COOPERATIVE LAW ENFORCEMENT AGREEMENT WITH THE U.S. DEPARTMENT OF AGRICULTURE, FOREST SERVICE, TONTO NATIONAL FOREST AND OPERATING AND FINANCIAL PLAN Approve the Cooperative Law Enforcement Agreement between Maricopa County on behalf of the Maricopa County Sheriff’s Office and the U.S. Department of Agriculture, Forest Service, Tonto National Forest (21-LE-11031200-041), commencing upon last signature and ending December 31, 2025. Approval of this item includes acceptance of $100,400 in funding as outlined in Exhibit A, Operating and Financial Plan. The term of this agreement begins the date of last signature and ends December 31, 2025. Also approve acceptance of up to $30,000 for special enforcement situations (outlined in Section V. of the Agreement) that include but are not limited to fire emergencies, drug enforcement, and certain group gatherings (normally unanticipated); and approve acceptance of up to $35,000 for limited preapproved emergency work done in support of USFS Fire. Such costs were incurred during calendar year 2020 for this grant. The total amount for approval is $165,400. The MCSO Indirect Rate is 14.6% and is applicable to the entire award of $165400. Indirect costs are estimated to be $24,148.40, of which no amount is recoverable and will be absorbed within Sheriff’s General Fund operations. This grant award is multi-year and recurring and is a non-competitive award. The Sheriff’s Office has been providing these services for more than 30 years. The award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. This service is not mandated; however, it furthers the Sheriff’s public safety mandate. Funding is used to pay deputy overtime, the leases on two vehicles, monthly charges for cell phones, and other supplies related to this grant agreement for MCSO to assist in patrolling portions of the Tonto National Forest, located in Maricopa County. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. (C-50-21-140-X-00)

53. NOTICE OF AWARD WITH HEALTH RESOURCES AND SERVICES ADMINISTRATION FOR HEALTHY START INITIATIVE (HSI): ELIMINATING DISPARITIES IN PERINATAL HEALTH Approve Notice of Award (NOA) No. 5 H49MC00174-21-00 for Healthy Start Initiative (HSI): Eliminating Disparities in Perinatal Health, from Department of Health and Human Services, (DHHS), Health Resources and Services Administration (HRSA) to Maricopa County through its Department of Public Health (MCDPH), South Phoenix Healthy Start (SPHS), to provide continued funding for the Healthy Start program. The NOA is in the amount of $1,144,121 for the budget period April 1, 2021 through March 31, 2022. The project period is June 1, 2002 through March 31, 2024. The Department of Public Health’s indirect rate for FY21 is 18.8%. Indirect is estimated at $181,056, all of which is recoverable. Departmental Indirect Rates are reestablished at the beginning of each fiscal year and the future Indirect Rate will be collected at the corresponding rates. The HSI grant award is reoccurring and has been awarded to the department since 2002. This grant does not require an in-kind match, indirect cost is fully recoverable and ongoing cash contributions are not required. Healthy Start services are not a mandated function but provide a benefit to the citizens in perinatal case management services, health education events and learning opportunities, and community referrals to women and their families in the large urban Maricopa County communities of South Phoenix, Maryvale, and Laveen. The grant award is competitive. All program costs are allocated to the grant so there will be no additional burden on the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by HRSA and will not affect the County’s General Fund. (C-86-02-165-2-46)

AGREEMENT WITH PROPERTY OWNERS FOR LEAD HAZARD REDUCTION GRANT PROGRAM Approve an Agreement between Maricopa County (“County”), administered by its Human Services Department and Maricopa County property owners (“Owners”) that qualify for removal of Lead Hazards. The County and the Owners are referred to collectively as the “Parties.” The purpose of the Agreement is for the Human Services Department (HSD) to assess the property of Owners to determine if Lead Hazards are in the home and on the property that could impact the health of household members, specifically, children under the age of 6 and pregnant women. HSD will work with County Contractors to test the property and to remove Lead Hazards. 83. CHANGE ORDER NO. 7 FOR CAVE BUTTES DAM MODIFICATION DESIGN AND ENGINEERING SUPPORT DURING CONSTRUCTION Approve Change Order (CO) No. 7 to the Flood Control District of Maricopa County (District) Contract FCD 2009C027 – Cave Buttes Dam Modification Design and Engineering Support During Construction (On-Call) with URS Corporation (URS) in the amount of $500,000.00 for a revised contract value of $3,600,000.00 and a contract duration increase of 730 days with a new end date of June 30, 2023. Construction completion is anticipated in June 2021. Change Order No. 7 provides additional contract time and funds necessary to complete required project closeout activities and documentation including: as-built plans and specifications, construction completion report, Gate Operations Manual/Water Control Plan, and resolution of all remaining technical items with the US Army Corps of Engineers (USACE) and Arizona Department of Water Resources (ADWR) in order to close out the USACE 408 Permission and ADWR Permit associated with the project. The additional contract funds and time have been conservatively estimated in consideration of the USACE and ADWR involvement on this project inclusive of the ongoing “gate redundancy” issue with the USACE. Agency response times and issue resolution are difficult to estimate and can significantly impact schedule and cost. This Agenda Item impacts Supervisorial District 3. (C-69-15-005-5-01)
