6. LEED PLATINUM PLAQUE FOR THE WHITE TANK BRANCH LIBRARY AND NATURE CENTER Presentation of a copy of the LEED Platinum plaque the Library District received for the The White Tank Branch Library and Nature Center. This project has set, and achieved, aggressive energy conservation goals, among them was LEED Platinum certification and it has documented a 50% reduction in energy usage beyond a typical code-compliant building. About 25% of the building’s energy is generated on site by a photovoltaic array. The project’s design team also was conscious of water usage, and all fixtures are “low flow,” contributing to a 30% reduction of water beyond a typical library. Other features that contribute to a large reduction in energy usage include the library’s sweeping panoramic windows, concrete shade fins, R30 foam roof insulation, and R13 foil-faced batt insulation to minimize the impact of the desert’s harsh temperature swings. The library is enhanced by its pristine desert location and the inclusion of the park’s Nature Center where visitors can combine a trip to the library with lessons learned about their environment. We are proud to present to the Library District Board of Directors a copy of our LEED Platinum plaque in recognition of their outstanding support for the project. (C-65-12-001-M-00)

8. PUBLIC HEARING FOR RULE 280 (FEES) The Maricopa County Air Quality Department (department) is proposing to amend Rule 280 (Fees) to change the fees the department charges to owners and operators of sources of air pollution. The fees being amended include fees for billable permit actions, annual administrative and emission based fees for Title V sources, annual administrative fees for non-Title V sources, application and annual administrative fees for general permits, subcontractor registration fees and training fees. The goal of this rulemaking is to provide sufficient revenue to cover the costs of the air quality program, maintaining compliance with federal and state law. The current fee structure does not generate sufficient revenue to cover the operating expenses for department permit and plan approval activities. The department’s fee fund revenue in fiscal year 2011 is projected to be $8.8 million while the corresponding expenditures are projected to be $11.1 million. For fiscal year 2011, the department will be relying on its existing air quality fund balance and general fund revenues (a temporary allocation) to subsidize the program. Without corrections to the fee structure, the department will not be able to operate on a structurally balanced budget as is required by County policy and will deplete all reserves. The proposed fee changes would become effective on July 1, 2011 and are expected to result in annual fee revenue for fiscal year 2012 of approximately $10.9 million corresponding to the department’s annual expenditures. The fee revenue with proposed fees includes approximately $1.5 million from the Title V program, $3.5 million from the dust control compliance program, $731,000 from the asbestos/NESHAP compliance program, and $5.1 million from the balance of the non-Title V programs. The remaining $5.8 million of the department’s $16.7 million in total expenditures are considered to be non-recoverable by fees and are expected to be funded by other sources such as grants or county general funds. The department anticipates that this proposed rulemaking would directly impact approximately 4,000 sources that are permitted by the department, 3,600 individuals and entities involved in performing ancillary services on a dust control permitted site (subcontractor registration fee), and 1,600 individuals required to attend a basic or comprehensive dust control training class (dust control training class fees). Entities impacted include Title V facilities, non-Title V facilities and general permit sources; individuals and entities involved in performing ancillary services on a dust control permitted site (subcontractor registration fee); individuals and entities required to complete dust control training; and trainers required to be certified by Maricopa County to conduct dust control training classes. This item was continued from the June 22, 2011 and July 6, 2011 meeting . (C-85-11-020-7-00)

F-7. RESOLUTION FOR THE MCMICKEN DAM REHABILITATION PROJECT Adopt Resolution FCD2010R009 for the McMicken Dam Rehabilitation Project (the REHABILITATION PROJECT), authorizing the Chief Engineer and General Manager of the Flood Control District of Maricopa County (District) to advertise, select, negotiate, and award contracts for engineering and construction services; negotiate Intergovernmental Agreements; acquire rights-of-way; include funding in the District’s Five-Year Capital Improvement Program; and TO PLACE ON HOLD OR terminate the District’s Feasibility Cost Share Agreement (FCSA) (Intergovernmental Agreement FCD 2004A013) with the USACE. The District owns, operates and maintains the McMicken Dam Project, which includes McMicken Dam, the McMicken Dam Outlet Channel, and McMicken Outlet Wash. Constructed in 1956 to address substantial realized flooding, the McMicken Dam Project provides enhanced flood protection for downstream areas including Luke Air Force Base and significant portions of the City of Surprise, the City of El Mirage, the City of Avondale, the Town of Litchfield Park, the Town of Youngtown, Sun City and other unincorporated Maricopa County areas. The McMicken Dam Project is an essential component of the flood control infrastructure in Maricopa County. Recurrent District dam safety operations identified safety deficiencies associated with the McMicken Dam Project requiring corrective action. The REHABILITATION PROJECT was recommended for implementation by the Wittmann Area Drainage Master Plan (ADMP), which was completed in April of 2009, to address these noted deficiencies. The REHABILITATION PROJECT was reviewed under the District’s Fiscal Year 2011/2012 Capital Improvement Program Prioritization Procedure and is recommended by the District Chief Engineer and General Manager. The REHABILITATION PROJECT includes modifications to all components of the McMicken Dam Project. The REHABILITATION PROJECT design and construction is proposed to be completed in approximately 10 years with four construction phases at a total estimated cost of $98 million. The construction of the first phase of the REHABILITATION PROJECT may result in generating 280 acres of excess District fee land at the north end of the dam near Grand Avenue, potentially providing an opportunity for future revenue. L-13. LIBRARY MATERIALS ASSISTANCE PROGRAM Approve a Library Materials Assistance Program that will allow the Library District to purchase material for the independent libraries in Maricopa County through "Library Materials Credits" through selected vendors. The participating public libraries will select and order the materials they want, approve the invoices, and then send the approved invoices to the Library District for payment. All materials selected under this program must be catalogued and freely available to all Maricopa County residents. The formula for distribution of the credits will be that each participating public library will receive the percentage of available funds ($1,000,000 for FY 2011-2012) that is equal to the percentage of the taxes collected by the District from their city or town as a percentage of the total raised by the Library District Tax. The District would combine all the library materials budgets of the participating public libraries and bid to get the best price discount possible. L-14. FREEGAL SERVICES TO MARICOPA COUNTY PUBLIC LIBRARIES FOR ACCESS TO SONGS Approve the distribution of Freegal to all public libraries in Maricopa County. Library Ideas, LLC, a media company focused on Public Libraries, has an agreement with Sony Music Entertainment to provide its network of Public Library websites with access to songs from Sony Music’s catalog of legendary artists. The service, called Freegal, allows libraries to increase the size and diversity of library collections by offering access to an incredibly expansive and popular catalog of hundreds of thousands of songs. Under terms of the agreement, registered card holders of participating libraries access the service through their local library website and download a select number of Sony Music tracks in the MP3 format each month at no direct cost. The total annual cost for this service is $247,690.00. Freegal delivers great music, compatibility with lots of devices and simplicity of use. A library is a focal point of the community that requires many tools to excite people about library resources. More than anything, that is the reason for this service; to reach new customer segments for digital music. This is incredibly popular with our customers and will help the library in marketing all its services to the community. (C-65-12-006-M-00)
