25. ACCEPT THE U.S. DEPARTMENT OF EDUCATION TEACHER INCENTIVE FUND (TIF) GRANT, FUNDED THROUGH THE AMERICAN RECOVERY AND REINVESTMENT ACT (ARRA) Approve and accept federal grant funding from the US Department of Education’s Teacher Incentive Fund (TIF) via the American Recovery and Reinvestment Act of 2009 to Maricopa County through the Maricopa County Education Service Agency in the amount of $51,539,512. This grant is part of the five-year $1.2 billion Teacher Quality Grant program. The term of the grant is five years beginning October 1, 2010, through September 30, 2015. The purpose of this grant is to strengthen the education profession by rewarding excellence, attracting teachers and principals to high-need and hard to staff areas, and providing teachers and principals with the feedback and support they need to succeed. The Education Service Agency’s calculated indirect cost rate is 33.6% for FY 2010-11. The grant allows a 5% rate for indirect costs for the administration of the grant. Therefore the recoverable indirect cost of administering the grant is $1,351,245, and the non-recoverable indirect cost is $7,729,119. $23,163,375 will be passed through to sub recipients and is not subject to indirect cost recovery. Acceptance of this grant requires a revenue and expenditure appropriation adjustment increasing the FY 2010-11 Education Service Agency (370) Grant Fund (715) operating (0000) revenue and expenditure budgets in the amount of $3,152,955. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The Rewarding Excellence in Instruction and Leadership (REIL) program will create a systemic K–12 performance-based compensation system (PBCS) that transforms how six Alliance Districts recruit, retain, support, and compensate effective teachers and principals in high-need schools. REIL will accomplish this by: assembling the Right Team, consisting of a strategic Alliance of Stakeholders including Public Policy Makers (Governor’s Office; Chairs of the State Senate and House Education Committees; Governing Board Members), Professional Educators, and Professional Associations (AEA; ASBA; AASA; AASBO); providing the Right Tools to measure and develop teacher and leader effectiveness; and placing the Right Talent in teaching and leading in the highest need schools on career paths and support roles to ensure that all teachers and principals have the job-embedded training to help youth succeed. For the first time in Arizona’s history, this unique Alliance includes 3,380 teachers, 174 principals, and 6 superintendents united to: (1) ensure that over 52,000 students graduate college-and-career ready by increasing student achievement and growth in all content areas; (2) enhance careers for effective teachers and administrators by implementing a fiscally sustainable PBCS; and, (3) develop talent in Teachers and Principals through a sustainable, comprehensive program of performance-based evaluation, support, and compensation. REIL will realize its goals by ensuring that the Right Team has the Right Tools to identify the Right Talent resulting in REIL Change for students in the highest needs schools throughout Maricopa County. 34. RESCIND ACTION AND APPROVE PURCHASE AND OPERATING TRANSFER OF VEHICLES Rescind the previous action taken by the Board on July 7, 2010 (C-88-10-017-V-00) regarding the Purchase and Operating Transfer of Two Vehicles. The rescinded action will be replaced with the following action: Approve the purchase and operating transfer of two vehicles from the Air Quality Department (850) Air Quality Fees Fund (504) to replace one vehicle from the Environmental Services Department (880) Environmental Services Fees Fund (506). This action results in a net reduction of one vehicle in the County fleet. The net value of the transferred assets is $17,242, which will require a fund transfer from the Environmental Services Fees Fund (506) to the Air Quality Fees Fund (504). Before the end of FY 2011, the Department of Finance will prepare and submit for Board approval a consolidated set of fund transfers to reconcile all inter-fund transfers of vehicle and other assets, along with necessary appropriation adjustments. The purpose of the change is to reduce the number of fund transfers and appropriation adjustments due to transfer of vehicles and other assets between funds. The revised action language directs that the vehicle transfer in this agenda item be included with others in a single fund transfer and appropriation adjustment that would be carried out later in the fiscal year. According to the terms of the contract, Maximus agreed to pay a total of $138,904.41 for co-locating in two career centers, East Valley and West Valley. During the final quarter of the agreement Maximus withdrew staff from the West Valley location, due to their budget cuts. Maximus did not provide formal notification of this withdrawal. Maximus asserts that, because of this staff withdrawal, the payment for the final quarter should be $19,773, although the total amount due for that period is $27,491. Maximus has submitted a check in the amount of $19,773 as a proposed settlement for amounts due. This will constitute a loss of $7,716.00 in revenue. Authorize the Chairman of the Board to take any action necessary to accept the check for the reduced amount provided by Maximus. The original contract with Maximus (C-22-09-066-1) was approved by the Maricopa County Board of Supervisors on June 18, 2008, for the term of July 1, 2008 to June 30, 2010 to co-locate in two career centers. F-3. RESOLUTION FOR SLOPE EMBANKMENT EROSION HAZARD MITIGATION PROJECT Adopt Resolution FCD 2010R006 for the Slope Embankment Erosion Hazard Mitigation Project (Project), authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to advertise, select, negotiate, and award contracts for engineering and construction services, negotiate Intergovernmental Agreements and budget funds for implementation of the Project, subject to Board ratification and approval. The District operates and maintains flood control dams, channels, levees and basins within and without Maricopa County that provide flood protection for significant portions of Maricopa County. Slope embankments associated with many of these structures are earthen and prone to erosion, which can adversely impact the functioning and/or integrity of the structure. Minimizing erosion of slope embankments can most effectively be accomplished by placing gravel mulch on slope embankments or making similar improvements. RESOLUTION FLOODPRONE PROPERTIES ASSISTANCE PROGRAM Approve Resolution FCD 2010R007, Floodprone Properties Assistance Program (FPAP) FY 2010-11 authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to obtain all necessary information to acquire floodprone properties as listed on Exhibit “A” in accordance with the FPAP policy. Acquisitions will be based on voluntary acceptance of offers by the applicants, which will be made according to ratings following the prioritization procedure previously approved by the Flood Control Advisory Board (FCAB) and the Board of Directors (Board), and within the available budget, currently established at $750,000. The Board adopted Resolution FCD 2006R003, Floodprone Properties Assistance Program, on October 4, 2006 (Agenda Item: C-69-07-016-6-00), recorded March 2, 2007, which amended Resolution FCD 95-01A, the floodprone properties acquisition program, and allows for floodproofing as an alternative to acquisition of residential structures located in floodprone areas where standard structural capital projects are determined to be unfeasible. The DISTRICT is also authorized to negotiate and prepare intergovernmental agreements with local jurisdictions for property acquisition or floodproofing under the FPAP; to update and revise the FPAP as required and present any proposed revisions to the BOARD for review and approval; to update Exhibit “A” during FY 2010-2011 by adding eligible properties and deleting properties whose owners have declined acquisition or are later determined to be ineligible; to acquire additional properties within the approved budget amount; and to include funds in the DISTRICT’s current and future five-year CIP Budgets for property acquisition or floodproofing under the FPAP, subject to prioritization by the DISTRICT and subsequent approvals by the BOARD. F-5. IGA WITH MARICOPA COUNTY DEPARTMENT OF TRANSPORTATION FOR THE RIGGS ROAD BRIDGE AT SONOQUI WASH PROJECT Approve Intergovernmental Agreement FCD 2010A004 for the Riggs Road Bridge at Sonoqui Wash Project (Project [#480]) between the Flood Control District of Maricopa County (District) and the Maricopa County Department of Transportation(MCDOT). This IGA provides for the rights-of-way acquisition, Design, Utility Relocations, Construction, Construction Management, and Operation and Maintenance of the Project. IGA 2010A004 shall become effective when executed by both parties and recorded by the Maricopa County Recorder, and shall expire ten years from the date of Recording by the County Recorder, or upon completion of the Project, whichever occurs first. The Project provides a vital element of the channelization and will be built under a combined contract with the channelization to avoid throwaway costs of a low flow crossing. The Project is being designed under the lead of MCDOT in coordination with the District’s channelization design. IGA FCD 2010A004 establishes a cost share relationship whereby MCDOT funds the differential between the cost of the Project and the cost of the low flow crossing that the District would have otherwise constructed under the channelization effort.
