PZ-1. STANDAGE RV STORAGE Case Number: CPA2012014 Supervisorial District: 2 Applicant: Pew & Lake, PLC Owner: Leonard & Barbara Standage Request: Comprehensive plan amendment (CPA) to change the land use designation from Suburban Residential (0 - 2 d.u./ac.) to Neighborhood Retail Center (CPA case approval is by Resolution, attached). CPA case approval is by Resolution. Site Location: West of the southwest corner of Baseline Rd. and Recker Rd. (in the Gilbert area) Site Size: Approximately 3 acres Commission Action: By a vote of 6-0, recommended approval subject to conditions ‘a’ – ‘d’ as follows: Provided the following conditions are met: a. Development and use of the site shall comply with the narrative report entitled, “Comprehensive Plan Amendment – Standage RV Storage”, including all exhibits dated revised July 8, 2013, and stamped received July 10, 2013, except as modified by the following conditions. b. The applicant is proposing to develop RV, boat and vehicle outdoor storage which, pursuant to the Maricopa County East Mesa Area Plan, necessitates a change in the land use designation from Suburban Residential to Neighborhood Retail Center. The proposal by the applicant represents a comprehensive approach to the subject property and will allow the applicant to pursue the proper entitlements pursuant to state law so that they can lawfully operate in unincorporated Maricopa County. This particular proposal is an appropriate plan for the property and is consistent with the overall intention of the comprehensive plan and area plan. However, in the event that the special use permit for this particular proposal is not approved by Maricopa County Board of Supervisors within three (3) years from the date of Board approval of this comprehensive plan amendment, this amendment shall no longer be effective as the planning justification for this comprehensive plan amendment will no longer be present. In such instance, a change of the land use designation from Neighborhood Retail Center to Suburban Residential will occur, and all comprehensive plan land use maps shall be altered to reflect as such, because this represents superior long-range planning by Maricopa County. c. The land use designation of Neighborhood Retail Center approved as part of CPA2012014 shall be subject to the time limits set forth in the subsequent Special Use Permit, and shall change to the previous Suburban Residential land use designation upon Special Use Permit expiration. d. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. PZ-2. STANDAGE RV STORAGE Case Number: Z2012106 Supervisorial District: 2 Applicant: Pew & Lake, PLC Owners: Leonard and Barbara Standage Request: Special Use Permit (SUP) for RV/Boat/Vehicle Storage in the Rural-43 zoning district Site Location: West of the southwest corner of Baseline Rd. and Recker Rd. (in the Gilbert area) Site Size: Approximately 3 acres Commission Action: By a 6-0 vote, recommended approval subject to conditions ‘a’ – ‘o’ as shown below: a. Development of the site shall comply with the Site Plan & Landscape Plan entitled “5649 E Baseline Rd Site Plan “, consisting of one (1) full-size sheets, dated May 14, 2013, and stamped received May 23, 2013, except as modified by the following conditions. Within 30 days of board approval, the applicant shall provide a revised site plan calling out screening (mesh or slatting) for the existing chain-link fence. b. Development of the site shall be in conformance with the Narrative Report entitled “Standage RV & Storage”, consisting of four (4) pages, dated June 25, 2013, and stamped received June 27,2 013, except as modified by the following conditions. Within 30 days of board approval, the applicant shall provide a revised narrative describing the screening for the site. c. All transformers, back-flow prevention devices, utility boxes and all other utility related ground mounted equipment shall be painted to complement the development and shall be screened with landscape material where possible. All HVAC units shall be ground-mounted or screened with a continuous parapet for commercial projects. d. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance. e. Development of the site shall be in compliance with all applicable Maricopa County Air Quality rules and regulations. f. Prior to zoning clearance the owner shall establish emergency fire protection services, covering all real property contained within the project area during course of construction and shall obtain a ‘will serve’ letter substantiating coverage from the appropriate Fire District, Department or Company servicing the site. g. The following Drainage Review conditions shall apply: 1. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance, Drainage Policies and Standards and current engineering policies, standards and best practices at the time of application for construction. 2. Drainage review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards. 3. Detailed Grading and Drainage Plans showing the new site improvements must be submitted for the acquisition of building permits. h. This Special Use Permit shall expire ten (10) years from the date of approval by the Board of Supervisors, or upon termination of the use, whichever occurs first. i. The as-built permits, specified as part of the special use, shall be completed within one (1) year of approval by the Board of Supervisors. j. The applicant/owner shall submit a written report outlining the status of the development at the end of one year from the date of approval by the Board of Supervisors. The status report shall be reviewed by staff to determine whether the Special Use Permit remains in compliance with the approved stipulations. k. This development, due to its proximity to Phoenix-Mesa Gateway Airport, may be affected by noise, aircraft overflights, and general operating conditions. Therefore the Phoenix-Mesa Gateway Airport Authority strongly suggests the following statement be contained within any public report or title: “This property due to its proximity to Phoenix-Mesa Gateway Airport is likely to experience aircraft overflights, which could generate noise levels which may be of concern to some individuals. The mix of air traffic consists of cargo, commercial, charter, corporate, general aviation and military aircraft”. l. Amendments to the site plan and narrative report shall be processed as a revised application in accordance with Maricopa County Zoning Ordinance Article 304.9. m. Noncompliance with the conditions of approval will be treated as a violation in accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the conditions of approval may be grounds for the Planning and Zoning Commission to take action in accordance with Chapter 3 (Conditional Zoning). n. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. o. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions and stipulations. In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. The grant award begins on March 1, 2014 and ends on February 28, 2015. Authorize the Chairman to sign all documents related to these grant funds, as applicable. Upon receipt of funds and pursuant to ARS §42-17106(B), approve revenue and expenditure appropriation adjustments to the Department of Employee Benefits and Health (390) Public Health Grant Fund (532) Operating (0000) budget associated with the grant in the amount of $9,081,224 for FY 2014. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Ryan White Part A program receives funds from HRSA, under Part A of the Ryan White Treatment Modernization Act of 2006, to provide services to people infected with, or affected by HIV/AIDS. The grant provides contracts with HIV and AIDS service organizations which deliver/enhance health related and support services for HIV positive/affected persons. These services include, but are not limited to, case management, counseling, outpatient health services, food and nutrition services, legal services, transportation and emergency financial assistance. Pursuant to federal statue, 85% of the grant funds must be passed through to contractors ($7,719,040). HRSA's allowable administration includes: 10% of grant award for Administration and Planning Council Support ($908,122); and 5% of grant award for Clinical Quality Management ($454,062). The Ryan White Part A program serves up to 3,500 People Living with HIV/AIDS in Maricopa and Pinal Counties, and is the "Payer of Last Resourt" for their primary medical care. The Ryan White Act requires that the funding is provided to the county in each state that has the largest number of people diagnosed with HIV/AIDS living in an eligible metropolitan area. By providing continuity of care, People Living with HIV/AIDS maintain a measurable lower viral load and are thus less likely to transmit the virus to other individuals. (C-39-14-006-G-00)

F-2. RESOLUTION FOR ALERT 2: REAL-TIME MONITORING FOR AUTOMATED FLOOD WARNING SYSTEM Adopt Resolution FCD 2013R004 for the ALERT 2: Real-time Monitoring for Automated Flood Warning System Project (Project #017), authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to include Project funding in the District’s Five-Year Capital Improvement Program; advertise, select, negotiate, and award contracts for Project engineering and construction services; and expend funds necessary to upgrade the existing flood warning system, subject to the ratification and approval of the Board. The Flood Control District of Maricopa County operates a 24-hour rain, stream and weather gage network which provides "real-time" information to the County and many other agencies about rainfall, floods and weather conditions in Maricopa County. This network operates in the National Weather Service ALERT (Automated Local Evaluation in Real Time) format and is commonly referred to as an ALERT system. The ALERT system uses "automatic" telemetry gages for data collection. Data is also used to reconstruct storm events in order to show the origin of flooding problems and to provide data for use in floodplain studies, computer modeling of watersheds and design of future flood control structures. ALERT2 is the new standard protocol designed to replace the existing ALERT. ALERT2 provides a graceful transition of real-time data collection systems from providing slow, lean, error-prone environmental data to receiving fast, information-rich, virtually error-free knowledge about events in the real world. It differs from ALERT in that it is much faster, carries more information, and operates virtually error free. Using a channel sharing technique called TDMA, where each transmitter has its own brief time slot in which to transmit, the message contention and data loss problems of ALERT can be minimized. It has a large enough ID space to eliminate the ID assignment problems common in some areas of the country. This Agenda Item impacts Supervisorial Districts 1, 2, 3, 4 & 5. (C-69-14-007-6-00)

F-3. AGREEMENTS AND EASEMENTS WITH THE BUCKEYE WATER CONSERVATION AND DRAINAGE DISTRICT FOR THE LOOP 303 OUTFALL DRAINAGE SYSTEM PROJECT Approve IGA 2013A008, Development Agreement between the Flood Control District of Maricopa County (FCDMC) and the Buckeye Water Conservation and Drainage District (BWCDD) for the Loop 303 Outfall Drainage System, and the following attachments: Facilities and Access Easement Agreement, Discharge Easement Agreement, Ingress and Egress Easement Agreement, and Easement and Agreement for Flood Control Purposes. IGA 2013A008 and its attachments establish the related construction improvements, establish operational and access rights for both parties, and authorize the District to include three upgraded BWCDD canal control gates at BWCDD’s cost. The Loop 303 Outfall Drainage System Project (PROJECT) of the Flood Control District of Maricopa County (FCDMC) crosses irrigation facilities of the Buckeye Water Conservation and Drainage District (BWCDD), is aligned along a segment of the existing BWCDD wasteway ditch for canal excess flows, and will provide conveyance for future excess flows. Features have been incorporated into the PROJECT design to mitigate the effects of the crossings and to maintain the functions of the facilities of both agencies. The related project features include a “shoe fly” style of irrigation canal realignment, canal lining, and structures for delivery, check, and overflow functions. BWCDD has requested and will fund an $80,000 upgrade of three control gates of the canal. Access for the operation and maintenance activities of both agencies will be established by these easement agreements. This item impacts Supervisorial District 4. (C-69-14-008-3-00)

H-2. DECLARATIONS OF TRUST FOR PUBLIC HOUSING DEVELOPMENT GRANT PROJECTS (ASSET MANAGEMENT PROPERTY 15) Approve and execute Declaration of Trust documents for Housing Authority of Maricopa County Public Housing Development Grant Projects (form HUD-52190-A) which declares and acknowledges that during the existence of the trust hereby created, the U.S. Department of Housing and Urban Development (HUD) has been granted and is possessed of an interest in its public housing properties. This is to assure HUD of the performance by HAMC of the covenants contained in the Development Project Grant Amendment (dated 3/31/1982) and Annual Contributions Contract (dated 3/15/1996). HAMC does acknowledge and declare that it is possessed of and holds in trust for the benefit of HUD lower income housing properties known as Project No. AZ009015 AMP 15 located in the City of Peoria, County of Maricopa, State of Arizona. The requirement for public housing authorities (PHAs) to ensure a current Declaration of Trust (DOT) is recorded against all property that has been acquired, developed, maintained, or assisted with funds from US Housing Act of 1937 (Act) funds is long-standing and well established by the Act, HUD regulations, and the Annual Contributions Contract (ACC). The DOT is a legal instrument that grants HUD an interest in public housing properties. It provides public notice that the property must be operated in accordance with all public housing federal requirements, including the requirement not to convey or otherwise encumber the property unless expressly authorized by federal law and/or HUD. Since HAMC public housing developments have continued to receive assistance (capital funds) under the Act, federal law requires that HAMC record current and updated DOTs against them. In addition to being an ongoing federal requirement, it is important for HAMC to maintain current DOTs against its public housing properties for other reasons, including: 1) to ensure the accuracy of HUD subsidy calculations and payments under the Operating Fund and Capital Fund; and b) to expedite HUD’s processing and approvals of other federal public housing programs (e.g., Capital Fund Finance Program and Operating Fund Financing Program under Section 30 of the Act, mixed-finance development under 24 CFR 941 Subpart F, and dispositions under Section 18 of the Act).
