At the time of application for building permits, detailed grading and drainage plans must show diversions necessary to direct flows from solar development site to a retention basin. No flow from the solar development site shall be permitted to flow directly offsite (unretained). 6. Electrical equipment, includi ng inverters must be elevated to be at or above the regulatory flood elevation for each respective flood zone; or otherwise floodproofed. 7. Work with the floodplains will require a floodplain use permit issued concurrent with the building permits. 8. Extension of the gen-tie across FCDMC owned properties will require procurement of a Flood Control District R/W permit. 9. Extension of the gen-tie within County (MCDOT) right-of-way may require procurement of a lease or license to occupy the right-of-way. 10. The applicant shall route their plans through the Department of Defense (DOD) siting clearinghouse process in accordance with the letter from Luke Air Force Base dated November 1, 2021. Based on those findings, a revised site plan shall be submitte d in accordance with condition ‘a’ if required. f. The Owner or Developer shall address and respond to all recommendations of the Arizona Game and Fish Department (AZGFD) included in the letter dated February 24, 2022 at the time of construction permittin g. The response shall be sent to AZGFD for review and consideration. The Zoning Inspector and/or their designee shall review the applicant’s response, and any subsequent comments received from AZGFD, to determine whether the response issued by the Owner or Developer addresses AZGFD comments in good faith. Should the Zoning Inspector and/or their designee decide that the Owner or Developer has not substantially addressed AZGFD comments in good faith, the Owner or Developer shall be required to propose and implement alternatives to the recommendations made by AZGFD. g. The Owner or Developer shall receive approval of a Cultural Resource Survey accordance with the comments received by AZSHPO in the letter dated July 8, 2021 prior to the issuance of building permits. h. The IND-2 IUPD shall limit the use of the site exclusively to a solar electric generating facility including ancillary offices and ancillary uses. Any other site uses shall require a Zone Change Major Amendment. i . Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. j. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Zone Change, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Zone Change, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Zone Change. There shall be a right-turn deceleration lane at the main entry driveway to limit site traffic impact to eastbound thru traffic on Carefree Hwy. e. This special use permit is valid for a period of ten years and shall expire on April 6, 2032, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. f. There shall be no repair of RVs or boats on the site. g. There shall be a maximum lot coverage of 50% on the site. h. There shall be minimum interior side and rear yards of 15-feet on the site. i . There shall be a minimum front yard adjacent to the Highway right-of-way of 50-feet with no average front setback. j. All landscaping shall consist of indigenous trees, p lants, shrubs, and groundcover typical of the Upper Sonoran Desert, preserving existing vegetation where possible and any landscaping used shall be drought tolerant with low water consumptive landscaping materials. k. Any rooftop mechanicals, ground mecha nicals, parking areas, trash enclosures, and transformers shall be screened. l. All materials and colors used in screening walls, buildings, covered RV wash bay, and parking shade canopies must be muted and compatible with the desert environment and the architecture of the main office. m. There shall be no reflective glass used i n any building. n. All outdoor lighting shall be dark sky compliant, low intensity, fully shielded, and directed downward at least 20% below the horizontal plane at bottom of light fixture so that no illumination occurs off site. All light poles or stand ards shall have a maximum height of 16-feet from surface grade of the parking lot, treated to minimize glare, placed at intervals, and setback a minimum of 20-feet from adjacent properties. o. The developer must complete habitat and special status species evaluation and submit to the Arizona Game and Fish Department for review prior to the submission of building permits. p. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set for th in the Maricopa County Zoning Ordinance. q. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. APPLY AND ACCEPT THE 2022 TITLE III CONSORTIUM GRANT FROM THE ARIZONA DEPARTMENT OF EDUCATION Approve the application for and acceptance of $166,299.56 for the Title III Consortium grant from the Arizona Department of Education (ADE). This grant is a federal entitlement grant that provides funds for the support of students who are learning the Engl ish language. These funds also support instructors who teach classes for students who are learning the English language. The term of this grant is for one year, July 1, 2021 to June 30, 2022. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant award is reoccurring and has been awarded to the department in previous years. The cash or in-kind match is not applicable. MCSS’s indirect rate for FY 2022 is 18.3 percent. The indirect cost rate allowed by this gra nt source is 2.06 percent. Total indirect costs on this award are $0 as all the monies are a pass through to the consortium members. The estimated unallowable indirect costs are $26,397.29. Ongoing cash contributions not applicable. MCSS serves as the fisc al agent for this consortium as the districts, by federal law, must have a consortium when their allocation is less than $10,000. The grant award is non-competitive and an entitlement grant from the federal government. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 25. APPLY AND ACCEPT TITLE I - DELINQUENT LEA GRANT Approve the application for and acceptance of the Title I - Delinquent – LEA from the Arizona Department of Education in the amount of $86,000.71. The purpose of this grant is to provide prevention and intervention programs for children and youth who are neglected, delinquent, or at-risk. The Grant period is from July 1, 2021 to June 30, 2022. MCESA’s indirect rate for 2022 is 18.3%. MCESA's approved indirect cost rate for this grant is 2.06%. The estimated unallowable indirect costs are $13,684.61. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The grant award is reoccurring. The department has no in-kind match requirement during the grant award period. The grant award does not require ongoing cash contributions. The grant award is for a mandated function as it goes to the jail schoo l education for 16 to 18 year old's already in county jail. This award is non-competitive and the grant award is a federal entitlement grant award. If awarded, there are no dollars that will need to be absorbed by the department operating budget. IGA WITH CITY OF PHOENIX FOR ICAC Approve an Intergovernmental Agreement (IGA) between Phoenix Police Department (Primary Grantee)/Arizona ICAC Task Force Lead Agency and Maricopa County Sheriff’s Office (Affiliate Agency) regarding Arizona Internet Crimes Against Children Task Force (ICAC). This IGA becomes effective upon the date of the last signature of the executing parties and remains in effect for five (5) years after the effective date. This agreement can be terminated in writing by either party upon a thirty (30) day notice. This is a reimbursement agreement with a funding award of up to $30,000. Categories of reimbursement are direct costs such for training, investi gations, computer forensics and public awareness in connection with Internet Crimes Against Children (ICAC). The Sheriff’s Office indirect cost rate is 14.74%. Indirect costs for this award are $4,422 and are not recoverable. This amount will be absorbed within the Sheriff's Office budget. This award is competitive, and the Sheriff's Office has received this funding before. Funding is recurring, there is no match requirement and there are no future or ongoing contributions required following the agreemen t period. This funding is not for a specific mandate but supports the Sheriff's Office overall public safety mandate. The total estimated cost associated with this award including indirect costs is $34,422. The Letter of Promulgation is signed by the jurisdiction’s senior elected or appointed official(s). The Approval and Implementation Letter is a signed statement formally recognizing and adopting the plan as the jurisdiction’s all-hazards Emergency Operations Plan (EOP). The implementation letter introduces the plan, outlines its applicability, and indicates that it supersedes all previous plans. It includes a delegation of authority for specific modifications that can be made to the plan and by whom they can be made with out the senior official’s signature. To address recruitment issues and be consistent with market practice, the County implemented a nurse sign-on incentive program in June of 2021. The nurse rete ntion incentives below will help address retention issues for nurses who are not eligible for the sign-on incentive. Incentive: $3,000 in March of 2022 and $3,000 on the first paycheck in March 2023 Eligibility: Nurses hired before 6/28/21 (effective dat e of the nurse sign-on incentive program) Repayment Clause: Employees who receive a nurse retention incentive and voluntarily leave County employment before two (2) years of consecutive County service must repay all retention incentives received during th e last 12 months prior to their separation. Approve and execute Amendment No. 9 to Lease Agreement L-7410 with Housing for Hope, Inc, for the use of 1,890 square feet of classroom space and certain playground area located at 466 South Bellview Street, Mesa, Ar izona. The space is utilized by the Maricopa County Human Services Department for the Early Education Division to provide Head Start program services. The purpose of this Amendment is to address the following: (A) renew and extend the term of the Lease; ( B) provide for a renewal option; (C) establish reserved parking spaces; (D) replace alteration provisions; (E) approve certain Lessor maintenance; (F) replace termination language; (G) add Subordination and Attornment and Estoppel provisions; and (H) repla ce counterpart language. The term of the Lease shall be extended for ten (10) years to commence on October 1, 2022 and expire September 30, 2032, beginning at its current Lease rate of $14.08 per SF plus rental tax with an annual increase of 2.5%. The Le ase is subject to termination pursuant to the provisions of A.R.S. 38-511. The Department of Treasury assigned the funds to the Human Services Department DUNS Number 050391270, Assistance Listing Number and Title 21.023 Emergency Rental Assistance Program. The funding amount is $2,485,134.52. The total ERA 2.0 funding is now $23,504,592.80. Also request approval and authorization for the Human Services Department Director to submit reports and sign required documents required by the Department of Treasury for these designated funds. Section 3201(a) of the American Rescue Plan Act of 2021, Pu b. L. No. 117-2 (March 11, 2021), authorizes the Department of the Treasury to make payment to certain eligible grantees to be used to provide emergency rental assistance. On March 18, 2022, the Department of Treasury provided notification via email of the funding allocation to the County. GRANT RENEWAL AGREEMENT WITH A RIZONA EARLY CHILDHOOD DEVELOPMENT AND HEALTH BOARD, FIRST THINGS FIRST FIND HELP PHOENIX PROGRAM Approve Grant Renewal Award (GRA-MULTI-21-1067-01-Y2) between Arizona Early Childhood Development and Health Board (AECDHB), First Things First (FTF) and Ma ricopa County by and through its Department of Public Health (MCDPH) to provide continued grant funding to support the Find Help Phoenix (FHP) program. The grant fund not-to-exceed amount is $120,000 for the grant term, July 1, 2022 through June 30, 2023. This is the last year of the grant and the reoccurrence is not sure. This is a non-competitive grant and there is no cash or in-kind match required. In addition, there is no mandated service required. Find Help Phoenix is not a mandated function but prov ides a benefit to citizens. The First Things First Regional Councils within Maricopa County will continue to work to provide an online information and referral resource to families with young children and to agencies that provide supports and services to t hose families. Services available through the online resource address the social, health and early care and education needs of families with children 0-5. Should the grant cease, on-going contributions would not be required. This Grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the Grant Agreement. $80,000 is a pass-thru amount to the subrecipient (Crisis Response Network) and not subject to indirect cost. MCDPH indirect rate for FY22 is 17.97%. The full indirect costs are estimated at $6,534.55 of which $3,636.36 is recoverable. Unrecoverable indirect costs are estimated at $2,898.18 and will be subsidized by the Department’s indirect co st pool. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budg et will be adjusted as necessary to accommodate this grant through a future reconciliation. The City will pay for all costs associated with the right-of-way acquisition. The proposed improveme nt will complete the minor arterial standard in places it was not finished during development. The improvements will include four vehicular travel lanes (two lanes in each direction), raised medians, bike lanes, curb, gutters, sidewalks, ADA ramp upgrades, traffic signal upgrades, street lighting, undergrounding SRP 12kV, drainage improvements, landscaping, dual left turn lanes at Riggs Road, water, sewer and private utility improvements.
