MODIFICATION TO THE OPERATING AND FINANCIAL PLAN BETWEEN THE MARICOPA COUNTY AND THE U.S. DEPARTMENT OF AGRICULTURE, FOREST SERVICE, TONTO NATIONAL FOREST Approve “Modification of Grant or Agreement” #4 to accept funding in the amount of $116,278.77 for the CY 2020 Operating and Financial Plan (Exhibit A) between Maricopa County on behalf of the Maricopa County Sheriff’s Office and the U.S. Department of Agriculture, Forest Service, Tonto National Forest. The reimbursement period will be retroactive to January 1, 2020 through December 31, 2020. Also approve an estimated amount of $30,000 that is allowed for in the agreement for special enforcement situations that include but are not limited to fire emergencies, drug enforcement, and certain group gatherings for a total of $146,278.77. The MCSO Indirect Rate is 16.30%. Total grant indirect costs are estimated to be $23,843.44 and none of this amount is recoverable. The unrecoverable amount of $23,843.44 will be absorbed within Sheriff’s General Fund operations. This grant award is multi-year and recurring. The Sheriff’s Office has been providing these services for more than 30 years. The award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. This service is not mandated; however, it furthers the Sheriff’s public safety mandate. Funding is used to pay deputy overtime, the leases on two vehicles, monthly charges for cell phones, and other supplies related to this grant agreement for MCSO to assist in patrolling portions of the Tonto National Forest, located in Maricopa County. ASPCA TRANSPORT PROGRAM GRANT AGREEMENT Approve the acceptance of grant funds from the American Society for the Prevention of Cruelty to Animals (ASPCA) in the amount of $60,000 to support the relocation of animals to collaborating shelters with available space and a community need for adoptable pets. The grant award begins upon execution and ends on December 9, 2021. Authorize the Chairman to sign the Grant Acceptance Agreement and authorize the Animal Care and Control appointed authority and/or designee to sign other grant-related documents, such as reporting requirements, etc., as applicable. The Animal Care and Control indirect rate for FY2020 is 19.18%. Total grant indirect costs are estimated to be $11,508.00 and are not recoverable. Costs will be absorbed in the Animal Care and Control Fund 572 Operating Budget. The grant award is a one-time, non-recurring funding opportunity. Grant funds are provided using the advance funding method where funding is received in advance of actual expenditures. The grant award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. The grant award does provide funding for a mandated service, which is to provide adequate care of animals that are sheltered with the Animal Care and Control Department. This grant was competitively bid. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. ACCEPT GRANT FUNDS FROM ARIZONA DEPARTMENT OF EMERGENCY AND MILITARY AFFAIRS Approve and accept grant funds from Arizona Department of Emergency and Military Affairs, Grant No. PDMC-PL-09-AZ-2018-003 / EMF-2020-PC-001, CFDA# 97.047, in the amount not to exceed $82,000 for the purpose of implementing a sustained pre-disaster natural hazard mitigation program to reduce overall risk to the population and structures, while also reducing reliance on funding from major disaster declarations. The grant award begins on August 7, 2019 and ends April 1, 2022. The Department indirect rate for FY20 is 10%. The total grant indirect costs are estimated to be $8,200 and are not recoverable. The grant requires a 25% match ($28,000), which will be met through allowable non-federally funded staff's time spent on the Plan, from the period of August 7, 2019 through April 1, 2020. The grant award is non-reoccurring and competitive, the department has to apply every 5 years for the Plan update. The last grant award was in 2014. The department has a match requirement of $28,000 during the grant award period. Maricopa County does not have to fund any additional costs for the program. In order to remain compliant with the congressional regulations, the County and jurisdictions must perform full plan update and obtain FEMA approval in order to be eligible for Post Disaster Grants. This plan is mandated in order to receive Post-Disaster grant funds. The Grant Award is for the administration and completion of an approved Pre-Disaster Mitigation project. Funding for this agreement is provided by a Grant from Arizona Department of Emergency and Military Affairs in the amount not to exceed $82,000. Also, approve revenue and expenditure appropriation adjustments to the Department of Emergency Management (D150) Emergency Management (215) Non Recurring Non Project (NRNP) associated with the grant in th e amount of $82,000 for FY 2020 . This Resolution will allow the designated Applicant's Agent to execute and file with the appropriate authorities any applications necessary for Maricopa County Department of Emergency Management to receive financial assistance under the Disaster Relief Act, or the Hazard Mitigation Assistance Grant. When emergency situations occur, state and federal disaster relief funds may be available to reimburse qualified expenses incurred by responding organizations. To be eligible to receive these funds, each affected organization is required to appoint an Applicant's Agent. The Applicant's Agent must have the legal authority to apply for the assistance on behalf of the Applicant organization by executing a Disaster Assistance Agreement and submitting it to State or Federal authorities. These agreements outline work completion deadlines and other responsibilities of the Applicant organization necessary to receive relief funds. The Designation of Applicant's Agent must be signed by the Chairman of the Board of Supervisors and the Clerk of the Board. The Applicant Agent is required for the Hazard Mitigation Assistance Grant. OF SAVE THE FAMILY FOUNDATION OF ARIZONA AND THE CITY OF CHANDLER FOR HOME INVESTMENT PARTNERSHIPS ACTIVITIES Approve financial Amendment No. 1 to the Agreement between Affordable Rental Movement (A.R.M.) of Save the Family Foundation of Arizona, a Community Housing Development Organization (CHDO), City of Chandler and Maricopa County, administered by its Human Services Department. The Parties agree to enter into this Amendment No. 1 to the Agreement to amend the Agreement as follows: A. Extend the term of the Agreement from September 30, 2022 to September 30, 2023. B. Add an additional Work Statement hereinafter referred to as “2019 Work Statement” for the CHDO to acquire, rehabilitate and rent a single-family home for their scattered-site rental program. The expenditure term for this Work Statement shall expire on September 30, 2023. C. The County shall provide the CHDO with funding for the 2019 Work Statement in an amount not-to-exceed $240,000. D. The funding amount for this Agreement shall be increased to $465,000. E. Section IV, Compensation, Subsection D, Reimbursement shall be amended to reference total funding of $465,000. The County shall reimburse the CHDO on a Net 0 payment standard. This Agreement is subject to A.R.S. §38-511. The foregoing paragraphs contain all the changes made by this Amendment. FUNDING FOR IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR REFUGEE- MEDICAL ASSISTANCE PROGRAM Approve funding for Intergovernmental Agreement (IGA) Contract DI18-002141 between the Arizona Department of Economic Security (DES) and Maricopa County by and through its Department of Public Health to provide grant funding for the Refugee Screening Medical Assistance Program (RMAP). This is a fee-based reimbursement estimated not-to-exceed an annual amount of $12,000 for the retro-active budget period October 1, 2019 through September 30, 2020. The Refugee award is reoccurring and has been awarded to MCDPH in previous years. It does not require an in-kind match and indirect costs are fully recoverable. Refugee services are not mandated but provide a benefit to County residents by providing medical examinations and needed follow-up to newly arriving refugees for issues of public health significance. Should the grant cease, ongoing contributions should not be required. This grant award was not competitive. Maricopa County Department of Public Health’s indirect rate for FY2019-20 is 19.2%. This grant allows for full indirect, therefore the estimated amount of $1,933 is fully recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. There is no cost to the County’s operating budget. All other terms and conditions of the original contract remain in full force and effect. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. AMENDMENT TO LICENSE AGREEMENT P-50311 WITH CITY OF SCOTTSDALE Approve and authorize the Chairman to execute Amendment No. 1 to License Agreement No. P-50311 between the City of Scottsdale, Licensor, and Maricopa County, Licensee, for 448 square feet for a Public Health, Women and Infant Children (WIC) clinic and office space located at 6535 East Osborn Road, Scottsdale, AZ; and appoint Licensee Contract Administrator to be both the Deputy County Manager for Maricopa County or the Real Estate Director for Maricopa County and each, individually and separately, are given the authority and charged with the responsibility for proper administration of this Agreement as amended. The WIC program provides assistance to qualified low-income women and children of nutritional risk including providing supplemental foods, education, community referrals and other preventive services including, but not limited tom oral health screening for low-income pregnant, breast feeding and non-breast feeding post-partum women and for infants and children up to five years of age found to be at nutritional risk. Amendment 1 will, upon mutual agreement, allow the Licensee Contract Administrator and the City Contract Administrator to change the Use Area or Times of Use by executing an Amended Exhibit “A”. GRANT FUNDS FROM THE GILA RIVER INDIAN COMMUNITY FOR IMPROVEMENTS TO HUNT HIGHWAY Authorize the Maricopa County Department of Transportation (MCDOT) to apply, accept and expend grant funds from the Gila River Indian Community for improvement to Hunt Highway from Old Price Road to Dobson Road and a Resolution approving the application. The amount of the grant application is $798,752. The project will consist of constructing a 24’ wide engineered double chip seal road on the Hunt Highway alignment from Old Price Road to Dobson Road alignment which is roughly 1 mile in length. As part of this project there will need to be some utility relocations. This is one time funding, there is no required match, and the award is competitive. There are no future or ongoing contributions after the grant period ends. The grant allows MCDOT to fulfill a mandated service. The County’s FY 2020 indirect cost rate is 13.45%. All costs under this agreement are for capital expenditures which are not subject to indirect cost recovery.
