PZ-1. AG LAND INVESTORS Case #: Z2015049 Supervisor District: 2 Applicant & Owner: AG Land Investors, LP/ et al. Request: Zone Change from RU-43 to IND-2 and IND-3. Site Location: Located at the southwest corner of 80th Street and Elliot Road. Site Size: Approximately 80 ac. Commission Recommendation: 11/5/15, the Commission voted 7-0 to recommend approval of Z2015049 subject to conditions ‘a’ – ‘g’: a. An Industrial Unit Plan of Development (IUPD) is applied to the site specifically to limit the respective IND-2 and IND-3 permitted uses to those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated via individual septic systems until such time that either sewer service is provided or effective annexation by the City of Mesa. b. A Plan of Development (POD) is required prior to construction permitting. c. The site may be (re-) developed and used for any use that is statutorily exempt from County zoning authority without POD or permit. d. The following Maricopa County Environmental Services Department (MCESD) conditions shall apply: 1. The new onsite septic system design will be submitted to MCESD for approval. Wastewater discharge from industrial facilities to the septic system will consist of typical sewage only, and will not include any motor oil, gasoline, paint, varnish, solvent, pesticide, fertilizer, or other material not generally associated with toilet flushing, food preparation, laundry, or personal hygiene (AAC R18-9-A309.7a). 2. Any wastewater that is non-typical sewage shall be routed to an interceptor tank and removed from the site by an industrial waste disposal service (as is done for the non-typical sewage wastewater from the industrial buildings). e. The following Planning Engineering conditions shall apply: 1. Elliot Road along the north of the subject premises is under the jurisdiction of MCDOT. Dedication of right-of-way will be required to provide an ultimate right-of-way width of 65 feet (half-width). 2. E. Mesquite Street and S. 80th Street are mid-section alignments. Dedication of right-of-way will be required to provide an ultimate right-of-way width of 40 feet (half-width). Half-width improvements, conforming to the MCDOT Roadway Design Manual will be required. 3. A traffic study will be required with the plan of development (POD) application. Offsite road improvements requirements along Elliot Road are pending the results/recommendations of the traffic study. 4. Provide the required retention volume for the 100 year, 2 hour storm event for the POD area, including adjacent right-of-ways. Provide documentation that the retention basin(s) will drain within 36 hours. 5. Provide a runoff coefficient based on Table 6.3 of the Maricopa County Drainage Policies and Standards. Use 0.95 for commercial/industrial areas and 0.5 for retention areas. 6. Based on the conceptual design nature of the information submitted, changes to the site layout and/or a reduction in the number of buildings may be necessitated by the final engineering design of the drainage infrastructure. 7. Any application for development must demonstrate that historic drainage inflow and outflows flow and characteristics will be maintained. f. The property owner/s and their successors waive claim in diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The Comprehensive Plan Amendment enhances the value of the property above its value as of the date the Comprehensive Plan Amendment is granted and changing to the prior land use designation results in the same value of the property as if the Comprehensive Plan Amendment had never been granted. 6. REVISIONS TO MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS: AQ-2013-005-NEW SOURCE REVIEW Staff recommends that the scheduled public hearing be continued to February 3, 2016. The Department received public comment on the original proposed New Source Review (NSR) regulations, which has been incorporated into amended proposed NSR regulations. The Department will be submitting a supplemental notice pursuant to A.R.S. §49-471.07(C), which will necessitate continuance of this public hearing. See agenda item C-85-16-003-M-00 for additional information. Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of Maricopa County Air Pollution Control Regulations regarding New Source Review (NSR) and to solicit comments on submitting the rules as a revision to the (Arizona) State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed amendments to the Maricopa County Air Pollution Control Regulations regarding NSR and to submit the amended rules as a revision to the (Arizona) SIP. Upon Board approval, this item will become effective December 9, 2015. The purpose of this rulemaking is to update the Maricopa County Air Quality Department’s New Source Review (NSR) rules in order to secure their approval as part of the State Implementation Plan (SIP) under the federal Clean Air Act. The update will be consistent with revisions the Arizona Department of Environmental Quality (ADEQ) and the U.S. Environmental Protection Agency (EPA) made to the NSR Program required by the federal Clean Air Act . NSR is a long-standing Clean Air Act permitting program that requires businesses to get an air pollution control permit before they start construction or make major modifications to their business. NSR must ensure that air quality is not significantly degraded from the addition of new or modified businesses, while also providing flexibility to businesses to improve or modernize their operations. Permits must include an air quality analysis to demonstrate that new emissions emitted from the business will not cause or contribute to a violation of a National Ambient Air Quality Standard. Permits are issued for generators, paint booths, printing, wood working, chemical mixing, concrete batch plants, electronic assembly, abrasive blasting, gasoline resale, power plant. Permit fees are not changing due to this rulemaking. (C-85-16-003-M-00)

8. DECREASE IN TUBERCULOSIS (TB) HEALTH CARD FEE Pursuant to A.R.S. §11.251.08, to convene the public hearing to solicit comments and consider adopting a fee decrease for a health card. The Department of Public Health requests a fee decrease for a health card with a Quantiferon (QFT) blood test. The new fee would be $65. If approved, the fee for a health card and TB skin test will remain at $65; the fee for a health card and a QFT blood test will be $65; and the fee for a health card and a two-step skin test will remain at $130. If approved, the new fee ($65) will be effective the date of Board approval, December 9, 2015. On May 7, 2014, new fees were set for TB testing and health cards offered by the Department of Public Health. The new fees were $65 for a health card and TB skin test, and $110 for a health card and blood test (QFT or T-Spot). The fee for a two-step skin test with a health card was set at $130. In April 2015, the Department of Public Health laboratory began conducting and resulting the QFT blood test in-house. This change resulted in a $45 reduction in costs for laboratory services associated with the QFT. The fee for the health card with a TB Skin Test is $65. The fee for a health card with a QFT is currently $110. This was approved when the Laboratory was using an outside lab and the price of running the test at an outside lab was about $80. Laboratory testing is now running the QFT in-house, so the Laboratory is no longer paying $80 per test. Our cost is between $28 and $35 per test (depending on how many tests are done). That is a difference of about $45 (80 – 35). So the current $110 cost minus the savings of $45 is calculated as the cost of a health card with a QFT at $65. (C-86-16-045-M-01)

14. EXEMPTION FROM MARKINGS AND ISSUANCE OF NON-GOVERNMENTAL LICENSE PLATES FOR REPLACEMENT FLEET VEHICLES Pursuant to A.R.S. § 38-538-03 and §28-2511(A), approve the exemptions from county markings and issuance of non-governmental license plates for two (2) undercover vehicles. These vehicles are replacing two (2) vehicles that were used for law enforcement investigative purposes. Vehicle details and identification numbers will be on file in the Clerk of the Board's Office and retained in accordance with Library Archives and Public Records (LAPR) approved retention schedule. These vehicles were purchased in accordance with Maricopa County’s vehicle replacement process. The replacements were acquired using General Government (Agency 470) General fund (100) monies through the Equipment Services department. The County Attorney agrees to reimburse General Government Equipment Services for any applicable cost differences of upgrading the class of vehicle from that of the one it replaced. The replacements were deemed critical by equipment services due to excessive mileage and/or the age of the vehicles which made it cost prohibitive to acquire replacement parts with which to maintain them. As this action involves the replacement of existing vehicles in the fleet, therefore expenditures for the operation and maintenance of the vehicles will continue to be absorbed by the County Attorney's general fund budget with zero net impact. As the vehicles being replaced are currently exempt from markings and governmental license plates, the Maricopa County Attorney's Office requests that the replacement vehicles also be exempt from County markings and issued regular Arizona license plates as provided in accordance with A.R.S. § 38-538.03 and A.R.S. § 28-2511(A). This will ensure that they can be used in furtherance of their law enforcement mission. (C-19-16-016-V-00)

15. APPROPRIATION ADJUSTMENT FOR COUNTY ATTORNEY SPECIAL REVENUE FUND Per A.R.S. §42-17106(B), authorize the following amendment to the FY 2016 budget: a) Decrease the expenditure authority for the Non Departmental (470) Non Departmental Grant (249) Non-Recurring, Non-Project (0001) in the line "Unreserved Contingency" in the amount of $1,500,000. b) Increase the expenditure authority in the County Attorney (190) RICO (213) Non-Recurring, Non-Project (0001) in the amount of $1,500,000. These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenue duly adopted by the Board pursuant to A.R.S. §42-17105. The County Attorney has identified several major technology-related projects that will enable the department to enhance the public’s safety. These projects are of a one-time nature and will be resolved by the end of the 2015-2016 fiscal year. The County Attorney proposes to utilize $1,500,000 in existing fund balance of the County Attorney (190) RICO (213) fund. This expenditure appropriation budget increase will allow the County Attorney to utilize accumulated fund balance to respond to extraordinary needs of the organization that directly impact public safety and expend such non-recurring funds for programs and services of limited terms and duration. 46. USE MANAGEMENT AGREEMENT WITH ESTRELLA YOUTH SPORTS, LLC FOR SPORTS FIELD COMPLEX AT ESTRELLA MOUNTAIN REGIONAL PARK Approve the Use Management Agreement (“Agreement”) between Maricopa County and Estrella Youth Sports, LLC (“Concessionaire”), for the development, improvements, operation and maintenance of a sports field complex at Estrella Mountain Regional Park (“EMRP”). Maricopa County Parks and Recreation Department (“Parks”) continues to pursue additional recreational opportunities, through concessionaires, that will enable residents and visitors of Maricopa County to enjoy a safe and meaningful outdoor experience. An additional goal of Parks is to explore additional revenue opportunities that will be used to offset operations and maintenance costs associated with Parks. In May 2013, Parks, through the Maricopa County Office of Procurement Services, solicited an Invitation to Negotiate (Serial 13-001-ITN) for additional recreational opportunities and programs as determined by market conditions and prudent business practices for EMRP. Concessionaire responded to this solicitation and through an evaluation committee was selected to negotiate an agreement with Parks. Concessionaire is a non-profit organization that provides youth sports opportunities to the community. When not in use by Concessionaire, sections of the turf area shall be available for general EMRP/public use by visitors. All development costs will be at the expense of the Concessionaire. There are up to five (5) phases throughout the term of the Agreement that are deemed as renewal options. Each phase is contingent upon market and financial feasibility, funding and EMRP Master Plan, as determined by the County. Improvements and expansion for the phases will include, but not be limited to, improvements of the existing ball fields, adding new ball fields, adding multi-use fields, adding sand volleyball along with other sports-related amenities. If a phase does not commence per the terms of the Agreement, the County and Concessionaire shall amend the Agreement for the term and completion of the subsequent Phase(s). If all phases are completed as implemented, the term of the Agreement shall be until December 31, 2065. Specific parameters for the recreational activities in the Agreement are provided as an Annual Management Plan (“AMP”) to identify management, operational procedures and methodologies to clarify responsibilities, understandings and actions in place for that specific year as new phases are developed and that advance the overall development of the complex. It is expected that the AMP will also allow for greater flexibility in adapting to changes in business practices, economic climate, technology and recreation trends. The AMP will be developed annually and approved by Estrella Youth Sports (EYS) and Parks' Director or his or her designee. The activities for this concession will be located in Supervisory Districts 5. (C-30-16-007-M-00)

57. IRREVOCABLE STANDBY LETTER OF CREDIT WITH JPMORGAN CHASE BANK Approve amendment to the Irrevocable Standby Letter of Credit. The original Irrevocable Standby letter of Credit with Chase/Bank One, Arizona was approved by the Board of Supervisors July 24, 2002, agenda number C-75-03-001-1-00. Subsequently, each year the Board of Supervisors has approved amendments as the projected liability amounts for workers' compensation claims have changed. The Letter of Credit with JPMorgan Chase Bank that was extended through December 31, 2014 was for $15,878,105 (C-75-09-006-2-07). The amount was amended to $15,151,706 and was extended through December 31, 2015. An amendment is now required for the new workers' compensation liability amount which is $15,705,634 that will be in place from January 1, 2016 through December 31,2016. This amount will fluctuate annually as it is based on claims and reserves, with older claims closing and new claims opening. The Letter of Credit serves as security for the County's projected liability for worker's compensation claims. The Letter of Credit will be reserved against the County's existing Line of Credit. The Line of Credit is restricted by the amount of the Letter of Credit. It is not expected that there will be reason for the Letter of Credit to be drawn on; however, the Industrial Commission of Arizona requires the negotiable security. (C-75-09-006-2-08)

67. QUIT CLAIM DEED FROM MARICOPA COUNTY TO THE CITY OF PEORIA Approve and execute a Original Quit Claim Deed from Maricopa County to the City of Peoria. This Quit Claim Deed identifies right-of-way for Thunderbird Boulevard that has been annexed by Peoria by Resolution 225 approved by Peoria City Council on January 25, 1977 and Resolution 89-40 approved on December 19, 1989. The City of Peoria developed a project to install Americans With Disability Act (ADA) compliant sidewalk ramps at 94th Drive and Thunderbird. During the course of the project development it was determined that what Peoria had thought was an annexation of the existing south half-width of 55 feet for Thunderbird Boulevard turned out to be private property. As a result, the City of Peoria entered into a condemnation action with the Lewis M. and Diana M. Westover Estate Trust (CV2015-005848) to resolve that issue and construct the ADA ramp. As part of the Westover condemnation case Maricopa County was a named Defendant and subsequently disclaimed interest in the case. As part of the completion of that case and to clarify any potential future ownership disputes pertaining to the south half-width of Thunderbird Road lying 330 feet westerly of 94th Drive, the City of Peoria is seeking that Maricopa County Quit Claim any interest in said south half-width as legally described in the Quit Claim Deed. The County Attorney Civil Division along with the Real Estate Division reviewed this request with the Maricopa County Department of Transportation and it was determined that the Department of Transportation did not have any interest in the south half-width of Thunderbird Boulevard in this location and would support Quit Claiming interest in said portion of the roadway. A cost savings of approximately $12,000 would come from the equipment trade-in reducing the $99,000 purchase to $87,000 . 72. TRANSFER VEHICLE FROM THE FLOOD CONTROL DISTRICT OF MARICOPA COUNTY Approve the operating transfer of vehicle number 558, a New Holland Tractor with a book value of $35,000 from the Flood Control District (690) Flood Control Fund (991) to Waste Resources and Recycling (670) General Fund (100). As Waste Resources and Recycling continues to expand the current green organics grinding program to include 5 closed landfill, the ability to efficiently spread and windrow materials is needed. The processed material (grindings) need to be both spread then disked into the landfill surface soil. The materials once applied are very effective in minimizing erosion and controlling dust generation. The most efficient way (speed and surface area application) to accomplish would be via a tractor that can pull a spreader and disc. The backhoe (410) is design to excavated materials and not very well designed to pull attachments. Based on Waste Resources and Recycling operations and landfill maintenance activities, a tractor would be more efficient and cost less versus a rental or using the backhoe. Waste Resources and Recycling will sell the surplus backhoe, equipment number 410, and replacing it with the New Holland Tractor, equipment number 558, from Flood Control. This will result in a net zero impact to the County Fleet. (C-67-16-002-3-00)

AQ-2013-005-NEW SOURCE REVIEW Continue the public hearing set for December 9, 2015 (C-85-16-003-M-00) as required by A.R.S. § 49-471.07 and § 49-479(B), to February 3, 2016, at 9:00 a.m. to solicit comments on proposed amendments to Maricopa County Air Pollution Control Regulations regarding New Source Review (NSR) and to solicit comments on submitting the rules as a revision to the (Arizona) State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed amendments to the Maricopa County Air Pollution Control Regulations regarding NSR and to submit the amended rules as a revision to the (Arizona) SIP. Environmental Protection Agency (EPA) made to the NSR Program required by the federal Clean Air Act. At conclusion the of the public comment period on the original proposed New Source Review (NSR) regulations, the Department received public comment which it has incorporated into amended proposed NSR regulations. Some of the changes to the proposed NSR regulations are substantive in nature. Accordingly, pursuant to A.R.S. §49-471.07(C), the Department will be submitting a supplemental notice which will necessitate continuance of the public hearing currently scheduled for December 9, 2015 on the original proposed NSR regulations (C-85-16-003-M-00). The Department will request that the public hearing be continued from December 9, 2015 to February 3, 2016, at 9:00 a.m. In the interim, the Department will seek additional public comment on the amended proposed NSR regulations and on the issue of whether the proposed amendments to the NSR regulations should be submitted as a revision to the Arizona State Implementation Plan (ASIP). Following the public hearing February 3, 2016, the Board will be asked to adopt the proposed amendments to the Maricopa County Air Pollution Control Regulations regarding NSR and to submit the amended rules as a revision to the ASIP. (C-85-16-004-M-00)

F-2. OPERATION AND MAINTENANCE AGREEMENT AND PLAN WITH U.S. DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICES FOR WHITE TANKS FRS NO. 4 REHABILITATION PROJECT Approve the Operation and Maintenance (O&M) Agreement (Agreement) and O&M Plan (Plan) FCD 2015A015, between the U.S. Department of Agriculture Natural Resources Conservation Service (NRCS) and the Flood Control District of Maricopa County (District) for the White Tanks FRS No. 4 Rehabilitation Project (Project [#201.02.31]). The NRCS and Sponsor agree to carry out the terms of the O&M Agreement and O&M Plan, which defines the responsibilities for operating, inspecting, and maintaining rehabilitation work completed for the White Tanks FRS No. 4 Rehabilitation Project and existing structure features. The Agreement and Plan shall become effective when signed by both parties. The Agreement and Plan are required by the NRCS funding authorization process and for reimbursements of construction costs, prior to the construction of dam rehabilitation projects. Phase I of the overall rehabilitation is completed and consisted of the removal of the existing central filter material and replacement with a suitably engineered filter material. The central filter is an element of the dam that is designed to prevent a failure of the dam due to embankment cracking. Phase II construction which will start in January 2016 will remove the two existing corrugated metal pipe outlets and replace them with a single concrete outlet pipe system. The left auxiliary spillway will also be removed by extending the left abutment of the dam to the north. The right auxiliary spillway will be widened to accommodate the removal of the left spillway and the flood pool will be graded to remove the existing pit and dead storage. In addition the embankment will be raised to accommodate future land subsidence and regulatory requirements for freeboard and modified as needed to address all remaining dam safety issues. This item impacts Supervisorial District 4. (C-69-16-022-3-00)

F-3. TRANSFER VEHICLE TO THE MARICOPA COUNTY WASTE RESOURCES AND RECYCLING Approve the operating transfer of vehicle number 558, a New Holland Tractor with a book value of $35,000 from the Flood Control District (690) Flood Control Fund (991) to Waste Resources and Recycling (670) General Fund (100). (C-69-16-023-V-00)
