Site Location: Located approximately 270 ft. south of the southwest corner of Ocotillo Rd. and 132nd St. (in the Chandler area) Site Size: Approximately 400 sq. ft. of an approximate 1 acre parcel County Island Status: Class 1 (City of Chandler) Additional Comments: N/A Commission Recommendation: On 5/7/15, the Commission voted 6-0 to recommend approval of Z2014094 subject to conditions ‘a’ – ‘g’: a. Development of the site shall comply with the Site Plan entitled “T-Mobile Pierce Raw Land”, consisting of four (4) full-size sheets, dated received on February 13, 2015, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “T-Mobile Site – PH10539B Pierce Property”, consisting of four (4) pages, dated received February 13, 2015, except as modified by the following conditions. c. The height of the wireless communication facility shall be limited to 68’. d. The wireless communication tower shall retain the stealth properties as originally designed. Any damaged or missing fronds or branches shall be replaced within 60 days of such damage occurring. e. This Special Use Permit shall expire 30 years from the date of approval by the Board of Supervisors, or upon termination of the use for a period of 90 days. All of the site improvements shall be removed within 60 days of such termination or expiration. f. The following Drainage Engineering conditions shall apply: 1. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and current engineering policies, standards and best practices at the time of application for construction. 2. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the MCDOT Roadway Design Manual. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. The status report shall be reviewed by staff to determine whether the Special Use Permit remains in compliance with the approved conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. PZ-6. WIRELESS COMMUNICATION FACILITIES / CONDITIONAL USES Case #: TA2014001 Supervisor District: All Applicant: Commission-initiated Request: Text Amendment to the Maricopa County Zoning Ordinance, Chapters 2, 12 & 13 regarding Wireless Communication Facilities / Conditional Uses. The purpose of this text amendment is to overhaul the Section 1202 in order to streamline the entitlement process for WCFs as recommended by the Maricopa County Planning and Development Ad Hoc Task Force. The text amendment does so by eliminating the WCF Use Districts, promoting co-location on existing vertical structures, and fostering moderate height and slim monopole designs that would be permitted by right in all zoning districts throughout unincorporated Maricopa County. In most instances, there would not be a need to obtain a Special Use Permit. The text amendment will create an administrative Conditional Use Permit for WCFs. Additional Comments: The Commission recommended language was revised as discussed in the Commission report. Attached is the proposed verbatim language with highlights of the two changes (clarifications) as recommended by the Commission. Commission Recommendation: On 5/21/15 the Commission voted 7-0 to recommend approval with the additional language as recommended by staff. (C-44-15-097-M-00)

CPA case approval is by Resolution, attached. Site Location: Approximately at the northwest corner of Glendale Ave. and the 127th Avenue alignment (in the Glendale area) Site Size: Approximately 55 acres County Island Status: NA Additional Comments: At the May 6, 2015 Board of Supervisors hearing, the applicant requested a 30 day continuance to work with the adjacent property owner, see attached e-mail. The Board voted to continue CPA2015001 to the June 10, 2015 Board hearing. As of the writing of this report, no new information has been provided. Commission Recommendation: On 4/9/15, the Commission voted 7-0 to recommend approval of CPA2015001 subject to conditions ‘a’ – ‘g’: a. Development and use of the site shall comply with the narrative report entitled, “A Comprehensive General Plan Amendment for Luke Land 58”, including all exhibits dated revised February 19, 2015, and stamped received February 20, 2015, except as modified by the following conditions. b. If the Board takes action to amend or revert/rescind subsequent zoning, this land use plan shall be considered for amendment to change the land use designation back to the prior Mixed Use Employment. c. The total number of residential units shall not exceed 274 dwelling units. d. Prior to initial Final Plat approval or initial precise plan of development, the applicant shall submit to the Maricopa County Planning and Development Department a “will serve” letter and verification of approval of a Maricopa Association of Governments (MAG 208) amendment from Liberty Utilities. e. The following Luke Air Force Base condition shall apply: Luke Land 58 shall notify future occupants/tenants that they are located near a military airport with the following language: “You are locating in a residential dwelling inside the State Statute defined “territory in the vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly as low as 1,500 feet above the ground. You will be subject to direct overflights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes an average of approximately 165 overflights per day. Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. For further information, please check the Luke Air Force Base website at www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and Development Department.” Such notification shall be permanently posted on not less than a 3 foot by 5 foot sign in front of all leasing offices and be permanently posted on the front door of all leasing offices on not less than 8½ inch by 11 inch sign. f. The applicant shall submit a written report every five years from the date of Board of Supervisors approval of CPA2015001 which details the status of this project, including progress on obtaining necessary entitlements, licenses, and permits; compliance with the conditions of approval; compliance with the approved narrative report; compliance with the approved land use plan; and justification as to how the approved land use plan still represents appropriate land use planning for the property and unincorporated Maricopa County in accordance with the goals and policies in its comprehensive and applicable area plan. This report shall be scheduled for public hearing by the Maricopa County Board of Supervisors (Board), upon recommendation by the Maricopa County Planning and Zoning Commission (Commission), to consider whether the planning justification for this comprehensive plan amendment is still present, and whether the land use designations associated with this comprehensive plan amendment still represent appropriate and better long-term land use planning in accordance with the goals and policies of the Maricopa County Comprehensive Plan and applicable area plan. If the Board rescinds this comprehensive plan amendment and reverts the current land use designations back to ‘Mixed Use Employment’ all entitlements associated with this project that were conditional pursuant to the Maricopa County Zoning Ordinance may also be considered by the Board, upon recommendation by the Commission, for reversion to the prior entitlements. In such an event, the comprehensive plan land use map, area plan land use map, and, as applicable, zoning map shall be altered to reflect Board action. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property owner to enjoy uses in excess of those permitted by the land use existing on the date of application, subject to conditions. In the event of the failure to comply with any condition of approval, the property shall change to the land use designation that existed on the date of application. It is, therefore, stipulated and agreed that revocation due to the failure to comply with any conditions does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. FILING MOTION IN U.S. DISTRICT COURT Approve the filing of Maricopa County’s Notice of its Position regarding Pending Motion for Recusal or Disqualification filed on May 27, 2015 in the matter of Melendres v. Arpaio, et al. Case No.: 2:07-CV-02513-GMS in which the Board determined it would not be appropriate to take a position in light of the County’s opposition to and request for reconsideration of the April 15, 2015 decision of the U.S. Court of Appeals for the Ninth Circuit making the County a party litigant. These funds come from Fiscal Year 2014-2015 Crime Victim Compensation funds passed through the Arizona Criminal Justice Commission. Of these monies, $40,000 are State funds, and $75,000 are Federal funds under CFDA 16.576. The Board of Supervisors approved this agreement July 30, 2014 (C-19-15-001-G-00). These monies are to be used solely for the benefit of victims of crime through the Maricopa County Victim Compensation Program. The grant allows a 0% rate for indirect costs, or $0 which may be incurred by the County Attorney's Office or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the County Attorney's Office's composite indirect cost rate at 16.1%, or $18,515. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $18,515. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget containing the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. 16. FY 2015 BUDGET TRANSFER FROM THE MCSO GENERAL FUND OPERATING BUDGET TO THE MCSO MELENDRES OPERATING BUDGET Pursuant to A.R.S. §42-17106B, approve a budget transfer not-to-exceed $3,000,000 from Sheriff's Office (500) FY 2015 General Fund (100) operating (0000) to Sheriff's Office (500) FY 2015 General Fund (100) Melendres Operating (MEL0). This action will have a County-wide net impact of zero and does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Approval of this action allows the Sheriff's Office to fund operational cost increases and subsequent funding shortfalls that are attributable to the Melendres Court Order and the Court Appointed Monitor recommendations within its existing resources. The shortfall is due primarily to the addition of 24 positions that were required to meet supervisory specifications, overtime associated with training and report writing requirements, and staffing for the Early Intervention System. The Sheriff's FY 2016 budget recommendation accommodates this transfer in costs. (C-50-15-099-2-00)

21. ANIMAL CARE AND CONTROL BUDGET ADJUSTMENTS In accordance with A.R.S. §42-17106B, approve and authorize the following: a) Decrease FY 2015 Revenue and Expenditure budget for Animal Care and Control (790) Grants Fund (573) Operating (0000) in the amount of $1,539,157. b) Increase FY 2015 Revenue and Expenditure budget for Animal Care and Control (790) License Shelter Fund (572) Operating (0000) in the amount of $1,539,157. c) Increase FY 2015 Revenue Budget for Animal Care and Control (790) License Shelter Fund (572) operating (0000) in the amount of $900,000 for increased revenue from licensing and adoptions. d) Increase FY 2015 Expenditure authority for Animal Care and Control (790) License Shelter Fund (572) operating (0000) in the amount of $1,600,000 for the increased costs of medical care. e) Decrease non departmental (470) Grants Fund (249) operating (0000) in the amount of $1,600,000. f) Increase FY 2015 Expenditure authority for Animal Care and Control (790) License Shelter Fund (572) non-recurring (0001) in the amount of $500,000 for new IT equipment to include Microsoft Surfaces and servers. g) Decrease non departmental (470) Grants Fund (249) non-recurring (0001) in the amount of $500,000. Animal Care and Control Grants Fund 573 revenue and expenditure budget has been used to track donations associated with the low cost spay/neuter vouchers rather than actual grants awarded to Animal Care and Control, not grants for which it had been originally established for. Therefore, the Fund 573 revenue and expenditure budget is being moved to the Animal Care and Control License Shelter Fund 572 to better track the low cost spay/neuter program’s activity. Currently the Friends of Animal Care and Control are awarded the grants and the grant money is donated to Animal Care and Control. In the future when grants become available, Animal Care and Control would apply for grants directly and if awarded, Fund 573 would be used for the purpose intended by the Department of Finance. The operational costs associated with the Animal Care and Control Licensing Shelter Fund 572 are exceeding the revenues generated by licensing and adoptions. Licensing and adoption fees are not set at a rate to cover the ever increasing costs of pharmaceuticals, medical supplies and long-term care for animals in need of medical attention. Critical information technology infrastructure such as servers and computers were beyond their useful life and in need of immediate replacement to ensure that there was no loss of data or the ability to provide basic level customer service. Currently there is fund balance within the Animal Care and Control Licensing Shelter Fund 572 to support the one-time replacement of IT infrastructure for FY 2015. (C-79-15-127-2-00)

22. APPLY AND ACCEPT GRANT FUNDS FROM EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/DRUG ENFOREMENT ACCOUNT Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/ Drug Enforcement Account (DEA) in an amount not-to-exceed $237,289 for the portion allocated to the Office of the Public Defender (520). This grant is a recurring grant administered by the Arizona Supreme Court, Administrative Office of the Courts (AOC). The Office of the Public Defender applies for this grant jointly with Adult Probation, Clerk of the Superior Court, and Superior Court. These funds support the justice system by providing staff in all of these departments. In FY 2014-15, this grant funds 11.8 full-time equivalent positions Countywide. The Office of the Public Defender is requesting authorization to again apply for the DEA Grant for FY2015-16. The new grant period will begin on July 1, 2015 and end on June 30, 2016. The grant does not currently allow for the recovery of indirect costs in FY 2014-15, and no change is anticipated in future years. Therefore, the Office of the Public Defender and Maricopa County may receive no administrative cost recovery for this grant in FY 2015-16. The Maricopa County Department of Finance has calculated the Office of the Public Defender's composite indirect cost rate at 10.1%. The non-recoverable indirect cost will not exceed $23,967. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The grant award will begin on July 1, 2015 and end on June 30, 2016. However, the application for funding has historically been received late and submitted even after the start of the applicable fiscal year. The application turnaround involves tight time constraints, therefore, the Office of the Public Defender is requesting advance approval to apply for the departmental share of these funds through a joint application with the Superior Court, Clerk of the Superior Court, and Adult Probation. The FY 2015-16 budgeted amount for this grant is $237,289 as developed through the normal annual budget process. If funding is awarded in excess of that amount, a budget adjustment will be requested. We also anticipate we will be required to provide an in-kind match of 25%. We have a General Fund position which is being used to fulfill the match requirement in the current year, and that position is funded in the following year as well. Therefore, there is no additional burden to the General Fund as a result of the in-kind match requirement. (C-56-15-002-G-00)

23. AMENDMENT AND TECHNICAL CORRECTION TO NON TOBACCO USE INCENTIVE Approve an Amendment and technical correction to Wellness Programs and Benefit Incentives for Plan Year 2015-16 (approved January 7, 2015 and amended March 11, 2015) by eliminating Exhibits A and replacing it with an amended version of Exhibit B re-designated as Exhibit A. The new Exhibit A makes changes to improve the incentives offered by Maricopa County to encourage and support employees to stop using tobacco products in a manner that is fully compliant with current Federal laws and regulations. Exhibit A also incorporates changes approved in the previously approved amendment (C-39-15-015-2-01), as well as further clarifying changes. Changes are included to enhance and improve the incentive for non-tobacco use based on advice from wellness experts, as well as to insure that the incentive program is in full compliance with current federal laws and regulations. Recent federal regulations require the County to offer employees who use tobacco products a “reasonable alternative” that may be in the form of a requirement to participate in an approved tobacco cessation program. Changes approved by the Board of Supervisors on March 11, 2015 (C-39-15-015-2-01) are consolidated with the original text of C-39-15-015-2-00 Exhibit B, approved January 7, 2015. A statement is added to clarify that the requirements for wellness incentives that are contained in the new Exhibit A supersede all previously-approved program requirements. (C-39-15-015-2-02)

24. INCREASE EXPENDITURE BUDGET FOR EMPLOYEE BENEFITS FY2014-2015 Approve an increase to the FY 2015 Employee Benefit Trust Expenditures in the amount of $7,600,000. This action will increase the expenditure appropriation in Employee Benefits and Health (390) Medical HDHP Fund (606) Operating (0000) by $4,400,000, and the expenditure appropriation in the Employee Benefits and Health (390) Co-insurance Pharmacy Fund (608) Operating (0000) by $3,200,000. Budgeted expenditures in the Benefits Trust can be increased pursuant to A.R.S. § 11-981 (C), which states that expenditures during the fiscal year from a trust are not subject to the provisions of title 42, chapter 17, article 3. There are three major factors that have contributed to the increase in expenditures over the budgeted amount: 1) The total number of members enrolled in plans has increased by approximately 750 over the June 2014 count, a 3% increase. 2) Medical Claims are higher than anticipated, as the budget was based on optimistic actuarial projections of claims per subscriber which was developed in the fall of 2013. Subsequently the trend turned more unfavorable. 3) New specialty drugs launched in 2014 including those for Hepatitis C were not budgeted for in Fiscal Year 2015. The expenditure increase was forecast by actuarial consultants in September 2014 during their annual review of the Trust’s self-insured liabilities and reserves. The increase is funded by reserves within the Benefits Trust, but will not reduce reserves below the levels established by the Board of Trustees. Adjustments have been made in premiums and plan designs to bring revenue in line with expenditures in the upcoming fiscal year and maintain reserves at reasonable levels. (C-39-15-025-2-00)

41. IGA WITH THE ARIZONA DEPARTMENT OF HEALTH SERVICES FOR BEHAVIORAL HEALTH SERVICES TO THE SERIOUSLY MENTALLY ILL AND REMANDED JUVENILES Approve an Intergovernmental Agreement (IGA) between Maricopa County (the County) and the Arizona Department of Health Services (ADHS) which in effect extends the existing arrangement for the County's funding of behavioral health services for a term of one year. County funding for services to the seriously mentally ill (SMI) under this IGA will be $50,392,060 for FY2015-16. This increases the level of County funding based on medical inflation for services to the seriously mentally ill by $2,399,622 over the funding paid under the previous IGA in FY2014-15. The FY2015-16 IGA also requires the County to fund non-SMI services in the amount of $3,366,705 and substance abuse services in the amount of $1,489,871 (LARC) for the one-year term which is equal to the FY2014-15 level. The IGA will be in effect upon signature of the last party and shall remain in effect until June 30, 2016. The IGA may be amended, further extended or terminated pursuant to the IGA provisions, including a 90-day termination without cause provision. Total County funding for behavioral health services in FY2015-16 under the IGA will be $55,248,636 for a one-year term. Approve an Intergovernmental Agreement (IGA) between Maricopa County and the Arizona Department of Health Services (ADHS) authorizing ADHS or its contracted Regional Behavioral Health Authority (RBHA) to provide mental health services to remanded juveniles (of a screening agency, an evaluation agency and mental health treatment agency) when evaluation is ordered by the Maricopa County Superior Court pursuant to Arizona Revised Statutes, (A.R.S.) Title 36, Chapter 5, Article 4 and treatment is ordered by the Superior Court pursuant to Arizona Revised Statutes, Title 36, Chapter 5, Article 5. Pursuant to the judgment in Arnold v Sarn and the subsequent March 10, 1994 court order, the County is required to enter into an Intergovernmental Agreement (IGA) between Maricopa County and the Arizona Department of Health Services (ADHS) under which the County contributes funding for behavioral health services for seriously mentally ill (SMI) indigent residents of the County. The County also contributes funding for non-SMI services under the IGA in order to integrate the behavioral health system in Maricopa County. The IGA requires the County to adjust its SMI contribution annually. Through FY04, the adjustment was calculated by using a base amount established in the FY96 IGA, as adjusted in subsequent IGA's. Since FY01, the amount has been determined by multiplying the base amount for each year by an inflation factor derived from the Bureau of Labor Statistics medical market basket cost index. Program: State Withholdings and Contract Management Activity: State Mental Health Programs Activity. This IGA will provide financial management and oversight for County Administration of funds that are paid to, or withheld by, the State and/or the Maricopa Integrated Health System so they can ensure accurate and proper distribution of funds to health programs. The activity will provide financial oversight of funds that are paid to the State under court order for mental health programs for County Administration so that they can limit their liability while ensuring that their court-ordered obligations are met in an efficient and effective manner. This IGA also authorizes ADHS or its RBHA to expend up to $200,000 from the “Non-SMI” payment funds for remanded juveniles. The Department of Health Care Mandates and ADHS, in conjunction with the Superior Court, previously negotiated to provide evaluation services for remanded juveniles using funds that are not part of the County’s mandated obligations under Arnold v. Sarn. A “remanded juvenile” means a person under the age of eighteen who has been transferred to the criminal division of the Superior Court pursuant to A.R.S. § 8-327 or who has been charged with an offense pursuant to A.R.S. § 13-501; and has not been sentenced, pursuant to A.R.S. § 13-701 on the charges pending against the juvenile in the criminal division of the Maricopa County Superior Court pursuant to A.R.S. § 8-327 or A.R.S. § 13-501. This Agreement, FCD 2015G004, establishes responsibilities with respect to archeological mitigation work to be completed prior to any disturbance or construction within the proposed project area. The PA shall become effective the date it is fully executed by all parties to this agreement and shall expire 5 years after the effective date. The proposed area of potential effects (APE) for the archeological work includes the property upstream of the three earthen flood retarding structures (Vineyard Road FRS and Rittenhouse FRS are the other two) located in northwestern Pinal County, east of the Central Arizona Project (CAP) canal and south of Baseline Road. The Powerline, Vineyard Road, and Rittenhouse FRSs Rehabilitation or Replacement Project is a District planning study currently in the design stages with a tentative date of construction in June, 2015. As part of the requirements under the National Historic Preservation Act of 1966 archeological surveys were completed by the District and identified 12 to 15 register eligible sites within the APE which will require testing and data recovery prior to any disturbance or construction activities. In order to move forward with data recovery efforts and ultimate construction of the project, approval of the treatment plan and PA are required by all the consulting parties including the District. Subsequently, the proposed agreement allows for mitigation of the sites within the APE prior to the proposed project construction. This Project has been selected by NRCS to be fully cost share funded from planning through construction. Per NRCS funding authorization requirements the Project must be constructed by September 30, 2018. Currently the Project is in the design phase. This IGA obligates NRCS funds for the project. In addition, this IGA requires that FCDMC reimburse NRCS for all assistance for this project. Terms of reimbursement will be established by a separate agreement.
