The interest was broken into two segments for the interest earned prior to the final court decision and the “post-interest” earned after the court decision until the actual payment was made. The county is responsible for the post-interest payments. This file format is utilized by the MCDOT road design teams to provide project deliverables that meet established MCDOT CADD standards within MicroStation. MCDOT has used this software platform for a number of years and is an industry standard for DOT agencies nationally. All MCDOT standards have been developed based on the use of this software. Bentley Systems, Incorporated is the only supplier and provider of this software. The original contract was approved by the Board on November 5, 2014 14079-CI under agenda item C-64-15-047-M-00. That approval authorized the expenditure amount of $283,366.77. This amount was estimated to cover cost for FY15, FY16 and FY17. Two increases to the expenditure were authorized for $62,975 (C-64-15-047-M-01) and $3,340 (C-64-15-047-M-02) to cover the remainder of the 3 year contract expiring on 11-30-2017. An additional increase of $343,940 is requested to cover cost for a 3 year renewal option FY18, FY19 and FY20. (C-64-18-069-M-00)

AMENDMENT TO RESOLUTION 2001-01: PERMITS TO WORK IN DEDICATED MARICOPA COUNTY RIGHT-OF-WAY Approve the Amendment to Maricopa County Resolution 2001-01: Permits to Work in Dedicated Maricopa County Right-of-Way. The amendment to the Resolution followed the Enhanced Regulatory Outreach Process and the additional language was approved by the Board of Supervisors on November 8, 2017. This request formalizes the inclusion of the additional language as part of Resolution 2001-01. HB 2365 requires the County to establish rates, fees, and terms for the installation, modification, or replacement by a wireless provider of a utility pole located in a right-of-way; the collocation of a small wireless facility in a right-of-way; and the collocation of a small wireless facility on a county utility pole. Currently the permit fees charged for small cell wireless follow the permit fees outlined in Resolution 2001-01 (Permits to Work in Dedicated Maricopa County Right-of-Way). The average cost for installation of a utility pole with small wireless is currently $414. HB 2365 limits the amount charged to a maximum fee of $100 and a maximum rate of $175. HB 2365 also requires the rate be based on the average fair market value of the County right-of-way that is suitable for the deployment of wireless facilities and utility poles. It requires an ordinance establishing time frames for processing small wireless facility permits. This is accomplished by current Ordinance No. P-30. HB 2365 also requires the County to establish an administrative waiver process for height limitations, undergrounding requirements, and spacing requirements.
