18. AGREEMENT AND GRANT FUNDS FROM DRUG ENFORCEMENT ADMINISTRATION Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Drug Enforcement Administration, Organized Crime Drug Enforcement Task Force (OCDETF) Investigative/Strategic Initiative # MN-17-0012/SWAZP0826 in the amount of $451,128.53 for the award period beginning October 1, 2018 and terminating on September 30, 2019. This Agreement may be terminated by any of the parties by written notice to the other parties ten (10) business days prior to termination. The funding award is recurring and has been awarded to the Sheriff’s Office the past seven years. There is no match requirement. The Sheriff’s Office indirect cost rate for FY19 is 18.3%, applicable to the award amount of $451,128.53 less capital expenses of $34,003.40 for an indirect cost base of $417,125.13 and indirect costs of $76,333.90. Indirect costs are unallowable by the terms of this Agreement (paragraph 16) and $76,333.90 in indirect costs will be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends; however, property (items) purchased with these funds must remain available to the Strike Force/Strategic Initiative for the duration of its existence. This is not a mandated function although it supports the MCSO public safety mandate and provides a benefit to the citizens by disrupting the illicit drug trafficking organizations in Maricopa County and the State of Arizona resulting in a more safe and secure community. This is a non-competitive award. The Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro area that participate in this effort. This is reimbursement funding that will be used to purchase capital and non-capital equipment; to lease and operate a vehicle; to secure subscription technical service; to pay monthly data charges relating to several types of equipment; and to secure contracted analyst service. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 19. AMENDMENT TO AGREEMENT WITH TOWN OF QUEEN CREEK FOR LAW ENFORCEMENT SERVICES Approve amendment #3 to the Agreement for Law Enforcement Services between the Town of Queen Creek and Maricopa County on behalf of the Sheriff’s Office to correct FY 2018 cost worksheet charges resulting in a lump sum payment by the Town to the County of $32,204.78. This amendment also corrects and replaces the FY 2019 Worksheet Exhibit A that was distributed in February 2018 with an original total of $6,350,815.11 to a new total of $6,383,019.90. This amendment is effective retroactive to July 1, 2017. The term of the current Agreement is through June 30, 2020 and it can be terminated with a 12-month written notice from either party. The Town of Queen Creek was incorrectly charged for fixed benefits per FTE in FY 2018 (beginning July 1, 2017) and FY 2019 (beginning July 1, 2018). The charge is $11,400 per FTE. When documents were being compiled for new year billing, staff realized that the Town of Queen Creek was charged the FY 2017 rate of $10,671.22 per FTE. The annualized difference between the two rates is calculated to be $32,204.78. (C-50-15-008-3-03)

Also, approve an exemption from markings and issuance of non-governmental license places per A.R.S. §38-538.03 because these vehicles will be used to provide surveillance and supervision of convicted felons residing in the community. Markings are detrimental to the mission. These will be take home vehicles because surveillance and apprehension are not regularly scheduled assignments with set hours. The vehicle information, including make, model, year, color and VIN number will be provided to the Clerk of the Board upon approval of this agenda and purchase of the vehicles. These vehicles were previously leased by the state. They are now past their useful life, have not been replaced by the state and were never part of the County’s vehicle fleet. They have now been added to the vehicle replacement list. The annual savings from the state lease for these vehicles being replaced is estimated at $5,868. These funds will be used to offset fuel and repair costs for the five (5) new vehicles. The balance of any operating costs will be absorbed in the Adult Probation General Fund (Fund 100) operating budget. (C-11-19-001-2-00)

69. AMENDED PARK LAND DISPOSAL POLICY AND PROCEDURE Approve the revised Park Land Disposal Policy and Procedure (A2610) effective upon Board approval. These revisions exclude from the Policy easements for utilities for the benefit or support of park lands consistent with approved park master plans and provide other administrative updates to the 1997 Policy language. Per the 1997 Policy, generally, the County will not dispose of park lands held in any capacity by the County, believing that park lands should be held in perpetuity. In the event that disposal of park lands is proposed, certain procedures shall be followed, including public hearings by both the County Parks and Recreation Commission and the County Board of Supervisors as provided by law and this Policy. In following the Policy, all easements, even those needed to provide utilities for the benefit or support of park lands and facilities have been subject to the extensive public hearing process. All facilities developed in a park must be in accordance with a park master plan, which already includes a thorough public input and vetting process, including hearings by the County Parks and Recreation Commission and approval by the Board of Supervisors. In an effort to avoid duplication of efforts and potential results through the policy process that may contradict with a park’s master plan, it is requested that these park specific easements be exempted from the Policy. The Policy was originally recommended by the Maricopa County Parks and Recreation Commission on September 8, 1992 and approved by the Board of Supervisors on April 21, 1993 (PR-93-279). The current Policy was recommended by the Parks and Recreation Commission on October 8, 1996 and approved by the Board of Supervisors on January 8, 1997 (C-30-97-017-6-00). The Parks and Recreation Commission recommended this revision for approval by the Board of Supervisors at their August 21, 2018 meeting. This revised Policy shall supersede all previously adopted Park Land Disposal policies. (C-30-19-006-6-00)

The contract term is extended through September 30, 2020. The current budget period is October 1, 2018 through September 30, 2019 for the not-to exceed amount of $2,213,178.00. ADHS shall have the right, at its sole option, to renew the Grant, in two additional one (1) year increments, not to exceed a total Grant term of five (5) years. This award is reoccurring and has been awarded to the department for many years. There is no cash or in-kind match required and indirect cost is fully recoverable (less that which is set aside for sub-recipients). Ongoing cash contributions are not required. This is not a mandated function but benefits our citizens with the provision of nutrition and physical activity education. The grant award is competitively bid. MCDPH’s indirect rate for FY 2018-19 is 18.9%. The full indirect costs are estimated at $291,456 all of which are recoverable; and $379,626 is pass thru and not subject to indirect. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. (C-86-16-020-3-03)

74. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR REFUGEE SCREENING MEDICAL ASSISTANCE PROGRAM Approve an amendment to the Intergovernmental Agreement (IGA) Contract between the Arizona Department of Economic Security (ADES), Refugee Resettlement Program for Coordination – Refugee Preventive Health Screening, and Maricopa County by and through its Department of Public Health (MCDPH) to provide continued grant funding to the ‘Domestic Medical Examination for Newly Arrived Refugees (DME) Program’. Based on the agreed upon hourly rate of $110.15, the anticipated IGA total is $229,993.20 for the budget period October 1, 2018 through September 30, 2019. The IGA term is September 1, 2017 through September 30, 2022. The grant award is reoccurring and has been awarded to the department since 1983. There is no in-kind match requirement nor is there a requirement for continued contributions should the grant end. The grant award is not a mandated function but provides a benefit to the citizens by coordinating medical exams for refugees settling in Arizona. The grant award is competitively bid and other eligible agencies may or may not bid on this grant award. Maricopa County Department of Public Health’s indirect rate for FY2018-19 is 18.9%. This grant allows for full indirect, therefore the estimated amount of $36,559 is fully recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. There is no cost to the County’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this Agreement is provided by a Grant from ADES and will not affect the County’s general fund. (C-86-18-010-3-02)
