Development of the site shall be in substantial conformance with the site plan entitled “A New Leaf #Z2023053“, consisting of one full-size sheet, dated December 18, 2023, and stamped received December 19, 2023, except as modified by the following conditions. Staff may determine slight refinements to remain in substantial conformance with the approved site plan. Minor and major amendments to the site plan will be determined in accordance with Chapter 3 of the Maricopa County Zoning Ordinance. b. Development of the site shall be in substantial conformance with the narrative report entitled “A New Leaf East Valley Men’s Center”, consisting of six pages, dated December 18, 2023, and stamped received December 19, 2023, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. If/when the existing septic system fails, if there is no reserve location on the site, the existing septic system must be exacted and replaced, including select fill for the entire leach bed system. 2. Engineering review of planning and/or zoning cases is for conceptual design only. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 3. Prior to issuance of initial building permits, the applicant must provide a report to Maricopa County Planning & Development and Arizona Game & Fish Department regarding the existence of any animals covered under the Migratory Bird Treaty Act. Prior to issuance of initial building permits, written confirmation will be required from the emergency fire protection jurisdiction having authority that the facility has been designed in accordance with their regulations and requirements, and that emergency fire protection service will be provided to the facility. Prior to issuance of the certificate of occupancy, local fire protection jurisdiction review and approval will be required. f. Prior to issuance of initial building permits, a lot split shall be processed to create a single, separate parcel matching the zone change area. g. The following Planning Engineering conditions shall apply: 1. Without the submittal of a precise plan of development, no development approval is inferred by this review, including, but not limited to number of proposed building lots/units, drainage design, access and roadway alignments. These items will be addressed as development plans progress and are submitted to the County for further review and/or entitlement. 2. A Preliminary Grading and Drainage Plan and Drainage Report are required with the Plan of Development. The Maricopa County Zoning Ordinance (MCZO) required that all commercial submittals be prepared by a Civil Engineer registered in the State of Arizona. (MCZO 1205.7.2) 3. For retention volumes required, please see section 6.10.5 of the Maricopa County Drainage Policies and Standards Manual for the equation, V=C*(P/12)*A. The 100-year, 2-hour rainfall depth (P) in inches can be taken from NOAA Atlas 14. The volumes, using this equation, vary slightly compared to the drainage report and does not affect the overall volume provided. This can be addressed during the Plan of Development. 4. Structures in the floodplain must be elevated to the regulatory flood elevation determined by the engineer. 7. The site is adjacent to lands owned or encumbered by the Flood Control District. In addition to floodplain use permitting, ROW permitting may be required by the District. 8. Please see MCDOT TIS approval attached. A traffic impact study must also be submitted with future entitlement (POD) application(s). 9. Gated access(es) must provide an adequate turnaround area so that vehicles will not back onto public roads. 10. The City of Phoenix maintains a +/- 45’ strip annexation north of Indian School Road. The applicant will be responsible for coordinating with the City to review any permitting requirements for work in their jurisdiction. 11. The subject site is located within the County’s Urbanized Area and thus will require a Storm Water Pollution Prevention Permit (SWPPP) from the County for any disturbance one (1) acre or more. The SWPPP is issued by the County (PND) and will be required prior to issuance of any building permits required for site development. 12. Engineering review of re-zone cases is conceptual in nature. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. h. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. l. A water truck shall be employed to control dust within arenas and on site. m. The operator show notify all persons entering the site that there are private aviation operations in the immediate vicinity via signage at site entrances. n. Events held on site shall adhere to the Board of Supervisors Resolution, December 1980 as applicable which establishes guidelines and conditions for temporary uses. The following conditions shall apply: Security 1. At least one patrolman or security guard for every 500 persons in attendance. Access to Event 2. The applicant shall provide adequate ingress and egress to the premises and parking areas. Traffic guards shall be employed to ensure orderly traffic movement and relieve traffic congestion onto public rights-of-way. Water and Wastewater 3. The applicant shall provide an ample supply of water for drinking and sanitation purposes. APPROPRIATION ADJUSTMENT FOR GRANT FUNDING FROM ARIZONA DEPARTMENT OF HOMELAND SECURITY (230825-01) Approve and authorize the Recorder’s Office for the application of the Homeland Security Grant Program Award administered by the Arizona Department of Homeland Security (AZDOHS) and authorize the Chairman to approve the receipt of any and all such funds awarded. In accordance with A.R.S.42-17106(B), approve a revenue and expenditure appropriation adjustment increasing the FY 2024 Recorder’s Office (360) Recorder Grant Fund (298) Non-Recurring/Non-Project (NRNP) budget in the amount of $235,000. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Funding for this Agreement is provided by AZDOHS and will not affect the County’s general fund. The program will support the continued hardening of Maricopa County’s critical election equipment and data infrastructure. The acquisition of hardware, software, and critical services will harden security for both hard and cyber targets. The request represents the Office's efforts to continue to strengthen elections infrastructure and the mitigation and/or elimination of any security gaps identified during the 2020 election cycle and subsequent audits. Elections remain the cornerstone of American democracy and funding from the AZDOHS Homeland Security Grant Program will aid in the department’s mandate to provide fair, safe, and secure elections. The total amount of funds requested is $235,000. The grant period will cover the periods October 1st, 2023 through September 30th, 2024. The grant does not allow for indirect costs for which the County is eligible. The Maricopa County Recorder’s Office composite indirect cost rate for FY 24 is 22.07% or $51,864.50. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $51,864.50. Nonrecoverable indirect costs will be covered by the departmental general fund budget. This grant is competitive and does not require a match or on-going cash contributions after the grant period end date. The grant award is nonrecurring and has not been awarded to the department in past years. Maricopa County and the Recorder’s Department are eligible to apply for and receive grant funding through various state agencies. 21. ACCEPT GRANT FUNDS FROM THE FLINN FOUNDATION FOR SCHOOL SUPERINTENDENT'S OFFICE Approve the acceptance of grant funds from The Flinn Foundation, in the amount totaling $754,159 for the purpose of bridging the gap between the education sector and the Bioscience and Healthcare industries, promoting Bioscience and Healthcare as potential careers for students, and helping teachers teach and students learn about essential skills required for these careers. The grant award begins on January 1, 2024, and ends on December 31, 2026. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The County School Superintendent Office’s (Office) approved indirect rate for fiscal year (FY) 2024 is 1.43%, and total grant indirect costs are estimated to be $10,784. However, indirect costs were not included in the grant application and will be absorbed in current budget appropriations. The grant award is reoccurring, and The Flinn Foundation has awarded grants to the Office in the past. This new grant will enable the Office to continue and expand educational support programs that benefit citizens by helping students pursue and be prepared for post-secondary education in in-demand career fields. In so doing, the grant will help the Office meet its statutory requirement (A.R.S. §15-302(A)(11)) to collaborate with the department of education to assist school districts, charter schools, and others on curriculum alignment and teacher staff development to improve student performance leading to college and career readiness. The grant award was competitively bid and has an in-kind match requirement for the Office to maintain an Industry-Education Program Partnership Director, educational tools development, teacher professional development training and training delivery, data analytics, marketing, and communications support. The Office will provide this support through current Office staff. Additionally, the grant agreement requires the Office to develop a strategy for program growth and increased impact beyond the grant period. Any ongoing or future costs will be absorbed by the Office’s operating budget appropriation, new fee revenues, grants/donations, and/or special revenue funds. As a result of this funding and pursuant to A.R.S. §42-17106(B), approve an adjustment to the FY2024 County School Superintendent (D370) Schools Grants Fund (715) Operating (OPER) revenues and expenditures budget in the amount of $251,386. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. AGREEMENT WITH THE ARIZONA CRIMINAL JUSTICE COMMISSION FOR ARIZONA CRIMINAL JUSTICE AND TREATMENT IMPROVEMENT PROGRAM - CY2024 FUNDING Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Arizona Criminal Justice Commission, Arizona Criminal Justice and Treatment Improvement Program (AZCJTIP) Agreement Number CJTIP-24-002 in the amount of $350,000 for the award period beginning retroactively on January 1, 2024, and terminating on December 31, 2024. This agreement can be terminated by any of the parties by written notice to the other parties thirty (30) business days prior to termination. This is the first time the Sheriff’s Office has received this funding. There is no match requirement. The Sheriff’s Office indirect cost rate for FY24 is 16.72%, applicable to the award amount of $350,000 with $0.00 in capital expenses for an indirect cost base of $350,000 and indirect costs of $58,520. Indirect costs are unallowable by the terms of this Agreement and $58,520 in indirect costs will be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends. This is a competitive award. This is not a mandated function although it supports the MCSO public safety mandate and provides a benefit to the citizens by providing financial and technical assistance to develop, implement, and/or expand efforts to identify, respond to, treat and support those impacted by illicit opioids, stimulants and other drugs of abuse. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. 28. APPLICATION AND ACCEPTANCE OF FUNDING FROM THE ARIZONA DEPARTMENT OF EDUCATION FOR THE FY2025 INDIVIDUALS WITH DISABILITIES EDUCATION ACT (IDEA) BASIC ENTITLEMENT Approve Application and Acceptance of up to $50,000 in continued grant funding from the Arizona Department of Education, for the FY2024 Individuals with Disabilities Education Act (IDEA) Basic Entitlement. This funding provides contracted special education consulting services for staff training and IDEA implementation along with a variety of contracted professional services for juvenile inmates. The term of this funding is from July 1, 2024 through June 30, 2025. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. This funding award is re-occurring and has been awarded for last twenty (20) years. A cash or in-kind match is not applicable. There is no future or ongoing contribution required following termination of the grant period. The grant award is not competitively bid. The Sheriff’s Office indirect cost rate for FY2024 is 16.72%. Unrecoverable indirect costs associated with this funding are estimated to be $8,360.00. The maximum recoverable indirect cost is estimated to be $6,000; there is a cap of 12% on operating costs. The priority use for these funds is to ensure Maricopa County Jail Education Programs are in compliance with state and federal special education requirements. These funds will be used to contract with special education consultants to work with staff in implementing the IDEA Laws and Regulations, to assist staff in providing transitional services and to assist in special education program improvement efforts. COMPETITION IMPRACTICABLE WITH TELEDYNE FLIR UNMANNED GROUND SYSTEMS, INC Approve a Competition Impracticable (CI) with Teledyne FLIR Unmanned Ground Systems, Inc. in the amount of $114,000 to upgrade and repair existing robot systems. These robot systems are manufactured and provided by FLIR Unmanned Ground Systems, Inc. There are no other systems available on the market that use the same operating systems or allow the ability to combine multiple units onto one controller unit. These robot platforms are a system currently used by the Bomb Squad Bomb Technicians which ensures complete compatibility of both training and usage. This MOU will provide up to $169,400 in funds to support the State Clean Diesel Grant Program and benefit air quality by replacing one 2007 Class 6 diesel shuttle bus with one new 2021 or newer Class 6 CNG low NOx shuttle bus. NEW HOPE AGREEMENT WITH STAY WITH ME ANIMAL RESCUE Approve an agreement between Stay With Me Animal Rescue and Maricopa County, administered by Maricopa County Animal Care and Control, to allow said rescue to transfer animals that have been deemed eligible for the New Hope program. Maricopa County will provide a rabies vaccination, dog license tag, and new owner transfer fee within the first year of transfer for each dog three months of age or older at no cost to the Contractor. The cost for these services is $52 for each animal transferred in FY 2024 and thereafter. Animal Care and Control estimates six (6) New Hope transfers annually, for a total of $312.00 per year, over the term of the agreement. 34. AMENDMENT TO IGA WITH ARIZONA HEALTH CARE COST CONTAINMENT SYSTEM (AHCCCS) Approve Amendment No. 6 to the Intergovernmental Agreement (IGA) between Arizona Health Care Cost Containment System (AHCCCS)-MEDICAID YH16-0018-07 and Maricopa County by and through the Department of Correctional Health Services (CHS). The purpose of this Amendment is to change rates and quarterly estimate of State Match Advance Payments. All other terms and conditions of the Intergovernmental Agreement remain in full force and effect. This is a cost avoidance for Maricopa County, as CHS would be responsible for 100% of the cost if patients are not approved to be AHCCCS eligible, thereby making AHCCCS the payer rather than the County as payor of last resort. This Agreement is entered into pursuant to A.R.S. § 36-2903 to provide AHCCCS with the appropriate State Match in order to pay for Medical Services that qualify for Federal Financial Participation (FFP) provided to Inmates who qualify for Title XIX while they are an inpatient in a non-secure ward of a Medical Institution. APPOINTMENTS OF 2024 MARCH PRESIDENTIAL PREFERENCE ELECTION BOARDS In accordance with state law (A.R.S. §16-531), approve the appointment of election boards and central boards necessary to conduct the March 19, 2024, Presidential Preference Election. The board worker appointments are made by the Elections Director overseeing in-person voting, election services, warehouse operations, and tabulation. ADOPT RESOLUTION FOR THE MARCH 2024 PRESIDENTIAL PREFERENCE ELECTION The list of vote centers and emergency voting centers and their hours of operation are on file with the Clerk of the Board of Supervisors and retained in accordance with LAPR approved retention schedule and are posted on Maricopa County Elections’ website. If a vote center established pursuant to this resolution becomes unavailable and there is not sufficient time for the Board of Supervisors to convene to approve an alternate location for that vote center, the Director of In-Person Voting and Tabulation is authorized to make changes to the approved vote center location and shall notify the public and the Board of Supervisors regarding the change as soon as practicable. The alternate vote center shall be as close in proximity to the approved vote center location as possible. The list of vote centers and emergency vote centers as of February 19, 2024, are listed in exhibits (A) and (B). The Board of Supervisors also authorized the use of drop boxes for the March 19, 2024, Presidential Preference Election. The list of Drop Boxes is included in exhibit (C). The drop boxes will adhere to the security requirements established in the December 2023 Arizona Secretary of State’s Elections Procedures Manual and will be used to accept early ballots. The list of drop boxes and their hours of operation will be on file with the Clerk of the Board of Supervisors and posted on Maricopa County Election’s website. 47. MCTIS PROJECT BUDGET ADJUSTMENT Pursuant to A.R.S. §42‐17106B, authorize the following adjustments to the FY 2024 budget: 1. 48. MARICOPA COUNTY CODE OF CONDUCT (HR2416) REVISION Approve the revisions to the Maricopa County Code of Conduct (HR2416) effective February 7, 2024. This revision updates the political activity section of the Code of Conduct to be consistent with the rules for Classified Employees found in the Employee Merit Rules and clarifies that only service animals are allowed in the workplace. This Policy applies to all employees of Maricopa County-appointed departments as well as the Flood Control District of Maricopa County and the Maricopa County Library District (Special Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on April 11, 2018. AMENDMENT TO THE IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR COMMUNITY ACTION AGENCY PROGRAM SERVICES Approve financial Amendment No. 11 to the Intergovernmental Agreement (Agreement) between Arizona Department of Economic Security (DES) and Maricopa County administered by its Human Services Department (County). DES provides funding to the County for administration of community services. The Human Services Department administers the Community Action Agency Program SERVICES to provide eligible residents with low-incomes with eviction prevention services and crisis navigation. The purpose of the Amendment is to amend the Agreement as follows: A. To revise the Itemized Service Budget for the period of July 1, 2023, through June 30,2024 B. In accordance with the Alert issued on 11/20/2023, the revised allocations are as follows: The total value of the budget is revised from $3,341,569.00 to $4,027,092.36 as detailed in the attached Itemized Service Budget. This amount includes the estimated carryover funding from State Fiscal Year 2023 in the amount of $685,523.36. DES contracts with the County on an annual reoccurring, non-competitive basis for service delivery of the Community Action Agency program activities. Receipt of the funds from DES does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. The services provided under this Agreement are not a mandated function but provide a benefit to the citizens by providing eligible low-income residents with financial assistance and services for economic self-sufficiency. Receipt of the funds from DES does not require in-kind or match funds and there will be no future or ongoing contribution by the County at the end of the Agreement term. The services provide under this Agreement are not a mandated service but provide a benefit to the citizens by providing eligible low-income residents with community and navigation services. The Human Services Department provisional indirect rate for FY2024, approved by the U.S. Department of Health and Human Services is 22.2% for salaries and employee related expenses. The Amendment funds are $685,523.36 of which $0 is for salaries and ERE, therefore indirect costs are $0 and are not subject to indirect cost recovery. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this Amendment through future budget reconciliation. All terms and conditions of the original Agreement and previously approved Amendments shall remain unchanged and in full force and effect. The amendment shall become effective on the date of last signature. The County contracts with local Cities and Towns to provide services at the local level: Avondale, Surprise, Tolleson, Scottsdale, Tempe, Buckeye, Guadalupe and Wickenburg. 52. DEVELOPER AGREEMENT WITH NAC EL MIRAGE HOUSING, LLC Approve the following actions: 1. Approve a financial Developer Agreement (“Agreement”) between Maricopa County, administered by its Human Services Department (“County”), and NAC El Mirage Housing, LLC, an Arizona Limited Liability Corporation (“Developer”). The County and the Developer are collectively referred to here as the “Parties” and individually as a “Party.” The purpose of the Agreement is for the Developer to expand affordable housing availability by constructing a new 45-unit multifamily rental community to be located in Surprise, Arizona. The project will service residents located within Maricopa County in the Urban County Cities of: City of El Mirage, Town of Youngtown, City of Tolleson, City of Avondale, City of Peoria, City of Surprise and any unincorporated areas of Maricopa County West of 67th Avenue. The Developer will provide onsite supportive services, including individualized case management and workforce development services. This project was identified in the HUD-required Annual Action Plan as approved by the Board of Supervisors on March 23, 2022. The County will provide the Developer with $6,140,196 in U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program funds (HOME ARP) under Assistance Listing Number 14.239 and $10,583,125 in American Rescue Plan Act Funds (“ARPA”) under Assistance Listing Number (“ALN”) 21.027 provided to the County by the U. S. Treasury. The total amount to be funded under this Agreement is $16,723,321. The Agreement term shall begin February 28, 2024, and will expire December 31, 2026. 2. 66. AMENDMENT TO IGA WITH MARICOPA COUNTY SPECIAL HEALTHCARE DISTRICT (VALLEYWISE HEALTH) Approve Amendment number one (1) for Intergovernmental Agreement (IGA) C-86-22-145-X-00 between Maricopa County Department of Public Health, Ryan White Program and Maricopa County Special Health Care District, DBA Valleywise Health. This amendment will increase the Agreement Amount from $2,000,000 annually to $3,000,000 annually, for a not-to-exceed amount of $9,000,000. The term of this contract has not been changed and it is from March 1, 2022, to February 28, 2025. The amendment also updates Section III Scope of Work to include two new services (Referrals for Healthcare and Support, and an EHE Infrastructure Development and Expansion of data systems). All other terms and conditions of the original contract shall remain in full force and effect. The purpose of this IGA is to provide medically necessary health care and support services for individuals with HIV infection. The award was competitive and there is no cash or in-kind match required. This is not a mandated service but provides a benefit to the community through enhancing access to a comprehensive continuum of high quality, community-based care for families with HIV/AIDS. If discontinued, ongoing cash contributions should not be required. The Department of Public Health indirect rate for FY24 is 15.65%. Full indirect costs are estimated at $405,966.28 all of which are recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. All program costs are allocated to the grant so there will not be an additional burden on the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. No future or ongoing contributions are required after the grant period ends. The Department of Health’s indirect rate for FY24 is 15.65%. Indirect costs are estimated at $28,417.58, all of which is recoverable. Departmental indirect rates are re-established at the beginning of each fiscal year, future indirect rates will be collected at the corresponding rates. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. Although this is a new IGA, this grant award is recurring and has been awarded to the department for several years. This grant deviates from County Policy A2505 and does not allow for full indirect cost reimbursement, but a maximum of 15% of salaries and employee related expenses. The Department of Health’s indirect rate for FY24 is 15.65%. Total indirect expenses are estimated to be $126,952.80 of which $5,272.80 is not recoverable and will be absorbed by the department’s operating budget. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. The current work activities require the administration of a Dental Sealant Program in Maricopa County. This school based dental sealant program is an evidenced-based, comprehensive strategy that is effective in reducing tooth decay. PURCHASE ORDER FOR IGA WITH ARIZONA DEPARTMENT OF HEALTH SERVICES FOR A CLINICAL SURVEILLANCE AND TESTING PROJECT Approve a retroactive Purchase Order (PO) for Intergovernmental Agreement (IGA) Contract No. CTR045915 between Arizona Department of Health Services (ADHS) and Maricopa County by and through its Department of Public Health. The goal of eGISP (Enhanced Gonococcal Isolate Surveillance Project) is to monitor antimicrobial susceptibility trends in the U.S. The PO is in the not-to-exceed amount of $52,848.00 for the budget period August 1, 2023 through July 31, 2024. The term of this PO is August 01, 2019 – July 31, 2024. This grant is in its last year of it’s 5-year term and it is not certain whether it will reoccur. The award was noncompetitive and there is no cash or in-kind match required. This is a mandated function; should this grant be discontinued ongoing cash contributions may be required. The Department of Public Health indirect rate for FY24 is 15.65%. The full indirect costs are estimated at $7,151.50 all of which is recoverable. Departmental indirect rates are reestablished at the beginning of each fiscal year and the future indirect rates will be collected at the corresponding rates. Program costs not covered by the grant will be subsidized by the MCDPH indirect cost pool. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation therefore expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. (C-86-20-013-3-04)

RATIFICATION OF PURCHASE PRICE Ratify the Real Estate Director’s agreement to a reduction in Purchase Price for the Purchase Agreement and Escrow Instructions (C-78-24-045-X-00) between the County and D23, LLC, previously approved by the Board on December 6, 2023. The original Purchase Price was $11,500,000, however, inspection of the property resulted in a request by staff to reduce the Purchase Price to $11,300, 000. Because of the need to transfer title by an established date certain, the Director agreed to the reduction. The property was transferred to the County on January 31, 2024, and was purchased for use as an office building by Public Health Department. The property is in Supervisory District 3. PURCHASE AGREEMENT AND ESCROW INSTRUCTIONS Approve and execute a Purchase Agreement and Escrow Instructions (PSA) for the purchase of real property and improvements located at 450 S. 5th Avenue, Phoenix, from WIC West Lincoln JV, LLC, a Delaware corporation, and authorize the Chairman to execute all other documents required to purchase the property, including a Prospective Purchaser Agreement with the Arizona Department of Environmental Quality, without further Board action provided the terms are in substantial conformance with the PSA and approved by legal counsel. The purchase price is $4,200,000. The property is being purchased for parking, staging, and other County uses. In accordance with A.R.S. 42-17106(B), approve the following amendments to the FY 2024 budget: 1. Increase the expenditure authority for the Non Departmental (D470) County Improvement COP Series 2023 (444) Downtown Facility (DELF) budget by $1,800,000. 2. Decrease the expenditure authority for the Non-Departmental (D470) Non Departmental Grants Fund (249) Non Recurring (NRNP) Contingency (4711) budget by $1,800,000. These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. LISTING AGREEMENT WITH ROI PROPERTIES, LLC Request the Board to approve and execute a Listing Agreement between Maricopa County (County) and ROI Properties, LLC (ROI) authorizing ROI to list and market real property to the public that has been declared as excess to the needs of the County. The County is authorized to offer up to a 3% brokerage fee pursuant to Resolution 2007R012. Interested buyers procured by ROI will be required to bid at public auction pursuant to A.R.S. § 11-251. LISTING AGREEMENT BETWEEN FLOOD CONTROL DISTRICT AND ROI PROPERTIES Request the Board to approve and execute a Listing Agreement between the Flood Control District (District) and ROI Properties, LLC (ROI) authorizing ROI to list and market real property to the public that has been declared as excess to the needs of the District. The District is authorized to offer up to a 3% brokerage fee pursuant to Resolution 2007R012. Interested buyers procured by ROI will be required to bid at public auction pursuant to A.R.S. § 48-3603. The District utilizes its disposition program on all excess properties to evaluate them for the best potential of sales or leasing, depending on current market information. The properties would be sold at public auction with the minimum bid being market value as determined by appraisal, unless to another agency for public purposes, at market value without auction.
