PETITIONS HEARING FOR THE FORMATION OF THE PROPOSED NANCY KAY IRRIGATION WATER DELIVERY DISTRICT Pursuant to A.R.S. § 48-261, § 48-3423 and § 48-3424, convene the scheduled public hearing regarding the petitions filed for the formation of the proposed Nancy Kay Irrigation Water Delivery District, as they have been determined to be signed by a majority of the owners of the acreage within the proposed district. FY20 BUDGET ADJUSTMENT FOR ELECTION COSTS In accordance with A.R.S.42-17106(B), approve a revenue and expenditure appropriation increase in the Elections Department (210) General Fund (100) Non Recurring Non Project (NRNP) budget in an amount not to exceed $2,582,614. This adjustment is needed due to increased election costs associated jurisdictional primary and general elections held during FY 2020. The increase in expenditures is offset by the increase in revenue from the cities and towns. Intergovernmental revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of these funds is not prohibited by the budget law. GRANT FUNDING FROM STATE 2018 HELP AMERICA VOTE ACT (HAVA) FORTIFICATION SUBGRANT Retroactively, approve and authorize the Elections Department to submit application for the 2018 Help America Vote Act (HAVA) Election sub grant program administered by the Secretary of State, and authorize the Chairman to approve the receipt of any and all such funds awarded. The Help America Vote Act (HAVA) Election addresses improvements to voting systems and voter access of which the following items were identified after the 2000 elections: provisional voting, voting information, updated and upgraded voting equipment, voter identification procedures and administrative complaint procedures. The grant does not allow for indirect costs for which the County is eligible. The Maricopa County Elections Department composite indirect cost rate for FY 20 is 146.7% or $125,511. Total indirect costs associated with this award are estimated to be $4,797.98, of which $3,532.25 is allowable and recoverable. Unrecoverable indirect costs associated with this funding are estimated to be $1,265.72. There is a cap of 12% on operating costs. A cash or non-cash match is non-applicable. When emergency situations occur, state and federal disaster relief funds may be available to reimburse qualified expenses incurred by responding organizations. AMENDMENT TO AGREEMENT WITH ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY FOR VOLUNTARY VEHICLE REPAIR PROGRAM Approve an Amendment to an Agreement between Arizona Department of Environmental Quality (ADEQ) and Maricopa County through the Air Quality Department, for the purpose of allowing ADEQ to administer the Voluntary Vehicle Repair Program (“VVRP”) on behalf of Maricopa County, as required by A.R.S. §49-474.03. This Amendment to the Agreement is non-financial and is effective from July 1, 2020 until June 30, 2021. The Voluntary Vehicle Repair and Retrofit Program (VVRRP) was enacted (Laws 1998, Chapter 217, § 19) to provide assistance to the owners of vehicles that were 12 years old or older to help them comply with the requirement to successfully repair vehicles that had failed emissions inspections. Arizona law (A.R.S. §49-474.03) requires Maricopa County and Pima Counties to operate and administer a VVRRP in Area A and Area B (A.R.S. §49-541) and to coordinate the program with ADEQ and the Arizona Department of Transportation (ADOT). The program is required to provide for quantifiable emission reductions based on actual emissions testing performed on the vehicle before and after repair. This Amendment to the Agreement will allow ADEQ to implement the VVRP on behalf of Maricopa County. The Asset and Work Order Management software is the application that Maricopa County’s Office of Enterprise Technology Wireless Systems uses for day to day tracking of radio assets, work orders, inventory control, customer invoicing, and constant monitoring of work flow. This new contract replaces the current Sole Source contract (10108-SS) originally approved by the board on October 6, 2010 and renewed for five years on October 21, 2015; which expires on October 31, 2020. RESOLUTION TO APPLY FOR TRIBAL GAMING FUNDS FROM FORT MCDOWELL YAVAPAI NATION Pursuant to the Board’s Resolution, Processing of Tribal Gaming Fund Applications, dated May 31, 2016 (“Gaming Resolution”), Maricopa County is the administrative pass-through for tribal gaming applications (“Applications”) received pursuant to the State of Arizona Department of Gaming Compact (“Compact”). The Applications seek funds for government services that benefit the general public, including public safety, mitigation of the impacts of gaming, or promotion of commerce and economic development. Pursuant to the Board’s Gaming Resolution, Maricopa County defers substantive review of the Applications to the Tribal authorities and place these matters on the consent agenda. AMEND WELLNESS INCENTIVE PLAN FY 20-21 Approve modification of the FY 20-21 Wellness Incentive Program activities for employees who elect to participate in County-sponsored medical plans as follows: 1. Approve revisions to Policy HR2426 Employees Assisting and Supporting Employees (E.A.S.E.) with a retroactive effective date of April 1, 2020, to incorporate the following changes: • Incorporate the COVID-19\Coronavirus pandemic as a crisis reason for loss of income, including due to furlough or reduced hours, until December 31, 2020. • Add unexpected expenses arising from COVID-19\Coronavirus pandemic as qualifying expenses. • Provides that through December 31, 2020, for purposes of a Crisis Reason arising from the COVID-19/coronavirus pandemic only, any employee employed by the County may qualify as long as that employee is employed by the County at the time of application and at the time EASE funding is issued. Current eligibility is full-time with twelve months of service. • Removes reference to an Operations Manual and adds reference to the Employee Assistance Fund Guidelines document. This policy applies to employees of County Appointed Departments; County elected offices, and the Maricopa County Stadium District, Flood Control District of Maricopa County and the Maricopa County Library District (Special Districts), and other governmental agencies for whom the County provides payroll services. GRANT AWARD FROM NATIONAL ASSOCIATION OF COUNTY & CITY HEALTH OFFICIALS (NACCHO) – ‘LOCAL INNOVATIONS IN CONGENITAL SYPHILIS PREVENTION’ Approve the acceptance of grant funds from NACCHO in the not-to-exceed amount of $25,000 for the project purpose of identifying innovations and improvements in congenital syphilis prevention. Authorize the Board Chairman to sign all documents related to these grant funds, as applicable. The award period is effective for 12 months following full execution. The grant is a part of the “Identifying Promising Practices for Congenital Syphilis Prevention” project. It was a competitive award opportunity. There is no cash or in-kind match required. This is not a mandated portion of STD services but provides a benefit to our citizens by working to contain and prevent cases of congenital syphilis. Should the grant cease, on-going contributions should not be required. The grant allows for the full indirect rate of 19.2%. Indirect cost is estimated to be $4,027.00 all of which is recoverable. All program cost are allocated to the grant so there will not be additional burden on the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The STD grant award is reoccurring and non-competitive and has been awarded to the Department for a number of years. There is no cash or in-kind match required and indirect cost is fully recoverable. Should this grant be discontinued, ongoing cash contributions may be required as this is a mandated function. At this time, there are no costs that will need to be absorbed by the department’s operating budget. The Department of Public Health indirect rate for FY 2019-20 is 19.2%. The budget period is October 1, 2019 through September 30, 2020. The IGA term is October 1, 2018 through September 30, 2023. Maricopa County Department of Public Health’s Indirect Rate for FY 2019-20 is 19.2% The indirect costs related to the additional funds are estimated at $288.08 all of which are recoverable. The WIC Services award is reoccurring and has been awarded to the department for many years. This grant does not require match, indirect cost is fully recoverable and ongoing cash contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by providing vouchers for approved foods (milk, cheese, cereals, peanut butter, eggs, infant formula, and juice etc.) for low-income pregnant, post-partum, breast-feeding women, infants, and children up to five (5) years of age. Clients also receive nutrition and breast-feeding education and referrals to applicable social services. .The grant award is competitive. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This oral health grant award is not a mandated function but provides a benefit to citizens as the Office of Oral Health - OOH FTF Administrative Home; collaborating and providing professional development, preventive oral health education, dental screenings and fluoride varnish to children ages zero to five throughout East Maricopa, Northwest Maricopa, Phoenix North, Phoenix South, Southwest Maricopa and Southeast Maricopa Regions. Should the grant cease, on-going contributions would not be required. This Grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the Grant Agreement. MCDPH indirect rate for FY19-20 is 19.2%. The Pass thru amount to sub-recipients, Dignity Community Care and AZ Early Childhood Education total the amount of $434,250.00 and are not subject to indirect. The full indirect costs are estimated at $260,204 of which $135,523 is recoverable and $124,681 is unrecoverable. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. AGREEMENT WITH GOLDWATER AIR NATIONAL GUARD BASE – 161ST AIR REFUELING WING Approve an agreement between Maricopa County, by and through the Department of Public Health (MCDPH), and Goldwater Air National Guard Base – 161st Air Refueling Wing (ARW). The agreement recognizes that in the event of a Public Health Emergency, the 161 ARW will operate their own Point of Dispensing (POD) operation and MCDPH will issue the 161 ARW the Strategic National Stockpile (SNS) items required to run the site. In the context of the COVID-19 response, the 161 ARW POD site and this agreement will be a critical piece of the vaccination program whenever that may be initiated. The 161 ARW possesses their own internal Medical Group and Logistical support to set up mass vaccination PODs on site to handle their own population. This capability significantly supports MCDPHs ability to support “Open” POD operations by decreasing the number of individuals MCDPH has to vaccinate. In addition, military personnel are typically given a higher priority along with first responders and healthcare workers. The main complication to any future POD operations is that the PPE that is typically part of the SNS, has now been depleted nationally because of the recent distribution for COVID-19. With or without the PPE, this agreement is still critical in dispensing vaccine (possible COVID-19 or Pan-Flu) or prophylaxis (Anthrax). (C-86-20-051-3-00)

AMENDMENT TO AGREEMENT WITH MARICOPA COUNTY MUNICIPAL WATER CONSERVATION DISTRICT Approve the Amendment to the Agreement between the Maricopa County Municipal Water Conservation District (MWD) and Maricopa County for the relocation of the irrigation facilities in conflict with the MCDOT Roadway Improvement Project TT0562, Olive Avenue: Sarival Avenue to Reems Road. The estimated cost to relocate the irrigation delivery facilities is $3,066,352. Funds are budgeted in Capacity (CAPY) project, Sub-Project TT0562 Olive Avenue: Sarival Avenue to Reems Road.
