PZ-1. 1080 E. GILBERT DR. TEMPE Case #: Z2016010 Supervisor District: 1 Applicant/Owner: Carolyn Oberholtzer / Gilbert Drive Industrial Partners, LLC Request: Major Amendment to the IND-2 IUPD development standards Site Location: Generally located approximately 600 feet to the east of the northeast corner of Mary St. and Gilbert Dr. in the Tempe area Commission Recommendation: On 5/5/16, the Commission voted 6-0 to recommend approval of Z2016010 subject to conditions ‘a’ – ‘g’: Provided the following conditions are met: a. Development of the site shall comply with the site plan entitled “IUPD Amendment“, consisting of two full-size sheets, dated December 7, 2015, and stamped received February 19, 2016, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “Application for Major Amendment to Approved IUPD Standards”, consisting of 9 pages, dated February 19, 2016, and stamped received February 19, 2016, except as modified by the following conditions. c. The following IND-2 IUPD standards shall apply for the off-site advertising sign: 1. Height of the off-site advertising sign: 54 feet (except that lighting fixtures may extend another four feet above the top of the sign) 2. Maximum sign face area: 672 square feet d. Billboard lighting shall adhere to MCZO Article 1112.3.2. Lighting shall be from the top down and fully shielded. e. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Major Amendment to the IND-2 IUPD standards as set forth in the Maricopa County Zoning Ordinance. f. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. g. The granting of this change in the development standards for the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, the property shall revert to the development standards that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation of the Major Amendment. The Major Amendment is granted and reverting to the prior development standards results in the same value of the property as if the Major Amendment had never been granted. Department requests continuance of this item to the June 22, 2016 meeting in order to meet publication requirements. (C-44-16-074-M-00)

PZ-2. PHO CARPINTERO Case #: Z2015082 Supervisor District: 1 Applicant/Owner: Centerline Solutions on behalf of Verizon Wireless / Land Hill Holdings, LLC Request: Special Use Permit (SUP) for a Wireless Communication Facility (WCF) - 70’ (h) monopalm in the R-4 zoning district Site Location: Generally located at the northeast corner of Hunt Highway and Valencia Ave. in the Queen Creek/Gilbert area Commission Recommendation: On 5/5/16, the Commission voted 6-0 to recommend approval of Z2015082 subject to conditions ‘a’ – ‘l’: Provided the following conditions are met: a. Development of the site shall comply with the Zoning Exhibit entitled “Verizon PHO Carpintero”, consisting of three (3) full-size sheets, stamped received February 26, 2016, except as modified by the following conditions. b. Development of the site shall be in conformance with the Narrative Report entitled “Verizon PHO Carpintero”, consisting of five (5) pages, stamped received January 8, 2016, except as modified by the following conditions. c. The maximum height of the Wireless Communication Facility shall be limited to 70’ (h) including attachments, except for palm fronds/concealment elements. d. Live palms of no less than 10’ and 20’ in height shall be planted in close proximity to the monopalm within 180 days of approval. The live palms shall be maintained and deceased palms shall be replaced so long as the Special Use Permit remains in effect. e. The antenna array diameter shall be limited to 8’ across. All future appurtenances shall protrude no further from the center of the tower than this initial antenna array, and shall maintain integrity of concealment elements. f. The wireless communication tower shall retain the stealth properties as originally designed. Any damaged or missing fronds or branches shall be replaced within 60 days of such damage occurring. g. Future carriers may co-locate on the Wireless Communication Facility if co-location does not increase overall tower height, increase protrusion of appurtenances, or adversely impact concealment elements. Any change to these elements will require an amendment to the Special Use Permit. h. This Special Use Permit shall expire 20 years from the date of approval by the Board of Supervisors, inactivity of the use for a period of 90 or more consecutive days, or upon termination of the use, whichever occurs first. All of the site improvements shall be removed within 60 days of such termination or expiration. i. Major changes to this Special Use Permit shall be processed as a revised application in the same manner as the original application, with final determination made by the Board of Supervisors following recommendation by staff and the Planning and Zoning Commission. Minor changes may be administratively approved by staff of the Planning and Development Department. j. Non-compliance with the Special Use Permit (the site plan and narrative report) or the conditions of approval will be treated as a violation in accordance with provisions of the Maricopa County Zoning Ordinance. k. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Special Use Permit as set forth in the Maricopa County Zoning Ordinance. l. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Special Use Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Special Use Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Special Use Permit. The Special Use Permit enhances the value of the property above its value as of the date the Special Use Permit is granted and reverting to the prior zoning results in the same value of the property as if the Special Use Permit had never been granted. Department requests continuance of this item to the June 22, 2016 meeting in order to meet publication requirements. (C-44-16-075-M-00)

IGA WITH CITY OF PHOENIX FOR MAINTENANCE ON CONSOLE UNITS USED BY ADULT PROBATION IN THE COMMUNICATIONS CENTER Approve an IGA between City of Phoenix and Maricopa County through the Sheriff's Office, in the not-to-exceed amount of $81,000 per year. The purpose of this IGA is to provide hardware maintenance, preventative maintenance, and help desk support for nine (9) consoles, "positions," located in the Sheriff's 911 Center that are used by the County Adult Probation Department. This IGA is effective from July 1, 2015 until June 30, 2017 with up to five annual automatic renewals. In FY 2016 the County Adult Probation Department dispatch function was located to the Maricopa County Sheriff's Office Communications Division/911 Center. The consoles that are assigned to Adult Probation do not meet the emergency criteria for those that are covered by Regional 911 resulting in a monthly service charge per console to the Sheriff's Office by the City of Phoenix. The cost is $750 per month (12) per console (9), for an annual total of $81,000. As a regional 911 Center, the Sheriff's Office will be billed annually for this service and the cost will be passed through to the Adult Probation Department. (C-50-16-105-3-00)

17. APPROPRIATION ADJUSTMENT FOR THE JUVENILE RESTITUTION FUND Per A.R.S. §42-17106(B), authorize the following amendment to the FY 2016 budget: a) Decrease the expenditure authority for the Non Departmental (470) Non Departmental Grant (249) Non-Recurring, Non-Project (0001) in the line "Unreserved Contingency" in the amount of $6,000. b) Increase the expenditure authority in the Juvenile Probation (270) Juvenile Restitution Fund (229) Non-Recurring, Non-Project (0001) in the amount of $6,000. These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenue duly adopted by the Board pursuant to A.R.S. §42-17105. The Juvenile Probation Department has identified a gap in some youth probationers’ ability to earn salary or wages to pay Court Ordered Restitution. The department, through its Juvenile Community Offender Restitution and Public Services (JCORPS) activity, provides youth with opportunities to complete community service projects while earning work credit hours to compensate victims through restitution. This expenditure is of a one-time nature and will be resolved by the end of the 2015-2016 fiscal year. The Juvenile Probation Department proposes to utilize $6,000 in existing fund balance of the Juvenile Probation Department (270) Juvenile Restitution (229) fund. (C-27-16-008-2-00)

18. APPOINT SUPERIOR COURT COMMISSIONER AS SUPERIOR COURT JUDGE PRO TEMPORE In accordance with Arizona Revised Statutes § 12-141, approve the appointment of Court Commissioner Lori A. Ash as a Superior Court Judge Pro Tempore in accordance with Arizona Revised Statutes § 12-141. The appointment will be for the period commencing June 20, 2016 through June 30, 2017. In order to obtain greater flexibility in the use of Court Commissioners, the Superior Court customarily has all Court Commissioners appointed as Superior Court Judges Pro Tempore so they may, on occasion, hear contested matters. This serves the interest of judicial economy and promotes sound caseflow management. Court Commissioner Lori A. Ash would serve as a Superior Court Judge Pro Tempore without any additional compensation other than that to which she is entitled as a Court Commissioner. (C-80-16-016-2-00)

19. APPROPRIATED BUDGET ADJUSTMENT Approve increases in the appropriated budget for the Assistant County Manager's Office (950) Non-Departmental Grant Fund (249) Operating (0000) in the amount of $750,352.67 in revenues and expenditures. This appropriation adjustment brings the Assistant County Manager's Office grant budget to the amount $818,811.67. The appropriation adjustment is necessary because the award amount of the Justice Assistance Grant (JAG) differs from the amount approved in the FY2016 budget appropriation. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. The approval of this budget adjustment does not alter the budget containing the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-95-16-008-G-00)

36. EMPLOYER SHARED RESPONSIBILITY PROVISIONS UNDER SECTION 4980H OF THE INTERNAL REVENUE CODE 1) Approve the following time periods for compliance with regulations on the Employer Shared Responsibility provisions under section 4980H of the Internal Revenue Code: a) For the “annual” look-back period related to service hours to determine full time status of an employee, the “measurement period” will start on April 1st and end on March 31st of the following calendar year; the “administrative period” will start on April 1st and end on June 30th of the same year; and the “stability period” will start on July 1st and end on June 30th of the following calendar year. b) For the monthly “initial” look-back periods for new employees related to service hours to determine full time status, the “measurement period” will start on the first day of the month following hire date and end on the last day of the twelfth full month following hire date; the “administrative period” will start on first day following the end of the “measurement period” and end on the last day of the same month; and the “stability period” will start on the first day of the month following the “administrative period” and end on the last day of the twelfth full month. 2) Approve the assignment of any Employer Shared Responsibility Payment determined to be owed by the IRS, and resulting from employees being classified incorrectly for benefit eligibility purposes, to the departments failing to follow the rules for benefit eligibility prescribed by the Patient Protection and Affordable Care Act. The Maricopa County Benefits Plan document provides that County and Judicial Branch employees are eligible for County-sponsored medical benefits if they are a regular employee employed to work 19 or more hours per week. The 2016-17 medical benefit premiums adopted by the Board of Supervisors provide for two sets of employee rates, one for employees who work 30 or more hours per week and one for employees who work at least 19 hours per week but less than 30 hours per week. Employees hired in temporary status are not offered County medical benefits, even if they are hired to work 30 or more hours per week because by virtue of their temporary status, it is anticipated that the duration of their employment will be less than a year. The Patient Protection and Affordable Care Act (“ACA”) requires Maricopa County and other large employers to make Employer Shared Responsibility Payments for each employee who works 30 hours per week or more during the look-back period, was not offered employer-sponsored medical benefits that are affordable and provide minimum essential coverage, and who subsequently enroll in a medical insurance plan through the Federal marketplace and receive a Federal premium tax credit. The County is required to retrospectively evaluate the hours worked by employees who were not offered medical benefits and determine if any of them actually work an average of 30 hours per week or more and thus trigger the Employee Shared Responsibility requirements. The Federal law allows affected employers to define the amount of time they use for the “look back” period to evaluate employee hours worked. The purpose of this agenda item is to request Board of Supervisors’ approval for the time periods to be used to comply with the Federal law and budgetary responsibility for any Employer Shared Responsibility Payment imposed by the IRS. Effective 7/1/2015 the County will use a look-back measurement method to determine whether an employee is a full-time employee for purposes of coverage under the Maricopa County Benefits Plan. The look-back measurement method is based on Internal Revenue Service (IRS) final regulations under the ACA. The look-back measurement method applies to all County employees. The look-back measurement method involves three different periods: • A measurement period for counting an employee’s hours of service (also called a standard measurement period or an initial measurement period under the regulations); • An administrative period that allows time for Plan enrollment and disenrollment; and • A stability period when the employee is either treated as full-time or non-full-time for Plan eligibility purposes and is covered for benefits (or waived). If an ongoing employee was employed, on average, for at least 30 hours of service per week during the measurement period, the employee is treated as a full-time employee for a set period into the future, known as the stability period. If employees working at least 30 hours of service per week and their dependents are not offered health coverage that provides a minimum level of coverage, the County may be subject to an Employer Shared Responsibility Payment under the IRS regulations for employees that receive a premium tax credit from the federal government for other health care coverage. Departments must accurately classify part-time employees (working less than 30 hours per week) and temporary employees. Employees classified as part-time or temporary that nonetheless work in excess of 30 hours per week for a period of a year may subject the County to an Employer Shared Responsibility Payment. The Amendment reduces Maricopa County’s required Non-Federal Share (NFS). The Human Services Department submitted a waiver to DHHS/AFC/OHS for a reduction to the required NFS in the amount of $1,000,000 from the required $1,122,715. The waiver was approved and the required NFS is now reduced to $122,715. The Federal grant amount remains at $4,490,863 through the January 1, 2015 to June 30, 2016 period. The grant contract period is January 1, 2015 to June 30, 2019. The reduction in the NFS does not impact the grant award. Acceptance of the Amendment NSF amount will not impact the County General Fund. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. This grant does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. § 42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation. The Department provides NFS through in-kind donations. (C-22-15-036-G-03)

54. ADMINISTRATIVE CORRECTION TO DONATION OF TWO MODULAR BUILDINGS TO CATHOLIC CHARITIES AND CATHOLIC CHARITIES NATIVE AMERICAN MINISTRIES Approve the donation of two modular buildings to Catholic Charities and/or its designee the Catholic Charities Native American Ministries is a sub-recipient (delegate agency) to Maricopa County’s federal Head Start grant. The modular buildings were originally purchased by Catholic Charities with Head Start funds and mistakenly titled to Catholic Charities. Thereafter, the County approved without unanimous consent the transfer of the units from Catholic Charities to Catholic Charities Native American Ministries (C-22-11-045-M-00). The approval was in error because the property should have been titled to the County pursuant to the federal law and regulation and the approval referenced the wrong Vehicle Identification Number (VIN) for one of the modular units. Moreover, the transferor should have been Maricopa County, not Catholic Charities and the vote should have been unanimous. The retitling of the modular units in the County’s name pursuant to the direction of the U.S. Department of Health and Human Services was approved by the Board in subsequent agenda items (C-22-14-036-V-00 and C-22-14-036-V-01). The Department now wishes to properly effectuate the transfer to Catholic Charities and/or its designee Catholic Charities Native American Ministries, the two modular buildings, correctly identified as: Unit # VIN# MB004 R65933060A MB011 R65933060B The estimate market value of the units is approximately $7,000. Also approve the removal of the donated units from the County’s Asset Inventory. THIS ITEM REQUIRES UNANIMOUS APPROVAL OF THE BOARD (C-22-11-045-M-01)
