10. ACCEPT FY2017 STATE CRIMINAL ALIEN ASSISTANCE (SCAAP) FUNDS Approve acceptance of $859,765 Federal FY2017 reimbursement funding from the Bureau of Justice Assistance, State Criminal Alien Assistance Program (SCAAP). The corresponding application was approved by the Board of Supervisors (Agenda C-50-18-054-M-00), on March 7, 2018. This has been a reoccurring grant for nearly 20 years and there is no cash or in-kind matching requirement. Indirect costs are not recoverable since the reimbursement formula calculation only allows for staff whose primary responsibility is the care, custody, or supervision of persons detained (pre-trial detention) and incarcerated (convicted and sentenced) inmates. This funding is not competitive. There are no future or ongoing contributions required. This grant reimburses a portion of the costs for a mandated requirement--incarcerating undocumented criminal aliens who are convicted of felony offenses. The Bureau of Justice Assistance allows these funds to be used for corrections purposes only. The specific planned use, as determined by the Office of Management and Budget, will be stated in the electronic request to drawdown the funds not later than February 1, 2019. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. This cargo trailer is customized with equipment and accessories that include one Onan 5500-watt commercial gas generator plumbed to the fuel tank and a roof mounted air conditioning system. This trailer will replace trailer #393, which is currently 16 years old. This trailer is used specifically for the Under Water Remote Operated Vehicle (ROV) which was purchased with Homeland Security Funds and is used throughout the region. The trailer will also be used as an operations center where the ROV pilot will be able to conduct an effective search while in a climate controlled and enclosed environment. Because this cargo trailer is a replacement, annual operating costs are anticipated in the budget. (C-50-19-045-V-00)

17. IGA WITH GOVERNOR'S OFFICE OF YOUTH, FAITH AND FAMILY FOR YOUTH ENGAGEMENT PROGRAM Approve an Intergovernmental Agreement between the Governor's Office of Youth, Faith and Family and Maricopa County through the Education Service Agency (MCESA) in the amount of $20,000. This IGA is effective from October 1, 2018, through June 30, 2019. This provides funding for MCSS to work with the Governor's Office for Youth, Faith and Family on a program for 7th graders and their families to stay drug and alcohol free. The department's indirect cost rate for FY 2019 is 9.4%. The recoverable indirect cost of administering this grant is $1,718.46; the non-recoverable indirect cost is $0.00. Grant revenues are not "local revenues" for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This budget request does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The Youth Engagement Program grant award is non-reoccurring. This grant does not require an in-kind match. Indirect costs are fully recoverable. Ongoing cash contributions are also not required. The program is not a mandated function but provides a benefit to the citizens by educating 7th graders on benefits of staying alcohol and drug free. The grant award is competitive. There are no costs that will need to be absorbed by the department’s operating budget. Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents related to this award. 30. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR COMMUNITY ACTION ACTIVITIES Approve revenue Amendment No. 10 to the Intergovernmental Agreement (Agreement) between Arizona Department of Economic Security (DES) and Maricopa County, administered by its Human Services Department. The purpose of Amendment No. 10 is to increase funding by $920,972.77 for the period of July 1, 2018 through June 30, 2019. Per the Community Action Network (CAN) Alert issued on October 2, 2018, the Case Management contract reimbursement ceiling is increased from $4,680,575 to $5,417,168, an increase of $736,593 and the Community Services reimbursement ceiling is increased from $876,426 to $1,060,805.77, an increase of $184,379.77. The Human Services Department FY2019 Indirect cost rate has not been fully negotiated. However, the U.S. Department of Health and Human Services has approved the use of the FY2018 indirect cost rate to be used until rate is fully negotiated. Therefore, the FY2019 indirect cost rate is 22.9% for salaries and employee related expenses. The total Amendment funds are $920,972.77 of which $0 is for salaries and benefits. The total estimated indirect costs are $0 and fully recoverable. The total amended funds are being allocated to direct services and operating expenses. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant amendment through future grant reconciliation. This amendment does not impact County funds. The Amendment shall become effective on the date of last signature unless otherwise specified herein. The Agreement with DES began on July 1, 2015 and ends on June 30, 2020. The funding during this period is reoccurring. Except as provided herein, all terms and conditions of the original contract as heretofore changed and/or amended remain unchanged and in full force and effect. Receipt of the funds does not require cash or in-kind match and no future contributions after the Agreement expires. The funding increase is issued by DES through a State formulary process as identified in the CAN issued on October 2, 2018. Therefore, receipt of funds is non-competitive. The services provided under this Agreement are not mandated services but provide assistance to low-income residents of Maricopa County by assisting with eviction prevention services, rent, mortgage and providing utility assistance. Therefore, the FY2019 indirect cost rate is 22.9% for salaries and employee related expenses. The total Agreement funds are $86,219 of which $6,378 is for salaries and benefits. The total recovered allowable indirect costs is $1,460.56. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Acceptance of this Agreement will not impact the County General Fund. The overall grant budget will be adjusted as necessary to accommodate this Agreement through a future reconciliation. 32. AGREEMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR EVICTION PREVENTION SERVICES Approve a revenue Agreement with Arizona Department of Housing (ADOH). The Agreement effective date is February 1, 2019 and will terminate on April 30, 2020. ADOH will provide the County with State Housing Trust Funds (HTF) funds in the amount of $464,250. The purpose of the Agreement is for Maricopa County Human Services Department to administer ADOH’s Eviction Prevention services for eligible households in specific zip-codes areas of the County, targeting the Manistee and Country Meadows Justice Courts service areas. The Human Services Department FY2019 Indirect cost rate has not been fully negotiated, but the U.S. Department of Health and Human Services has approved the use of the FY2018 indirect cost rate to be used. Therefore, the FY2019 indirect cost rate is 22.9% for salaries and employee related expenses. The total Agreement funds are $464,250 of which $86,297 is for salaries and benefits. The total recovered allowable indirect costs is $19,762.01. Maricopa County is one of twelve federally designated Community Action Agency (CAA) in the state of Arizona. As a designated CAA, the County receives a variety of grant funds to provide crisis case management and financial assistance services to low-income individuals and families in Maricopa County. ADOH requested the Human Services Department to provide the eviction prevention services because the Department currently provides these services in the designated area and provided the agreement through a non-competitive process. The services to be provided are not a mandated function but will provide a benefit to the citizens by increasing the number of low-income individuals and families in Maricopa County that will receive rental assistance, eviction prevention, and case management services. Receipt of these one-time funds does not require in-kind of match funds and no future or ongoing contributions by the County at the end of the Agreement. CACFP funds are reimbursement for meals that are provided to Head Start program participants and are passed through to two (2) School districts that contract to provide Food Catered Meals and snacks that meet 1/3 to 2/3 of the daily nutritional needs of Head Start program participants: Mesa Unified School District (C-22-17-022-3-00); and Scottsdale Unified School District (C-22-17-023-3-00). Also request authorization for the Chairman to sign all documents related to acceptance of these funds and any additional awards issued subsequently up to the estimated funding amount. CACFP funds may be increased throughout the budget year as additional funds are made available to cover unanticipated food costs. If the Head Start program is notified of availability of additional funds, the Department will request formal approval for acceptance of any increase in funds. The County has had a permanent agreement (C-22-14-027-G-00) with Arizona Department of Education for the CACFP funds since October 2013 and has received an annual allocation for the past five (5) years. Annual Funding is non-competitive, reoccurring, and does not require an in-kind or cash match or a commitment after the end of the Agreement. The services provided by the grant award are not a mandated function, but are required by the Head Start Program Performance Standards. These services provides a benefit to the citizens by providing Head Start program participants with the nutritional needs required. The total Amendment funds are $475,000 of which $0 is for salaries and benefits. The total estimated indirect costs are $0 and fully recoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The grant funds do not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Supervisory District: All (C-22-14-027-G-05)

34. NON-BINDING MEMORANDUM OF UNDERSTANDING FOR THE CONCEPTUAL DESIGN OF THE EL RIO LAKE AT THE CONFLUENCE OF THE AGUA FRIA AND GILA RIVERS Execute the Non-Binding Memorandum of Understanding between the Flood Control District of Maricopa County (District), Maricopa County (County) and other partners for the Conceptual Design of the El Rio Lake at the Confluence of the Agua Fria and Gila Rivers, authorizing District to fund and manage consultants’ efforts in the preparation of preliminary concept schematics to include river stabilizing structures, subject to the availability of funding to the District. The County will 1) review project submittals; 2) participate in the permit process, scoping, consultant progress, stakeholder and public meetings; and 3) provide a no-cost right-of-way entry at Estrella Mountain Regional Park during project planning and designing. The District, in cooperation with its project partners, including the County, developed the El Rio Watercourse Master Plan (the “WCMP”) in 2006. The WCMP is a blueprint for flood mitigation, economic development, recreational amenities and habitat restoration on the Gila River between its confluence with the Agua Fria River and SR 85. Building on the WCMP, the District, Maricopa County and the Cities of Avondale, Goodyear and Buckeye cooperated in the development and approval in 2016 of the “El Rio Design Guidelines and Planning Standards” to supplement current development regulations with techniques that can increase awareness and appreciation of, as well as access to, the Gila River. The creation of the El Rio Lake is one of many recommendations developed as part of the WCMP. WCMP implementation activities have indicated the potential for previously mined areas adjacent to the river to capture sediment loads during flood events and thus endanger critical infrastructure both upstream and downstream by erosion and headcutting. By providing grade control and sediment management, the Lake would offer important public safety benefits. The Lake is envisioned as a demonstration project of components for the overall WCMP and El Rio Design Guidelines and Planning Standards. These components will include flood control elements, riparian habitat and river function enhancements, and active and passive recreational facilities developed through local and Federal partnerships. This Agenda Item impacts Supervisor District 5. (C-30-19-010-M-00)

The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a Grant from ADHS and will not affect the County’s general fund. (C-86-18-018-3-04)

46. AMENDMENT TO AGREEMENT FOR RELOCATION OF MARICOPA WATER DISTRICT FACILITIES: CAMELBACK ROAD AT BEARDSLEY CANAL Approve an amendment to a Maricopa County Department of Transportation agreement with the Maricopa Water District (MWD) in order to establish and fund a draw account in the amount of $1,503,840.00 for MWD. This is for construction, construction observation and administration services necessary to relocate the irrigation facilities. This work must occur during this season’s scheduled canal dry-up in order to be out of conflict with Maricopa County Department of Transportation project TT0520 Camelback Road at Beardsley Canal. Maricopa Water District (MWD) has agreed to construct their own irrigation structure and well improvement in order to relocate their facilities outside the County’s road improvement project limits. An initial agreement was signed in March of 2017 in order to obtain MWD’s design/construction approval. Initially the Maricopa County Contractor was to construct these facilities for MWD as part of the road project. However, due to time constraints and construction logistics, having MWD forces construct during their scheduled dry-up was determine to be a best approach. In order to proceed they have provided an amendment to the initial contract and based on the final costs, requires formal Board approval. All other elements of the original agreement remain in place, the amendment provided by MWD allows them to perform the necessary construction work. Supervisory District No. 4 (C-64-19-102-M-00)

The lowest responsive bidder exceeded the Engineer’s estimate by 11 percent. Per the original Board approval to construct: “Award the contract to the lowest responsive bidder, provided that the lowest bidder does not exceed the Engineer’s estimate by more than ten percent" (April 25, 2018, C-64-18-111-5-00). The Engineer’s estimate was $2,439,067. The low bid was $2,730,992, a difference of $291,925. County staff and consultants have reviewed the lowest bidder and have determined that the increase is due to regional cost increases to concrete, aggregates, asphalt, trucking expenses, and skilled labor costs. The purpose of this project is to construct passing lane, shoulder improvement, intersection improvements, guardrail installation, extend and upgrade signing and striping for the corridor. ROAD DE-ANNEXATION FROM CITY OF BUCKEYE TO MARICOPA COUNTY Pursuant to A.R.S. §9-471.03(D), set a hearing for January 30, 2019 to determine if the public interest is served by de-annexing road right-of-way from City of Buckeye jurisdiction to Maricopa County in accordance with City of Buckeye Ordinance No. 16-18. Also, for the hearing, direct MCDOT to prepare an analysis of the requested action. Right-of-way location: Along Jackrabbit Trail between Bethany Home Road and Missouri Avenue. Supervisory District No. 4. At the hearing, if after reviewing the analysis and hearing those that may appear for or against the action, the Board determines that the public interest is served by this de-annex/annexation action, the Board shall file in the Clerk of the Board’s Office an ordinance setting forth the legal description of the public right-of-way and declare the return of the right-of-way contingent on the fulfillment of the additional conditions of the statute which would include setting a second public hearing on this matter. The Board action will result to add 10 feet of right of way to County ownership and enable the County to assume responsibility for road maintenance. (C-06-19-248-7-00)
