastructure is rebuilt in a co-located facility with the Sheriff’s Data Center in the new Sheriff Headquarters building. The ICJIS functionality needs to be moved before the existing Sheriff’s Data Center is relocated, and that project is anticipated to start in the summer of 2013. The funding approved in agenda item C-56-13-009-M-00 included $41,500 for consultant services to install the new equipment. The equipment has been purchased but it cannot be installed until building occupancy is permitted. Given that the installation cannot occur until after July 1, 2013, it is requested that the amount of $41,500 be re-appropriated from FY2012-13 to FY2013-14, so that the necessary consultant services are funded upon occupancy of the new Sheriff Data Center. 96. IGA WITH THE TOWN OF GILBERT FOR POWER ROAD FROM STATE ROUTE 202L TO NUNNELLEY ROAD Approve the Intergovernmental Agreement between Maricopa County (County) and the Town of Gilbert (Town) for Power Road from State Route 202L (SR 202L) to Nunnelley Road and the traffic signal at the intersection of Power Road and Nunnelley Road. The County will not participate financially in the Project. The Project will include adjustments to the through travel lanes on Power Road, turning movements to and from Power Road, design and construction of a traffic signal at the intersection of Power Road and Nunnelley Road, and other related infrastructure improvements. The Town will be the lead agency for the Project and will be responsible for 100 percent of the cost of the Project not otherwise borne by the developer. The County will have no responsibility, financial or otherwise, for any aspect of the Project. The County’s primary role in the Project will be to request the Arizona Department of Transportation (ADOT) to abandon a portion of Power Road (just north of SR 202L) to the County and then process the Town’s annexation of the same portion of Power Road after ADOT has abandoned the road to the County. 97. ABANDONMENT OF POWER ROAD NORTH OF STATE ROUTE 202L (SR202L) Authorize the Maricopa County Department of Transportation (MCDOT) Director/County Engineer to request abandonment of Power Road north of State Route 202L (SR202L) from the Arizona Department of Transportation (ADOT) to the County in accordance with Arizona Revised Statutes (A.R.S.) Section 28-7209. Also authorize the Maricopa County Department of Transportation (MCDOT) Director/County Engineer to cooperate with ADOT to waive the advance notification requirements and surface condition requirements of A.R.S Section 28-7209, and to take all appropriate actions to accomplish the abandonment and a subsequent annexation of Power Road by the Town of Gilbert. The Town of Gilbert is seeking to make improvements to Power Road between SR 202L and Nunnelley Road in the summer of 2013. To accomplish this project in a timely manner, the Town needs to acquire Power Road right-of-way that is currently under the control of ADOT. However, due to provisions in state law related to annexation (A.R.S. 9-471), ADOT may not abandon the right-of-way directly to the Town, but must first abandon the right-of-way to the County, and then the Town can subsequently annex the right-of-way from the County. The first step is to accomplish the ADOT abandonment of Power Road to the County in a timely manner. Normally, under A.R.S. Section 28-7209, ADOT must provide four years advance notice of abandonment to an affected jurisdiction and the pavement must be in such a condition that additional surface treatments and major maintenance are not required for at least five years. However, the same statute allows ADOT and the affected local jurisdiction to waive these requirements by mutual agreement. These waivers are needed to ensure the Town of Gilbert can acquire the right-of-way in time to complete their project on Power Road. Therefore, MCDOT is requesting Board of Supervisors to authorize the MCDOT Director/County Engineer to officially ask ADOT for and agree to waivers from these requirements for the abandonment of Power Road. The waivers would ultimately be agreed to by the State Transportation Board. The second step will be Gilbert’s annexation of Power Road between SR 202L, which will be administered through normal statutory process and facilitated under a separate agenda item for Power Road, State Route 202L (SR202L) to Nunnelley Road. The Town of Gilbert is the lead agency for the Power Road project and will be responsible for 100 percent of the cost of the project. The County will have no responsibility, financial or otherwise, for any aspect of this Power Road design and construction project. Supervisory Districts No. 1 and 2 (C-64-13-161-M-00)
