15. FUNDING FROM THE ARIZONA GAME AND FISH COMMISSION – FOR LAW ENFORCEMENT BOATING SAFETY FUND FY19 Approve the acceptance of up to $405,000 in continued funding from the Arizona Game and Fish Commission for Law Enforcement Boating Safety. The term of this funding is estimated to be July 1, 2018 through June 30, 2019. This funding will be used to pay for personnel costs, purchase equipment, maintenance/repair and/or replacement of watercraft patrol boat(s) to continue effectively patrolling the waterways in Maricopa County. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. The Sheriff’s indirect cost rate for FY18 is 19.9% ($80,595). These funds are the result of A.R.S. § 5-383 and indirect cost recovery is not allowed. There will be capital equipment purchases valued at $250,000 that are excluded from the indirect cost calculation. Thus the unrecoverable indirect cost impact of this funding is ($30,845). Acceptance of these funds will enable the Sheriff’s Office to purchase equipment and /or other items relating to patrolling the waterways in Maricopa County. (C-50-18-070-G-00)

18. RESOLUTION TO PARTICIPATE IN THE STATE OF ARIZONA FAMILY COUNSELING PROGRAM Participate, by resolution, in the State of Arizona Family Counseling Program for FY2018-19, administered by the Juvenile Court pursuant to A.R.S. 8-261 through 8-265 for the purpose of strengthening family relationships and prevention of juvenile delinquency. Authorize $68,081 (budgeted) matching General Funds for FY2018-19. The Juvenile Probation Department in Maricopa County has participated in the Family Counseling Program provided by the Arizona State Legislature, A.R.S. 8-261 through 8-265 for over 40 years. The objective of the program is to divert delinquent or incorrigible offenders from the court process by providing counseling until the family can mobilize its own resources for meeting its problems. In addition, the counseling is provided to reduce referral frequency to the Juvenile Probation Department. The allocation to Maricopa County for FY2018-19 is $272,329 which will be disbursed by the Administrative Office of the Supreme Court. A 4 to 1 ratio County match is required in the amount of $68,081 and is included in the Juvenile Probation Department's FY2018-19 budget. A resolution by the Board of Supervisors will make it possible for approximately 1,500 families to participate in the Family Counseling Program during the next fiscal year. (C-27-18-004-2-00)

19. APPOINT SUPERIOR COURT COMMISSIONER AS SUPERIOR COURT JUDGE PRO TEMPORE Approve the appointment of Court Commissioner Amy Michelle Kalman as a Superior Court Judge Pro Tempore in accordance with Arizona Revised Statutes § 12-141. The appointment will be for the remainder of FY 2018, commencing June 11, 2018 through June 30, 2018. Additionally, the court requests the appointment for FY 2019, commencing July 1, 2018 – June 30, 2019. In order to obtain greater flexibility in the use of Court Commissioners, the Superior Court customarily has all Court Commissioners appointed as Superior Court Judges Pro Tempore so they may, on occasion, hear contested matters. This serves the interest of judicial economy and promotes sound caseflow management. Court Commissioner Amy Michelle Kalman would serve as a Superior Court Judge Pro Tempore without any additional compensation other than that to which he/she is entitled as a Court Commissioner. 68. REQUEST FOR GRANT APPLICATION WITH AZ EARLY CHILDHOOD DEVELOPMENT AND HEALTH BOARD (FIRST THINGS FIRST) FOR SOUTHWEST MARICOPA REGION FOR NUTRITION, OBESITY AND PHYSICAL ACTIVITY Approve and accept an award for a Request for Grant Application (RFGA) (FTF-RC007-19-0632-00) Contract Number (FTF-RC007-19-0632-01), between Arizona Early Childhood Development and Health Board (AECDHB), First Things First (FTF) and Maricopa County by and through its Department of Public Health (MCDPH), Office of Community Wellness and Health Promotion (OCWPH) to provide funding for Nutrition, Obesity, and Physical Activity (NOPA) program for the Southwest Maricopa Region. The NOPA program will offer education to children, parents and/or caregivers; training to early care and education professionals using various curricula such as Color Me Healthy, Eat, Play Grow and SPARK. The funding for the budget period of July 1, 2018 through June 30, 2019 is in the not-to-exceed amount of $100,000. The term of this Agreement is July 1, 2018 through June 30, 2022 unless terminated, cancelled or extended. The parties may renew this Agreement for up to three (3) additional twelve (12) month extensions. This Grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the Grant Agreement. MCDPH indirect rate for FY17-18 is 16.6%. The full indirect costs are estimated at $15,091.00 of which $9,091.00 is recoverable and $6,000.00 is unrecoverable. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a Grant from AECDHB FTF and will not affect the County’s general fund. (C-86-18-091-G-00)

The County has since built their Southwest Regional Justice Court in an alternate location. The City has a first right of refusal for both parcels. (C-78-18-017-3-00)

77. APPROPRIATED BUDGET ADJUSTMENT FOR WASTE TIRE SPECIAL REVENUE FUND In accordance with A.R.S. §42-17106(B), approve the transfer of non-recurring revenue and expenditure authority between Non Departmental (D470) Non Departmental Grants Fund (249) and the Waste Resources and Recycling (D670) Waste Tire Fund (290). This action will require the following budget adjustments: Approve an increase in the expenditure authority in FY 2018 Waste Resources and Recycling (D670) Waste Tire Fund (290) Non Recurring Non Project (NRNP) in the amount not-to-exceed $747,274. Approve a decrease in the expenditure authority in FY 2018 Non Departmental (D470) Non Departmental Grants Fund (249) Non Recurring Non Project (NRNP) in the line “Unreserved Contingency” (4711) in the amount not-to-exceed $747,274. These adjustments will result in a countywide net impact of zero. This budget adjustment will allow the Waste Tire Fund (290) to absorb costs associated with the increased demands for tire recycling services. The Waste Tire Fund (290) is forecasted to receive revenue which will cover this additional expense. The approval of this action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-67-18-003-M-00)
