Non-compliance with the regulations administered by the Maricopa County Environmental Services Department, Maricopa County Department of Transportation, Drainage Review Division, Planning and Development Department, or the Flood Control District of Maricopa County may be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. u. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowners. The granting of this approval is temporary and allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions and stipulations. In the event of the failure to comply with any condition or stipulation, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. v. If a grading permit or construction permit for the facility has not been issued within five (5) years from the date of approval of this Major Amendment, this SUP and the related Comprehensive Plan Amendments (CPA2010012, CPA2010013, CPA2011004, CPA2013005) shall be scheduled for public hearing by the Maricopa County Board of Supervisors, upon recommendation by the Maricopa Planning and Zoning Commission, to consider reverting the zoning to back Rural-190 and the related land use designations to Business Park, Dedicated Open Space and Rural as applicable. w. Prior to issuance of any construction permits or ground disturbance activities, the developer shall provide financial assurance in an amount and form acceptable to the Maricopa County Planning & Development Department sufficient to secure the site, restore any natural areas to their pre-construction state, and to stabilize the entire site in the event the project is abandoned, expires or otherwise becomes defunct. 93. ADDITION TO FLEET OF FIVE BARRICADE TRUCKS Approve the addition of five (5) vehicles to the County fleet for the Transportation Department through the purchase of five (5) new barricade trucks. This equipment is used by the Department’s Traffic Operations section to install work zones to provide essential safety for the traveling public and MCDOT employees. The barricade trucks provide the equipment, supplies and resources necessary to enable MCDOT to establish temporary work zones that allow motorists to safely navigate through construction areas and around hazards, and that provide a safe working environment for MCDOT staff performing maintenance activities. In addition, these vehicles are used to respond to emergencies occurring 24/7 on Maricopa County’s roadways. The barricade trucks will be used by five (5) new employees to be hired in January 2015, and will replace services that are currently contracted at a life-cycle savings to the County of approximately $200,000. Maintenance cost for the barricade trucks will be absorbed within the department’s operating budget. Supervisor District: All (C-64-15-001-M-00)

96. ONE-TIME TEMPORARY ADDITION TO FLEET OF PAINT STRIPER Approve a one-time, temporary addition to the fleet for the Transportation Department of redlined vehicle #45503, Paint Striper, for use as a backup vehicle to maintain production when the primary stripers are down for maintenance. Operations and maintenance are anticipated to be $5,000 and will be covered using MCDOT budgeted funds. This vehicle will be removed from service at the end of its useful life with no funding from the general fund for its replacement. Paint striping trucks have very specialized equipment mounted on a standard 2.5 ton truck. By their nature these pieces of equipment require frequent service, and are out of production approximately 25% of the time. These specialized trucks are not available for rental, resulting in reduced ability to meet production goals and critical maintenance requirements. The extra paint striping truck requested herein is an existing truck that we are requesting be kept in service to support our pavement marking operations. The current paint striper is within its replacement period and is not reliable enough for everyday use, but would work well as an interim backup piece of equipment. Maintenance cost for the paint striper will be absorbed within the department’s operating budget. Supervisor District: All (C-64-15-003-M-00)
