18. ACCEPT GRANTS FOR THE ADULT PROBATION DEPARTMENT FOR FY 2013-14 Accept the FY 2013-14 grants for the Adult Probation Department of the Judicial Branch. The indirect cost rate as of July 2013 is 10.5% as approved by the Department of Finance. Some of the grants for FY 2013-14 do not allow indirect cost recovery as reflected in the attached funding agreements. The status of indirect costs as well as matching funds for each grant is noted on the attached summary sheet. For FY 2013-14, we anticipate accepting ten (10) new awards for Grant Fund revenue of $2,562,519, carrying over Grant Fund revenue balance of $594,194 on six (6) previously accepted awards with $58.00 in interest on one (1) carryover grant. On the new awards, indirect costs on eligible expenditures are estimated to be $268,030 with $9,847 recoverable and $258,183 unrecoverable. In addition, approve an increase to the FY 2013-14 Adult Probation (110) Adult Probation Grants Fund (211) Operating (0000) revenue and expenditure appropriation in the amount of $72,512. This increase is necessary because actual grant funding to be received is more than anticipated and budgeted. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation and, therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-11-14-005-G-00)

55. AMENDMENT TO IGA WITH THE ARIZONA DEPARTMENT OF ECONOMIC SECURITY CHILD CARE ADMINISTRATION Approve Amendment No.1 to Intergovernmental Agreement (IGA) between the Arizona Department of Economic Security (DES) Child Care Administration and the Maricopa County Office of Research and Reporting in an amount of $74,185.00 to conduct the Arizona Child Care Local Market Rate Survey. The term of this agreement is February 1, 2012 through June 30, 2017, for a new not-to-exceed amount of $146,722.00. Revenues and expenditures for the 2014 Market Rate Survey were included in the 2014 fiscal year budget for Research & Reporting. The Arizona DES Child Care Administration has requested that the Office of Research and Reporting conduct the 2014 Arizona Child Care Local Market Rate Survey. The data collected will be used to meet federal requirements in certifying the rates for the provision of child care services. Research and Reporting has conducted the Arizona Local Market Rate Survey bi-annually since first mandated in 1989 (1990, 1992, 1994, 1996, 1998, 2000, 2002, 2004, 2006, 2008, 2010 and 2012). The methodologies developed by Research and Reporting for conducting the survey are very acceptable in meeting the federal requirement and have been used as models by other states. This previous involvement and other considerations translate into savings for all Arizona Residents if Research and Reporting conducts the survey again this year. The data is used to determine the distribution of federal funds. The data collected is beneficial to the Maricopa County Human Services and Public Health agencies. (C-46-12-002-3-01)

60. PROPOSED CHANGES TO TRANSPORTATION ADVISORY BOARD BYLAWS Approve the proposed changes to the Transportation Advisory Board (TAB) Bylaws as recommended unanimously by the TAB on May 21, 2013 and November 19, 2013. The Transportation Advisory Board (TAB) bylaws require that the Vice Chairman of the TAB review the bylaws annually and recommend any changes he deems appropriate or necessary. At the May 21 TAB meeting, Vice Chairman Jeff Martin proposed and the TAB recommended changes to the bylaws. At the November 19, 2013 TAB meeting, the TAB recommended additional changes to the bylaws. (See attached copy of bylaws with proposed changes highlighted.) The proposed changes to the TAB bylaws are the following: Article II, Section 3 – Delete reviews and recommendations associated with the former Small Cities Transportation Assistance Program (SCTAP) from the duties of the TAB. This change is recommended because the SCTAP was ended on advice of the Maricopa County Attorney’s Office (MCAO). The SCTAP could potentially involve expenditures of Maricopa County Highway User Revenue Fund (HURF) monies in low income areas of certain incorporated cities and towns. Such expenditures are not permitted by law because MCAO advises County HURF monies may only be expended on County highways. Thus, the SCTAP language is recommended for deletion from the TAB duties under the bylaws. Article III, Section 2 – Provide that if a TAB Member’s (3-year) term expires and there is no appointed replacement, the Member’s term shall extend until a replacement is appointed. This proposed change is to address situations where terms may expire during periods where the Board of Supervisors (BOS) is not scheduled to meet. This also addresses instances where re-appointments or new appointments are not decided in time to coincide with the end of a Member’s term. The Maricopa County Attorney's Office (MCAO) has advised that it is acceptable by State law for an advisory board member to continue to serve until a new member is appointed. So, the recommended change to the bylaws will formalize the allowable continued service by a TAB member until a re-appointment or a new appointment can be made. Article VII, Section 1 - Clarify that proposed changes to the bylaws should be officially posted two weeks prior to a TAB meeting where the recommended changes to the bylaws are to be considered, so that all interested persons can see the proposed changes and have an opportunity to comment. Article VIII, Section 1 - This is technical or clerical adjustment. “Arizona Revised Statutes” is currently abbreviated in the bylaws as “A.R.S.” The recommendation is to use the long form for those who are not familiar with the abbreviation. Other changes are grammatical. Supervisory District No. 1, 2, 3, 4 and 5 (C-64-14-075-M-00)

68. SET PUBLIC HEARING FOR RULES 321, 360, 370, 371 AND APPENDIX G Pursuant to A.R.S. §49-479(b), set a public hearing for March 26, 2014 to solicit comments and consider the adoption of proposed amendments to Maricopa County Air Pollution Control Regulations, Rule 321: Municipal Solid Waste Landfills; Rule 360: New Source Performance Standards; Rule 370: Federal Hazardous Air Pollutant Program; Rule 371: Acid Rain; and Appendix G: Incorporated Materials. Upon Board approval, this item will become effective March 26, 2014. The Maricopa County Air Quality Department (department) is proposing to revise Rule 321: Municipal Solid Waste Landfills; Rule 360: New Source Performance Standards; Rule 370: Federal Hazardous Air Pollutant Program; Rule 371: Acid Rain; and Appendix G: Incorporated Material by incorporating by reference federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA) and published in the Federal Register: New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2011, to July 1, 2013, in each of the rules and appendix to remain current with federal regulations. The adoption of the proposed amendments to Maricopa County Air Pollution Control Regulations Rules 321, 360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of authority to the department for the implementation and enforcement of the federal regulations and documents. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rule or law was proposed and adopted. The department did not receive any public comments during the public comment period. (C-85-14-009-7-00)

F-4. CONSTRUCTION MANAGER AT RISK CONTRACT TO HUNTER CONTRACTING COMPANY FOR BUCKEYE FLOOD RETARDING STRUCTURE #1 - PHASE 1 Award Contract FCD 2013C007, Construction Manager at Risk (CMAR) Construction Services – Buckeye Flood Retarding Structure No.1 – Phase I to Hunter Contracting Company in a total contract amount of $7,114,914.71. The CMAR was procured under a qualification-based selection in accordance with Maricopa County Procurement Code, Article 5, Paragraph 504(F). Buckeye Flood Retarding Structure (FRS) No.1 is the westernmost of a series of three flood control dams designed and built by the Soil Conservation Service (now the Natural Resources Conservation Service, or NRCS) between 1973 and 1975. The dam is located along the southern slopes of the White Tank Mountains and parallels the north side of Interstate 10 for 7.1 miles west to the Hassayampa River. The dam is operated and maintained by the District and is regulated by the Arizona Department of Water Resources (ADWR). Several non-emergency dam safety deficiencies have been identified at Buckeye FRS No.1. During the planning phase, which was completed in July 2009, the District identified overall rehabilitation as the selected alternative. NRCS is a cost share participant in this Project under IGA FCD 2011A004 between the District and NRCS. To date, NRCS has obligated $4.0 million in federal funding for the Project with additional funding being requested. The subject contract implements Phase 1 of construction of the Project, which involves placing a central filter within a portion of the dam west of Johnson Dam and removing an existing irrigation outlet. Phase 2 of the Project construction will be accomplished under a separate contract. This Agenda Item impacts Supervisorial District 4. (C-69-14-027-5-00)
