Development and use of the site shall comply with the narrative report entitled “Southern Comfort Estates, LLC – Special Use Permit Request”, consisting of six (6) pages, dated revised February 19, 2016, and stamped received February 23, 2016, except as modified by the following conditions. c. This Special Use Permit shall expire 25 years from the date of approval by the Board of Supervisors, inactivity for a period of 90 or more consecutive days, or upon termination of the use, whichever occurs first. All of the site improvements shall be removed within 60 days of such termination or expiration. d. The applicant/owner shall submit a written report outlining the status of the development at the end of 5 years from the date of approval by the Board of Supervisors. The status report shall be reviewed by staff to determine whether the Special Use Permit remains in compliance with the approved conditions. e. The following Engineering conditions shall apply: 1. Turn blocks shall be provided in the screen walls within retention basins from finish grade to water surface elevation. The screen walls must allow water to freely flow through to equalize water surface elevations on both sides. 2. The Conic Frustum method for retention calculations must be used. Retention basins are not symmetrical to warrant the average end area method, which over estimates the volume. f. The following MCDOT condition shall apply: 1. Any construction (driveway, utilities, etc.) within the Southern Avenue right-of-way will require a City of Buckeye Right-of-Way Permit during the Building Permit review process. Please refer to the City of Buckeye for right-of-way dedications. MCDOT review shall require a City of Buckeye Approval Letter for work in the right-of-way during the Building Permit review process. g. The following MCESD condition shall apply: 1. A Notice of Intent to Discharge permit is required prior to construction permit issuance. h. All outdoor lighting shall conform to the Maricopa County Dark Sky Ordinance at time of permit. Future changes to outdoor lighting shall comply with City of Buckeye Dark Sky standards. i. Major changes to this Special Use Permit shall be processed as a revised application in the same manner as the original application, with final determination made by the Board of Supervisors following recommendation by staff and the Planning and Zoning Commission. Minor changes may be administratively approved by staff of the Planning and Development Department. j. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. 11. DONATION OF GENERATOR FROM BOOKING RV TO SHERIFF'S YOUTH ASSISTANCE FOUNDATION Approve the donation of a generator, fixed asset F0800407, valued between $2,000 and $3,000, to the Sheriff's Youth Assistance Foundation (YAF), a non-profit. This generator was installed in the old booking van that the Board approved for donation to the YAF in November 2014. Without the generator, the van is of little use to the organization. It's been recently determined that the generator that was associated with the booking van donated previously to the YAF was a separate fixed asset and should have been referenced separately in the original agenda item for proper item disposal. Approval of this item will finalize the matter. THIS ITEM REQUIRES A UNANIMOUS VOTE OF THE BOARD. (C-50-15-026-M-01)

24. APPLY AND ACCEPT GRANT FUNDS FROM EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/DRUG ENFOREMENT ACCOUNT Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/ Drug Enforcement Account (DEA) in an amount not-to-exceed $222,141 for the portion allocated to the Office of the Public Defender (520). This grant is a recurring grant administered by the Arizona Supreme Court, Administrative Office of the Courts (AOC). The Office of the Public Defender applies for this grant jointly with Adult Probation, Clerk of the Superior Court, and Superior Court. These funds support the justice system by providing staff in all of these departments. In FY 2015-16, this grant funds 11.8 full-time equivalent positions Countywide. The Office of the Public Defender is requesting authorization to again apply for the DEA Grant for FY2016-17. The new grant period will begin on July 1, 2016 and end on June 30, 2017. The grant does not currently allow for the recovery of indirect costs in FY 2015-16, and no change is anticipated in future years. Therefore, the Office of the Public Defender and Maricopa County may receive no administrative cost recovery for this grant in FY 2016-17. The Maricopa County Department of Finance has calculated the Office of the Public Defender's composite indirect cost rate at 9.8%. The non-recoverable indirect cost will not exceed $21,770. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of these revenues is not prohibited by budget law. The grant award will begin on July 1, 2016 and end on June 30, 2017. However, the application for funding has historically been received late and submitted even after the start of the applicable fiscal year. The application turnaround involves tight time constraints. As a result, the Office of the Public Defender is requesting advance approval to apply for the departmental share of these funds through a joint application with the Superior Court, Clerk of the Superior Court, and Adult Probation. The FY 2016-17 budgeted amount for this grant is $222,141 as developed through the normal annual budget process. If funding is awarded in excess of that amount, a budget adjustment will be requested. We also anticipate we will be required to provide an in-kind match of 25%. We have a General Fund position which is being used to fulfill the match requirement in the current year, and that position is funded in the following year as well. Therefore, there is no additional burden to the General Fund as a result of the in-kind match requirement. (C-56-16-007-M-00)

27. EMPLOYER ENROLLMENT AGREEMENT WITH THE PUBLIC SAFETY PERSONNEL RETIREMENT SYSTEM FOR CANCER INSURANCE PROGRAM FOR DETENTION OFFICERS Approve the Employer Enrollment Agreement with the Arizona Public Safety Personnel Retirement System (PSPRS) to provide for enrollment in the extended Cancer Insurance Program sponsored by PSPRS for corrections and detention officers; otherwise known as the Corrections Officer Retirement Plan (CORP) Cancer Insurance Program. The agreement will facilitate voluntary participation in the Program by eligible Maricopa County Detention Officers employed by the Maricopa County Sheriff’s Office. The PSPRS Cancer Insurance Program is designed to assist members with out-of-pocket expenses that arise while undergoing cancer treatment that may not be covered by other insurance. Arizona law requires coverage be afforded to firefighters and peace officers (including Deputy Sheriffs), and that the premiums be paid by the employer. The Program presently covers all Sheriff law enforcement personnel who meet the definition of “peace officer” as set forth in A.R.S. § 38-641. In light of recent legislative changes to A.R.S. § 38-642 and A.R.S. § 38-644, however, PSPRS now administers for public employers an extended, voluntary aspect of the Cancer Insurance Program for corrections and detention officers in CORP designated positions. PSPRS sets the criteria for participation and annual premium. The Program is voluntary, and eligible detention officers employed by the Maricopa County Sheriff’s Office who wish to participate will be responsible for paying the Program’s annual premium to PSPRS via a payroll deduction. 29. RESOLUTION FOR DECLARATION OF OFFICIAL INTENT TO REIMBURSE FOR PURPOSES OF SECTIONS 103 AND 141-150 OF THE INTERNAL REVENUE CODE OF 1986 Authorize the Chairman to approve and execute the Resolution, which constitutes a Declaration of Official Intent to Reimburse required for the issuance of tax exempt securities to reimburse prior expenditures, related to the acquisition of County departmental equipment and/or capital purchases from the five year capital projects schedule for Fiscal Year 2015-16 to 2018-19. The County is anticipating issuing tax-exempt obligations to finance equipment and/or capital purchases for General Fund and Special Revenue Fund departments. The maximum principal amount of obligations expected to be issued is $94,537,333. Exhibit A shows the proposed equipment and/or capital purchases (but not limited too) by anticipated fiscal year. The County reasonably expects to reimburse the expenditures with proceeds of a tax exempt borrowing. The Department of Finance and OMB have determined a need for the County to issue tax exempt securities to finance equipment and/or capital purchases to replace existing equipment along with new purchases for either obsolete items and/or new initiatives. Bond proceeds will be deposited into a Capital Projects Fund (TBD) to track expenditures and for arbitrage compliance. Equipment and capital purchases from bond proceeds will be individually tracked to ensure that purchases are capitalized, if applicable, and to track expenditures by department. The benefit to the County for issuing long-term debt obligations is debt payments are exempt from the ELR. (C-18-16-005-4-00)

55. AGREEMENT WITH MARICOPA ASSOCIATION OF GOVERNMENTS FOR GILBERT ROAD BRIDGE PROJECT Approve a Revenue Agreement (Project Agreement No. 16-GIL-20-03, “Agreement”) between Maricopa County, acting through the Maricopa County Department of Transportation (MCDOT), and Maricopa Association of Governments (MAG) for the Gilbert Road Bridge over the Salt River (MCDOT sub-project T339). This project is currently programmed in MAG’s Arterial Life Cycle Program (ALCP), which is reflected in this Agreement. The purpose of this action is to: 1) approve the Project Agreement for MAG regional reimbursements of federal-aid highway funding associated with the design and construction of bridge and roadway improvements; and 2) authorize the acceptance and expenditure of local and grant funds (federal aid highway funding reimbursements), including any additional monies in excess of the currently-estimated amount of $14,004,747 programmed by MAG. This Agreement is effective from the MAG approval date until completion of all reimbursements. The County’s estimated MAG regional match contribution is 30% of the total project costs, or anticipated to be $6,002,034, based on the current ALCP programming. Any additional right-of-way costs will be from MCDOT local funding; design and construction will be partially reimbursed from the ALCP. The construction of this Project is currently budgeted for FY2018 and FY2019; however, a combination of available ALCP closeout funds, anticipated federal advance construction authorizations and savings from other MCDOT ALCP projects may increase MCDOT’s regional reimbursement to offset anticipated higher project costs. MCDOT’s FY2016 indirect cost rate is 7.4%. All costs under this Agreement are for capital expenditures, which are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. Approval of this requested action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. Section 42-17105. As the lead agency, MCDOT has submitted the required MAG Project Overview and must also submit a County-approved Project Agreement (this Revenue Agreement) to MAG. Without this Agreement, MCDOT cannot be authorized to receive ALCP reimbursement funding for costs it incurs on eligible Project activities. The Gilbert Road Bridge project activities will include design, right-of-way and construction. Under the Project Agreement, the agencies will coordinate the Arterial Life Cycle Program construction funding, which will be budgeted in FY2019 for Transportation Department (640), Transportation Capital Project Fund (234) for sub-project T339.
