Upon Board approval, this item will become effective April 12, 2017. The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC Chapter XII (EROP Case ES-2016-002/Primitive Campgrounds) as an EROP expedited case at a public meeting held on Monday, January 23, 2017, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at http://www.maricopa.gov/3563/Active-Regulatory-Process. This revision will align MCEHC Chapter XII with the recently enacted Primitive Campgrounds statutory update, Arizona Revised Statute (A.R.S.) §36-136. A.R.S. §36-136 includes an exemption for Primitive Campgrounds, which by definition are remote in nature. To mesh with the A.R.S. update, new MCEHC Chapter XII language is proposed that will exempt Primitive Campgrounds from water, electricity and sewer public infrastructure requirements. This MCEHC revision proposal is following the EROP policy and workflow process, without added fees. (C-88-17-014-L-00)

11. FARMERS MARKET PROPOSED REVISIONS TO CHAPTER VIII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (ES-2016-003) Pursuant to A.R.S. §§ 11-251.05 and A.R.S. §36-184(B)(5), convene the scheduled public hearing, to solicit comments and consider the adoption of proposed revisions to Maricopa County Environmental Health Code (MCEHC) Chapter VIII Enhanced Regulatory Outreach Program (EROP) Case ES-2016-003/Farmers Market. Upon Board approval, this item will become effective April 12, 2017. The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC Chapter VIII (EROP Case ES-2016-003/Farmers Market) as an EROP expedited case at a public meeting held on Monday, January 23, 2017, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at http://www.maricopa.gov/3563/Active-Regulatory-Process. This proposal adds a farmer’s market coordinator and increases business owner market opportunities. The coordinator will submit documentation to the Department, be present during farmers market operating hours, and ensure certain sanitary measures are applied. Coordinator oversight of sanitary measures (e.g. hand sink design and application), will provide food venders the opportunity to utilize temporary hand wash stations in lieu of having installed units. By allowing greater flexibility under coordinator direction; this proposal increases opportunities for business owners while ensuring public health and safety are maintained. This MCEHC revision proposal is following Maricopa County’s Enhanced Regulatory Outreach Program (EROP) policy without added fees. (C-88-17-013-L-00)

12. CERTIFIED FOOD MANAGER PROPOSED REVISIONS TO CHAPTERS I AND VII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (ES-2016-004) Pursuant to A.R.S. §§11-251.05 and A.R.S. §36-184(B)(5), convene the scheduled public hearing, to solicit comments and consider the adoption of Enhanced Regulatory Outreach Program (EROP) Case ES-2016 004/Chapters I and VII Certified Food Manager (CFM). Upon Board approval, this item will become effective April 12, 2017. The Maricopa County Board of Health (BOH) reviewed and approved revisions to Maricopa County Environmental Health Code (MCEHC) Chapters I and VII (EROP Case ES-2016-004/Chapters I and VII CFM) as an EROP expedited case at a public meeting held on Monday, January 23, 2017, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at http://www.maricopa.gov/3563/Active-Regulatory-Process. The MCEHC Chapters I and VII CFM proposal eliminates Department issued Certified Food Manager cards. Also, this proposal clarifies when food establishments are exempt from the Certified Food Protection Manager requirement. Currently, a card is issued by the Department after each manager travels to a regional office and shares his/her certificate for passing an approved Food Protection Manager training. Upon this proposal’s BOS approval, the Certified Food Manager card and $5 fee will be discontinued; thereby, saving food managers $5 and a commute while ensuring public health and safety are maintained. Additional proposal updates include eliminating the Certified Food Protection Manager duplicate card with the $3 fee, and adding certificate text for training clarification. This MCEHC revision proposal is following Maricopa County’s Enhanced Regulatory Outreach Program (EROP) policy without added fees; it will eliminate fees. (C-88-17-012-L-00)

The plan will be valid until superseded by an updated version. The plan will be effective April 12, 2017. There is no cost to the County and no revenue will be generated. This plan is a joint plan that assigns emergency functions to the emergency response organizations of the State of Arizona and the County of Maricopa as delineated within the plan. The "Offsite Emergency Response Plan for Palo Verde Nuclear Generating Station" is based upon U.S. Nuclear Regulatory Commission and Federal Emergency Management Agency guidance to state and local governments, as contained in NUREG-0645 (FEMA-REP-1, Revision 1) "Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants." 43. EXTEND DEADLINE FOR WELLNESS INCENTIVE REQUIREMENTS FOR PROGRAM YEAR 2017-2018 Approve an amendment to the Wellness Incentive Requirements for Program Year 2017-2018 (C-39-16-021-2-00) to extend the deadline for employees to complete such requirements from May 31, 2017 to June 30, 2017. Employee engagement and participation is key to achieving the goals of the wellness incentive program. It has been determined that the original deadline for completion of activities required for 2017-18 wellness incentives can be moved back from May 31 to June 30. The extended time is intended to serve as a “grace” period to allow for additional communication with employees who do not meet the original deadline, and give them the opportunity to avoid losing out on the incentive if their failure to participate was a result of anything other than personal choice, i.e. lack of understanding given significant changes in requirements from previous years. 47. AMENDMENT TO PROGRAMMATIC AGREEMENT WITH CITY OF GLENDALE AND STATE HISTORIC PRESERVATION OFFICE FOR HUD-FUNDED PROGRAM ACTIVITIES Approve as a concurring party, a non-financial Amendment No. 1 to the Programmatic Agreement between the City of Glendale (City) and the State Historic Preservation Office (SHPO) governing the environmental clearance of U.S. Department of Housing and Urban Development (HUD) funded program activities. Concurrence by the Board of Supervisors is required by SHPO because the City of Glendale receives HUD HOME Investment Partnerships Program (HOME) grant funds through the Maricopa HOME Consortium. Maricopa County is the lead agency of the Maricopa HOME Consortium and, as such, serves as the certifying agency on all environmental clearances under the HOME program. Approving and signing the Amendment as a concurring party does not subject the Board to any additional responsibility or liability under the HUD regulations. The City and SHPO agree to amend as follows: a. Preamble to include a Discovery clause in statement five (5) to become an integral part of this Amendment; b. Applicability of Agreement: Addition of Exhibit L in the agreement for Infill and Replacement Housing utilizing HOME funds; c. Ratification of Agreement: City and State hereby agree that, except as expressly provided herein, the provisions of the Agreement will be and remain in full force and effect, and that if any provision of this Amendment conflicts with the Agreement, then the provisions of this Amendment will prevail. The Amendment requires the Board’s signature as a concurring party. HUD regulations require an environmental clearance on any activities undertaken with HOME funds. For all properties that are 50 years old or older, or that are listed on a historical register, SHPO must be consulted in order to determine whether the property is of historical significance and whether the property will be adversely affected by the investment of the HOME funds. SHPO allows any local government that has its own Historic Preservation Office or Commission to enter into a programmatic agreement that will allow the local Historic Preservation Office or Commission to determine the historical significance of local properties without a specific concurrence from SHPO. The City and the County cooperate in performing environmental reviews within the geographic boundaries of the City for HOME-funded HUD projects in accordance with the National Environmental Policy Act (NEPA), 24 CFR Part 58 and the related laws and authorities, listed at sections 58.5 and 58.6, including responsibilities under Section 106 of the NEPA. The County shall delegate and the City agrees to assume all Section 106 responsibility as required by 24 CFR Part 58.1 for all undertakings of HOME-funded HUD projects. The County remains the lead agency and will have ultimate responsibility, in concurrence with SHPO, for determining whether projects have or do not have a potential effect on historic properties in the environmental review process for projects funded by HOME funds. This Amendment to the Programmatic Agreement is subject to and incorporates by reference the statutory language of A.R.S. §38-511. (C-17-09-052-3-01)

53. COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH MTM RANCH LLC Approve a new Commercial Management Concessions Agreement with MTM Ranch LLC that will allow this Concessionaire to manage, operate and maintain a commercial concession within the Maricopa County Regional Park System. 54. EXPENDITURE APPROPRIATION FOR ELECTRONIC DOCUMENT REVIEW SYSTEM AND ASSOCIATED SUPPORT ITEMS In accordance with A.R.S. §42-17106(B), approve the transfer of non recurring expenditure appropriation between Non-Departmental (470), Non-Departmental Grants Fund (249) and the Planning and Development (440) Planning and Development Fees Fund (226). This action will require an expenditure appropriation adjustment decreasing the FY 2017 Non-Departmental (470), Non-Departmental Grants Fund (249), Non Recurring Non Project (NRNP) expenditure budget by $600,000 and increasing the FY 2017 Planning and Development (440) Planning and Development Fees Fund (226) Non Recurring Non Project (NRNP) expenditure budget by $600,000. This will allow the Planning and Development Department to purchase professional services, licenses, hardware and related implementation costs for a new and expanded Electronic Document Review (EDR) system for the Planning and Development Department under contract 15042-CI, originally approved by the Board of Supervisors on June 24, 2015. The amount includes approval for professional services to integrate Electronic Document Review with e-PlanCheck to the Accela Civic Platform. This item is the result of an ad hoc citizen task force initiative. The purpose is to minimize the cost and time necessary for customers to process permits by providing the option to submit and receive permits electronically. These adjustments will result in a County-wide net financial impact of zero. This is a continuation of the approved agenda C-44-16-042-3-00 approved by the Board on February 3, 2016. Original costs were anticipated to be concluded in FY 2016 but were not, therefore the department is requesting that $600,000 be added for FY 2017. (C-44-16-042-3-01)

76. REVISIONS TO REASONABLY AVAILABLE CONTROL TECHNOLOGY STATE IMPLEMENTATION PLAN AND NEGATIVE DECLARATIONS Pursuant to A.R.S. §49-479(b), set a public hearing for May 24, 2017, to solicit comments and consider the adoption of the submittal of the Reasonably Available Control Technology (RACT) State Implementation Plan (SIP) and negative declarations to the U.S. Environmental Protection Agency (EPA) as a revision to the (Arizona) SIP. Following the public hearing, the Board is requested to approve the submittal of the RACT SIP and negative declarations to the EPA as a revision to the (Arizona) SIP. Upon Board approval, this item will become effective May 24, 2017. The RACT SIP is an analysis made by the Maricopa County Air Quality Department (MCAQD) that concludes that the MCAQD has fulfilled the requirements of RACT, as applicable to the 2008 eight-hour ozone national ambient air quality standards (NAAQS) for all Control Techniques Guidelines (CTG) source categories and for all major sources of volatile organic compounds (VOCs) and nitrogen oxides (NOx). RACT is the lowest emissions limitation that a particular source is capable of meeting by the application of control technology that is reasonably available considering technological and economic feasibility. CTGs, issued by the EPA, are intended to provide States information that should assist them in determining RACT for source categories. In instances where either there were no sources in Maricopa County in a particular CTG source category or where there were no sources exceeding the CTG applicability threshold, the MCAQD made a negative declaration regarding such CTG source category; negative declarations are included in the RACT SIP. Permit fees are not changing due to this action. (C-85-17-018-M-00)

77. SUBMITTAL OF EMISSION GUIDELINES PLAN Pursuant to A.R.S. §49-479(b), set a public hearing for May 24, 2017 to solicit comments and consider the adoption of the submittal of a CAA Section 111(d) Plan to the U.S. Environmental Protection Agency (EPA) for implementing the municipal solid waste landfills emission guidelines (40 CFR Part 60, Subpart Cf (Emission Guidelines And Compliance Times For Municipal Solid Waste Landfills)). Following the public hearing, the Board is requested to approve the submittal of the CAA Section 111(d) Plan to the EPA. Upon Board approval, this item will become effective May 24, 2017. CAA Section 111 establishes a mechanism for controlling air pollution from 70 stationary source categories. CAA Section 111(d) establishes procedures, i.e., emission guidelines, for five (5) source categories, one of which is municipal solid waste (MSW) landfills. Emission guidelines establish procedures for States to submit a plan identifying sources in a source category and a program that provides for the implementation and enforcement of standards of performance for such sources in a source category. On August 29, 2016, the EPA promulgated emission guidelines for MSW landfills under CAA Section 111(d). The emission guidelines set forth specific mechanisms and requirements for controlling emissions of non-methane organic compounds (NMOC). The emission guidelines are codified at Title 40 of the Code of Federal Regulations, Part 60, Subpart Cf. The emission guidelines require States to submit to the EPA by May 30, 2017, a plan to implement the emission guidelines. For the purposes of the CAA Section 111(d) Plan, the MCAQD is considered a “State”. The CAA Section 111(d) Plans submitted to EPA must include elements described in EPA regulations, including 40 CFR Part 60, Subparts B and Cf, and in the EPA guidance document, “Municipal Solid Waste Landfills, Volume 2”. Such plan elements include: (1) Identification of enforceable mechanisms for implementing the EPA emission guidelines; (2) The MCAQD’s legal authority to carry out the CAA Section 111(d) Plan; (3) An inventory of existing municipal solid waste landfills; (4) An inventory of emissions from existing MSW landfills; (5) Emission standards for existing MSW landfills that are no less stringent than those in the emission guidelines; (6) The MCAQD process, for review and approval of site-specific gas collection and control system design plans; (7) Compliance schedules; (8) Testing, monitoring, recordkeeping, and reporting requirements; (9) A record of public hearing(s); and (10) Provision for annual MCAQD progress reports. Details for these elements can found in 40 CFR Part 60, Subparts B and Cf. The MCAQD has prepared the CAA Section 111(d) Plan that includes the elements described in EPA regulations, including 40 CFR Part 60, Subparts B and Cf and in the EPA guidance document, “Municipal Solid Waste Landfills, Volume 2”. Upon Board approval, the MCAQD will submit the CAA Section 111(d) Plan to the EPA by the EPA’s deadline of May 30, 2017. To implement the CAA Section 111(d) Plan, the MCAQD proposes to revise Maricopa County Air Pollution Control Regulations Rule 321 (Municipal Solid Waste Landfills). The rulemaking process to revise Rule 321 will follow the Enhanced Regulatory Outreach Program Policy and workflow process. Stakeholder Workshops will tentatively begin in May/June 2017 and a public hearing will tentatively be conducted in December 2017. The MCAQD is proposing to revise Rule 321 to reflect the requirements in 40 CFR 60, Subparts Cf and XXX. The proposed revisions will include changing the applicability of the rule to “…existing MSW landfills that commenced construction, modification, or reconstruction on or before July 17, 2014” and changing the standards of performance for collections and control system design plan, design capacity report, and non-methane organic compound emission rate report. The proposed revisions to Rule 321 would not take effect should 40 CFR 60, Subparts Cf and/or XXX be stayed, repealed, or rendered unenforceable or void as a result of any action by a federal court, Congress, or a new final action by the EPA and the proposed revision to Rule 321 would not take effect until the EPA approves the CAA Section 111(d) Plan. Permit fees are not changing due to this action. (C-85-17-019-M-00)
