43. APPROPRIATION ADJUSTMENT FOR HUMAN SERVICES DEPARTMENT GRANTS Approve an increase in the appropriated budget for Human Services Department (220) Human Services Grants Fund (222), Operating (0000) in the amount of $2,596,341 in revenues and $2,596,341 expenditures, and CDBG Housing Trust Fund (217) Operating (0000) in the amount of $925,598 in revenues and $925,598 expenditures as identified on the Fiscal Year 2014-2015 Grant Summary Worksheet on file in the Office of the Clerk of the Board. The appropriation adjustment brings the Human Services Grant Fund (222) budget to the total amount of $46,915,797 and CDBG Housing Trust Fund (217) to the amount of $17,131,833. The appropriation adjustment is necessary as the carry forward amounts of prior year grants and award amounts of new grants differ from the amount approved in the Fiscal Year 2014-2015 Budget Appropriation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limit, and therefore expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The indirect cost rate is 18.4% as approved by the Department of Health and Human Services. Most of the grants for Fiscal Year 2014-2015 allow for indirect cost recovery as reflected in the funding agreements. Detail of financial impact and grant summary worksheet are attached to be on file with the Clerk of the Board’s Office and retained in accordance with Arizona State Library Archives and Public Records (ASLAPR) approved retention schedule. F-1. CHANGE ORDER TO CONTRACT WITH URS CORPORATION FOR MCMICKEN DAM REHABILITATION PROJECT (ON-CALL) Approve Change Order No. 3 with URS Corporation (2011C030 in the amount of $2,000,000.00 for a revised total contract amount of $5,000,000.00. The purpose of this Change Order is to Approve Change Order (CO) No. 3 to the Flood Control District of Maricopa County (District) Contract FCD 2011C030 – On-Call McMicken Dam Rehabilitation Project with URS Corporation (URS) in the amount of $2,000,000.00 for a total revised contract value of $5,000,000.00 and a contract duration increase of 1095 days. Change Order No. 3 also renegotiates fees to some of the contracts Sub-Consultants, Exhibit B - Fee Schedule (attached), which supersedes all other Fee Schedules directly related to the individual Sub-Consultant. On June 12, 2012, the Board authorized award of Contract Number FCD 2011C030 (C-69-12-074-5-00) under a qualification-based procurement. To date, URS has developed the project designs to 30 percent. As such, URS is the only firm with sufficient project expertise to continue and complete the design. This requested action will increase the Contract Value from $3,000,000.00 to $5,000,000.00. This will allow additional funds to complete the design services of the McMicken Dam Rehabilitation Project (Phase I and II) as well as the McMicken Outlet Channel and Wash Phases which has changed from a levee design to an incised channel design with the opportunity for the sale of excess material to ADOT for their Loop 303 project. The project features in Phase I and II consist of constructing a new emergency spillway, principal outlet and ancillary facilities to provide protection from spillway discharges up to the 500-year storm. Approximately 200 acres of excess land will be available upon completion of Phase I and II construction. The McMicken Dam Project provides enhanced flood protection for properties located directly downstream, including significant portions of Surprise, El Mirage, Sun City West and Grand, Litchfield Park, Avondale, and unincorporated areas of Maricopa County. This change order also extends the contract period beyond the contractual period of 3 year to 6 years. The additional time is required because of complexities arising in the design and covers post-design and construction support services. A.R.S.34-605 specifies that a contract for professional services entered into as the result of a procurement under section 34-603, 34-604 or 34-606 shall have a term not exceeding five years after the date of contract award by the agent of the first contract under the procurement, except that the contract may continue in effect after the five year term for professional services on projects on which the rendering of professional services commences within the five year term. This Agenda Item impacts Supervisorial District 4. (C-69-15-026-5-00)
