14. DISPOSITION OF SURPLUS PROPERTY VIA TRADE-IN Approve the disposal of surplus property by trade-in in accordance with Article 8 of the Maricopa County Procurement Code (MC1-803.D.3). The Maricopa County Attorney's Office will retire 45 duty weapons that are over 10 years old that are in need of replacement. It was determined that it is in the best interests of Maricopa County to dispose of these weapons through a trade-in program. Through a trade-in, the County Attorney will realize a 67 percent rebate toward the purchase of replacement weapons. Due to Federal law and guidelines from the U. S. Department of Alcohol, Tobacco, Firearms and Explosives, law enforcement weapons can only be sold to licensed firearms dealers. Therefore, it is not prudent to dispose of weapons through normal surplus means. The use of the trade-in program assures Maricopa County that it receives the highest value for this type of surplus property. The County Attorney has identified a potential licensed firearms reseller through a competitive bid process and requests Board permission to conduct the trade-in and replacement through ProForce Law Enforcement. 16. MID YEAR GRANT FUND RECONCILIATION FY 2010 Pursuant to A.R.S. 42-17106, approve appropriation adjustment(s) resulting in net increases to revenue and expenditures of $431,279 in the FY 2009-10 County Attorney (190) County Attorney Grants Fund (219) Operating (0000) budget. Approval of this item will result in an overall grant funds appropriation of $8,223,369 for revenues and expenditures in County Attorney (190) County Attorney Grants Fund (219) Operating (0000) budget. Grant revenues are not local revenues for the purpose of constitutional expenditure limitation, and therefore, expenditure of these revenues is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Approval of this item allows reconciliation of budgeted to actual awards and aligns expenditures and revenues for the current fiscal year. The County Attorney's FY 2009-10 indirect costs rate is 14.4%. All allowable indirect costs have been identified for recovery and are included in this adjustment. This mid-year grant reconciliation is made in accordance with the County’s policy on the administration of grants and under guidance from the Office of Management and Budget. (C-19-10-025-G-00)

30. AMENDMENT TO “ATTORNEY MANAGEMENT AND CAREERPATH” FOR INDIGENT REPRESENTATION CAPITAL ATTORNEYS Approve an increase of four (from 45 to 49) in the number of Capital Attorneys allowed for Public Defense Services (Indigent Defense) per the ‘Attorney Management & Professional Career Paths’, approved by the Board of Supervisors on April 18, 2007 (C-49-07-047-6-00) and subsequently amended on October 1, 2008 (C-49-07-047-6-01). This item requests authorization for an increase in the number of Capital Attorneys allowed for Public Defense Services per the Attorney Management & Professional Career Paths. The Attorney Management & Professional Career Path for Public Defense Services was approved by the Board on April 18, 2007 and amended on October 1, 2008. Public Defense Services would like to increase the capital attorneys in the Office of the Legal Advocate by one (1) position. Public Defense Services would like to increase the capital attorneys in the Office of the Legal Defender by three (3) positions. This will require the number of allowed capital attorneys to increase from 45 to 49. Without the additional capacity in the staffed offices, the Office of Contract Counsel will be required to appoint contract attorneys at a higher cost per case. Stipend amounts for Capital Attorneys will remain unchanged. Capital Case Lead Counsel and Senior General Counsel would receive $17,500; and Capital Case second chair attorneys would receive $10,000. Attorneys working less than a full time schedule would receive a prorated share of the applicable stipend. The stipend would be paid out in substantially even increments based on the number of pay periods during the calendar year. The stipend is temporary “management assignment” or “professional assignment” pay pursuant to Section VII.A of the Maricopa County Employee Compensation Plan, and would end if the services of the employee are not longer needed in the function in the discretion of the appointing authority. This action authorizes the transfer of contingency funds to distribute to the Maricopa Association of Governments (MAG) for 2010 Census outreach efforts. On March 25, 2009, the MAG Regional Council approved using MAG federal funds to help offset the cost of 2010 Decennial Census outreach efforts for print and broadcast advertising. The purpose of this program is to allow departments to present spot awards throughout the course of the fiscal year to employees that have clearly demonstrated excellence on a project, task or function. The Peak Performers Program (also known as the Spot Award Program) is an employee recognition program for FY 2010. This program will allow both General Fund and non-General Fund departments to award Visa Gift cards to deserving employees per the attached schedule. Non-General Fund departments will utilize available funds within their budget. Beginning with this year’s program, spot awards will only be able to be used two different ways: 1) Given to employees within the department; and 2) Used by the department for employee recognition events. If given directly to an employee, both the employee and the department will be responsible for paying their share of taxes and retirement for this benefit. Workforce Management and Development will work closely with all County departments to ensure compliance and accountability to this program. Departments choosing to participate in other employee recognition programs must obtain Board of Supervisors approval. The General Fund portion of $492,453 is budgeted in Dept (470) Fund (100) Org (4712) Other Programs line item "Workforce Development Peak Performers" split between operating (0000) and Non-Operating (0001). This fund transfer is necessary to repay the Grant/Donation fund for Central Service Cost Allocation (CSCA) charges that were erroneously charged to the Grant/Donation fund. Per A.R.S. 42-17106(B), approve an increase to the FY 2009-10 Animal Care and Control (790) Animal Control Grant Fund (573) Non-Recurring/Non-Project (0001) revenue appropriation of $72,133, and an increase to the FY 2009-10 Animal Care and Control (790) Animal Control License Fund (572) Non-Recurring/Non-Project (0001) expenditure appropriation of $50,755, and an increase to the FY 2009-10 Animal Care and Control (790) Animal Control Field Fund (574) Non-Recurring/Non-Project (0001) expenditure appropriation of $21,378, and offsetting expenditure and revenue adjustments in Eliminations (980) Eliminations Fund (900) Non-Recurring/Non-Project (0001). Also, per A.R.S. 42-17106(B), approve a transfer of expenditure authority from FY 2009-10 Animal Care and Control (790) Animal Control Grant Fund (573)Operating (0000) in the amount of $45,802 to the FY 2009-10 Animal Care and Control (790) Animal Control License Fund (572) Operating (0000) in the amount of $32,061, FY 2009-10 Animal Care and Control (790) Animal Control Field Fund (574) Operating (0000) in the amount of $13,741. This action is necessary to provide expenditure authority for FY 2009-10’s CSCA charges that were budgeted erroneously to the Grant/Donation Fund. This expenditure authority transfer does not impact the expenditure limitation as it is related to the CSCA and is offset in eliminations. This results in a net county-wide impact of zero. 71. PROGRAMMATIC AGREEMENT WITH CITY OF TEMPE FOR HUD-FUNDED PROGRAM ACTIVITIES Approve as a concurring party the programmatic agreement between the City of Tempe and the State Historic Preservation Office (SHPO) governing the environmental clearance of U. S. Department of Housing and Urban Development (HUD) grant-funded program activities involving properties of potential historical significance. Concurrence by the Board of Supervisors is required by SHPO because the City of Tempe receives HUD HOME Investment Partnership Program (HOME) grant funds through the Maricopa HOME Consortium. Maricopa County is the lead agency of the Maricopa HOME Consortium and, as such, serves as the certifying agency on all environmental clearances under the HOME program. Signing the document as a concurring party does not subject the Board of Supervisors to any additional responsibility or liability under the HUD regulations. HUD regulations require an environmental clearance on any activities undertaken with HOME funds. For all properties that are 50 years old or older, or that are listed on a historical register, SHPO must be consulted in order to determine whether the property is of historical significance and whether the property will be adversely affected by the investment of the HOME funds. SHPO allows any local government that has its own Historic Preservation Office or Commission to enter into a programmatic agreement that will allow the local Historic Preservation Office or Commission to determine the historical significance of local properties without a specific concurrence from SHPO. 110. AGREEMENT WITH PIZZA HUT OF AMERICA, INC. FOR TEMPORARY RIGHT OF ENTRY Approve the Agreement between Maricopa County and Pizza Hut of America, Inc., a Delaware corporation (herein referred to as “Pizza Hut”), SDI of Buckeye, Az. LLC, an Arizona corporation (herein referred to as “Sonic”),and Standard Construction Company, Inc. (herein referred to as “Contractor”) for Temporary Right of Entry. Maricopa County is establishing a signalized intersection at MC-85 and Baseline to provide a safe intersection for the traveling public. This four legged intersection will also provide safe, controlled access to both Pizza Hut and Sonic necessitated by the need to eliminate existing driveways for both properties due to the proximity to the intersection that can create unsafe conditions, if left in place. The new access to Pizza Hut and Sonic Property and offsite construction is currently estimated at $45,000, but will not exceed $60,000.00. The County will pay for all work that will be performed using the funds in the Public Works (910) Transportation Capital Projects Fund (234) Traffic Improvements (TIMP) Bin, Project Number T271. With the 4th leg of the intersection in place, existing features were relocated and offsite traffic circulations were impacted and addressed in the construction plans. A Contractor has been retained by Maricopa County to extend Baseline Road across MC 85 which adjoins the Property. The performance of the work done by the Contractor retained by Maricopa County will be at NO cost or expense whatsoever to either Pizza Hut or Sonic, and it is recognized that all work will be performed by Maricopa County or their agents or contractors. The new access to Pizza Hut and Sonic Property and offsite construction is currently estimated at $45,000, but will not exceed $60,000.00. Supervisorial District: 4 (C-91-10-085-3-00)

112. REIMBURSEMENT FROM THE MARICOPA ASSOCIATION OF GOVERNMENTS TRANSPORTATION IMPROVEMENT PROGRAM Authorize MCDOT to apply for $735,000 in reimbursement funding from the Maricopa Association of Governments (MAG) Five Year (Federal FY2010-2014) Transportation Improvement Program (TIP), in order to upgrade MCDOT’s Traffic Management Center (TMC) with modern traffic management technology tools for managin g County and Regional (AZTech™) roadway traffic. If the award is made, authorize to accept the funds in Fiscal Year 2010-11 in the Public Works (910) Transportation Capital Projects Fund (234) Intelligent Transportation System (INTL) Project Number T289, M CDOT TMC Upgrade. To ensure regional project coordination and following long-standing federal aid requirements, the MAG five year, annually updated Transportation Improvement Program lists all planned transportation improvement projects in the MAG area for the current and subsequent four years. This TMC Upgrade project is a MCDOT proposed project which appears in the MAG TIP. TMC services have significantly expanded since the TMC was established over a decade ago. An equipment and software upgrade is badly needed in order to replace aging systems---systems which are no longer capable of meeting growing needs for traffic signal coordination, incident management, and traveler information services. The upgrade project will involve procurement and installation of a new signal management system, modern video projection hardware, and system integration software. The project will also install new office equipment so that MCDOT employees can take full advantage of the new systems. When completed, the project will improve traffic signal control and coordination, facilitate coordination among MCDOT and the County’s emergency response departments, and help to build on the positive relationship with media outlets established through the AZTech™ program. Overall, the upgrade will significantly expand and modernize TMC functions. Most importantly, it will provide the very best tools for MCDOT to use in achieving high-quality, real time traffic management and travel information services---for all County and Regional citizens. Current estimates of total project cost are $1,097,500, which include design and construction costs. The Federal funding portion which is available for the project is $735,000, available on a reimbursement basis. The Department of Transportation’s indirect cost rate is 19.7%. The total grant amount is for capital expenditures which are not subject to indirect cost recovery. The project benefits all Supervisorial Districts (C-91-10-138-M-00)

F-1. AMEND RESOLUTION REGARDING POWERLINE FLOOD RETARDING STRUCTURE FISSURE RISK ZONE MITIGATION PROJECT Adopt Amendment No. 1 to Resolution FCD 2008R015 for the Powerline Flood Retarding Structure (FRS) Fissure Risk Zone Mitigation Project (PROJECT [#310]). This Amendment No. 1 authorizes and directs the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to negotiate and prepare intergovernmental agreements and/or agreements with the United States, the State of Arizona, other municipalities, agencies and others, as appropriate, for cost sharing, design, construction, construction management and future operation and maintenance of the PROJECT, including appropriate District participation in landscape and multi-use improvements, subject to the ratification and approval of this Board. Powerline FRS is one of a system of three flood retarding structures the District has identified a need to fully rehabilitate or replace. This system provides significant flood control and erosion protection of public infrastructure, residential, commercial and agricultural land within Maricopa and Pinal Counties. The PROJECT will implement interim dam safety measures required for the operation of the Powerline FRS. On April 1, 2009, under Resolution FCD 2008R015 (C-69-09-056-6-00), the District authorized the negotiation of engineering and construction contracts, the budgeting of funds and the conduct of permitting activities to implement the Project, subject to Board authorization and approval. The District has identified the United States Department of Agriculture Natural Resources Conservation Service as a potential source of supplemental funding for the PROJECT and intends to negotiate agreements to obtain that funding. This Amendment No. 1 authorizes that negotiation process. This Agenda Item impacts Supervisory District 1. (C-69-10-060-6-00)

F-2. CONTRACT TO URS CORPORATION FOR CAVE BUTTES DAM MODIFICATION DESIGN AND ENGINEERING SUPPORT Award Contract FCD 2009C027, for the Cave Buttes Dam Seepage Remediation Project to URS Corporation for professional engineering services. Contract amount is a not-to-exceed amount of $800,000. The total contract performance is 1,095 calendar days from the date of approval by the Board of Directors. This is a qualifications-based selection in accordance with the Maricopa County Procurement Code, Article 5, Paragraph 504 and Article 5 Procurement Procedures Manual, Chapter II – Section 2. Cave Buttes Dam has not seen a full reservoir since constructed; however, a reservoir impoundment well below the spillway elevation produced seepage at the left abutment. This seepage and the lack of a downstream seepage control system raises dam safety concerns. In order to adequately mitigate this and other dam safety issues, a system of filter-drains with relief wells and an additional outlet are intended to be designed and constructed as reasonable and prudent dam safety modifications to the Cave Buttes Dam Project. Other measures to address dam safety issues may be identified and implemented as well as the design progresses. The final design work will also include landscaping and aesthetics within the project area where compatible with the safety and flood protection function of the project. This item impacts Supervisory District 3. (C-69-10-061-5-00)
