5. REVISION TO MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS: AQ-2015-001-INCORPORATION BY REFERENCE 2014-2015 Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of Maricopa County Air Pollution Control Regulations: Rule 321 (Municipal Solid Waste Landfills), Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Following the public hearing, the Board is requested to adopt the incorporations into the Maricopa County Air Pollution Control Regulations.. Upon Board approval, this item will become effective November 18, 2015. The Maricopa County Air Quality Department (department) is proposing to revise Rules 321, 360, 370, 371, and Appendix G by incorporating federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA): New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2014, to July 1, 2015, in each of the rules and appendix to remain current with federal regulations. The adoption of the proposed amendments to Maricopa County Air Pollution Control Regulations Rules 321, 360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of authority to the department for the implementation and enforcement of the federal regulations and documents. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rule or law was proposed and adopted. The department did not receive any public comments during the public comment period. (C-85-16-002-M-00)

14. COMPETITION IMPRACTICABLE PROCUREMENT WITH SAFE BOATS INTERNATIONAL FOR REPLACEMENT PATROL BOAT Approve a Competition Impractical Procurement as authorized by Maricopa County Procurement Code, MCI-351, for the not-to-exceed amount of $200,000.00 with Safe Boats International to purchase a replacement patrol boat for the Maricopa County Sheriff’s Office (MCSO) Lake Patrol Division. The current patrol boat (LP67) has exceeded its useful life. This purchase is funded through a Boating Law Enforcement Safety grant. The Board approved the acceptance of funding from the Arizona Game and Fish Commission on August 19, 2015, (C-50-16-006-G-00) for law enforcement boating that authorized the purchase and/or replacement of watercraft patrol boats. MCSO currently has four (4) Safe Boats in its fleet which have proven to provide a much better overall operational platform for Lake Patrol's operational requirements. SAFE boats were designed for, and used in a variety of law enforcement mission profiles to include port security, patrol, marine and boating safety, law enforcement, drug interdiction, and search and rescue. The Safe Boat is a semi-rigid construction that utilizes a full-sized foam collar system for flotation, stability and fendering. This full-sized foam collar system is unlike other manufacturer's collar systems that are susceptible to deflation and catastrophic failure due to temperature fluctuations, live fire/bullets, or striking docks, buoys, pilings or other obstacles. One (1) of these vehicles will be purchased using operating funds that exist within Adult Probation’s General Fund (Fund 100) at an estimated cost of $25,000. Two (2) of these vehicles will be purchased using operating funds that exist within Adult Probation’s Detention Fund (Fund 255) at an estimated cost of $50,000. Four (4) vehicles will be purchased using operating fund that exist in the Non Departmental Vehicle Replacement Fund (Fund 100) at an estimated cost of $100,000. Also, approve an exemption from markings and issuance of non-governmental license plates per A.R.S. §38-538.03 because these vehicles will be used to provide surveillance and supervision of convicted felons residing in the community and the location and apprehension of felony absconders. Markings are detrimental to the mission. These will be take home vehicles because surveillance and apprehension are not regularly scheduled assignments with set hours. The vehicle information, including make, model, year, color and VIN number will be provided to the Clerk of the Board upon approval of this agenda and purchase of the vehicles. FY2015-16 additional operating expenses for the new vehicles are estimated to be approximately $5,000 for the General and Non Departmental Fund vehicles and $2,000 for the Detention Fund vehicles. These costs will be absorbed in the Adult Probation General and Detention Fund operating budgets. These vehicles replace seven (7) state vehicles that have past their useful life and have not been replaced by the state, and were never part of the County’s vehicle fleet. The annual savings from the state lease for the seven (7) vehicles is estimated at $7,560.00 ($90/month/vehicle). These funds will be used to offset additional fuel and repair costs for the seven (7) new vehicles. (C-11-16-001-V-00)

35. 2015 MARICOPA COUNTY UNINCORPORATED AREA HAZARD MITIGATION PLAN Adopt a Resolution to approve and accept the 2015 Maricopa County Unincorporated Area Hazard Mitigation Plan as the official plan of Maricopa County. The mitigation plan identifies and establishes county policies and tools that will be implemented in the unincorporated areas of the county, over the long term, which will result in a reduction of risk and potential future losses from a disaster event. The Maricopa County Unincorporated Area Hazard Mitigation Plan is incorporated into the Maricopa County Multi-Jurisdictional Hazard Mitigation Plan which also includes plans from the cities, towns and tribes within Maricopa County. This multi-jurisdictional plan establishes a framework to ensure that the most appropriate and equitable mitigation projects are undertaken. State and local governments that have established mitigation plans that meet the Disaster Mitigation Act of 2000 criteria and have their mitigation plans approved by the Federal Emergency Management Agency (FEMA) are eligible to receive increased future grant funding. Conversely, if states and local governments do not have a FEMA-approved mitigation plan, they will not be eligible to apply for certain grant funding. There is no financial impact to the county as a result of this plan. (C-15-16-001-M-00)

56. TEMPORARY ACCESS LICENSE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT WITH CITY OF GOODYEAR AND CONSENT WITH TRES RIOS GOLF LLC AT ESTRELLA MOUNTAIN REGIONAL PARK Approve the Temporary Access License and Indemnification and Hold Harmless Agreement (“License”) between Maricopa County and the City of Goodyear and attached Consent to Temporary Access License and Indemnification and Hold Harmless Agreement (“Consent”) with Tres Rios Golf, LLC. The License allows for conducting site investigations and collection of data at Estrella Mountain Regional Park for development of a Design Concept Report for a potential wetlands project. The City of Goodyear (“City”), in cooperation with the United States Bureau of Reclamation (“BOR”), engaged in a pilot project using vertical flow wetlands to manage concentrate discharge from the City’s Bullard Water Campus Reverse Osmosis Facility. The City, in cooperation with BOR, conducted a study and identified Estrella Mountain Regional Park (including Tres Rios Golf Course) (“Park”) as potential locations that would be suitable for the development of wetlands and a blending pond for treatment of large quantities of the concentrate discharge. Both the Consent and License will provide the City of Goodyear and it’s consultant site access for purposes of conducting site investigations and data collection, among other things necessary to complete the scope of work in the License. It is expected that creating wetlands and a blending pond at the Park will provide a habitat for additional wildlife, provide interpretative and environmental education, and allow for additional passive recreational opportunities. It is also expected that the blending pond will return water back into the Gila River or El Rio project. The License will require administrative or operational action from time to time to carry out the spirit and intent of this License and Consent, and the County desires to delegate to the Director of Maricopa County Parks and Recreation Department, or his or her designee, the authority and responsibility for proper administration of this License and Consent. The activities for this concession will be located in Supervisory Districts 5. (C-30-16-006-M-00)

58. GRANITE VISTA AMENDED AND RESTATED DRAINAGE AND ACCESS EASEMENTS AND AGREEMENT AND EXTINGUISHMENTS Approve Granite Vista Amended and Restated Drainage and Access Easements and Agreement and Extinguishments. In accordance with the provisions of the Granite Vista Development Agreement, approved by the Board on June 10, 2015, the developer is obligated to grant certain forms of temporary easements for (1) rights of access and (2) creation/maintenance of interim drainage facilities, to be used while the subdivision is under development. Maricopa County is a party to each of those easements, either as the grantee or in another role. Each of the easements is designed to be temporary and to remain in place only for so long as the development process warrants. At the end of that process each such easement will be extinguished once the Planning & Development Department has determined that such action is warranted. An amended and restated version of that earlier document is now required given that the developer is going to donate a school site to a school district, and the district has requested that the interim drainage easements not encumber that school site. 60. RECOGNITON FOR RECEIPT OF A NATIONAL AWARD Recognize Social Worker, Adrienne Decker-Delgado for the receipt of a national award. Ms. Decker-Delgado was selected by the National Association of Social Workers to receive the National Social Worker of the Year Award 2013. (The award was presented in June, 2014). This award honors a member of the National Association of Social Workers (NASW) who exemplifies the best of the profession’s values and achievements through specific accomplishments. Adrienne received this award for her work in creating Find Help Phoenix (www.FindHelpPhx.org and www.EncuentraAyudaPhx.org ). • The concept behind FindHelpPhx.org is to deliver an easy to navigate site where people can find free and almost free community resources with two clicks. • Masters students from ASU are recruited to assist in updating the resource list and meeting with partners to introduce the site. • The website was developed with little budget and her husband generously volunteering his time after years of Decker-Delgado collecting resource information and trying to deliver it to clients in hard copy. • Today, grants have assisted the site to expand to include resources across Maricopa County, be mobile friendly and deliver the information in Spanish and English. • Due to Adrienne’s vision and recognition of community needs, residents are now able to more easily link with existing resources and find the assistance they need to lead a healthier life. 79. DECREASE IN TUBERCULOSIS (TB) HEALTH CARD FEE Pursuant to A.R.S. §11.251.08, set a public hearing for December 9, 2015 to solicit comments and consider adopting a fee decrease for a health card. The Department of Public Health requests a fee decrease for a health card with a Quantiferon (QFT) blood test. The new fee would be $65. If approved, the fee for a health card and TB skin test will remain at $65; the fee for a health card and a QFT blood test will be $65; and the fee for a health card and a two-step skin test will remain at $130. On May 7, 2014, new fees were set for TB testing and health cards offered by the Department of Public Health. The new fees were $65 for a health card and TB skin test, and $110 for a health card and blood test (QFT or T-Spot). The fee for a two-step skin test with a health card was set at $130. In April 2015, the Department of Public Health laboratory began conducting and resulting the QFT blood test in-house. This change resulted in a $45 reduction in costs for laboratory services associated with the QFT. The fee for the health card with a TB Skin Test is $65. The fee for a health card with a QFT is currently $110. This was approved when the Laboratory was using an outside lab and the price of running the test at an outside lab was about $80. Laboratory testing is now running the QFT in-house, so the Laboratory is no longer paying $80 per test. Our cost is between $28 and $35 per test (depending on how many tests are done). That is a difference of about $45 (80 – 35). So the current $110 cost minus the savings of $45 is calculated as the cost of a health card with a QFT at $65. (C-86-16-045-M-00)
