PZ-1. 1080 E. GILBERT DR. TEMPE Case #: Z2016010 Supervisor District: 1 Applicant/Owner: Carolyn Oberholtzer / Gilbert Drive Industrial Partners, LLC Request: Major Amendment to the IND-2 IUPD development standards Site Location: Generally located approximately 600 feet to the east of the northeast corner of Mary St. and Gilbert Dr. in the Tempe area Commission Recommendation: On 5/5/16, the Commission voted 6-0 to recommend approval of Z2016010 subject to conditions ‘a’ – ‘g’: Provided the following conditions are met: a. Development of the site shall comply with the site plan entitled “IUPD Amendment“, consisting of two full-size sheets, dated December 7, 2015, and stamped received February 19, 2016, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “Application for Major Amendment to Approved IUPD Standards”, consisting of 9 pages, dated February 19, 2016, and stamped received February 19, 2016, except as modified by the following conditions. c. The following IND-2 IUPD standards shall apply for the off-site advertising sign: 1. Height of the off-site advertising sign: 54 feet (except that lighting fixtures may extend another four feet above the top of the sign) 2. Maximum sign face area: 672 square feet d. Billboard lighting shall adhere to MCZO Article 1112.3.2. Lighting shall be from the top down and fully shielded. e. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Major Amendment to the IND-2 IUPD standards as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in the development standards for the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the development standards that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Major Amendment. The Major Amendment is granted and reverting to the prior development standards results in the same value of the property as if the Major Amendment had never been granted. This item was continued from the June 8, 2016 meeting. (C-44-16-074-M-00)

Development of the site shall comply with the Zoning Exhibit entitled “Verizon PHO Carpintero”, consisting of three (3) full-size sheets, stamped received February 26, 2016, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “Verizon PHO Carpintero”, consisting of five (5) pages, stamped received January 8, 2016, except as modified by the following conditions. c. The maximum height of the Wireless Communication Facility shall be limited to 70’ (h) including attachments, except for palm fronds/concealment elements. d. Live palms of no less than 10’ and 20’ in height shall be planted in close proximity to the monopalm within 180 days of approval. The live palms shall be maintained and deceased palms shall be replaced so long as the Special Use Permit remains in effect. e. The antenna array diameter shall be limited to 8’ across. All future appurtenances shall protrude no further from the center of the tower than this initial antenna array, and shall maintain integrity of concealment elements. f. The wireless communication tower shall retain the stealth properties as originally designed. Any damaged or missing fronds or branches shall be replaced within 60 days of such damage occurring. g. Future carriers may co-locate on the Wireless Communication Facility if co-location does not increase overall tower height, increase protrusion of appurtenances, or adversely impact concealment elements. Any change to these elements will require an amendment to the Special Use Permit. h. This Special Use Permit shall expire 20 years from the date of approval by the Board of Supervisors, inactivity of the use for a period of 90 or more consecutive days, or upon termination of the use, whichever occurs first. All of the site improvements shall be removed within 60 days of such termination or expiration. i. Major changes to this Special Use Permit shall be processed as a revised application in the same manner as the original application, with final determination made by the Board of Supervisors following recommendation by staff and the Planning and Zoning Commission. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. l. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. This item was continued from the June 8, 2016 meeting. (C-44-16-075-M-00)

The purpose of this amendment is to extend the agreement for a twelve (12) month period. This amendment is effective from July 1, 2016 to June 30, 2017. All other terms and conditions of the Intergovernmental Agreement not amended hereby remain in full force and effect as previously approved and amended. 36. GRANT FUNDS FROM ARIZONA DEPARTMENT OF EMERGENCY AND MILITARY AFFAIRS AND BUDGET ADJUSTMENT Approve and accept grant funds for Fiscal Year 2017 from Arizona Department of Emergency and Military Affairs, (CFDA# 97.042), not-to-exceed amount of $809,810 for the purpose of emergency planning within Maricopa County. The grant award begins on July 1, 2016 and ends on June 30, 2017. The Department of Emergency Management's composite indirect rate is 13.1% and estimated indirect cost recovery is $93,797.62. Additionally, in accordance with A.R.S. §42-17106(B), authorize the following amendment to the FY 2017 Emergency Management (150) Budget: a) Increase the expenditure authority in the Emergency Management (215) Fund, Operating (0000), by $77,144.63 from $951,853 to $1,028,997.63. b) Increase revenue in the Emergency Management (215) Fund, Operating (0000), by $77,144.63 from $951,853 to $1,028,997.63. This increase is needed because the Fiscal Year 2017 budget was developed with only the grant application amount of $732,665.37 included within the revenue and expenditure totals. The actual awarded amount is $809,810 which adds an additional $77,144.63 to the Fiscal Year 2017 revenue and expenditure amounts. The Emergency Management Performance Grant (EMPG) Program provides federal funds to assist state, local, tribal and territorial governments in preparing for all hazards, as authorized by Section 662 of the Post Katrina Emergency Management Reform Act (6 U.S.C. § 762) and the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended (42 U.S.C. §§ 5121 et seq.). Title VI of the Stafford Act authorizes FEMA to make grants for the purpose of providing a system of emergency preparedness for the protection of life and property in the United States from hazards and to vest responsibility for emergency preparedness jointly in the federal government and the states and their political subdivisions. 38. AMENDMENT TO EMPLOYER ENROLLMENT AGREEMENT WITH PUBLIC SAFETY PERSONNEL RETIREMENT SYSTEM FOR CANCER INSURANCE PROGRAM FOR PROBATION OFFICERS Approve an amendment to the original item that will allow for probation officers Judicial Branch employees participating in the Probation Officer Retirement Program as officers of the court the same privilege to coverage as county detention officers now have to participate in the Public Safety Personnel Retirement System (PSPRS) Cancer Insurance Program, pursuant to HB 2074 (Fifty-Second Legislature, Second Regular Session). The PSPRS Cancer Insurance Program is designed to assist members with out-of-pocket expenses that arise while undergoing cancer treatment that may not be covered by other insurance. Arizona law requires coverage be afforded to firefighters and peace officers (including Deputy Sheriffs), and that the premiums be paid by the employer. The Program presently covers all Sheriff law enforcement personnel who meet the definition of “peace officer” as set forth in A.R.S. § 38-641. In light of recent legislative changes to A.R.S. § 38-642 and A.R.S. § 38-644, however, PSPRS now administers for public employers an extended, voluntary aspect of the Cancer Insurance Program for corrections and detention officers in CORP designated positions. PSPRS sets the criteria for participation and annual premium. The Program is voluntary, and eligible detention officers employed by the Maricopa County Sheriff’s Office who wish to participate will be responsible for paying the Program’s annual premium to PSPRS via a payroll deduction. House Bill 2074 (Fifty-Second Legislature, Second Regular Session) amended the applicable statutes to extend participation in the Cancer Insurance program to Judicial Branch employees who participate in the Probation Officers Retirement Program. The Presiding Judge of the Superior Court has communicated her decision to allow eligible employees of the Judicial Branch in Maricopa County to participate in the Cancer Insurance Program. 39. COMPETITION IMPRACTICABLE PROCUREMENT WITH OPENGOV, INC. TO PROVIDE REPORTING TRANSPARENCY WEBSITE Approve a Competition Impractical Procurement, Maricopa County Procurement Code, MCI-351, with OpenGov, Inc. in the amount of $746,986 over a three year term ($338,246 in year 1, $204,370 annually for years 2 and 3) to support the OpenGov web-based platform. Also, approve repurposing funding in the amount of $702,000, approved by the Board of Supervisors on March 9, 2016, for purposes of legacy network maintenance, to partially fund this contract. Other accumulated savings in the FY 2016 Office of Enterprise Technology budget will cover the remaining funding requirement. OpenGov software is a web-based platform that will provide financial and non-financial information to both internal and external users. It provides an intuitive, user-friendly interface that allows users to easily access the County's financial and budgetary information. Over 1,000 governments around the nation have launched the OpenGov platform in an effort to make government finances more transparent, build civic engagement and increase community trust. The software makes it easy for users to see financial and non-financial data in both a graphical/visual format as well as raw numbers, enabling simple analysis of trends over time as well as side by side comparisons. On March 9, 2016, the Board of Supervisors approved NTE funding of $702,000 for increased costs associated with SmartNet maintenance in the FY 2016 Operating Major Maintenance program. The earlier than anticipated removal of legacy network equipment and related maintenance costs, along with other expenditure savings, has resulted in a forecasted $800,000 in savings in the Office of Enterprise Technology FY 2016 budget to cover the cost of this contract. 40. TRANSFER OF EXPENDITURE AUTHORITY In accordance with A.R.S. Section 42-17106(B), approve the transfer of Operating and Non Recurring expenditure authority between the Non Departmental Grants Fund and the Technology Infrastructure Fund in the amount of $1,012,000 and $300,000 respectively, also approve an increase in the Operating Revenue Budget of the Technology Infrastructure Fund. a) This action will require an adjustment increasing the FY 2016 Office of Enterprise Technology (410) Technology Infrastructure Fund (681) Operating (0000) revenue budget by $788,000; b) This action will also require an expenditure appropriation adjustment decreasing the FY 2016 Non Departmental (470) Non Departmental Grants Fund (249) Operating (0000) by $1,012,000 and increasing the FY 2016 Office of Enterprise Technology (410), Technology Infrastructure Fund (681), Operating (0000) by $1,800,000; c) This action will also require an expenditure appropriation adjustment decreasing the FY 2016 Non Departmental (470) Non Departmental Grants Fund (249) Non Recurring (0001) by an amount not to exceed $300,000 and increasing FY 2016 Office of Enterprise Technology (410), Technology Infrastructure Fund (681) Non Recurring (0001) by an amount not to exceed $300,000; d) Also offsetting revenue and expenditures adjustments in County Eliminations (980) Elimination Fund (900) Operating (0000) in the amount of $788,000. These increases are due to the increased demand in customer driven work orders and carrier provided services as well as increased voice network infrastructure expenditures. The additional revenue from charges for parts and services and the Technology Infrastructure Fund (681) fund balance will offset some of the increased expenditures, and the remainder will come from fund balance. Approval of this action will allow the Office of Enterprise Technology to meet the expenditure obligations in FY 2016. (C-41-16-014-M-00)

The term of the Agreement is effective July 1, 2016 thru June 30, 2017. The funding amount is not-to-exceed $52,028. This Agreement is renewable for up to one (1) additional twelve (12) month extension (including lesser parts thereof). This Grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 10% indirect cost reimbursement as delegated in the Grant Agreement. MCDPH indirect rate for FY2016-2017 is 15.1%. The full indirect costs are estimated at $7,142 of which $4,730 is recoverable and $2,412 is unrecoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Funding for this grant will be provided by First Things First and will not affect the County general fund. (C-86-16-113-3-00)
