7. PROCLAMATION PUBLIC DEFENSE RECOGNITION WEEK Proclaim the week of March 13, 2023, as Public Defense Recognition Week. WHEREAS, March 18, 2023, marks the 60th anniversary of the United States Supreme Court’s decision in Gideon v. Wainwright; and WHEREAS, on March 18, 1963, the United States Supreme Court ruled in Gideon that the United States Constitution’s Sixth Amendment right to the assistance of counsel is essential to a fair trial, and requires the appointment of counsel for indigent defendants accused of felonies in state court; and WHEREAS, the Supreme Court recognized in Gideon that “. . . lawyers in criminal courts are necessities, not luxuries;” and WHEREAS, Maricopa County upholds and affirms the guarantee of the Sixth Amendment’s right to counsel, recognizing counsel as essential to the fairness of criminal proceedings; and WHEREAS, Maricopa County Public Defense Services’ attorneys and support staff continue to work tirelessly to provide essential, constitutionally-guaranteed legal services to those who would not otherwise have access to representation; and WHEREAS, Maricopa County Public Defense Services not only represents its clients but also upholds the rights set forth in the United States Constitution. NOW, THEREFORE, BE IT RESOLVED that the Maricopa County Board of Supervisors does hereby proclaim that the week of March 13, 2023, shall be recognized as “Public Defense Recognition Week” in appreciation of the essential role played by the attorneys and staff of Public Defense Services in upholding the Sixth Amendment guarantee of counsel and protecting the fundamental right to a fair trial. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “101 & Northern: Zoning Exhibit “, consisting of 1 full-size sheet, dated December 7, 2022, and stamped received December 9, 2022, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. These items will be addressed as development plans progress and submitted to the County for further review and/or entitlement. 2. A traffic impact study must be submitted with future (non-billboard) entitlement (POD) application(s) Maricopa County Planning & Development. 3. Northern Avenue is within the jurisdiction of the City of Peoria. The City of Glendale maintains a strip annexation across the site’s frontage as well. The applicant will be responsible for coordinating with both cities to review any traffic impact, right-of-way dedication, permitting or roadway improvement requirements for this and future entitlements. 4. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. e. Prior to a precise plan of development approval for the development of a commercial use requiring utilities, not including billboards uses, the applicant shall provide the Maricopa County Planning and Development Department with an executed pre-annexation service agreement with the City of Glendale that identifies the detail for when the proposed project will be annexed and/or the provision of water and sewer service. In lieu of a pre-annexation service agreement, the developer must provide a ‘will serve’ letter from the certificated water and sewer provider, unless otherwise approved by Maricopa County Environmental Services Department. f. Administrative approval of a Plan of Development will be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the subject site. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. However, parking spaces may overhang two feet into a landscape strip or pedestrian walkway, but any parking spaces that protrude over a pedestrian walkway shall maintain at least a four-foot-wide clearance to allow for pedestrian access. e. 12. DEANNEXATION FROM THE CITY OF MESA ORDINANCE NO. 5762 TO MARICOPA COUNTY Pursuant to A.R.S. § 9-471.03 convene the scheduled public hearing regarding the de-annexing road right-of-way from City of Mesa jurisdiction to Maricopa County. Right-of-way location: From Sossaman and Warner intersection to 1471.47 feet north. Supervisory District No. 2. The Board of Supervisors determined at a public hearing on January 25, 2023 that such action would be in the public interest and has complied with the additional requirements of A.R.S. § 9-471.03. If approved, the Board of Supervisors: 1. Orders that the public right-of-way be returned as specified in City of Mesa Ordinance No. 5762, returning the public right-of-way to Maricopa County. 2. Pursuant to ARS § 9-471.02, directs the Clerk of the Board to notify the City of Mesa that the Board of Supervisors order regarding the de-annexation of the public right-of-way was approved, and 3. Directs the Clerk of the Board to certify a copy of the order of the Board and file it for record in the Office of the County Recorder. Legal description of the roadway being de-annexed, identified as Exhibit "A", is attached. MCDOT Analysis: The existing roadway is owned/operated/maintained by MCDOT. The adjacent area is currently under development for industrial uses requiring roadway improvements. These improvements require the deannexation of 32 feet along Sossaman Road to accommodate an arterial roadway. This deannexation will ensure the roadway is fully within unincorporated Maricopa County and reduce conflict of liability. The roadway improvements are a necessary improvement to the traveling public. The Board action will result to add 0.0019 square miles to County ownership and enable the County to assume responsibility for road maintenance. Financial Status: Cost of the roadway(s) development falls to the developer with no initial cost to Maricopa County. Cost of maintenance moving forward is typical of roadway maintenance cost and will be the responsibility of Maricopa County. 26. GRANT RECONCILIATION Accept FY2022-23 grants for the Clerk of the Superior Court in the amount of $1,402,221. The indirect costs (based upon a rate of 39.43%) of $600,818 are not fully recoverable, as reflected in the funding agreements. FY2022-23 grants allow for $396,540 of recoverable indirect costs and $204,278 of unrecoverable costs. Also, pursuant to A.R.S. §42-17106, approve appropriation adjustments, resulting in a net increase to revenue and expenditures of $240,785 in FY2022-23 Clerk of the Court (160) Grants Fund (216) Operating (OPER) budget. Approval of this item will result in an overall grant funds appropriation of $1,402,221 for revenues and expenditures in the Clerk of the Court (160) Grants Fund (216) Operating (OPER) budget. Grant revenues are not local revenues for the purpose of constitutionals expenditure limitation, and therefore, expenditure of these revenues is not prohibited by the budget law. This request does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Administrative Order #95-50, approved by Presiding Judge Robert D. Myers on June 29, 1995, adopted for the Judicial Branch a policy for the administration of grant funding. APPLY FOR AND ACCEPT THE 2023 TITLE I-D GRANT FROM THE ARIZONA DEPARTMENT OF EDUCATION FOR THE JAIL SCHOOL Approve the application for and acceptance of the Title I – Delinquent grant from the Arizona Department of Education in the amount of $84,369. The purpose of this grant is to provide prevention and intervention programs for children and youth who are neglected, delinquent, or at-risk. The Grant period is from July 1, 2022, to June 30, 2023. The grant award is reoccurring. The Department has no in-kind match requirement during the grant award period, and the grant award does not require ongoing cash contributions. The grant award is for a mandated function as it goes to jail school education for 16-to-18-year old's already in County jail. The ESSER Fund is authorized under Section 18003 of the Education Stabilization Fund per the CARES Act to aid schools in preventing, preparing for, and responding to the coronavirus virus (COVID-19). Funds for this program have been allocated per Section 18003(c) to local educational agencies (LEAs) in the State in proportion to the amount of funds such LEAs received under Title I-A in the most recent fiscal year. Funds for this program have also been allocated per Section 18003(e) to LEAs in the State that did not receive funds under Title I-A in the most recent fiscal year. The term of this grant is March 13, 2020, to September 30, 2024. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant award is a formula grant CFDA 84.425. The cash or in-kind match is not applicable. Ongoing cash contributions are not applicable. The Maricopa County School Superintendent’s Office serves as the fiscal agent for the jail education program. 41. PETCO LOVE GRANT AGREEMENT AND BUDGET ADJUSTMENT Approve the application and acceptance of grant funds from Petco Love Agreement (the “Agreement”) in the amount not-to-exceed $100,000. The grant provides funding for a mandated service, which is to support lifesaving objectives at the Maricopa County Animal Care & Control. The grant award begins upon execution and ends on March 31, 2024. Authorize the Chairman to sign the Agreement and authorize the Animal Care and Control appointed authority and/or designee to sign other grant-related documents, such as reporting requirements, etc., as applicable to administer the grant. In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure authority in the Animal Care and Control (D790) Animal Control Grants Fund (573) Non-Recurring Non-Project (NRNP) appropriation group by $100,000 in Fiscal Year 2023. The grant allows a 0% rate or $0 for indirect costs. The Maricopa County Department of Finance has calculated the Fiscal Year 2023 indirect cost rate at 16.70% or $16,700. The recoverable cost rates for administering this grant is $0 and the Animal Care and Control will absorb the non-recoverable indirect cost of $16,700 into the department’s operating budget over the next two fiscal years. This grant is non-recurring, and a cash or in-kind contribution is not applicable. There are no future or ongoing contributions required following the grant period. Funding for this agreement is provided by a Grant from Petco Love and was competitively bid. AGREEMENT WITH COMMUNITY MEDICAL SERVICES HOLDINGS, LLC Approve an agreement between Community Medical Services Holdings, LLC "CMS" and Maricopa County to establish a program to increase access to Medication Assisted Treatment (“MAT”), Opioid Use Disorder (“OUD”) recovery support services, and opioid prevention awareness for incarcerated patients transitioning to the community. This Agreement shall begin upon approval by the Maricopa County Board of Supervisors and shall terminate one year thereafter unless otherwise terminated or amended as provided herein. By mutual written amendment executed by the Parties’ authorized representatives, this Agreement may be extended for supplemental periods of twelve (12) months, up to maximum of forty-eight (48) months. There are no financial responsibilities assigned by this Agreement; the Agreement is intended to allow CMS and Correctional Health Services (CHS) to work together to better address the needs of the community. GRANT FUNDS FROM ARIZONA STATE DEPARTMENT OF HOMELAND SECURITY FOR RENEWAL OF EMERGENCY PLANS SOFTWARE Authorize Emergency Management to apply for grant funds from Arizona State Department of Homeland Security, (FFY23 SHSGP), in the not-to-exceed amount of $68,000 for the MaricopaRegionPrepares.com subscription renewal. This is a Continuity of Operations Planning (COOP) software package for all jurisdictions within Maricopa County. The grant period for this grant is October 1, 2023 through September 30, 2024. The Maricopa County Department of Finance has calculated the Department of Emergency Management's composite indirect cost rate at 28.82% or $19,597.60. The Department will not be recovering indirect costs off of this grant. The amount of unrecoverable indirect cost is $19,597.60. Emergency Management will absorb these indirect costs within their general budget. The grant award is non-recurring, the department has to apply every year however, we have received the grant for the past six years. The department does not have an in-kind match requirement for this grant. The grant award is not a mandated function, but it is a department strategic goal to have all county departments with a viable Continuity of Operations Plan (COOP). The grant is awarded through the Arizona State Homeland Security Department-State Homeland Security Grant Program (SHSGP), which is a competitive grant program. Maricopa County jurisdictions compete for projects based off the State grant initiatives. Maricopa County has spear headed the grant for the Emergency Operations Plans (EOP)/COOP software project for all county departments and jurisdictions within Maricopa County. Each year Maricopa County applies for the recurring cost of the software maintenance and training funds. Maricopa County does not have to fund any additional costs for the program. The grant is intended to renew the MaricopaRegionPrepares.com subscription. This software tool benefits Maricopa County in developing Emergency Operations Planning (EOP), Continuity of Operations Planning (COOP), Continuity of Government (COG) Planning for local government. The Department was awarded a grant for the software in 2015, we are applying for a grant to cover the cost associated with the maintenance of the system. Funding for this agreement is provided by a grant from the State of Arizona Department of Homeland Security in the amount not to exceed $68,000. The overall grant budget will be adjusted as necessary to accommodate this grant through future reconciliation. Indirect costs are not applicable since Maricopa County Department of Emergency Management (MCDEM) will not accept the grant funding. DEMA will retain and manage the grant during the performance period. It is the intent of MCDEM to MOU the grant funds to DEMA to retain and manage the money. All other provisions of the agreement remain unchanged. The HRPP NICP grant award is reoccurring and has been awarded to the department since 1988. This grant does not require an in-kind match, indirect cost is fully recoverable and ongoing cash contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by providing developmental follow-up through home-based services for families whose children received intensive or special care immediately after birth and for children with identified special health care needs. 70. IGA WITH CITY OF BUCKEYE FOR HOME BOX PROGRAM Approve an Intergovernmental Agreement (IGA) between Maricopa County by and through its Department of Public Health and the City of Buckeye. The purpose of this agreement is to provide funding to purchase residential lock boxes for residences located within the City of Buckeye. The targeted residences will be those occupied by seniors and non-ambulatory adults. The Home Box Program will offer a secure way for first responders to access homes when responding to elderly, chronically ill and homebound community members during emergency situations. This will allow the ability to expedite entry into a residence using a key rather than using forced entry methods. The City of Buckeye will provide small key vaults that will hold a single key and can be easily mounted near the door of homes. The Agreement amount is not-to-exceed $50,000 for the first year. The agreement amount for each year of the subsequent years of the term will be renegotiated based on the availability of funds. PH RFP 230126 SUPPORTING MARICOPA COUNTY’S AGING AND OLDER ADULTS’ POPULATION CONTRACTS Pursuant to MC1-329 of the Maricopa County Procurement Code, authorize the Chairman of the Board of Supervisors to execute one or more Public Health Request for Proposal (PH RFP) contracts, in a form approved by the County Attorney’s Office, to one or more successful bidders in response to PH RFP230126 Supporting Maricopa County’s Aging and Older Adults' Population. The goal is to contract with agencies serving older adults to identify new opportunities or expand existing initiatives. Initiatives may include building systems/networks/partnerships that address social isolation because of COVID; enhancing technology and virtual connection to increase access to telehealth; addressing vaccine hesitancy or increasing COVID-19 vaccination rates; strengthening agency infrastructure by building an inclusive workforce; increasing access to care and mental health using telehealth, home visitation, ambulatory care, community health workers, etc.; educating and preparing a better system to serve the aging population in case of a health emergency such as a pandemic; updating data infrastructure to better track key demographics; and, updating communications/processes/systems to be culturally and linguistically appropriate. The RFP was released on February 01, 2023, and responses are due by 2:00pm on March 10, 2023. A Public Health Evaluation Committee will review all responses received utilizing evaluation criteria included in the RFP and select those most advantageous to Maricopa County. The anticipated amount to be spent among all awarded contracts is approximately $1M with a limit of $500,000 per entity. The anticipated start date of the contracts is April 1, 2023 and will end May 31, 2024. If additional funds become available, awards resulting from this solicitation may be amended and/or extended based on the need for continuous services as well as satisfactory Contractor performance. These agreements will be funded by the COVID-19 Health Improvement Plan-Disparities Grant. 72. PH RFP 230125 PANDEMIC PREPAREDNESS PROJECTS IMPACTING MARICOPA COUNTY’S DISABILITY COMMUNITY CONTRACTS Pursuant to MC1-329 of the Maricopa County Procurement Code, authorize the Chairman of the Board of Supervisors to execute one or more Public Health Request for Proposal (PH RFP) contracts, in a form approved by the County Attorney’s Office, to one or more successful bidders in response to PH RFP 230125 Pandemic Preparedness Projects Impacting Maricopa County’s Disability Community. The goal is to contract with agencies serving adults and/or children with disabilities to identify either new opportunities or expanded initiatives. Initiatives should address any of the following: better preparation of the disability community for future emergencies such as pandemics; supporting COVID recovery; addressing vaccine hesitancy and/or increasing COVID-19 vaccination rates; increasing partnerships with community-based organizations; updating data infrastructure; ensuring seamless communication of public health information to historically marginalized groups; strengthening infrastructure by building or expanding an inclusive workforce; and, updating communications to be culturally and linguistically appropriate. The RFP was released on January 29, 2023 and responses are due by 2:00pm on March 6, 2023. A Public Health Evaluation Committee will review all responses received utilizing evaluation criteria included in the RFP and select those most advantageous to Maricopa County. The anticipated amount to be distributed among all selected Contractors is anticipated to be approximately $1.5M and entities are requested to limit their requests to no more than $500,000 each. Initial contracts will begin on April 1, 2023 and end May 31, 2024. If additional funds become available, awards resulting from this solicitation may be amended and/or extended based on the need for continuous services as well as satisfactory Contractor performance. These agreements will be funded by the COVID-19 Health Improvement Plan-Disparities Grant. Should the funding source cease and alternate funding not be available, Section 4.2 of the RFP, Availability of Funds, will apply allowing for a change or termination of the agreement. 73. PURCHASE ORDER FOR THE IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR THE MATERNAL HEALTH INNOVATION GRANT Approve a Purchase Order (PO) for the Maternal Health Innovation IGA (CTR048567), year 4, between the Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH), South Phoenix Healthy Start program (SPHS). This an additional funding for the budget period of September 30, 2022, through September 29, 2023. The PO is the amount of $90,000.00 which will bring the budget period to a not-to-exceed of $427,500.00. PO states that these additional funds shall be used by June 30, 2023. The term for the IGA started on March 1, 2020, through May 1, 2025. This was a new, non-competitive award and it is not known whether it will continue beyond this 5-year term. The grant does not require an in-kind match or ongoing cash contributions. This is not a mandated function but provides a benefit to the citizens by assisting MCDPH in optimizing resources to address disparities in maternal health. All program costs are allocated to the grant therefore no costs will be absorbed by the department’s operating budget. The MCDPH indirect rate for FY23 is 17.24%. The rescind action is necessary due to the incorrect funding amount that was stated by ADHS for MCH Healthy Arizona Families Public Health Improvement (PHI) Program. Also approve a revised Intergovernmental Agreement (IGA) CTR055260 Amendment between ADHS and Maricopa County By and through its Department of Public Health (MCDPH) to provide funding for the Title V Maternal and Child Health (MCH) Healthy Arizona Families & Preventive Health and Health Services Program. This Amendment 3 updates the funding amount of $330,280 for CHBLOCK for the budget period of July 1, 2022, through June 30, 2023. The term of this cost reimbursement IGA began on July 1, 2020 and terminates on June 30, 2025. The PHI portion of the grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 10%. AMENDMENT TO LICENSE AGREEMENT FOR USE OF REAL PROPERTY WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY Approve and execute Amendment No. 8 to License Agreement for Use of Real Property between Maricopa County (Licensor) and Arizona Department of Economic Security (Licensee) for the use of County controlled facilities located at 4425 W Olive Ave, Glendale, AZ, and 1001 W Southern Ave, Mesa, AZ. Licensee shall provide County with base rent and shared operation costs associated with the operations of the facilities which are not considered revenue. The purpose of this Amendment No. 8 is as follows: A. Increase Licensee’s use of space in Facility 4 to total space of 1,308 SF. With the space increase the Licensee costs will also increase. Commencing March 1, 2023 through June 30, 2023 Licensee shall pay a monthly amount of $4,703 for base rent and $949 for shared operations costs. B. This Amendment extends the term of the Agreement as of July 1, 2023 through June 30, 2024. Licensee shall pay a monthly amount of $4,762 for base rent and $996 for shared operations costs for the extension term. All funds collected under this Agreement will be applied against the costs associated with the operation of the Facilities and are not considered revenue. C. MOU WITH ASU REGARDING SEX TRAFFICKING INTERVENTION RESEARCH (STIR) Approve an MOU establishing a partnership between MCSO and ASU’s Sex Trafficking Intervention Research (STIR) Office for the purpose of jointly securing grant funding to use in training personnel and MCSO sharing relevant crime data so that it can be researched and analyzed by ASU. 98. APPLY FOR GRANT FUNDING OPPORTUNITY FROM CENTERS OF DISEASE CONTROL AND PREVENTION Approve MCDPH to apply for a Grant funding opportunity from the Centers for Disease Control (CDC) NOFO title “BOLD Public Health Programs to Address Alzheimer’s Disease and Related Dementias”. The anticipated funding and term date has yet to be determined. The estimated award date will be issued September 2023 with the final amount and terms. This is a competitive award, at this time, it has not been determined if it will be reoccurring. There is a cash or in-kind matching requirement of 30% during the cooperative agreement period. Match can be provided through additional funds by MCDPH and in-kind services. Should the agreement cease, ongoing contributions are not required. This grant allows for full indirect cost reimbursement. The indirect rate for (FY23) is 17.24%. Indirect costs are fully recoverable. The grant award is not a mandated function but provides a benefit to the citizens in Maricopa County by building an infrastructure and increase capacity in the field of Alzheimer’s Disease and related Dementia. 99. ON-CALL SERVICES CONTRACT WITH ENTELLUS, INC FOR CENTRAL MESA FLOODPLAIN DELINEATION STUDY Award Contract FCD 2022C010 On-Call Services to Entellus, Inc. (Consultant) to provide professional engineering services for the development of a hydraulic model to evaluate the floodplains in Central Mesa for possible updates to the floodplain as a part of the On-Call Central Mesa Floodplain Delineation Study (Contract FCD 2022C010). The estimated contract price is $500,000.00. The contract will be effective for 730 calendar days, from the date of the Notice to Proceed to Final Completion with possible extensions. The Flood Control District of Maricopa Country (District) and Consultant will mutually agree to a detailed scope of work for each work assignment. This is a qualifications-based selection in accordance with the Maricopa County Procurement Code, Article 5, Paragraph 504 and Article 5 Procurement Procedures Manual, Chapter II – Section 2. Floodplains were identified in previous studies, such as the Eastern Canal FDS, the Consolidated Canal FDS and the Upper Roosevelt Water Conservation District Canal FDS.
