Development of the site shall be in substantial conformance with the Site Plan entitled “Shield RV & Boat Storage“, consisting of 1 full-size sheet, dated April 9, 2020 and stamped received April 13, 2020, except as modified by the following conditions. b. The applicant must contact the City to review any traffic impact, right-of-way dedication, and permitting or roadway improvement requirements. Provide evidence of concurrence by the City prior to final approval of the building plans. 3. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 4. Johnson Blvd. and Meeker Blvd., in the Sun City West area Commission Recommendation: On 3/12/20, the Commission voted 7-0 to recommend approval of Z2019130 subject to conditions ‘a’ – ‘i’: a. Development of the site shall be in substantial conformance with the Zoning Exhibit entitled “Beth Emeth Congregation – Zone Change Exhibit,” consisting of 1 8.5 x 11-inch sheet, stamped received February 3, 2020, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Beth Emeth Congregation Rezone Request”, consisting of 4 pages, dated January 27, 2020 and stamped received February 18, 2020, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. A traffic impact study must be submitted with any future entitlement application (i.e. plan of development). 3. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. d. All future buildings subject to noise attenuation as per ARS § 28-8482(B). e. The master developer shall notify future homeowners that they are located within the state-defined “territory in the vicinity of a military airport” with the following language: “You are buying a home or property in the ‘vicinity of a military airport’s described by State of Arizona statute ARS §28-8481. Your house should include sound attenuation measures as directed by State law. You will be subject to direct over flights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes over 200,000 flight operations per year, at an average of approximately 170 overflights per day. Although Luke's primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight training areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. Such notification shall be recorded on all Final Plats, be permanently posted on not less than a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and conveyance documents. For further information, please check the Luke Air Force Base website or contact the Maricopa County Planning and Development Department.” f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. g. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. i. CC&Rs shall be recorded in association with the subject property and shall include an age-restriction as outlined below. It shall be the responsibility of the Homeowners’ Association to enforce the CC&Rs. Failure to comply with this Condition of Approval will be considered substantial noncompliance with this zone change approval and grounds for the Planning and Zoning Commission to consider revocation of approval of the zone change and for the site to revert back to its original Rural-43 zoning designation. An age restriction shall be recorded in CC&Rs associated with the subject property prior to issuance of the first building permit on the subject property that states: “All dwelling units on the subject property will be occupied by at least one (1) person not less than 55 years in age and no person 18 years or younger will be allowed to reside there for longer than 90 days.” Additional Comments According to the applicant, discussions with representatives of the neighborhood opposition have resulted in an agreement to implement certain limitations on the R-5 development standards. On June 24, 2020 Ken Told (Brookside HOA Representative) Brian Halhead (Indian Wells HOA Representative) and Jordan Colbert (Beth Emeth Congregation Authorized Agent/Applicant) signed a “Good Neighbor” agreement to withdraw all 40 of the letters of objection that were submitted by members of those two HOAs if conditions were added to the approval of Z2019130 to stipulate a maximum building/structure height of 30 ft., a rear (west) building setback of 40 ft. and limitations on off-site lighting were implemented under a future Plan of Development. Because this agreement results in the withdrawal of all 40 of the Letters of Objection, the Super-majority vote no longer applies. These new conditions ‘j’ and ‘k’ are in addition to conditions of approval ‘a’ – ‘i,’ which were recommended for approval by the Commission. Staff recommends the Board motion for approval with inclusion of conditions ‘j’ and ‘k’ as follows to address the concerns raised by area residents. j. Any future Plan(s) of Development for the subject property shall include a maximum building/structure height of 30' and a minimum setback of 40' from the northwest property line. k. All outdoor lighting shall be shielded and directed downward below the horizontal plane to ensure there is no illumination of nor light trespass onto adjacent properties and there shall be no illuminated signs. Development of the site shall be in substantial conformance with the Military Compatibility Permit entitled “Cross-Dock Facility“, consisting of 5 full-size sheets, dated February 14, 2020, and stamped received February 14, 2020, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Falcon – Military Compatibility Permit Narrative”, consisting of 32 pages, dated February 14, 2020 and stamped received February 14, 2020, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. The owner/applicant shall be responsible for the improvements along Camelback Road as required by the City of Goodyear-approved Traffic Impact Study. 2. Prior to issuance of any construction permits for any public Right-of-Way improvements on APN 501-61-006C, an intergovernmental agreement between Maricopa County, the City of Glendale and the City of Goodyear must be executed, or an alternative plan for construction shall be approved, with respect to road improvements along Camelback Road. Construction of all on-site and off-site infrastructure improvements must be completed prior to issuance of a temporary certificate of occupancy or certificate of occupancy. 3. CLOMR approval by the FCDMC is required prior to issuance of and building/grading permit for development within a designated floodplain, including driveway access and road improvements along Camelback Road. 4. Prior to issuance of any construction permit(s) on APN 501-61-006C, an easement must be recorded through APN 501-61-006B to demonstrate legal access to the subject site. 5. Detailed Grading and Drainage Plans will be required to be submitted for issuance of any building/grading permits associated with the site and Camelback Wash relocation improvements and site development. 6. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards; Floodplain Regulations for Maricopa County; and the MCDOT Roadway Design Manual. d. The following Maricopa County Environmental Services Department (MCESD) condition shall apply: 1. Approval To Construct (ATC) approval must be obtained prior to any construction permit approval e. The applicant/property owner shall submit a ‘will serve’ letter for fire protection services for the project site. A copy of the ‘will serve’ letter shall be required as part of the initial construction permit submittal. f. All buildings subject to noise attenuation as per ARS § 28-8482(B). g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the MCP. The MCP enhances the value of the property above its value as of the date the MCP is granted and reverting to the prior zoning results in the same value of the property as MCP had never been granted. h. Prior to approval of the temporary certificate of occupancy or certificate of occupancy, the applicant shall provide the Maricopa County Planning and Development Department with an executed service agreement (“will serve” agreement) with Liberty Utilities certifying that the proposed project has been provided with connection to water and sewer service. i. The following Military Compatibility Permit (MCP) standards shall apply: 1. Maximum Building Height: 60’ 2. Maximum Light Pole Height: 110’ 3. Front and Street Side yards: 20’ (adjacent to Camelback Road), 15’ (adjacent to internal collector streets), 10’ (adjacent to internal local streets) 4. Side yard: 15’ 5. Rear yard: 15’ 6. Front/Rear Setback from LDN Noise Contour Lines: 0’ 7. Maximum Lot Coverage: 60% (of Individual Parcel) 8. Minimum Lot Area: 35,000 sq. ft. 9. Screening: 8’ Tall Chain Link Fence with or without 3 strands of barbed wire above 8’ 10. Signage: Per MCZO Section 1403 or Section 1404 11. ADA Parking Spaces: to be provided at a 2% ratio j. The MCP is applied to restrict the use of the site. Until such time as the site is served by sewer, uses on the site shall only be those acceptable to the Maricopa County Environmental Services Department (MCESD) that can be accommodated by septic systems. Connections to a public water system and public sewer system shall be required prior to establishment of any use that requires potable water. k. Except for local deliveries, development of the site shall include driveway design and/or signs that direct truck traffic (vehicles greater than 10,000 lbs.) to and from the site west along Camelback Rd. Additional Comments: The Commission recommendation included the addition of a condition ‘k’ to limit truck traffic and mitigate the potential adverse impact of truck traffic on residential neighborhoods to the south in Goodyear and to the east in Goodyear and Litchfield Park. DRUG, GANG, AND VIOLENT CRIME CONTROL GRANT FROM THE ARIZONA CRIMINAL JUSTICE COMMISSION Approve receipt of grant funds from the Arizona Criminal Justice Commission (ACJC) through the FY 2020-2021 Drug, Gang, and Violent Crime Program in the amount of $807,390, which includes: $578,748 in Federal funds under CFDA 16.738 and $228,642 in State funds. AMENDMENT TO INTERAGENCY SERVICE AGREEMENT WITH THE ARIZONA DEPARTMENT OF HEALTH SERVICES Approve Amendment 1 to the Interagency Service Agreement (ISA) Project CTR040227, approved January 30, 2019, in agenda number C-50-19-049-3-00. This amendment is effective when signed. It provides for contracted subrecipients and increased funding, replacing the original amount of $225,000 designated for 4 quarters that began February 1, 2019. The new funding amount is $300,000, $50,000 of which is for capital equipment funding. The purpose of this ISA is to stop Unlawful Medical Marijuana Trafficking. All other terms and conditions remain the same. The funding award is re-occurring. The Sheriff's Office indirect cost rate for FY 2021 is 14.6% applicable to the additional award amount of $300,000 less capital expenses of $50,000, and less estimated subrecipient expense of $200,000 for an indirect cost base of $50,000 and indirect costs of $7,300. Up to 10% of the indirect costs are allowable by the terms of this Agreement ($730) and the department requests a waiver so that 100% of the funding can be applied to direct program costs. $730 in indirect costs will be absorbed by the General Fund. There is no match requirement and there are no future or ongoing contributions required after the grant period ends. This is a competitive award and it supports the MCSO public safety mandate. The project funds overtime equipment and training to MCSO and subrecipient law enforcement agencies with responsibility for the regulation of activities within the local jurisdiction that fall outside of AMMA (Arizona Medical Marijuana Act) and under A.R.S. Title 13, including but not limited to, unlawful marijuana trafficking taking place outside of registered nonprofit medical marijuana dispensaries by persons that are representing themselves to cardholding patients and the public as acting within the scope of AMMA; as well as services related to the dispensaries or cultivation sites, including activities at dispensaries or cultivation sites that fall outside of an/or violate the Arizona Medical Marijuana Act. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. COMPETITION IMPRACTICABLE WITH NETSIAN TECHNOLOGIES GROUP (WILSON ELECTRIC) Approve a Competition Impracticable with Netsian Technologies Group (Wilson Electric) to purchase Milestone Systems, a video management software (VMS), which provides a fully scalable product specifically designed for high security surveillance in the amount of $115,063, excluding certain taxes, and any additional labor or materials required by change order or by the local jurisdiction having authority at the time of inspection. This is an enhanced camera security system and replaces the current system in the Sheriff's Headquarters building, which is unreliable and no longer meets MCSO's security needs. Existing pathways and cabling will be used. Netsian is the only local authorized reseller for Milestone Systems VMS product as stated by Milestone. The MCSO has purchased Milestone previously for two divisions (Special Investigations and the ACTIC). Milestone is a proven VMS and the MCSO has trained staff to operate this system effectively. Over the years the MCSO has purchased four (4) other VMS manufacturers, none of these provide the tools and flexibility which Milestone offers or the reliability that is essential in this building. ASPCA COVID-19 EMERGENCY RELIEF GRANT AGREEMENT Approve the acceptance of grant funds from the American Society for the Prevention of Cruelty to Animals (ASPCA) in the amount of $30,000 to support the installation of shade structures over the sidewalks and other areas where County shelter animals are moved. The grant award begins upon execution and ends on December 1, 2020. Authorize the Chairman to sign the Grant Acceptance Agreement and authorize the Animal Care and Control appointed authority and/or designee to sign other grant-related documents, such as reporting requirements, etc., as applicable. In accordance with A.R.S. §42-17106(B), authorize the increase of revenue and expenditure authority in Animal Care and Control (D790) Animal Care and Control Grant Fund (573) Non-Recurring Non-Project (NRNP) appropriation group by $30,000. APPROVE MICROSOFT ENTERPRISE AGREEMENT EXPENDITURE Approve the expenditure of an amount not-to-exceed $26,953,204 with Microsoft over the next three fiscal years and authorize the Chief Procurement Officer to sign the County’s Enterprise Agreement (EA) and all related Enrollment Agreements for County departments/agencies. The purpose of the County’s EA is to ensure continued and authorized licensing of Microsoft products including Windows, Office, Exchange (email), and SharePoint. The Agreement will be in effective from August 1, 2020 until July 31, 2023. The current EA with Microsoft expires on July 31, 2020, therefore the renewal is necessary to ensure continued and authorized licensing of Microsoft products including Windows Operating Systems, Office Applications, and Office 365 Features and Tools which include email, SharePoint and OneDrive. The EA is the result of extensive analysis completed by the Microsoft EA Subcommittee led by the Office of Enterprise Technology and comprised of members of other departments including the County Attorney's Office, Sheriff's Office, Clerk of the Superior Court, Superior Court, Transportation, and the Assessor's Office. RESOLUTION FOR DECLARATION OF OFFICAL INTENT TO REIMBURSE FOR PURPOSES OF SECTIONS 103 AND 141-150 OF THE INTERNAL REVENUE CODE OF 1986 Authorize the Chairman to approve and execute the Resolution, which constitutes a Declaration of Official Intent to Reimburse required for the issuance of tax-exempt securities to reimburse prior expenditures, related to the construction, acquisition and equipping of County capital projects scheduled for Fiscal Years 2020-21, 2021-22, and 2022-23. The County is anticipating issuing tax-exempt obligations to finance capital projects in the Capital Projects Fund (Fund 443). The maximum original amount of obligations expected to be issued is $76,500,000. Exhibit A shows the proposed capital project expenditures by anticipated fiscal year. The County reasonably expects to reimburse the expenditures with proceeds of a tax-exempt borrowing. The Department of Finance and Budget Office have determined a need for the County to issue tax exempt securities to finance the construction, acquisition and equipping of County capital projects scheduled for Fiscal Years 2020-21, 2021-22, and 2022-23. Proceeds of the borrowing will be deposited into a Capital Projects Fund (Fund 443) to track expenditures and for arbitrage compliance. Projects financed with proceeds of the borrowing will be individually tracked. The benefit to the County for issuing long-term debt obligations is debt payments are exempt from the ELR. AGREEMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR WEATHERIZATION ASSISTANCE PROGRAM Approve revenue Agreement between Arizona Department of Housing (ADOH) and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for ADOH to provide funding to the County to administer the Weatherization Assistance Program. ADOH will provide the County with Low Income Home Energy Assistance Program (LIHEAP) funds in the amount of $1,027,180 and Department of Energy (DOE) funds in the amount of $697,698 for a total Agreement amount of $1,724,878. The funding period of availability is July 1, 2020 to June 30, 2021. The funds will be utilized to provide weatherization measures in dwellings occupied by low-income households in Maricopa County outside of the City of Phoenix and the City of Mesa. ADOH contracts with the County on an annual reoccurring, non-competitive basis for service delivery of the Weatherization Assistance Program. The Human Services Department utilizes the provisional indirect rate of 22.2% by the U.S. Department of Health and Human Services for FY2021 for salaries and employee related expenses. The total Agreement funds are $1,724,878 (DOE $697,698 and LIHEAP $1,027,180) of which $82,407.53 (DOE $47,292.96 and LIHEAP $35,114.57) is for salaries and benefits. The total estimated indirect costs are $18,294.47 (DOE $10,499.04 and LIHEAP $7,795.43), and fully recoverable. Receipt of the funds from ADOH does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provides a benefit to the citizens by providing assistance to low income residents with weatherization measures to reduce their energy burden and improving health and safety concerns. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and Therefore, expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. Acceptance of this Agreement will not impact the County General Fund. CONTRACT WITH AREA AGENCY ON AGING, REGION ONE, INCORPORATED FOR SENIOR SERVICES Approve a financial Contract for services between Area Agency on Aging, Region One, Incorporated (“Area Agency”), and Maricopa County administered by its Human Services Department. The purpose of the Contract is for the County to provide case management services and facilitate services to assist eligible seniors and adults with disabilities to maintain independence in their homes. Area Agency shall provide the County with a Contract amount of $2,173,172 for service delivery. The Contract term is July 1, 2020 through June 30, 2021 and shall be effective upon approval and signature by both Parties. Funding period of availability shall begin July 1, 2020 to June 30, 2021. Area Agency contracts with the County on an annual reoccurring, non-competitive basis to provide Senior Adult Independent Living (SAIL) services to eligible individuals currently living at home that may require assistance to reduce the probability of placement in nursing homes. The Human Services Department approved provisional indirect rate for FY2021 is 22.2% from the U.S. Department of Health and Human Services for salaries and employee related expenses. The Agreement funding amount is $2,173,172 of which $1,688,315 is for salaries and employee related expenses. The estimated recoverable indirect rate costs are $374,806 and fully recoverable. This grant award was non-competitive, and this award is the 2nd year of a five (5) year project period. The grant funds are reoccurring for the project period that began on July 1, 2019 thru June 30, 2024. The budget period for the funding begins on July 1, 2020 thru June 30, 2021. Funding for Grant No. 09HP000200 was non-competitive and was awarded to Maricopa County because the County had been a recipient of a prior Early Head Start program grant. The purpose of the grant is for the County to provide Early Head Start program services to children ages 0 to 3, supporting families to promote healthy development and to promote school readiness. The grant requires a 20% non-federal share (NFS) match of the total approved project costs. The total required NFS for FY2021 is $673,423.00 for the budget period of July 1, 2020 thru June 30, 2021. NFS is generated through in-kind donations of goods and services as well as parent volunteering. Upon approval of receipt of funds, the grant amount for the project period shall be increased to $5,387,382. The services provided under this grant are not a mandated function but provides a benefit to the citizens by providing eligible children with high quality care and education by integrating Head Start performance measures. The approved Early Head Start enrollment is 160 infants and toddlers (0 to 3- year old’s). Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and Therefore, expenditure of the revenues is not prohibited by the budget law. This Grant award does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The District and County collectively are referred to as the “Parties” and individually as a “Party.” The purpose of this Agreement is to establish the process for collaboration between the Parties to provide services to preschool children, including children with disabilities as defined in A.R.S. § 15-761, ages three years old to kindergarten-eligible five years old, in compliance with federal and state laws and regulations, and in accordance with District policies and the Improving Head Start for School Readiness Act of 2007 (42 U.S.C. §§ 9801, et seq.). 71. APPLY AND ACCEPT EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/ DRUG ENFORCEMENT ACCOUNT BYRNE FUNDING Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/Drug Enforcement Account (DEA) in the amount not-to-exceed $196,232. The department budgeted $194,215 through the normal annual budget process. Grant funds will be used to partially fund the salaries of attorneys providing legal representation for defendants with drug related charges. The grant award supports mandated legal representation per the United States Constitution. The grant award is competitively pursued and other eligible agencies may or may not apply for this grant award. The grant award begins on July 1, 2020 and ends on June 30, 2021. The Public Defender indirect rate for FY2021 is 14.66%. Unrecoverable indirect costs are estimated to be $28,768. The grant award is reoccurring and has been awarded to the department for the past 30years. The cost of the positions supported by this grant for FY2020-21 total $385,704. If awarded, the grant will cover up to $196,232 and the remaining amount (which includes the in-kind match requirement) will be absorbed by the department’s general fund budget. CONTRACT FUNDING FROM ARIZONA DEPARTMENT OF HEALTH SERVICES FOR COMMUNITY HEALTH NURSING CONSULTING SERVICES Approve funding letter dated June 23, 2020, to contract ADHS17-154596, High Risk Perinatal Program (HRPP) Community Health Nursing (CHN) Consultant Services, between the Arizona Department of Health Services (ADHS) and Maricopa County, by and through its Department of Public Health (MCDPH). The amendment adds funds in the amount of $15,000 for the period July 1, 2020 through June 30, 2021. The HRPP CHN Consultation Services RFP award is reoccurring and has been awarded to the Department since 2016. This grant does not require an in-kind match, indirect cost is fully recoverable and ongoing cash contributions are not required. The grant award is not a mandated function but provides a benefit to the citizens by providing guidance, education, and standardization to NICP Community Nursing Contractors in the implementation of community nursing services for the critically ill/premature newborns enrolled in the NICP program. The award is competitive. There are no costs that will need to be absorbed by the department’s operating budget. MCDPH indirect rate for FY20-21 is 18.8%. Full indirect costs are estimated at $2,374 all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. SOLE SOURCE CONTRACT WITH HOLOGIC FOR RAPID IDENTIFICATION TESTS KITS Approve a Sole Source Contract between Maricopa County by and through its Department of Public Health (MCDPH) and Hologic to provide FDA approved tests kits for the clinical lab services division. A Sole Source contract is necessary because Hologic is the only company that offers an FDA approved nucleic acid-based culture identification system capable of identifying Mycobacterium tuberculosis complex, M. kansasii, M. gordonae, M. avium complex, M. avium and M. intracellulare. The MCDPH laboratory has been using these probes for several years and has the equipment and instrumentation required for testing. The Sole Source contract term will be effective from August 31, 2020 through August 30, 2023 and allows for two (2) one (1) year extensions. Clients also receive referrals to applicable social services and community resources. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR EMERGENCY PREPAREDNESS PROGRAM Approve Amendment 8 to Intergovernmental Agreement (IGA) Agreement No. ADHS17-133194, Emergency Preparedness Program (EPP) between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health (MCDPH), Office of Preparedness and Response (OPR). Of the total Price Sheet, $2,257,890 was approved previously. The amendment provides an additional $252,808 for the COVID-19 response and is for the budget period March 5, 2020 through March 15, 2021. Funds can be used to cover pre-award costs dating back to January 1, 2020. The amendment also provides $1,720,093 for Public Health Emergency Preparedness (PHEP) activities for the budget period July 1, 2020 through June 30, 2021. The IGA term began July 1, 2016 and ends June 30, 2021. The COVID 19 portion of this award is emergency funding and it is unknown at this time whether it will be reoccurring. The Emergency Management grant has been awarded to MCDPH for several years and is expected to continue. 10% in-kind or soft match is required and the OPR program tracks and reports. Ongoing cash contributions are not required. This is not a mandated function though it does provide a benefit to the citizens by strengthening the readiness of the community to prepare for, respond to, and recover from this public health emergency. The funding was not competitive. Maricopa County Department of Public Health’s Indirect Rate is 18.8% for FY21. Full indirect is allowable and estimated at $312,210. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. 87. CHANGE ORDER NO. 11 WITH COMBS CONSTRUCTION COMPANY, INC. Approve Change Order No. 11 to allow MCDOT to compensate the Contractor a negotiated amount as settlement of claimed inefficiencies and other financial damages incurred during a 7-month portion of contract time between November 19, 2019 and June 17, 2020, due to unanticipated utility conflicts. This Change Order includes a time extension of 136 calendar days and establishes a new completion date of 11/30/20 (currently 7/17/20), for the cumulative schedule impact associated with the subject inefficiencies of this Change Order No. 11 and the previous Change Order No. 10. Contract No. 2018-034 was executed on September 12, 2018 in the amount of $20,069,707.53 for improvements to MC 85 between 75th Ave and the 95th Ave alignment, and along 83rd and 91st Aves, both north and south of their intersection with MC 85. The majority of the roadway work during this subject 7-month portion of contract time (11/19/19 to 6/17/20) involved constructing the west half of 83rd Ave for 800’ north of MC85; and the north half of MC85 from 79th to 87th Aves; and included roadway earthwork, storm drain pipeline, traffic signals, street lighting, concrete curb/driveways/sidewalk, and pavement structure. This roadway work was underlain by significant existing utility infrastructure of various types (communication, natural gas and electric), of which many were encountered at unexpected locations and depths, during not only the underground work but also the roadway construction activities. The unexpected and conflicting utility conditions brought about delays and lost production to the associated construction activity and the project as a whole while the conflicts were mitigated. The Contractor itemized and presented their claimed losses to MCDOT prior to, and at two meetings of 6/3 and 6/10/20 with MCDOT Management, which concluded with this negotiated, agreed upon settlement. This Change Order extends the contract time 136 calendar days for the cumulative schedule impact associated with the subject inefficiencies settlement of this Change Order No. 11 and the previous Change Order No. 10. 88. CHANGE ORDER NO. 12 WITH COMBS CONSTRUCTION COMPANY, INC. Approve Change Order No. 12 to allow MCDOT to compensate Contractor for full and complete compensation for all inefficiencies and financial damages their subcontractor incurred as a result of utility conflicts encountered during construction of a SRP Irrigation 42” pipeline and for the performance of extra work as directed. Per plan, the widening of 83rd Avenue to the south of MC85, between Stations 404+00 and 412+00, caused a section of existing SRP Irrigation 42” pipeline currently outside of the roadway to be within the new roadway widening limits. Therefore, this 735-foot-long section of Class III RGRCP pipeline was to be replaced with new stronger Class V RGRCP on the same vertical line and grade. During construction, it was discovered that the designed vertical line and grade of the new pipeline was set to a deeper depth than the existing pipeline. Therefore, two utility crossings, Southwest Gas and CenturyLink, coincidently not shown on the plans, which crossed underneath the existing pipeline, were now in direct conflict with the new pipeline. This caused delays resulting in standby cost for equipment and inefficiencies for the crew which resulted in this entire operation taking four days longer to complete. This change order compensates the subcontractor for the equipment idle time and impacts to their productivity for an average manpower and equipment cost of four crew days. This change order also compensates the same subcontractor, fully and completely, for performance of additional work as directed on other existing SRP Irrigation infrastructure on 83rd Avenue, south of MC85. This work included pavement removal, irrigation pipeline and structure excavation, the construction of a 42” RGRCP pipe collar, and cement slurry backfill to pavement subgrade. 104. APPROVE REAL PROPERTY PURCHASE DOCUMENTS Approve and authorize the Chairman to execute a Purchase Agreement and Escrow Instructions for the purchase of that certain real property located between West Madison and West Jackson Streets and South 4th and 5th Avenues in Phoenix, Arizona from Downtown Phx Storage LLC, a Delaware limited liability company (DPS), and Downtown Phx Storage II, LLC, a Delaware limited liability company (DPS II), and authorize the Chairman to sign all other documents approved by legal counsel required to purchase the properties. This item is located in Supervisory District 5. On April 8, 2020 the Board authorized the County’s contracted Real Estate Broker to send a Letter of Intent to purchase the properties described as Maricopa County Assessor Parcel Numbers (APN) 112-19-022B, 112-19-119B, 112-19-022C, and 112-19-976B (located adjacent to the County’s Downtown Campus) for the purchase price of fourteen million dollars ($14,000,000.00) (C-78-20-010-3-00). This agenda will authorize the Chairman to execute all documents to consummate the purchase and accept the property conveyance. The combined site contains approximately 89,911 square feet (SF) of land, and, once seller demolition activities are complete, will contain one (1) single-story building (12,820 rentable SF) and a parking canopy. The County’s purchase includes the condition that APN 112-19-022B (the south half of the block) is delivered within six (6) months of the close of escrow as a vacant graded, fenced lot (all costs included in purchase price), that the County has ninety (90) days to conduct its due diligence and address any findings with the seller, and that closing will not occur prior to one hundred twenty (120) days after the opening of escrow or thirty (30) days after seller has completed the demolition of the damaged building on APN 112-19-022B. Two (2) million dollars ($2,000,000) will be held back at close of escrow until all demolition and site stabilization on APN 112-19-022B is complete. (C-78-20-010-3-01 )

The City proposed the Project for the District’s evaluation under the District’s Small Project Assistance Program for Fiscal Year 2021. This IGA is proposed in accordance with the terms of the Small Project Assistance Program, adopted by the Board under Resolution FCD 2009R003A (C-69-09-062-6-01). The Project will reduce the flood hazard to several residential properties and streets in the vicinity that have experienced historic flooding. This Agenda Item impacts Supervisorial District 2.
