Development of the site shall be in substantial con formance with the Narrative Report entitled “Project Narrative”, consisting of 8 pages, dated February 15, 2023, and stamped received February 15, 2023, except as modified by the following conditions. b. Administrative approval of a plan of development wi ll be required prior to approval and issuance of construction permits to develop and establish use of the site. Prior to issuance of a building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority t hat the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction rev iew and approval will be required. c. The following IND-2 IUPD standards shall apply: 1. MCZO Article 902.5.3 Max. Lot Coverage: 60%; solar panels do not count towards lot coverage 2. MCZO Article 1102.1. Parking Regulations: Does not apply to s olar panels for utility scale solar developments; applies normally to all other structures 3. MCZO Article 902.9.: All uses shall be conducted within a completely enclosed building except parking loading, unloading, or storage, except outdoor solar pa nels. 4. MCZO Articles 902.9.3.B & 902.9.3.C: Minimum chain link fencing at min. 6’ (h) including 1’ barbed wire topping. Gates shall be allowed on the perimeter of the project. Areas adjacent to existing or future residential development, slats will be added to the perimeter fence to provide visual screening. 5. The following uses shall be prohibited: i . Single-family and multi-family residential ii. Adult oriented facilities iii. Medical marijuana dispensary facilities and/or marijuana establishments iv. Hospitals v. Hotels, resorts, motels vi. Halfway Houses vii. Boarding Houses viii. Amusement enterprises and parks ix. Circus, carnival, rodeos, and other related permanent facilities x. Zoos d. The IUPD overlay is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by s eptic systems. A public water system and public sewer system shall be required prior to establishment of any non-residential use that requires potable water. e. The following Planning Engineering conditions shall apply: 1. Any new site improvements w ill require a plan of development and traffic impact study. 2. Broadway Road is classified as a principal arterial, and 65-feet dedication in fee is required from the section line. i . At this time only preservation is needed for this requireme nt and can be requested as a design waiver through the narrative of the next submittal. 3. A section line (363rd alignment) coincides with the eastern portion of the parcel. At a minimum, Maricopa County Zoning Ordinance Section 1105 requires building setbacks to start from a future half-street rightof -way of 55 feet. 4. A midsection line ( Roeser Road alignment) coincides with the northern boundary of APN 506-42-2021, and per Maricopa County Zoning Ordinance Section 1105 requires building setbacks to start from a future half street right-of-way of 40 feet. i . Based on geographic constraints, this alignment is not needed for a public roadway and can be requested as a design waiver through the narrative of the next submittal. 5. Any additional dedication and offsite improvements needed will be determined by MCDOT Traffic and MCDOT Permits based on submittal of a TIA/TIS. 6. Without the submittal of a plan of development, no development approval will be inferred by the engineering review, including, but not limited to drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 7. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. f. All outdoor lighting shall be designed as recommended by the International Dark-Sky Association and shall be in compliance with Section 1112 of the Maricopa County Zoning Ordinance. g. Prior to issuance of the initial building permit, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been de signed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be req uired. h. Zoning approval is conditional per Maricopa County Zoning Ordinance, Article 304.6, and ARS § 11-814 for six (6) years within which time the initial plan of development and initial construction permit must be obtained. i . The property owner/s a nd their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Ch ange as set forth in the Maricopa County Zoning Ordinance. k. Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance l. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the fa ilure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any right s that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Cha nge enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Go ldwater Gunnery Range and other flight areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflec tions off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. The Plan of Development may be amended administratively under separate application as long as the amendment complies with the established SUP development standards as approved by the Board of Supervisors. No amplified music or sound shall eminent from the site prior to 8:00 am or later than 9:00 pm. i . Group events shall have a maximum of 20 participants. j. The following SUP standard shall apply: 1. Height of trapeze structure: 34’ k. The following Planning Engineering conditions shall apply: 1. Prior to the building permit approval, update the Engi neered Grading and Drainage Plans to show the extents of the SUP area (parking, trapeze area, overflow area, etc.). Provide the outline (top of slope perimeter) of the retention basin. 2. Prior to the building permit approval, update the Engineered Grading and Drainage Plans with proposed contours and spot elevations to show how the SUP area will drain into the retention basin. 3. Detailed grading and drainage (site infrastructure) plans must be submitted with the application for Bu ilding Permits. 4. At the time of application for the building permits, the grading and drainage plans must indicate that all on-site areas flow to a retention basin including the “uncapturable” area at the southwest driveway. 5. Cooper Road will be annexed to be within the jurisdiction of the City of Chandler. The applicant will be responsible for coordinating with the City to review any traffic impact, right-of-way dedication, permitting, or roadway improvement requirements. 6. Prior to the Drainage Review approval on the Building Permit, a Storm Water Pollution Prevention Permit (SWPPP) from the County will be required prior to the issuance of any construction permits. 7. Prior to the Drainage Review approval on the building permit, a reduction factor for the material stored in Retention Basin A must be applied to the volume-provided calculations. 8. Maximum side slopes for the retention basins shall be 4:1. d. This special use permit is valid for a period of ten (10) years and s hall expire on August 9, 2033, or upon the termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use . e. Prior to occupying the existing residence or any portion thereof for any use associated with the special use permit, the applicant shall obtain a building permit to retrofit the existing residence to meet current commercial building code requirement s as applicable and shall obtain a certificate of occupancy for the retrofitted building prior to occupancy. f. Any outdoor storage shall not exceed the height of the perimeter fencing. g. Parking areas and driveways shall be surfaced with decomposed g ranite to minimize dust pollution, excluding ADA-accessible parking area(s) which shall be paved. Any surfacing shall meet Maricopa County Air Quality regulations. h. There shall be a minimum street side yard of nine (9) feet measured from Cooper Road’s ultimate 65-foot half-width right-of-way. i . The north sight-visibility triangle of the north driveway shall have a dimension of 13 feet by 25 feet and shall not occup y any area of an adjacent property. j. Solid fences more than two (2) feet in height shall be allowed in a sight-visibility triangle but must be spaced a minimum of 11 feet away from a vehicular travel lane of Cooper Rd. k. Any outdoor lighting shall be in conformance with the provisions of Section 1112 of the Zoning Ordinance and shall be placed so as to reflect light away from any adjoining rural or residential zoning district. l. Noncompliance with any Maricopa County regulation shall be grounds for initiating revocation of this special use permit as set forth in the Maricopa County Zoning Ordinance. m. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of th is approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the special use permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the special use permit, does no t reduce any rights that existed on the date of application to use, divide, sell, or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the special use permit. The special use permit enhances the value of the property above its value as of the date the special use permit is granted and reverting to the prior zoning results in the same value of the property as if the special use permit had never been granted. This special use permit is valid for a period of ten (10) years and shall expire on August 23, 2033, or upon the termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. e. Training and exercise area may not exceed 25% of the total p arcel and the outdoor area must be visually screened by a solid wall or buildings adjacent to any residential or rural zoning district. f. The number of customers/adopters shall not exceed five at any time, and shall only occur between the hours of 8 a.m. to 5:00 p.m. g. All dogs shall be placed indoor, within the designated kennels, and only allowed outdoors on a rotational routine between the hours of 6 a.m. and 8 p.m. h. This SUP allows the property owner to host up to a maximum of four (4) fundraiser or non-profit events per calendar year that exceed the three (3) volunteer person limit. The Property owner shall notify Maricopa County at least two weeks in advance of such events, including the date and hours of the event, which shall not exceed three (3) hours in length per event. i . Volunteers are considered employees. Therefore, the total number of non-resident person who volunteer and/or employed in connection with the business and are not an immediate family member as defined by ARS § 11-820, shal l not exceed three (3 ); except for special fundraiser or non-project events. j. DEANNEXATION FROM THE TOWN OF GILBERT ORDINANCE NO. 2871 TO MARICOPA COUNTY Pursuant to A.R.S. § 9-471.03 convene the scheduled public hearing regarding the de-annexing road right-of-way from Town of Gilbert jurisdiction to Maricopa County. Right-of-way location: Power Road from Elliot Road to Guadalupe Road. Supervisory District No. 1. The Board of Supervisors determined at a public hearing on August 9, 2023, that such action would be in the public interest and has complied with the additional requirements of A.R.S. § 9-471.03. If approved, the Board of Supervisors: 1. Orders that the public right-of-way be returned as specified in Town of Gilbert Ordinance No. 2871, returning the public right-of-way to Maricopa County. 2. Pursuant to ARS § 9-471.02, directs the Clerk of the Board to notify the Town of Gilbert that the Board of Supervisors order regarding the de-annexation of the public right-of-way was approved, and 3. Directs the Clerk of the Board to certify a copy of the order of the Board and file it for record in the Office of the County Recorder. Legal description of the roadway being de-annexed, identified as [Exhibit "A"], is attached. MCDOT Analysis: The existing roadway is ow ned/operated/maintained by MCDOT. The property adjacent to the eastern right-of-way is developing requiring roadway improvements. These improvements require deannexation to accommodate an arterial roadway This action will ensure the roadway is fully with in unincorporated Maricopa County and reduce conflict of liability. The roadway improvements are a necessary improvement to the traveling public. Financial Status: Cost of the roadway(s) development falls to the developer with no initial cost to Maricopa County. Cost of maintenance moving forward is typical of roadway maintenance cost and will be the responsibility of Maricopa County. The cost of roadway maintenance provides a benefit to the traveling public. The Board action will result to add 0.0025 square miles of right of way to County ownership and enable the County to assume responsibility for road maintenance. AGREEMENT WITH PHOENIX CHILDREN'S HOSPITAL FOR SERVICES FOR MINOR VICTIMS Approve the agreement with Phoenix Children's Hospital on behalf of the Maricopa County Attorney to aid in the investigation and possible prosecution of c hild physical abuse, child sexual assault, and sexual abuse matters involving minors. The term of the agreement becomes effective upon approval of the Board of Supervisors and shall continue for three years thereafter unless otherwise extended. Phoenix Chi ldren’s Hospital maintains and is willing to provide professional healthcare providers, staff, personnel, knowledge, and expertise in the medical evaluation and examination in cases of child sexual abuse and sexual abuse and in records review in cases of s uspected child physical abuse. Authorize the Chairman to sign any and all documents related to this action. The Maricopa County Attorney’s Office (MCAO) will reimburse Phoenix Children’s Hospital at rates outlined in “Attachment B: Compensation and Reimbursement” for services under this agreement. 34. APPROPRIATION ADJUSTMENT FOR GRANT FUNDING FROM THE OFFICE OF THE STATE TREASURER ARIZONA In accordance with A.R.S. 42-17106(B), approve the following amendments to the FY 2024 budget: Increase the revenue and expenditure authorities for Recorder's Office (D360) Recorder Grants (298) Non Recurring Non Project ( NRNP) budget by $4,053,942. Sec. 129. Appropriation; state treasurer; accuracy; voter registration rolls; fiscal year 2023-202 4. The sum of $6,000,000 is appropriated from the state general fund in fiscal year 2023-2024 to the state treasurer's office for distribution to county recorders offices in counties with a population of more than two hundred thousand persons according to the 2020 United States decennial census. The state treasurer shall allocate monies to the county recorder offices proportionally based on population according to the 2020 United State decennial census. The monies shall be used by county recorders to revi ew the accuracy of the voter registration rolls, including whether any registrations should be canceled pursuant to section 16-165, Arizona Revised Statutes. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitatio n, and therefore expenditure of the revenues is not prohibited by the budget law. These actions will have a county-wide net impact of zero and they do not alter the budget constraining the expenditures of local revenue duly adopted by the Board pursuant to A.R.A 42-17105. The total amount of funds requested is $4,053,941.67. The grant period will cover October 1st, 2023 through September 30th, 2024. The Recorder Department’s indirect rate for FY24 is 22.07%. Total grant indirect costs are estimated to be $894,704.93 and are not recoverable. Nonrecoverable indirect costs will be covered by the departmental general fund budget. This grant does not require a match or on-going cash contributions after the grant period end date. The grant award is nonrecurrin g and has not been awarded to the department in past years. FUNDING REIMBURSEMENT FROM PHOENIX PD CRIMES AGAINST CHILDREN TASK FORCE Approve acceptance of up to $30,000 from City of Phoenix, PD Internet Crimes Against Children Task Force, for which MCSO is an affiliate authorized in IGA 157605--0, AKA C-50-22-139-X-00, approved in an action taken by the BOS on April 6, 2022. The IGA terminates December 22, 2027. The Sheriff’s Office indirect cos t rate for FY24 is 16.72%. The indirect cost basis is $30,000. Unrecoverable indirect costs associated with this Agreement are estimated to be $5,016. These unrecoverable indirect costs will be absorbed by the General Fund. This funding is competitive and does not require a match. The funding is recurring and has been awarded to the Sheriff’s Office for over five years. AMENDMENT TO SUBGRANTEE AGREEMENT FROM THE ARIZONA DEPARTMENT OF HOMELAND SECURITY – PROJECT #220206-02 Approve Amendment #1 to the Subgrantee Agreement from the Arizona Department of Homeland Security, Project #220206-02. This amendment extends the expiration date of the Agreement from September 30, 2023, until September 30, 2024. All other terms and condit ions are the same. This Amendment extends the amount of time to expend the funding awarded for the analyst position. The analyst position wasn’t filled until seven months into the first grant program period because of the extensive hiring process. Ext ensions on the position and this award period are necessary to enable MCSO to expend all funding by 9/30/2024. MOU WITH MARICOPA COUNTY OFFICE OF ENTERPRISE TECHNOLOGY FOR BACK UP HELICOPTER TRANSPORTATION SERVICE Approve a Memoran dum of Understanding between the Sheriff’s Office and the Office of Enterprise Technology, Radio Division, whereby the Sheriff’s Office will provide backup helicopter transportation when the contracted commercial vendor is unable to deliver service. The un derstanding is retroactively effective to July 1, 2023 and will continue through June 30, 2026. It can be cancelled by either party at any time with a 2-week written notice. The Sheriff’s Office will charge a minimum cost for fuel per service request and based on type of equipment used. The cost of fuel will be based on the rate at the time of service. SUBRECIP IENT AGREEMENT WITH ARIZONA STATE UNIVERSITY (ASU) FOR THE MARICOPA COUNTY SHERIFF'S OFFICE, FY2023 ANTI-HUMAN TRAFFICKING GRANT FUND PROGRAM Approve a Subrecipient Agreement (‘Agreement’) between Arizona State University (ASU) (hereinafter referred to as ‘subrecipient’), and the Maricopa County Sheriff’s Office. The value of this Agreement is not to exceed $254,939. MCSO will reimburse ASU using grant funds awarded from the State of Arizona Department of Emergency and Military Affairs (DEM A) and designated for use in Anti Human Trafficking. The Agreement and acceptance of this funding was authorized by the BOS (C-50-23-170-X-00) on April 26, 2023. The Agreement term shall begin on the date of the last signature and terminate on December 31, 2025. The Subrecipient will perform tasks to include, but not limited to: developing approved training courses and videos; assisting with hosting annual conferences; providing training to both MCSO corrections and sworn staff; Building a network with MCS O within the Maricopa County jails to respond to potential sex trafficking victims, identified victims and identified traffickers; working with MCSO program designers to develop prevention and awareness trafficking materials for inmate tablets, and providi ng social work interns to work with MCSO jail staff to provide support and community referrals to high risk and identified victims. IGA WEST VALLEY SEX TRAFFICKING TASK FORCE CREATION AND PARTICIPATION Approve an IGA by and between the City of Avondale, the City of Buckeye, the City of Goodyear and Maricopa County, for and on behalf of their respective police departments or law enforcement agencies, to provide a multi-disciplinary team approach with rega rd to investigation, assessment, medical treatment, and prosecution of child and vulnerable sexual/physical abuse, sexual abuse of adults and domestic violence cases on behalf of the Southwest Family Advocacy Center (“Center”). This IGA is effective upon the date it is signed by all parties and ends December 31, 2025. Any party can withdraw from this IGA with or without cause with a 30-day notice. The City of Avondale was awarded grant funding from the Arizona Department of Emergency and Military Aff airs (“DEMA”) for costs associated with programs, equipment and/or activities that reduce human trafficking, and was authorized to distribute grant funding to task force partners. Also approve acceptance of reimbursement funding for the MCSO deputy assig ned to this task force in an amount not to exceed $73,500 which is comprised of up to $64,800 for monthly overtime for the duration of the grant period; a total of up to $4,800 for out of state travel for professional development for three years; and a tot al of up to $3,900 for out of state travel for case follow up for 3 years. The award is nonrecurring, non-competitive, there is no match requirement, and there are no future or ongoing contributions after the grant period ends. The Sheriff’s Office indir ect cost rate for FY24 is 16.72%, applicable to the award amount of $73,500 with no capital expenses for an indirect cost base of $73,500 and indirect costs of $12,289.20. Indirect costs will be absorbed by the General Fund. This is not a mandated functio n although it supports the public safety mandate. The Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro area that participates in this effort. These revenues are not local revenues for the purpose of t he constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. Adult Probation will be moving into County owned space. The multi-use site included probation services, GED/literacy education, job training, housing to probationers and counse ling services to probationers and local residents in need. 48. MARICOPA COUNTY JUSTICE COURT NAME CHANGES Approve and authorize the name changes of the San Tan Regional Court Center and the Downtown Justice Court. The San Tan Justice Court resides inside of the San Tan Regional Center. Because the court shares the name of the region, litigants and other members of the pu blic have been confused about the correct jurisdiction of their court cases. Staff have been fielding additional phone calls and incorrect court reports, adding additional case processing time and added frustration for public access to court services. Ch anging the name of the San Tan Regional Center to the Ocotillo Regional Center will enhance the public’s access and understanding of court processes. The Downtown Justice Court has the same access to justice challenges, as it resides within the Downtown Regional Center. Changing the name of the Downtown Justice Court to the El Centro Justice Court will also enhance the public’s access and understanding of court processes. The selected names more accurately reflect the history and constituency of the prec incts. The Downtown Justice Court Center name accurately reflects the regional boundary lines. Changing the Downtown Court to El Centro maintains the essence of the original name. In addition, a new name for one of the five occupying courts was a more cost -effective solution to meet the needs of the region. The current San Tan Regional Center name, on the other hand, is not reflective of the regional boundaries of the four courts that occupy the center. The Regional Center name change was more consistent wi th the overall purpose. MCJC Staff discussed the purpose of the naming changes and potential names with the associated Justices of the Peace and members of the Board of Supervisors. These proposed names are consistent with the rationale of the modificatio ns and would enhance public access to justice. The cost of the Downtown Justice Court name change would be $4,000. This cost includes internal wayfinding (directional, office doors, courtrooms, etc.). San Tan Regional Center name change would cost $22,91 5 and will replace building signage and monument sign. Maricopa County Justice Courts will fund the cost of the name changes out of the Judicial Court Enhancement Funds: Fund 204. We respectfully request the Board of Supervisors approve the above listed c hanges. The effective date of the name changes, if approved, will be 1/1/2024. (C-24-24-000-X-00)

53. MOU WITH MOLINA HEALTHCARE, INC. Approve a Memorandum of Understanding (MOU) between Molina Healthcare, Inc. (“MH”) and MARICOPA COUNTY by and through its DEPARTMENT OF CORRECTIONAL HEALTH SERVICES, (“CHS”). The purpose of this MOU is to establish a collaborative protocol, as described in Section III for effective communication, coordination and continuity of care as outlined in AHCCCS Medical Policy Manual Policy1022 and Policy 1040, for individuals eligible for services provided by MH who are also served by CHS. This MOU shall in no w ay change, modify, or amend the contract between AHCCCS and MH and does not create liability from one party to the other by a party's failure to comply with the protocol. Should any information within this MOU conflict with any terms or conditions within t he AHCCCS contract, the AHCCCS contract shall prevail. This MOU shall begin upon approval by the Maricopa County Board of Supervisors and shall terminate one year thereafter unless otherwise terminated or amended as provided herein. DEPARTMENT OF HOMELAND SECURITY GRANT MONEY FOR SECURING THE CITIES PROGRAM Approve and accept additional grant funds from Department of Homeland Security, Grant No. 20CWDSTC00016-04-00 in the amount of $2,175,000. This grant provides assistance in developing regional radiological/nuclear detection programs and integrating them into a national detection architecture. The grant award begins on Septe mber 25, 2020 and ends October 31, 2031. The Department has an approved Indirect Cost rate of 11.98%. Due to obligated project costs EM will be able to recover $232,689 . The grant award is reoccurring. There is no match requirement for this grant. Maricop a County does not have to fund any additional costs for the program. The grant award is a non-mandated function for This grant award is non-competitive. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, an d therefore, expenditure of the funds is not prohibited by the budget law. 62. AMENDMENT TO LEASE AGREEMENT WITH BOYS & GIRLS CLUB OF THE VALLEY, INC. L7339 Approve and execute this Sixth Amendment to Lease Agreement between Maricopa County (“Lessee”) and Boys & Girls Club of the Valley, Inc. (“Lessor”) dated August 18, 2003, as amended. Space is utilized by the Head Start Program, consisting of approximately 740 square feet of classroom space, playground facility and parking located at 44 North Oak, Gilbert, Arizona, 85233. The Amendment addresses the following: 1. Revises the term of the Agr eement: The term of the Agreement shall commence upon full execution of this Amendment and expires August 31, 2028. 2. Lessee shall pay $5,100 on an annual basis, payable quarterly, upon receipt of electronic invoice, in the amount of $1,275 plus rental tax. 3. Revise Section 11 which addresses Agreement renewal term for an additional four-year term, with annual rent t o remain unchanged at $5,100 annually. In the event of expiration of the Agreement, Lessor hereby grants to Lessee the right of continued occupancy of the property as a “hold over tenant” on a “month to month” basis for up to six (6) months at the rent in effect at the time of expiration, payable monthly. 4. Revise Section 18 to update Agreement's Points of Contact. The Amendment also addresses the following Sections: 23) This Agreement may be executed in two or more counterparts, each of which shall be deemed an original but all of which together shall constitute one and the same instrument. Electronic signatures shall have the same force and effect as original signatures. 24) The Assistant County Manager for Maricopa County and/or the Real Estate Direct or shall administer this Agreement, including the execution of documents. 25) This Agreement, as amended, is subject to cancellation pursuant to the provisions of A.R.S. 38-511. This Agreement may be terminated by Lessee at the end of any fiscal year due t o non-appropriation of funds without penalty or liability to Lessee. Lessee's county and state fiscal years end June 30th federal fiscal year ends September 30th. Lessor and/or any of its employees, agents, officers, directors, members, successors or assig ns hereby waives any and all rights to bring any claim against Lessee or its employees, agents, officers, directors, members, successors or assigns from or relating in any way to Lessee's termination of this Agreement pursuant to this Section 25. Funding for this Amendment shall be provided through the grant from the U.S. Department of Health and Human Services (DHHS)/Administration for Children and Families (ACF), Office of Head Start (OHS), Grant No. 09CH012079/C-22-22-174-X-00. IGA WITH CITY OF AVONDALE FOR HOMELESSNESS PROGRAM Approve an Intergovernmental financial Agreement (IGA) between the City of Avondale (“City” or “Subrecipient”) and Maricopa County (“County”), administered by its Human Services Department. The purpose of the Agreement is to expand homelessness services in the Avondale area. The Subrecipient shall perform street outreach services to individuals and families experiencing homelessness, provide shelter, family navigation services and flexible funds. It is anticipated that a minimum of 30 individuals will be provided assistance on a daily basis. The County shall provide the Subrecipient with $262,500 in American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery (ARPA) Funds under the Assistance Listing Number 21.027. The Agreement is retroactive to August 1, 2023, through June 30, 2025. CONTRACT WITH MAYO CLINIC FOR COMMUNITY HEALTH NEEDS ASSESSMENT REPORT Approve a Contract for Service and Business Associate Agreement between Mayo Clinic and Maricopa County by and through its Department of Public Health for participating in a Community Health Needs Assessment (CHNA). Mayo Clinic shall pay the County for the services described for a total not-to-exceed amount of $46,800. The term of this Contr act is from July 1, 2023, through June 30, 2026. The Contract may be extended for one (1) additional month, not to exceed a total extended tern of eight (8) months, except that the cost will be subject to renegotiation. The Department of Public Health’s F Y24 indirect rate for the Fee Fund is 18.67%, indirect costs are estimated at $1,573.27 (per year) and are fully recoverable. This contract will provide funds to support MCDPH’s Community Health Needs Assessment (CHNA) aimed to identify the unmet need for health services in the service area and/or proposed service area based on the population served. The Patient Protection and Affordable Care Act (ACA) approved by Congress in 2010 requires hospitals to conduct regular CHNA’s and adopt implementation strate gies to meet the needs identified. Maricopa County Department of Public Health (MCDPH) and the Maricopa County Synapse coalition, a coalition of non-profit and federally qualified health care partners, will work collaboratively to implement a comprehensive assessment of health needs of residents in Maricopa County through this contract. This PO is in the amount of $73,791.74 which brings the not-to-exceed amount to $131,695.74 for the budget period January 1, 2 023, through December 31, 2023. The IGA term is January 01, 2022, to December 31, 2026. This grant award is reoccurring and has been awarded to the department in previous years. It is non-competitive and there is no cash or in-kind match required. The grant award is a mandated function and should it be dis-continued, on-going contributions may be required. This grant deviates from County policy A2505 and does not allow for full indirect cost reimbursement but a maximum of 15% of salaries and employee related expenses. The Department of Public Health’s indirect rate for FY24 is 15.65%. Total indirect expenses based on full award are estimated to be $10,042.09 of which $9,625.01 is recoverable and $417.08 is not recoverable; and, if necessary, will be absorbed by the departments operating budget. Departmental indirect rates are re-established at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure lim itation, and therefore expenditure of revenues is not prohibited by the budget law. IGA WITH CITY OF PHOENIX FOR THE CONSTRUCTION OF A TRAFFIC SIGNAL AT INDIAN SCHOOL ROAD A ND 99TH AVENUE Approve the Intergovernmental Agreement between Maricopa County and the City of Phoenix to assume full responsibility for the traffic signal at 99th Avenue and Indian School Road (TT0738). The intersection of 99th Avenue and Indian School Road is an existing signalized intersection operated by Maricopa County. The City operates traffic signals north and south of Indian School Road on 99th Avenue. Assuming full responsibility for the signalized intersection will allow the City to prov ide uniform traffic management along the 99th Avenue corridor. The traffic signal will need to be upgraded to sustain the increase in traffic volumes. The City will lead the efforts to rebuild the traffic signal at the intersection. Maricopa County will co ntribute $150,000, and private development within the City will contribute the remaining cost of rebuilding the traffic signal. The southwest corner was recently rebuilt to current standards. Development is occurring in Phoenix on the northeast and southe ast corners, and the developers will be responsible for the cost of rebuilding the traffic signals at their respective corners. The City will be responsible for ongoing operations and maintenance costs for the traffic signal. IGA WITH MESA FOR THE STAPLEY DRIVE AND BROADWAY ROAD DRAINAGE IMPROVEMENTS PROJECT Approve IGA FCD 2023A002 for the Stapley Drive and Broadway Road Drainage Improvements Project (PROJECT) for the Construction, Construction Management, Operation & Maintenance between the City of Mesa (CITY) and the Flood Control District of Maricopa County (DISTRICT). The estimated total PROJECT cost is $3,500,000 and will be shared 65% DISTRICT and 35% CITY. The DISTRICT’s estimated share of the PROJECT’s cost is $2,275,000. CITY will be the lead agency for the PROJECT and will operate and maintain the PROJECT. The DISTRICT does not have any operation or maintenance responsibilities. The Stapley Drive and Broadway Road Drainage Improvements Project area is located within the City of Mesa (CITY) in the vicinity of the intersection of Stapley Drive and Broadway Road. The construction of t his PROJECT will consist of storm drains and other conveyance improvements in the vicinity of the Stapley Drive and Broadway Road intersection in Mesa to mitigate flooding caused by the 10-year event. In 2008, the City of Mesa completed a Storm Drain Maste r Plan which identified several storm drain systems within the City that warranted improvement.
