Development of the site shall be in substantial conformance with the Site Plan entitled “Sun State Towers: AZ01-033 Papago/PHO Wintersburg”, consisting of six (6) full-size sheets, stamped received October 6, 2015, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “Sun State Papago”, consisting of six (6) pages, stamped received October 6, 2015, except as modified by the following conditions. c. The antenna array diameter shall be limited to seventeen feet (17’) across. All future appurtenances shall protrude no further from the center of the tower than this initial antenna array. e. The applicant/owner shall enclose the compound with a chain link fence no less than 8’ in height. f. Future carriers may co-locate on the Wireless Communication Facility if co-location does not increase overall tower height or increase protrusion of appurtenances. Any change to these elements will trigger an amendment to the Special Use Permit. g. This Special Use Permit shall expire 35 years from the date of approval by the Board of Supervisors, inactivity of the use for a period of 90 or more consecutive days, or upon termination of the use, whichever occurs first. All of the site improvements shall be removed within 60 days of such termination or expiration. h. The following Drainage condition shall apply: 1. Per Maricopa County Zoning Ordinance (MCZO) 1205.7.7.3, Concurrent projects that cumulatively exceed a total project construction envelope and disturbance limit of 1,500 square feet shall not be considered as meeting Section 1205.7.7 and must meet the requirements of Section 1205.7. i. The following Flood Control District conditions shall apply: 1. There is Pending Floodway and Pending Floodplain in the most west/northwest portion of the property. The PVNGS placards shall be posted in at least two locations within the 50 x 50 compound upon consultation with the PVNGS Emergency Planning Department. k. Major changes to this Special Use Permit shall be processed as a revised application in the same manner as the original application, with final determination made by the Board of Supervisors following recommendation by staff and the Planning and Zoning Commission. Minor changes may be administratively approved by staff of the Planning and Development Department. l. Non-compliance with the plan of development (the site plan and narrative report) or the conditions of approval will be treated as a violation in accordance with provisions of the Maricopa County Zoning Ordinance. m. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. n. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. o. There shall be no lighting on the tower structure, attachments, or appurtenances. (C-44-16-037-M-00)

5. REVISIONS TO MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS: AQ-2013-005-NEW SOURCE REVIEW Hold the public hearing continued from December 9, 2015 (C-85-16-003-M-00) as required by A.R.S. § 49-471.07 and § 49-479(B), to solicit comments on proposed amendments to Maricopa County Air Pollution Control Regulations (100,200,210,220,230,240,241,500,510,600, and Appendix D and E) regarding New Source Review (NSR) and to solicit comments on submitting the amended rules as a revision to the (Arizona) State Implementation Plan (SIP) as more fully set forth in the Notice of Supplemental Proposed Rulemaking, Rule Docket AQ-2013-005 published in the Arizona Administrative Register on December 18, 2015. Full text of the NSR is on file in the Office of the Clerk of the Board. Following the public hearing, the Board is requested to adopt the proposed amendments to the Maricopa County Air Pollution Control Regulations regarding NSR and to submit the amended rules as a revision to the (Arizona) SIP. In doing so, the Board will also be asked to approve additional non-substantive amendments to Rules 100, 240 and 241 which were made in response to public comment which ended January 18, 2016 and are outlined below. NSR is a long-standing Clean Air Act permitting program that requires businesses to get an air pollution control permit before they start construction or make major modifications to their business. NSR must ensure that air quality is not significantly degraded from the addition of new or modified businesses, while also providing flexibility to businesses to improve or modernize their operations. Permits must include an air quality analysis to demonstrate that new emissions emitted from the business will not cause or contribute to a violation of a National Ambient Air Quality Standard. Permits are issued for generators, paint booths, printing, wood working, chemical mixing, concrete batch plants, electronic assembly, abrasive blasting, gasoline resale, and power plants. Permit fees are not changing due to this rulemaking. The purpose of this rulemaking is to update the Maricopa County Air Quality Department’s New Source Review (NSR) rules in order to secure their approval as part of the State Implementation Plan (SIP) under the federal Clean Air Act. The update will be consistent with revisions the Arizona Department of Environmental Quality (ADEQ) and the U.S. Environmental Protection Agency (EPA) made to the NSR Program required by the federal Clean Air Act. Recommended amendments to the NSR after the Supplemental Rulemaking Publication Amend Rule 100, Section 200.75(a) FROM: a. The amount by which the sum of Section 200.66(a)(1) and Section 200.66(a)(2) below exceed zero : A creditable increase or decrease in actual emissions is contemporaneous with a particular modification if it occurs between the date five (5)years before the commencement of construction or modification on the particular change and the date that the increase from the particular modification occurs. This Agreement is non-financial and is effective from February 3, 2016 until no end date. Maricopa County has an existing agreement with EPA Region 9 that was executed in December 1993 whereby the Federal PSD air quality program is delegated to the Maricopa County Air Quality Department. The key requirement in the agreement is that EPA has to cosign up to ten PSD permits issued by Maricopa County. The new proposed agreement removes that requirement and provides other updates. The agreement has been signed by the Acting Air Division Director at EPA Region 9. (C-85-16-005-3-00)
