MARBELLA RANCH EAST Case #: Z2021062 Supervisor District: 4 Applicant & Owner: Joe Walsh, Walsh Design Group / Midwest Land Trust, LLC Request: Zone Change from Rural-43 to R-5 RUPD Site Location: Approx. 1,280’ south of the SEC of Northern Ave. and El Mirage Rd., in the Glendale area Commission Recommendation: On 8/5/21, the Commission voted 6-0 to recommend approval of Z2021062 subject to conditions ‘a’ – ‘k’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “Marbella Ranch East”, consisting of 1 full-size sheet, dated and stamped received July 6, 2021, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Project Narrative for Rezone of Marbella Ranch East”, consisting of 7 pages, dated and stamped received July 6, 2021, except as modified by the following conditions. c. A traffic impact study must be submitted with any future entitlement application ( i.e. preliminary plat or plan of development). 3. Dedication of right-of-way for El Mirage Road may be required as part of future entitlement application(s). 4. The site contains regulated floodplains. Encroachment into FEMA Zone AE and FW floodplains/floodways is extremely restrictive. The applicant must address requirements required to develop the site as the project progresses through future entitlement(s). 5. The applicant must address how improvements, residences and other improvements necessary for development of the site will be protected from scour along the Agua Fria River (34,500 cfs ) as development plans progress and are submitted to the County for further review and/or entitlement. 6. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. e. The following Maricopa County Environmental Services Department (MCESD) condition shall apply: 1. It should be noted that this document does not approve the referenced project. Comments are provided only as advisory to Maricopa County Planning and Development Department to assist staff to prepare a staff report. Other Maricopa County agencies may have additional requirements. Final review and approval will be made through Planning and Development Department procedures. Applicant may need to submit separate applications to the Maricopa County Environmental Services Department for approval of proposed facilities regulated by the Department. Review of any such application will be based on regulations in force at the time of application. f. All buildings subject to noise attenuation as per ARS § 28-8482(B). g. The master developer shall notify future homeowners that they are located within the state-defined “territory in the vicinity of a military airport” with the following language: “You are buying a home or property in the ‘vicinity of a military airport’ as described by State of Arizona statute ARS §28-8481. Your house should include sound attenuation measures as directed by State law. You will be subject to direct over flights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes over 200,000 flight operations per year, at an average of approximately 170 overflights per day. Although Luke's primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight training areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. Such notification shall be recorded on all Final Plats, be permanently posted on not less than a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and conveyance documents. h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. i . The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. k. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and ARS § 11-814 for five (5) years, within which time the subject site shall obtain an approved plan of development or final subdivision plat, and an issued infrastructure permit for initial development. If this term is not met the Planning and Development Department may present the R-5 RUPD zoning for Z2021062 to the Board of Supervisors (Board), upon recommendation by the Planning and Zoning Commission (Commission), for consideration of amendments or revocation of zoning due to undeveloped parcels. The initial Plan of Development shall be developed in substantial conformance with the Site Plan entitled “RE Papago Solar Photovoltaic Power and Energy Storage Project” consisting of 32 full-size sheets, dated June 15, 2021, and stamped received July 7, 2021, except that a revised site plan shall be submitted within 30 days of Board approval that reflects compliance with condition ‘d.4.” as it pertains to maximum lot coverage. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Zone Change Narrative”, consisting of 22 pages, dated July 6, 2021, and stamped received July 6, 2021 except as modified by the following conditions except that a revised narrative shall be submitted within 30 days of Board approval that reflects compliance with condition ‘d.4.” as it pertains to maximum lot coverage. c. The following Planning Engineering conditions shall apply: 1. Drainage Waiver case DRB2021005 must be approved prior to issuance of building permits. 2. Detailed Grading and Drainage Plans showing the new site improvements must be submitted for the acquisition of building permits. On-site (solar field & substation) areas must be designed in such a manner so that flows are directed to retention basin(s). Basin overflows must be directed to well-defined drainage corridors, to the maximum extent possible. 3. Owner or owner’s agent shall be responsible for identifying and procuring any permit(s) for disturbance of, or work within delineated jurisdictional (Section 404) washes. 4. Sizing of the basin spillways must be determined based on the peak unattenuated flow rate, based on the proposed site condition, using either the Rational Method or DDMSW. Where the retention areas will be comingled with offsite flows, the offsite flows must be included in the discharge rate. 5. As part of the final design, channelized flow may be required to be dissipated (spread) at their outflow locations to match existing downstream conditions. 6. Drainage review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and the Maricopa County Drainage Policies and Standards. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 7. Any disturbance to Special Flood Hazard Areas (floodplains) will require that a Floodplain Use Permit be issued concurrent with the associated building permit. 8. Pads for inverters, other electrical equipment, and any buildings within a Floodplain must be elevated to the regulatory flood elevation or otherwise designed to meet the requirements of the Floodplain Use Regulations. All development and engineering design shall be in conformance with the most current version of the Floodplain Use Regulations for Maricopa County. 9. Project improvements ( i.e. electric lines) within and immediately adjacent to District owned properties require a Right-of-Way Permit from the Flood Control District. 10. Future right-of-way needs, dedication, preservation, and offsite improvements, shall be addressed during site plan and/or building permit review, with the submittal of a traffic impact study, prior to any approvals. 11. Driveway accesses to paved MCDOT right-of-ways must be paved for the full width of the right-of-way. d. The following IND-2 IUPD Zoning District standards shall apply: 1. Maximum Electric Transmission Line Height – 140’ 2. Minimum Side Yard – 0’ 3. Minimum Rear Yard – 0’ 4. Maximum Lot Coverage – 60% 5. Parking Spaces Required – None required with a Maricopa County Air Quality Department approved dust control plan. High curb and/or bumper guards not required. 6. Landscaping – No landscaping areas required 7. Sight Visibility Triangles – No sight visibility triangles are required at project site entry/access points and road intersection, section line, mid-section line or alignment corners 8. Article 902.91 – All utility uses shall be permitted to be conducted outdoors 9. Site Enclosure and Screening – 6’ chain-link fencing with 1’ of barbed wire permitted e. The Owner or Developer shall address and respond to all recommendations of the Arizona Game and Fish Department (AZGFD) included in the letter dated May 26, 2021 at the time of construction permitting. The response shall be sent to AZGFD for review and consideration. The Zoning Inspector and/or their designee shall review the applicant’s response, and any subsequent comments received from AZGFD, to determine whether the response issued by the Owner or Developer addresses AZGFD comments in good faith. Should the Zoning Inspector and/or their designee decide that the Owner or Developer has not substantially addressed AZGFD comments in good faith, the Owner or Developer shall be required to propose and implement alternatives to the recommendations made by AZGFD. f. The IND-2 IUPD shall limit the use of the site exclusively to a solar electric generating facility including ancillary offices and ancillary uses. All other site uses shall require a Zone Change Major Amendment. g. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. h. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i . The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Zone Change, the property shall revert to the zoning that existed on the date of application. AQ-2017-008-RULE 336 (SURFACE COATING OPERATIONS) Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on the proposed revision of Maricopa County Air Pollution Control Regulation III - Rule 336 (Surface Coating Operations) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed revisions to the rule and to approve submission of the revised rule as a revision to the Arizona SIP. Rule 336 establishes limits for the emission of Volatile Organic Compounds (VOCs) from surface coating operations. Rule 336 applies to VOC-containing coatings as well as related activities, such as coating preparation/mixing, coating application, and the cleanup of coating application equipment. The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 336 to address rule deficiencies identified by the U.S. Environmental Protection Agency (EPA) to secure full approval of Rule 336 as a revision to the Arizona SIP. The MCAQD is also proposing revisions to address rule recommendations provided by the EPA, incorporate revisions recommended by stakeholders, and make other revisions to improve and clarify the rule. DELEGATION OF AUTHORITY REQUEST TO IMPLEMENT THE FEDERAL PLAN REQUIREMENTS FOR EXISTING MUNICIPAL SOLID WASTE (MSW) LANDFILLS Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-474(4), to solicit comments on the approval of the Maricopa County Air Quality Department’s (MCAQD) request for delegation of authority from the U.S. Environmental Protection Agency (EPA) to implement the Federal Plan Requirements for Existing MSW Landfills at 40 CFR Part 62, Subpart OOO. Following the public hearing, the Board is requested to approve the request for delegation of authority and to approve submission of the delegation request to the EPA. On August 29, 2016, the EPA promulgated emission guidelines for existing MSW landfills which set forth specific mechanisms and requirements for controlling emissions of non-methane organic compounds. The emission guidelines are codified at Title 40 of the Code of Federal Regulations, Part 60, Subpart Cf and require States to submit a plan, also known as a 111(d) plan, to the EPA to implement the provisions Subpart Cf. The MCAQD submitted a 111(d) Plan to the EPA in 2018, however, it was not approvable as submitted because it did not contain a locally enforceable rule which incorporated the emission guidelines in Subpart Cf. As a result, the MCAQD withdrew the 111(d) Plan in 2019. Currently, the MCAQD is working to revise Rule 321 (Municipal Solid Waste Landfills) to incorporate the emission guidelines, but these revisions have not yet been adopted. Once revisions to Rule 321 are adopted, the MCAQD will submit another 111(d) Plan to the EPA for approval. In August 2019, the EPA released the proposed Federal Plan requirements for existing MSW Landfills. The Federal Plan was finalized on May 21, 2021, became effective on June 21, 2021, and requires all existing MSW landfills in states without approved 111(d) Plans to comply with the Federal Plan requirements until a local 111(d) plan is approved by the EPA. The EPA encourages states that do not have approved 111(d) plans to request delegation of authority of the Federal Plan so that they can have primary responsibility for implementing the 2016 emission guidelines. This delegation of authority request must be approved by the Board of Supervisors before the MCAQD can request delegation of authority from the EPA to implement the Federal Plan. The Federal Plan and corresponding delegation of authority will no longer apply upon the effective date of the approved 111(d) plan for Maricopa County. (C-85-22-061-X-01)

19. FY22 VICTIMS’ RIGHTS GRANT FUNDING FROM ARIZONA ATTORNEY GENERAL Approve receipt of FY 2021-2022 grant funds from the State of Arizona, Office of the Attorney General, in the amount of $283,320. These grant funds will support mandated functions by covering direct costs of implementing victims’ rights laws pursuant to Arizona Revised Statues Title 13, Chapter 40 and Title 8, Chapter 3, Article 7, that impact prosecutorial agencies as an entity type. This agreement commenced, retroactively, July 1, 2021 and terminates on June 30, 2022. In accordance with Victims’ Rights Program Guidelines, Section IV, page 5, the grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the administration of this grant. The Maricopa County Attorney’s Office FY2022 composite indirect cost rate is 20.3%, or $57,514. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $57,514. Non-recoverable indirect costs will be covered by the department's general fund budget. This grant is non-competitive and does not require a match. The grant award does not require on-going cash contributions after the grant period end date. Authorize the Chairman of the Board of Supervisors, or designee, to sign all documents related to this award. Grant revenues are not "local revenues" for the purpose of the constitutional expenditure limitation, and therefore expenditure of the funds is not prohibited by the budget law. This award agreement is in the amount of $283,320. This award will ensure that victims of crime are notified of the progress of criminal proceedings. The Sheriff’s Office is mandated by Arizona Revised Statues Title 13, Chapter 40 (Crime Victim’s Rights) and Title 8, Chapter 3 (Victim Rights for Juvenile Offenses) requires victim notification upon a suspect’s arrest, next court appearance, release from custody, post-conviction/post adjudication release etc. This funding directly supports the overall mandated function of providing victim notification services. AMENDMENT TO THE IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR COMMUNITY ACTION SERVICES PROGRAM Approve revenue Amendment No. 4 to the Intergovernmental Agreement (Agreement) between Arizona Department of Economic Security (DES) and Maricopa County, administered by its Human Services Department (County). The purpose of Amendment No.4 is for DES to provide the County with carryover allocations from State Fiscal Year 2021 for the Case Management COVID 19 and the Community Services COVID 19 Supplemental Funding Budgets. The funding amount shall be increased by $1,419,613. The Amendment addresses the following: • Pursuant to the Terms and Conditions, Section 28.0 Levels of Service, this Amendment is to revise the Case Management Service Budgets and the Community Services Service budgets for the period of July 1, 2021 through June 30, 2022. • The revised funding allocations are as follows: o The Case Management reimbursement ceiling for the period of July 1, 2021 through June 30, 2020 is revised from $5,138,670 to $5,542,885, an increase of $404,215. o The Community Services service reimbursement ceiling for the period of July 1, 2021 through June 30, 2022 is revised from $898,744 to $1,914,142, an increase of $1,015,398. o The Case Management and the Community Services Itemized Service Budgets are added and attached. 43. LEASE AGREEMENT WITH SHADOW RIDGE ESTATES, LLC Approve and execute Lease Agreement (“Agreement”) L-7513 with Shadow Ridge Estates (Mesa), LP, California limited partnership, ("Lessor" or “Landlord”) and Maricopa County (“Lessee” or “Tenant”). The Lease is for the Maricopa County Human Services Department’s use of 41,917 rentable square feet (RSF) of office and storage space at 1001 W. Southern Avenue, Mesa (“Premises”); and authorize the Assistant County Manager and/or the County Real Estate Director to administer the Agreement. The purpose of this Agreement is for two Human Services Department programs ( Arizona@Work Maricopa County and the Early Education Division-Head Start administration) to be co-located in the same site. The Lessor shall deliver to County the Premises as a turn-key space on or before March 1, 2022. This Agreement shall commence after the County has: (1) accepted the condition of the Premises as suitable for the Permitted Use; (2) obtained all required approvals to open to the public (“Commencement Date”). The initial term of the Agreement is for 124 months (March 1, 2022 through June 30, 2032). The County will have two (2) five-year options to renew provided that County gives the Lessor a one hundred eighty-day (180) notice to renew and the first right to purchase the building should it become for sale. County, at County’s expense, shall have the right to fabricate and install panels on the monument sign, exterior signage on the top of the building and eyebrow signage on the first-floor level. The County will utilize two hundred forty-six parking spaces at no charge of which forty-one (41) will be reserved covered spaces at no charge to the County. In addition, the existing furniture can be used at no charge should County determine they want it. Such furniture can be purchased by County via a separate bill of sale in the amount of $10.00. Although County shall have access/usage of the Premises from 7am to 7pm Monday – Friday and 8am to 12pm Saturday; from time to time, Human Services may need to utilize the building after hours for Program related activities and Lessor agrees to allow such use upon receipt of the request form. If after hours HVAC is necessary, the parties agree that the rate for such usage shall be at $7 per hour per HVAC unit used, payable within thirty (30) days of receipt of invoice from Lessor. An annual estimate for this type of usage is one thousand ($1,000.00) dollars per year. The Commencement Date shall be memorialized by the Parties via execution of a Commencement Date Confirmation Form. This Agreement shall be effective upon full execution and delivery by the Parties (“Effective Date”). Upon notification from Lessor which shall be no less than thirty (30) days prior to the commencement date as hereinafter defined, Lessee and its employees, agents, contractors, subcontractors, engineers, consultants, suppliers and other representatives, and their respective employees, shall be permitted to enter and occupy the Premises, free of charge, for the purposes of inspecting same, and to install Lessee’s furniture, fixtures and equipment (including, but not limited to telephone, communications and computer equipment, wiring and cabling, and badge readers) (the “Early Occupancy Period”); provided, however, that Lessee shall not interfere with Lessor’s performance of any remaining work in the Premises during such Early Occupancy Period. All of Lessee’s covenants and obligations under this Agreement other than the payment of Rent (defined in § 3.1) shall apply during the Early Occupancy Period. Rent for the Premises shall be at an annual full-service gross rate of $974,570.25 plus 2.7% rental tax for the term of the Agreement. Supervisory District: 2 (C-22-22-169-X-00)

COMPETITION IMPRACTICABLE AGREEMENT WITH AREA AGENCY ON AGING, REGION ONE, INCORPORATED Approve a Competition Impracticable Agreement (“Agreement”) between Area Agency on Aging, Region One, Incorporated, a non-profit corporation (“Contractor”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for Contractor to administer a grant assistance program that will support the increase in demand for services for Maricopa County seniors and adults with disabilities as a result of the COVID-19 Pandemic. Funding of this Agreement is through the American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds under the CFDA number of 21.027. The Agreement amount shall not-to-exceed $10,600,000. The Contractor shall provide oversight of the following service activities: • Biohazard cleaning services, for Senior and Adult Services Division clients up to $540,000; • Hire an analyst to research and analyze factors affecting the recruitment and retention of Direct Care Workers in Maricopa County up to $200,000; • Administer grants to qualified agencies, and distribute up to $8,800,000 on behalf of the County to partner agencies serving Maricopa County residents: o Grants to Senior Centers located in Maricopa County up to $2,700,000; o Support the recruitment and retention efforts by Home Care Agencies for Direct Care Workers in Maricopa County up to $3,400,000 with a maximum of $1,700,000 annually; o Grants to Adult Day Health Care Centers up to $2,700,000. The Contractor shall receive a maximum of $1,060,000 for administration of these services. Agreement term is September 1, 2021 and will expire June 30, 2024. Also request authorization for the Chairman to sign Administrative Change Orders as outlined in Paragraph 7.0: 7.1 Administrative Change Orders – The Chairman of the Board of Supervisors is authorized upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the Contractor’s authorized Representative. Administrative Change Orders may address any of the following areas: 7.1.1 Modifications to the project timeline if the last day of the project timeline is within the Agreement term; 7.1.2 Modifications to Budget line items if the Agreement Amount remains unchanged; 7.1.3 Modifications required by federal, state, or County regulations, ordinances, or policies; and 7.1.4 Modifications to Administrative requirements such as changes in reporting periods, frequency of reports, or report formats required by Department of Treasury or local regulations, policies or requirements. 7.2 It is the responsibility of the Contractor to ensure the latest documents are consulted and followed. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR STD CONTROL SERVICES Approve an Amendment to Intergovernmental Agreement (IGA) Contract No. CTR040486 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health to provide continued funding for the Sexually Transmitted Diseases (STD) Services Program. The amendment is in the additional amount of $67,616 for the period January 1, 2021 through December 31, 2021, for the budget period total of $649,943. The term of the Contract is January 1, 2019 through December 31, 2023. The STD grant award is reoccurring and non-competitive and has been awarded to the Department for several years. There is no cash or in-kind match required and indirect cost is fully recoverable. Should this grant be discontinued, ongoing cash contributions may be required as this is a mandated function. At this time, there are no costs to be absorbed by the department’s operating budget. The Department of Public Health indirect rate for FY22 is 17.97%. Indirect costs are estimated at $10,300 and are fully recoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR CLINICAL SERVICES CAPACITY PROGRAM Approve an amendment to the Intergovernmental Agreement (IGA) Contract No. CTR043100, HIV Surveillance Capacity Expansion Program, between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH). The Price Sheet is in the not-to-exceed amount of $192, 000 for the budget period January 1, 2022 through December 31, 2022. The term is April 1, 2019 to March 31, 2024. This is a new IGA with a 5 year term. It may reoccur but it is uncertain. Neither cash nor in-kind match is required and the need for ongoing cash contributions is not anticipated. The grant award services are not a mandated function. This was not a competitive process. The Department of Public Health’s indirect rate for FY 2022 is 17.97%. Total indirect expenses are estimated to be $29,247 all of which is recoverable. All program costs are allocated to the grant so there should be no additional burden on the department’s operating budget. The Purchase Order will indicate the contract number and the dollar amount of funds authorized. The Contractor shall only be authorized to perform services up to the amount on the Purchase Order. ADHS shall not have any legal obligation to pay for services in excess of the amount indicated on the Purchase Order. No further obligation for payment shall exist on behalf of ADHS unless a) the Purchase Order is changed or modified with an official ADHS Procurement Change Order, and/or b) an additional Purchase Order is issued for purchase of services under this contract. The Department of Public Health’s indirect rate for FY 22 is 17.97%. Indirect costs are fully recoverable in the amount of $124,362. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. This grant award is reoccurring and has been awarded to the department in previous years. There is no cash or in-kind match requirement and indirect costs are fully recoverable. Ongoing cash contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by delivering community-based tobacco cessation and prevention programs. The Programs provide an education component and responds to written, on-line, and telephone complaints or other means of communication directly received from the public as provided in the County delegation authority. The grant award is not competitively bid, and the department’s operating budget is not required to absorb any costs. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The new 2017 FDA Food Code and annexes contain the latest food safety practices. In addition, this proposal provides a consistent, statewide regulatory framework that will reduce stakeholder confusion between agencies because both Maricopa County and the State will have adopted the FDA 2017 Food Code and annexes. The Governors Regulatory Review Council approved the 2017 FDA Food Code and annexes, which the State adopted in June 2020. This MCEHC revision proposal is following Maricopa County’s EROP policy. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF WATER RESOURCES FOR PRE-APPLICATION REVIEW SERVICES AND ASSOCIATED ACTIVITIES Approve Intergovernmental Agreement (IGA) Amendment No. 4 FCD 2010A006 for Arizona Department of Water Resources (Department) Pre-Application Review Services and Associated Activities between the Flood Control District of Maricopa County (District) and the Department. Amendment No. 4 modifies the terms of the original IGA FCD 2010A006 and previous Amendments 1, 2 and 3. The District agrees to pay $100.00 per staff-hour based on actual staff-hours worked (invoiced quarterly) not to exceed $300,000.00 per District fiscal year (July 1st through June 30th) for costs incurred by the Department in providing the detailed pre-application reviews by qualified Department staff under each year of this agreement from October 1, 2021 through June 30, 2023. Pre-application reviews by the Department result in earlier identification and resolution of design issues for all District dam projects which require a permit from the Department. Identification of the Department’s design concerns and issues early in the design process reduces costly redesign during the later stages of the design process. AMENDMENT TO RESOLUTIONS FOR ACQUISITION OF LAND RIGHTS FOR IMPROVED ACCESS TO EXISTING STRUCTURES AND PROJECT AREA PROPERTIES Adopt Resolution FCD 2009R002B, an amendment to previous resolutions numbered FCD 2009R002 and 2009R002A, for the acquisition of land rights and for the construction of road improvements to provide improved legal access to existing structures and project area properties for the Flood Control District of Maricopa County (District). This amendment includes all structures and areas operated and maintained by the District rather than limit the authorization to a specific list of structures. The District operates and maintains flood control structures and properties within and without Maricopa County that protect the residents of Maricopa County from flooding. Several of these structures lack adequate access for operation and maintenance. In some cases, this lack of legal access has been exacerbated by new and on-going development. The Board previously authorized the District to acquire rights-of-way for additional access for specific structures under resolutions FCD 2009R002 dated March 18, 2009 (C-69-09-052-6-00) and FCD 2009R002A (C-69-09-052-6-01) dated February 10, 2010. District staff have identified several more structures and properties operated and maintained by the District that require additional access. The acquisition of additional rights-of-way and construction of road improvements for operations and maintenance access will require expenditure of both District operating funds and capital improvement program funds. This amendment expands the previous authorizations to acquire additional access to include the ACDC and Cave Creek Arm, Apache Jct. FRS and Floodway, Buckeye FRS #1 #2 #3, Bulldog Floodway, Dreamy Draw Dam, Harquahala Dam FRS, East Valley Drains, Hermosa Vista-Hawes Rd., Loop 303 Outfall Drainage System, IBW Outlet Channel, New River Channelization, Old Cross Cut Canal, Perryville Bank Stabilization, Reems Rd Channel, Rittenhouse Rd Drain and Basin, Salt River Channel, Scatter Wash, Sonoqui Wash, Signal Butte Floodway, Skunk Creek, Sossaman Rd Drain, Vineyard FRS, and Tres Rios Levee; all District maintained properties and structures and adds authority for the expenditure of operating funds in addition to previously authorized capital improvement program funds.
