12. WICKENBURG ILA (Supervisorial District: 4) Case #: SU260019 Applicant and Owner: Jamie Hartig, Ledcor Group / Charlene Brungs Request: Special Use Permit (SUP) for a fiber-optic utility compound in the Rural-190 zoning district Site Location: Generally located at the SWC of Forepaugh Peak Rd. and the Arizona & California Railroad, approx. 2 miles N of US 60, in the Wickenburg area Commission Recommendation: On 9/10/2026, the Commission voted 7-0 (motion by Commissioner Whitney D3, seconded by Commissioner Rochwalik D3) to adopt a motion recommending the Board of Supervisors approve SU260019 subject to conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Wickenburg ILA,” consisting of five full-size sheets, dated June 23, 2026, and stamped received June 25, 2026, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “MMI-Wickenburg AZ,” consisting of five pages, dated February 3, 2026, and stamped received June 25, 2026, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. The site contains areas of regulated floodplains (FEMA Zone A). Any development in the floodplain will require a floodplain use permit issued concurrent with building permit(s) required for site development. 2. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 905 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 3. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 4. Detailed Grading and Drainage (Site Infrastructure) Plans must be submitted with the application for Building Permits. 5. No use is anticipated outside of the disturbed area. Any additional improvements that increase disturbed area will require additional retention. d. This special use permit is valid for a period of 30 years and shall expire on October 21, 2056, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. The owner shall submit construction permits to establish the land use and for site improvements as shown on the site plan and receive final inspection status from the Planning & Development Department Inspections Division establishing the use prior to commencing operations. Violation of this condition may be grounds for revocation as set forth in the Maricopa County Zoning Ordinance. g. Noncompliance with any of the conditions assigned to the approval of this Special Use Permit by the Maricopa County Board of Supervisors may be grounds for revocation in accordance with the requirements and procedures as set forth in the Maricopa County Zoning Ordinance. h. The property owners and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. i. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. These items will be addressed as development plans progress and are submitted to the County for review. 3. 4. The three items below require, at applicant’s expense, an American Land Title Association (“ALTA”) Owner’s Policy of Title Insurance showing title vested in Maricopa County, a political subdivision of the State of Arizona. i. 355th Avenue is classified as an urban principal arterial requiring fee dedication of a 65-foot half street from the section line per the Maricopa County Zoning Ordinance Section 804. ii. Camelback Road is classified as an urban parkway requiring preservation of a 100-foot half street from the section line per the Maricopa County Zoning Ordinance Section 805. iii. Cambell Avenue is classified as a rural major collector requiring fee dedication of a 40-foot half street from the mid-section line per the Maricopa County Zoning Ordinance Section 804. 2. It is the developer's responsibility to determine if the existing right of way is fee simple, if it is not then the developer will need to provide the right of way in said form. 3. Dedication shall be completed by time of permit approval or after 6 months after BOS Approval if no MCDOT or PND permit is required. 4. The above comments do not include identification of utilities or underground facilities within or adjacent to the required right-of-way that may have prior rights and/or require relocation. 5. Any additional dedication and offsite improvement requirements will be determined by MCDOT Traffic based on a submitted TIA/TIS and the above roadway classifications. If a TIA/TIS has been previously submitted, approval is valid for one year. If review for construction is not underway within this time period, MCDOT may request an updated traffic report to assess any changes in condition 6. A mid-section line alignment is located on the western perimeter of the proposed development requiring the setback line to start from a future half street Right-of-Way of 40-feet per the Maricopa County Zoning Ordinance Section 805. 7. Applicant to notify ADOT of proposed project through the Red-Letter Process, RedLetter@azdot.gov, due to the proximity to the future Hassayampa Freeway. g. Unless waived or modified by the County at time of subsequent development applications, the applicant or developer shall document implementation of the best practices and any recommendations by the Arizona Game and Fish Department (AGFD) related to habitat and wildlife resources. Should the Zoning Inspector and/or their designee decide that the owner or developer has not substantially undertaken these best practices in good faith, the owner or developer shall not receive final permits or certificate of occupancy until the best practices are implemented. h. Administrative approval of a plan of development will be required prior to approval and issuance of construction permits to develop and establish use of the site. i. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. j. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property may be considered for revocation to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. 38. FY27 VICTIMS' RIGHTS GRANT FUNDING FROM ARIZONA ATTORNEY GENERAL Approve receipt of FY 2026-2027 grant funds from the State of Arizona, Office of the Attorney General, in the amount of $339,400. These grant funds will support mandated functions by covering direct costs of implementing victims’ rights laws pursuant to Arizona Revised Statutes Title 13, Chapter 40, and Title 8, Chapter 3, Article 7, that impact prosecutorial agencies as an entity type. This agreement retroactively commenced on July 1, 2026, and terminates on June 30, 2027. In accordance with the Victims’ Rights Program Guidelines, Section IV, page 5, the grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney’s Office of Maricopa County for the administration of this grant. The Maricopa County Attorney’s Office FY2027 composite indirect cost rate is 21,720%, or $73,717.68. The recoverable indirect cost of administering this grant is $0; the nonrecoverable indirect cost is $73,717.68. Nonrecoverable indirect costs will be covered by the department's general fund budget. This grant is non-competitive and does not require a match. The grant award does not require ongoing cash contributions after the grant period ends. Authorize the Chair of the Board of Supervisors, or designee, to sign all documents related to this award. Grant revenues are not "local revenues" for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This award agreement is for $339,400. This award will ensure that victims of crime are notified of the progress of criminal proceedings. This grant will expire at the end of the agreement. There is no long-term expectation of continued funding for this grant; however, the County Attorney’s Office has received grant funds from the Attorney General’s office for victim services since FY96/97. The most recent award was for FY 25/26 in the amount of $339,400. (C-19-27-048-X-00)

40. REPLACEMENT WARRANTS - VICTIM COMPENSATION PROGRAM Approve the issuance of replacement warrants for county warrants related to the Victim Compensation Program that have been outstanding for more than two years. Necessary affidavits have been filed with the Board. The Maricopa County Attorney’s Office (MCAO), through grant funding received from the Arizona Criminal Justice Commission, provides financial assistance to victims of crime or others who may have experienced financial loss as a direct result of a crime and have had their claims approved by the compensation board. Unfortunately, in some cases, warrants are returned to MCAO or remain uncashed because of an address change or an incorrect address on file. The County Coordinator and the MCAO Investigations Division have located the current contact information for four victims who were issued warrants after September 24, 2018, which have not been negotiated. MCAO requests the issuance of replacement warrants to these victims in the amount of $539.25. These funds will directly impact victims by making them financially whole. (C-19-27-049-X-00)

REPLACEMENT WARRANTS - FELONY PRETRIAL INTERVENTION PROGRAM AND FELONY DIVERSION PROGRAM Approve the issuance of replacement warrants for county warrants related to the Felony Pretrial Intervention Program (FPIP) and Felony Diversion Program (FDP) that have been outstanding for more than two years. Necessary affidavits have been filed with the Board. FPIP and FDP provide an alternative to traditional prosecution and allow eligible individuals to participate in community-based education or treatment programs that promote long-term behavioral change. One requirement for successful completion is payment in full of all restitution to any victims. When restitution has been received, the Maricopa County Attorney's Office (MCAO) issues a warrant to the victim. Unfortunately, in some cases, warrants are returned to MCAO or remain uncashed because of an address change or an incorrect address on file. The MCAO Investigations Division has located current contact information for eight victims who were issued warrants after February 22, 2019, and whose warrants remain outstanding. 86. FY 2027 PUBLIC HEALTH FEE FUND BUDGET APPROPRIATION ADJUSTMENTS Approve an increase in the expenditure authority in the FY 2027 Public Health (D860) Public Health Fees Fund (265) Non-Recurring Non-Project (NRNP) budget in the amount of $546,000. Approve a decrease in the expenditure authority in FY 2027 Non-Departmental (D470) Non-Departmental Grants Fund (249) Non-Recurring Non-Project (NRNP) budget in the line "Unassigned Contingency" in the amount of $546,000. This expenditure adjustment supports converting the Tuberculosis (TB) clinic exam room, #1007, located at the Public Health Clinic at 1645 E. Roosevelt St., into a certified Airborne Infection Isolation Room (AIIR). This upgrade will directly resolve current bottleneck constraints in the TB clinic workflow, increase the daily patient throughput, and ensure compliance with infection-control standards while treating active TB patients. TB Isolation Room TI Cost Breakdown: • Design team construction administration cost: $6,917.00 • Construction cost: $480,000.00 • Environmental cost: $2,500.00 • Permit fees: $3,500.00 • MC PM cost: $3,000.00 • Contingency: $50,083.00 Total: $546,000.00 The proposed increase from one to two negative-pressure isolation rooms will strengthen the TB clinic’s ability to meet current increased community demand more effectively to maintain optimal patient care and efficiency. These actions will have a net zero impact on the County-wide budget and do not alter the budget constraining the expenditures for local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a Grant from ADHS. (C-86-27-017-X-00)

93. NOTICE OF AWARD WITH HEALTH RESOURCES AND SERVICES ADMINISTRATION FOR HEALTHY START INITIATIVE Approve the Notice of Award (NOA) H49MC00174‐26‐02 from the U.S. Department of Health and Human Services (HHS), Health Resources and Services Administration (HRSA), to Maricopa County by and through its Department of Public Health (MCDPH) to support efforts to improve maternal and infant health outcomes through the Healthy Start Initiative (HSI) program. The NOA was issued on September 10, 2026. This NOA authorizes the carryover of $327,009.00 in unobligated funds from April 01, 2025, through March 31, 2026, budget period into the current April 01, 2026, through March 31, 2027, budget period. The current budget period previously received $1,100,000.00 in federal funding. No additional federal funds are awarded through this action. With the authorized carryover, the total approved not-to-exceed amount is $1,427,009.00 for the current budget period, inclusive of the authorized carryover. The term of the award is May 1, 2024, through March 31, 2029. This NOA is an administrative action authorizing carryover of previously awarded funds. The award has been received by MCDPH in previous years. There is no cash or in-kind match required. This is not a mandated service but provides valuable benefits to Maricopa County residents; should the grant cease, ongoing contributions would not be required. MCDPH’s FY27 indirect rate is 20.24%. This award deviates from Policy A2505 because the NOA approves $197,214.00 in total indirect costs, which is less than the amount recoverable under MCDPH’s current FY27 rate. The $197,210.49 consists of $148,854.00 in previously approved indirect costs calculated using MCDPH’s FY26 State Negotiated Indirect Cost Rate (SNICR) of 16.69%, and $48,360.00 in indirect costs included in the $327,009.00 authorized carryover. Based on MCDPH’s current FY27 indirect rate of 20.24%, $197,210.49 is recoverable and approximately $51,700.73 is unrecoverable and, if necessary, will be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. Approval of this action does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. (C-86-24-181-X-06)
