Habitable structures (office trailer) must be elevated to comply with the Floodplain Regulations for Maricopa County. 4. Applicant is responsible for coordination of any offsite and/or intersection improvements that may be required with the City of Peoria due to the site’s proximity to their jurisdiction. 5. Work/improvements within the power line easement on the site is subject to approval by the owner of said easement. 6. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 7. Based on the conceptual design nature of the information submitted, changes to the site layout may be necessitated by the final engineering design of the site’s drainage infrastructure. 8. Detailed Grading and Drainage (Site Development) Plans must be submitted with the application for Building Permits e. This special use permit is valid for a period of 10 years and shall expire on December 8, 2031, or upon termination of the use for a period of 90 or more days, whichever occurs first. All site improvements associated with the special use permit shall be removed within 90 days of such expiration or termination of use. f. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. g. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. The access easement inside of the roadway easement along the east boundary of the site shall be surfaced with decomposed granite from the paved driveway to the north to the site’s southern boundary to minimize dust pollution. e. The existing five parcels of the site shall be combined into one parcel prior to submission of any building permits. f. The existing Federal Patent Easements and west roadway easement (MCR# 2020-708344) on the site shall be abandoned prior to submission of any building permits. g. The following R-5 RUPD development standards shall apply: 1. Minimum front yard of three feet. 2. Minimum rear yard of three feet. 3. Minimum interior side yard of three feet. 4. Minimum street side yard of three feet. 5. Required guest parking of zero percent. 6. Maximum height for residential perimeter wall signs of eight feet. h. A Plan of Development is approved subject to site plan entitled “Villages at Pleasant Village” consisting of five full-size sheets, dated September 27, 2021, and stamped received September 30, 2021. The Plan of Development may be amended administratively under separate application as long as the amendment complies with the established RUPD development standards as approved by the Board of Supervisors. i . Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this zone change as set forth in the Maricopa County Zoning Ordinance. j. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. k. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The master developer shall notify future homeowners that they are located within the state-defined “territory in the vicinity of a military airport” with the following language: “You are buying a home or property in the ‘vicinity of a military airport’ as described by State of Arizona statute ARS §28-8481. Your house should include sound attenuation measures as directed by State law. You will be subject to direct over flights and noise by Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes over 200,000 flight operations per year, at an average of approximately 170 overflights per day. Although Luke's primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight training areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base's normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends.” Such notification shall be recorded on all Final Plats, be permanently posted on not less than a three foot by five foot sign in front of all home sales offices, be permanently posted on the front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and conveyance documents. Such notification shall be recorded on all Final Plats, be permanently posted on not less than a 3 foot by 5 foot sign in front of all home sales offices, be permanently posted on the front door of all home sales offices on not less than an 8½ inch by 11 inch sign, and be included in all covenants, conditions, and restrictions (CC&Rs) as well as the Public Report and conveyance documents. f. The following R1-6 RUPD PAD development standards shall apply: 1. Maximum rear yards of 15-feet. 2. Minimum lot size of 5,175 sq. ft. 3. Minimum lot width of 45-feet. 4. Average lot area per dwelling unit of 8,000 sq. ft. 5. Maximum lot coverage of 60 percent. g. The following R1-7 RUPD PAD development standards shall apply: 1. Maximum rear yards of 15-feet. 2. Minimum lot width of 55-feet. 3. Average lot area per dwelling unit of 9,000 sq. ft. 4. Maximum lot coverage of 60 percent. h. The following R1-10 development standards shall apply: 1. Minimum front yards of ten feet. 2. Minimum side yards of five feet. 3. Minimum street side yards of five feet. 4. Minimum rear yards of 20 feet. 5. Minimum lot width of 75 feet. 6. Maximum lot coverage of 50 percent. i . There shall be at minimum three-foot-high shielded bollard lighting in pocket parks and amenity areas to minimize light pollution and maintain safety in these areas of the subdivision. j. All residential lots that abut Tract ‘A’ of White Tank Foothills Phase 1B shall be limited to a single story, excluding Lots 87 through 94 of Parcel 3.19. k. There shall be a ten-foot-wide multi-use trail along Northern Ave. outside of the ultimate right-of-way and public utility easement. l. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Zone Change as set forth in the Maricopa County Zoning Ordinance. m. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. n. Use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Zone Change. The Zone Change enhances the value of the property above its value as of the date the Zone Change is granted and reverting to the prior zoning results in the same value of the property as if the Zone Change had never been granted. Development shall comply with the Development Master Plan Narrative Report entitled “White Tank Foothills”, dated August 12, 2021, and stamped received August 20 , 2021, including all exhibits, maps, and appendices, except as modified by the following conditions. b. The master developer shall be responsible for the construction of all public and private on-site roads within the Development Master Plan. Further, the applicable homeowner’s association shall be responsible for the maintenance and upkeep of all private roads, public open spaces and facilities, washes, parks, roadway median landscaping, landscaping within public rights-of-way, and all pedestrian, bicycle, and multi-use paths. d. Landscaping of all common areas and open spaces, except for identified recreational areas shall consist of indigenous and or low water use species. e. The Development Master Plan shall be developed sequentially as depicted on the phasing diagram contained in the narrative report. f. The total number of residential dwelling units of White Tank Foothills Phase 3 shall not exceed 770 dwelling units. Overall, the total number of residential dwelling units for the entire White Tank Foothills master community shall not exceed 1,746 dwelling units. To help ensure compliance, the cumulative number of dwelling units completed to date, in relation to the identified limit, shall be identified on all plats. g. The master developer shall notify all future residents that they are not located within an incorporated city or town, and therefore will not be represented by, or be able to petition a citizen-elected municipal government. Notification shall also state that residents will not have access to municipally managed services such as police, fire, parks, water, wastewater, libraries, and refuse collection. Such notice shall be included on all final plats, be permanently posted on the front door of all home sales offices on not less than an 8-½ by 11-inch sign, and be included in all homeowner association covenants, conditions, and restrictions (CC&Rs). h. All park facilities shown on plats shall be completed concurrently with residential development. Park facilities and amenities shall be identified on all applicable plats. i . Not less than 51.41 acres shall be reserved for active and passive open space. Further, the project shall have not less than five pocket parks and one off-site park as depicted on the parks plan exhibit in the narrative. Further, not less than six pocket parks and off-site park shall be provided. At the time of each preliminary plat submission, the master developer shall include a description of the status of the cumulative open space acreage and park numbers with respect to the requirements of this condition. A description of the types of recreational amenities that will be included in the pocket parks and off-site park shall be submitted with all preliminary plats. j. Unless otherwise agreed to in writing by the applicable school districts, not less than 15-acre school site and a minimum of 15 acres shall be reserved. Said school shall not front on to arterial streets. k. Development phasing shall assure two access points are provided. l. Bike lanes shall be required on all arterial and collector streets as specified in the Maricopa County Bicycle Transportation System Plan. m. Prior to approval of the final plat, a total half-width 65-foot right-of-way shall be dedicated for Citrus Rd. and Northern Ave. n. Prior to approval of the final plat, a total half-width 55-foot right-of-way shall be dedicated for Perryville Rd. with a ten-foot roadway and utility easement shall be provided adjacent to the right-of-way. o. Prior to approval of each applicable final plat of any subdivision within a phase containing Olive Ave., the developer will be obligated to construct (or post the necessary financial assurances) the ultimate half-width roadway for the extent of Olive Ave. in that phase. p. Prior to approval of each applicable final plat of any subdivision within a phase containing Citrus Rd., the developer will be obligated to construct (or post the necessary financial assurances) the ultimate half-way width roadway for the extent of Citrus Rd., in that phase. q. AQ-2017-010-RULE 600 (EMERGENCY EPISODES) Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on the proposed revision of Maricopa County Air Pollution Control Regulation VI - Rule 600 (Emergency Episodes) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed revisions to the rule and to approve submission of the amended rule as a revision to the Arizona SIP. Rule 600 establishes criteria to determine when air pollutant concentrations are significantly elevated and establishes appropriate control actions to prevent the occurrence of ambient air pollutant concentrations which would cause significant harm to the health of persons. The Maricopa County Air Quality Department is proposing to amend Rule 600 to align the rule with the episode level criteria and significant harm levels with the criteria listed in Arizona Administrative Code R18-2-220 (Air Pollution Emergency Episodes) which was amended by the Arizona Department of Environmental Quality in March of 2019. 32. AGREEMENT WITH ROBIN SCHAEFFER CONSULTING LLC. Approve a Competition Impracticable Agreement (“Agreement”) between Robin Schaeffer, LLC (“Contractor”) and Maricopa County (the “County”). The purpose of the Agreement is to create and implement a pilot nursing workforce practice readiness program for senior nursing students. This model would enhance the partnership between education and practice using nursing faculty and specially trained practice-based nurse preceptors. Funding of this Agreement is through the American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds under the CFDA number of 21.027. The Agreement amount shall not exceed $750,000. Agreement term begins November 15, 2021 and will expire December 31, 2024. AGREEMENT WITH US ENVIRONMENTAL PROTECTION AGENCY TO ADMINISTER STATE CLEAN DIESEL GRANT PROGRAM Approve an agreement between the US Environmental Protection Agency (USEPA) and Maricopa County through the Air Quality Department (MCAQD) in the not-to-exceed amount of $525,392. This agreement is funded by a grant from the USEPA, Award ID# 98T26201, which increases the MCAQD federal funding by $525,392 dated September 27, 2021. The grant award is reoccurring and has been awarded to the department since 2016. The cash or in-kind match is not applicable, indirect cost is fully recoverable, ongoing cash contributions not applicable. The grant award is not a mandated function but provides a benefit to the citizens by supporting grant, rebate, and loan programs which are designed to achieve significant reductions in diesel emissions. The grant award is non-competitively bid. There are no costs that will need to be absorbed by the department’s operating budget. The Agreement is effective from October 1, 2021 to September 30, 2023. MOU WITH ARIZONA HUMANE SOCIETY Approve the Memorandum of Understanding (MOU) regarding the process outlining outline responsibilities and major actions to support the Maricopa County Emergency Operations Center (MCEOC) response and recovery operation, when requested, specifically as it relates to providing assistance and services to animal victims of disaster; as well as other services for which cooperation may be mutually beneficial. This agreement is effective upon signature of the parties and the term is three (3) years from the date of signature. This is a non-financial agreement. Per the MOU, the Arizona Humane Society will, to the extent feasible and within its discretion, support or carry out animal housing operations in the following areas: - Under Emergency Support Function (ESF) 6, act as lead agency regarding animal sheltering, evacuations and search and rescue for domestic household pets only. - Rescue of abandoned or stranded domestic household pets, by authorized and qualified personnel. - Offer guidance and support regarding coordination of domestic household animal food and supplies. - Under ESF 8, provide veterinary exams for domestic household pets that have been impacted by the disaster. - Act as lead agency to respond, set up and operate an animal decontamination center in the event that domestic household pets have been exposed to hazardous material. - Act as lead agency to respond to a Palo Verde Generating Station emergency response at the Reception and Care Center (RCC) to include temporary on-site kennel, monitoring of household pets and service animals, and decontamination of household pets and service animals if necessary. - Manage the receipt, sorting, transportation, storage and distribution of all donated good associated with domestic animal sheltering and/or search and rescue as it pertains to domestic household pets. - Establish a Shelter Lead(s) who will act as a liaison to the Red Cross, MCDEM, the Emergency Operations Center (EOC) and any other associated organizations. - Compassionate removal of unclaimed domestic household animals who don’t survive the disaster. - Participate in the planning, training, and exercise initiatives of Maricopa County Department of Emergency Management when requested. 65. AMENDMENT TO THE AGREEMENT WITH COMMUNITY BRIDGES, INC. FOR THE PROVISION OF RAPID REHOUSING SERVICES Approve Amendment No. 3 to a financial Agreement (“Agreement”) between Community Bridges, Inc. (“Subrecipient”) and Maricopa County the (“County”) administered by its Human Services Department. The Purpose of this Amendment is to address the following: A. Add that the County shall provide the Subrecipient with an additional $150,000 in ESG Program Year/Fiscal Year (PY2021/FY2022) funding for rapid rehousing services. Upon approval of this Amendment the total funding amount for this Agreement shall be: 1. $300,000 ESG, 2. $400,000 ESG-CV, and 3. $460,000 ESG-CV2. The total available funding under the Agreement now is increased from $1,010,000 to a not-to-exceed amount of $1,160,000. B. Revise the Contract Amount on page 1 of the Agreement to $1,160,000. C. Period of funding availability for Amendment No. 3 funds shall expire on June 30, 2022. D. Regarding Section 4 (Compensation): 1. Replace Paragraph 1.0 (Funding) in its entirety with the following: 1.0 FUNDING 1.1 Funding for this Agreement is through the following federal Catalog of Federal Domestic Assistance (CFDA) programs: $300,000 – 14.231 Emergency Solutions Grant (ESG ); $400,000 – Emergency Solutions CARES Act (ESG-CV); and $460,000 - Emergency Solutions CARES Act (ESG-CV2). 2. 66. AMENDMENT TO THE AGREEMENT WITH COMMUNITY BRIDGES, INC. FOR HOMELESS NAVIGATION SERVICES Approve financial Amendment No. 5 to the Agreement (Agreement) between Community Bridges, Inc. (Subrecipient) and Maricopa County (County) administered by its Human Services Department. The purpose of the Agreement is for the Subrecipient to provide Navigation services for individuals experiencing homelessness in Maricopa County. The Subrecipient and the County shall be referred to as the Parties. The purpose of the Amendment is to address the following: 1. Extend the Agreement term from July 1, 2021, through December 31, 2022. 2. Revise Section III (Work Statement) Paragraph A (Scope of Work), to add an additional Scope of Work hereinafter referred to as a “Outreach Scope of Work”, attached and incorporated into the Agreement. The Outreach Scope of Work activities include outreach and navigation services for individuals who are experiencing homelessness or at risk of becoming homeless in the West and East Valley of Maricopa County. Services are intended to mitigate crises, assist with diversion, and connect to long-term preventative and chronic condition care management. 3. 67. IGA WITH CITY OF EL MIRAGE Approve an intergovernmental Agreement (“Agreement”) between City of El Mirage (the “Subrecipient”) and Maricopa County Human Services Department, (“County”). The Agreement's purpose is for the Subrecipient to construction a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. The COVID-19 pandemic required socially distancing measures to be implemented to prevent the spread of the COVID-19 virus. The path has been an unofficial/undefined way for children to walk to school, employees to walk/bike to work, and residents to exercise. The current 4-feet wide path is not wide enough to prevent the spread of airborne viruses. The new multi-use trail will be a defined space and will include lighting which will encourage more residents to be active and provide safe connectivity to community amenities. Beneficiaries of this project will be City of El Mirage residents. The County will provide the Subrecipient with U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds in the amount not-to-exceed $500,000. Agreement term shall begin December 1, 2021 and will expire March 31, 2023. Per Section 2 (Special Provisions), Paragraph 13.0 (Additional Certifications and Warranties), Subparagraph 13.1.18, also request authorization for the Chairman of the Board of Supervisors to approve and execute upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representative for the Subrecipient. The Refugee award is reoccurring and has been awarded to MCDPH in previous years. It does not require an in-kind match and indirect costs are fully recoverable. Should the grant cease, ongoing contributions should not be required. This grant award was not competitive. AMENDMENT TO IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR STD CONTROL SERVICES Approve an Amendment to Intergovernmental Agreement (IGA) Contract No. CTR040486 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health to provide continued funding for the Sexually Transmitted Diseases (STD) Services Program. The amendment is in the additional amount of $2,155,494.00 for the period January 1, 2022 through December 31, 2022, for the budget period total of $5,972,913.45. The term of the Contract is January 1, 2019 through December 31, 2023. The STD grant award is reoccurring and non-competitive and has been awarded to the Department for several years. There is no cash or in-kind match required and indirect cost is fully recoverable. Should this grant be discontinued, ongoing cash contributions may be required as this is a mandated function. At this time, there are no costs to be absorbed by the department’s operating budget. The Department of Public Health indirect rate for FY22 is 17.97%. Indirect costs are estimated at $328,340.00 and are fully recoverable. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. RFP CONTRACTS FOR MASS IMMUNIZATION SERVICES AND ADMINISTRATION Authorize the Chairman of the Board of Supervisors to execute, in a form approved by the County Attorney’s Office, two retro-active contracts developed under a re-solicitation of a Public Health Request for Proposal, PH RFP 200234. This re-solicitation for ‘Mass Immunization Services and Administration’ is related to the COVID-19 response. The two chosen Contractors, Premier Lab Solutions, LLC and Revive Community Health, are qualified to provide services by the Public Health Department Evaluation Committee. The Contracts are to be for a term of one (1) year and 10 months, beginning on November 3, 2021 and ending August 18, 2023. The County may, at its option and with the agreement of the Contractor, renew and term of this Contract for additional terms up to a maximum of two (2) additional years. This is to coincide with the existing Contractors that are already providing these services under the previous solicitations. The Department of Public Health is requesting these original contracts to be signed by the Chairman of the Board of Supervisors and authorize any subsequent amendments to be signed by the Maricopa County Office of Procurement Service’s Chief Procurement Officer or authorized representative. IGA WITH THE CITY OF LITCHFIELD PARK FOR IMPROVEMENTS TO CAMELBACK ROAD FROM 145TH AVENUE TO DYSART ROAD Approve the Intergovernmental Agreement between Maricopa County (County) and the City of Litchfield Park (City) for improvements to Camelback Road from 145th Avenue to Dysart. Under this Intergovernmental Agreement, the City will act as the lead agency for all aspects of the design and construction of the Project. The City has plans to improve Camelback Road from 145th Avenue to Dysart Road to four through lanes, bike lanes, turn lanes, raised landscaped median, sidewalk, curb and gutter, streetlights, and improved drainage facilities. The County will have a financial contribution in an amount not to exceed of $3,511,000. The funds are budgeted in FY2022 Transportation Department (640) Transportation Capital Project Fund (234) Five Year Program in the Transportation System Management Project, sub-project TT0707. Construction is planned for fiscal years 2022 and 2023. The hearing date is set for Wednesday, January 12, 2022 at 9:30 a.m., 205 W. Jefferson, Phoenix, AZ 85003. 2. Pursuant to A.R.S. § 48-261(C), approve a bond in the amount of $250 to be filed with the Board by the persons proposing the district to cover cost incurred by the County. 114. AUTHORIZE PAYMENT OF ATTORNEYS’ FEES AND RELATED NON-TAXABLE COSTS IN THE MATTER OF MELENDRES V. PENZONE, CV2007-02513 (D. ARIZ) Approve the Settlement related to attorney’s fees and costs for period of September 1, 2020 through February 28, 2021 in the amount of $263,543.18 between Maricopa County and Plaintiff(s), in Melendres v. Penzone, concerning District Court (Ariz.) No.CV2007-02513- GMS. Authorize the Chairman to sign any necessary documents upon review and approval as to form by assigned legal counsel. Direct the Department of Finance to issue payment according to the settlement awarding and allocating attorney’s fees and related non-taxable costs in this matter. The total amount of the payment shall be allocated as specifically outlined in the settlement agreement. Additionally, pursuant to A.R.S. §42-17106(B), approve the transfer of expenditure authority in the FY 2021 budget as follows: a. Under the Families First Coronavirus Response Act, employees who tested positive for COVID-19 could use up to 80 hours of Emergency Leave with Pay from 4/1/2020 till 12/31/2020. On 1/27/2021, the Board of Supervisors approved up to 80 hours of Emergency Leave with Pay (prorated for part-time employees) for employees who test positive for COVID-19 (C-31-21-057-X-00). On 5/19/2021, the Board of Supervisors extended the use of this Emergency Leave with Pay until 12/31/2021 (C-31-21-057-X-01). Employees who tested positive for COVID-19 from 1/1/2021 till 1/27/2021 were not eligible as they were not covered by the Families First Coronavirus Response Act nor the Emergency Leave with Pay approved by the Board of Supervisors on 1/27/2021. Allowing the previously approved leave to go retroactive to 1/1/2021 will cover those employees who tested positive during those few weeks. COMPETITION IMPRACTICABLE CONTRACT WITH NORTH BLACK CANYON HOSPITALITY, LLC Approve a Competition Impracticable Contract (220181-CI) between North Black Canyon Hospitality, LLC (“Contractor”), and Maricopa County administered by its Human Services Department. The purpose of the Contract is for the County to use 147 hotel rooms to house COVID-19 positive or quarantined individuals experiencing homelessness. Individuals will receive nursing and medical care while located in the hotel. Housing COVID positive homeless individuals in the hotel will reduce the likelihood of spreading COVID 19 and will allow individuals to recuperate in a safe, clean environment. The County will reimburse the Contractor $80 per room per night, $100 per room that is sanitized after the room is vacated. Funds for this Contract will be provided by Catalog of Federal Domestic Assistance (CFDA) 81.135 American Rescue Plan Act (ARPA). The anticipated spend for this Contract shall not exceed $2,600,000. The County will provide the Subrecipient with U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds in the amount not-to-exceed $450,000. B. Scope of Work B -To reconstruct approximately two hundred and fifty (250) feet of existing eight (8) inch sewer lines at two (2) locations along the south side of Papago Street between Washington Street and Cholla Avenue, and to restore existing sewer service that was damaged during the August 2021 flood. The sewer line rehabilitation project will restore the existing sewer service system to pre-flood conditions to ensure continual service to the residents of Gila Bend. Period of funding availability is December 1, 2021 through March 31, 2023. The County will provide the Subrecipient with American Rescue Plan Act (ARPA) funds in the amount not-to-exceed $500,000. 2. The County shall provide the Subrecipient with a total of $950,000 for the project activities. 3. Agreement term shall begin December 1, 2021 through March 31, 2023. 4. Per Section 2 (Special Provisions), Paragraph 13.0 (Additional Certifications and Warranties), Subparagraph 13.1.18, also request authorization for the Chairman of the Board of Supervisors to approve and execute upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representative for the Subrecipient. RESOLUTION FOR THE PIMA ROAD DRAINAGE CHANNEL PROJECT Adopt Resolution FCD 2021R003 for the Pima Road Drainage Channel Project (PROJECT), authorizing the Director of the Flood Control District of Maricopa County (District) to include funds for PROJECT implementation in the District’s current and future Five-Year Capital improvement Program; and to negotiate and prepare intergovernmental agreements and/or agreements with identified cost-share with City of Scottsdale (CITY). The Pima Road Drainage Channel was identified in the Pinnacle Peak South Area Drainage Master Study as being a necessary solution to mitigate the flood hazards in the area. The PROJECT will provide 100-year flood protection to 56 structures and will reduce the frequency of flooding and flood damage for 73 structures. This is a joint project with the CITY and the estimated total PROJECT cost is $8,500,000. The cost will be shared 50/50 with the City making the District’s estimated share of the PROJECT cost $4,500,000.
