7. AMERIPARK RV, BOAT, VEHICLE & SELF STORAGE FACILITY Case #: MCP2019004 Supervisor District: 4 Applicant / Owner: SimonCRE Saltair IV, LLC / Thomas E. Russell Revocable Trust Request: Military Compatibility Permit (MCP) with a Plan of Development for commercial development of a RV, boat, vehicle and self-storage facility in the Rural-43 MAAMF zoning district. Site Location: Generally located approx. 638’ west of the northwest corner of Bethany Home Rd. and Cotton Ln. in the Glendale area Commission Recommendation: On 10/22/20, the Commission voted 8-0 to recommend approval of MCP2019004 subject to conditions ‘a’ – ‘k’: a. Development of the site shall be in substantial conformance with the Site Plan entitled “Site Plan for AmeriPark RV, Boat, Vehicle & Self-Storage Facility“, consisting of 5 full-size sheets, dated September 15, 2020, and stamped received October 7, 2020, except as modified by the following conditions. b. Development of the site shall be in substantial conformance with the Narrative Report entitled “Narrative Report in Support of a Military Compatibility Permit”, consisting of 7 pages, dated September 16, 2020, and stamped received September 16, 2020, except as modified by the following conditions. c. The following Planning Engineering conditions shall apply: 1. Engineering review of planning and/or zoning cases is for conceptual design only and does not represent final design approval nor shall it entitle applicants to future designs that are not in conformance with Section 1205 of the Maricopa County Zoning Ordinance and Drainage Policies and Standards. Floodplain Regulations for Maricopa County; and the MCDOT Roadway Design Manual. 2. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance and current engineering policies, standards and best practices at the time of application for construction. 3. The one half street runoff from Bethany Home Road must be retained on-site. 4. All development and engineering design shall be in conformance with Section 1205 of the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain Regulations of Maricopa County: MCDOT Roadway Design Manual; and current engineering policies, standards and best practices at the time of application for construction. 5. Primary access to the site shall be from Bethany Home Road. Access to West Rose Lane shall be for emergency uses only. 6. 65’ half width right-of-way dedication required for Bethany Home Road must be initiated with the County (MCDOT/Real Estate) before any Building Permit will be issued by Planning and Development for any work associated with this project; and completed prior to the first certificate of occupancy for any structure/use on the property. 7. The applicant or future owners shall apply for an amendment to the MCP should the storage areas be changed to a paved surface. d. The following Planning Drainage conditions shall be addressed for the first Building Permit submittal: 1. The County As-Built certification needs to be added to the plan. 2. The Runoff Coefficient for commercial sites is C=0.95. The runoff coefficient for the retention basin area below the high water surface is C=0.5. This project has received approval to use a 0.88 runoff coefficient for the non-paved storage areas will be OK. If shade structures are proposed, those areas must be counted as 0.95. Revise the plan comments accordingly. 3. Add the date of the topographic survey to the Survey notes. 4. All walls, fences, gates shall be shown on the G&D plan, including all details. 5. Address all Drainage Report Comments: a) Please have someone QA/QC the report before submitting again. b) Appendix C Watershed Map is too small, not legible, etc. Please produce a map that fits on an 11” x 17” page, eliminate all the blank space on the map, clearly show all the drainage areas and clearly show the various areas within each drainage area that are used for any weighted C calculations. c) The County uses datums NVGD29 and NAVD88. I have not heard of the datum NVGD80. Maricopa County information shows a 1.696 ft. correction to convert NVGD29 to the higher NAVD88. d) Add and emergency spillway to the basin at the southeast corner of the site. e) The Rational Method runoff coefficient values vary throughout the report. Show detailed calculations for any composite C values and make sure the same values are used throughout the report. f) Add the Froude number to all channel calculations. e. All buildings are subject to noise attenuation as per ARS § 28-8482(B). f. The following Rural-43 Military Airport and Ancillary Military Facility Overlay Zoning District standards shall apply: 1. Max. Height – 40’ 2. Min. Front Yard – 10’ 3. Min. Side Yard – 10’ 4. Min. Street-side Yard – 5’ 5. Min. Rear Yard – 25’ 6. Min. Lot Area – 6,000 sq. ft. 7. Min. Lot Area Per Dwelling Unit – Not Permitted 8. Min. Lot Width – 60’ 9. Max. Lot Coverage – 60% 10. Parking Spaces Required – 10 spaces with 2 ADA spaces 11. Screening - 6’ wall, fence or hedge of 80% opacity or more required along and adjacent to any side or rear property line abutting any rural or residential zone boundary. The following Luke Air Force Base condition shall apply: SimonCRE Saltair IV, LLC shall notify future occupants/tenants that they are located near a military airport with the following language: Luke Air Force Base executes an average of approximately 165 overflights per day. Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater Gunnery Range and other flight areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately midnight, Monday through Friday, but some limited flying will occur outside these hours and during most weekends. For further information, please check the Luke Air Force Base website at www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and Development Department.” h. Noncompliance with any Maricopa County Regulation shall be grounds for initiating a revocation of this Military Compatibility Permit as set forth in the Maricopa County Zoning Ordinance. i. The property owner/s and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with conditions. j. The granting of this change in use of the property has been at the request of the applicant, with the consent of the landowner. The granting of this approval allows the property to enjoy uses in excess of those permitted by the zoning existing on the date of application, subject to conditions. In the event of the failure to comply with any condition, and at the time of expiration of the Military Compatibility Permit, the property shall revert to the zoning that existed on the date of application. It is, therefore, stipulated and agreed that either revocation due to the failure to comply with any conditions, or the expiration of the Military Compatibility Permit, does not reduce any rights that existed on the date of application to use, divide, sell or possess the property and that there would be no diminution in value of the property from the value it held on the date of application due to such revocation or expiration of the Military Compatibility Permit. The Military Compatibility Permit enhances the value of the property above its value as of the date the Military Compatibility Permit is granted and reverting to the prior zoning results in the same value of the property as if the Military Compatibility Permit had never been granted. k. The Department of Planning and Development may administratively approve minor changes. g. No person shall operate, maintain, use or allow the use of any area larger than 5,000 square feet for the parking, storage, servicing or dispatching of motor vehicles without first implementing reasonably available control measures to effectively prevent or minimize fugitive dust. h. After zoning approval, but prior to issuance of any building permits or the issuance of a drainage clearance, the developer or his representatives must contact the Flood Control Permitting Office. i. You will be subject to direct overflights and noise from Luke Air Force Base jet aircraft in the vicinity. Luke Air Force Base executes an average of approximately 165 overflights per day. Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will be apparent throughout the area as aircraft transient to and from Barry M. Goldwater Gunnery Range and other flight areas. Luke Air Force Base may launch and recover aircraft in either direction off its runways oriented to the southwest and northeast. Noise will be more noticeable during overcast sky conditions due to noise reflections off the clouds. All habitable buildings built on this site shall be constructed to attain a noise reduction level as per ARS § 28-8482(B). e. Sound attenuation measures shall be incorporated into the building design to achieve a 45-decibel (average day/night weighted) interior noise level due to the proximity of the adjacent railroad tracks. f. Prior to approval of the Plan of Development all of the parcels that make up the site shall be combined as one property with a newly assigned APN. g. Prior to approval of a Plan of Development a re-plat of Tract ‘D’ and Lot 21 of the Churchill South No. 2 subdivision to vacate the public alley and half-width right-of-way of Mitchell Rd. on the site shall be recorded. h. Prior to approval of a Plan of Development a MCDOT Right-of-Way Reduction Waiver shall be submitted and approved that addresses the reserved right-of-way along the Mid-Section Lines on the site. i. Prior to approval of a Plan of Development the developer shall provide Deeds for APN 503-48-004 for proof of ownership. j. The CUPD shall limit use of the site to a commercial storage facility or other use acceptable to the Maricopa County Environmental Services Department to have wastewater disposal via on-site septic system. k. The following C-3 CUPD standards shall apply: 1. Minimum front yard setback of ten feet regardless of adjacent zoning districts; 2. Maximum height for fences of ten feet; 3. AQ-2020-001-INCORPORATION BY REFERENCE [2019-2020] Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on incorporating federal standards into Maricopa County Air Pollution Control Regulations: Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Following the public hearing, the Board is requested to adopt the incorporations into the Maricopa County Air Pollution Control Regulations. The Maricopa County Air Pollution Control Regulations contain several rules, Rules 360, 370, 371, and Appendix G, which incorporate by reference federal regulations from Title 40 of the Code of Federal Regulations (CFR). These federal regulations include New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP) and Acid Rain regulations. Every July 1, the U.S. Environmental Protection Agency (EPA) codifies revisions made to these federal regulations during the preceding year. The purpose of this rulemaking is to incorporate by reference the applicable federal regulations as codified on July 1, 2020, and thereby update Rules 360, 370, 371, and Appendix G with any revisions made to the corresponding federal rules during the preceding year. This is necessary in order to continue to comply with the MCAQD’s delegated authority from EPA to implement and enforce NSPS, NESHAP, and acid rain programs in Maricopa County, except for those specific authorities retained by the EPA. AQ-2019-005-P-7 (MARICOPA COUNTY TRIP REDUCTION ORDINANCE) Convene a public hearing, as required by Arizona Revised Statutes (A.R.S.) § 49-479(b), to solicit comments on the proposed revisions of Maricopa County Air Pollution Control Regulations, Ordinance P-7 (Maricopa County Trip Reduction Ordinance). Following the public hearing, the Board is requested to adopt the proposed revisions to the ordinance. The MCAQD first adopted Ordinance P-7 on November 24, 1992 to reduce traffic impacts on air pollution and emissions within Maricopa County. Ordinance P-7 applies to major employers and schools with 50 or more employees or students at any single work or school site and requires them to develop, implement, and maintain a travel reduction program. Employers and schools subject to Ordinance P-7 are required to maintain a reduction of single occupant vehicle (SOV) trips and/or miles traveled to either their school or work site by 10 percent each year for a total of five years, and then five percent for three additional years, or until a 60 percent rate of SOV travel is reached. Progress is tracked through an annual commuter survey of employer/school sites. The results of the survey are used to develop an annual travel reduction plan that commits the employer/school to implementing and documenting various strategies to reduce SOV trips or miles traveled. The MCAQD is proposing to revise Ordinance P-7 to update and clarify the ordinance by removing language repeated from state statute, condensing information in the Equivalent Emissions Reductions and Plan Development sections, identifying new technologies for the implementation of the Maricopa County Travel Reduction Program (TRP) by both program staff and employers, and by incorporating six (6) existing Substantive Policy Statements into the ordinance. This is the first time the Sheriff’s Office has received this funding award and it is non-recurring. There is no match requirement. AGREEMENT WITH THE ARIZONA DEPARTMENT OF HOMELAND SECURITY FOR TLO ENHANCEMENT (TLOENH) - FFY2021 Approve the Agreement and acceptance of grant funds to the Sheriff’s Office from the Arizona Department of Homeland Security, TLO Enhancement (TLOENH) Agreement Number 20-AZDOHS-HSGP-200812-02 in the amount of $82,500 for the award period beginning October 1, 2020 and terminating on September 30, 2021. This Agreement may be terminated by any of the parties by written notice to the other parties thirty (30) business days prior to termination. Approve the one-time addition to the fleet of one (1) TLO Level A vehicle. The vehicle is a specific component of this funding for use by a Terrorism Liaison Officers and will enhance the capability of the office to prepare for, respond to and mitigate incidents of terrorism involving chemical, biological, radiological, nuclear and explosive (CBRNE) materials. This replacement vehicle is a onetime addition to the fleet and will be retired from the fleet at the end of its useful life with no funding from the general fund for replacement. The funding award is recurring and has been awarded to the Sheriff’s Office six time previously. There is no match requirement. The Sheriff’s Office indirect cost rate for FY21 is 14.6%, applicable to the award amount of $82,500 less capital expenses of $82,500 for an indirect cost base of zero ($0) and indirect costs of zero ($0). Indirect costs are unallowable by the terms of this Agreement unless applied for and approved in writing (page 6, Allowable Costs Section, letter A), and zero ($0) in indirect costs will be absorbed by the General Fund. There are no future or ongoing contributions required after the grant period ends; however, property (items) purchased with these funds must remain available to the unit for the duration of its existence and/or the useful life of the item. This is not a mandated function although it supports the MCSO public safety mandate and provides a benefit to the citizens by integrating information sharing and dissemination to ensuring that adequate capabilities exist to prevent, protect against, mitigate the effects of, respond to, and recover from incidents involving radiological accidents and incidents, resulting in a more safe and secure community. This is a competitive award. The Maricopa County Sheriff’s Office is one of several local law enforcement agencies in the Phoenix metro area that participate in this effort. This is reimbursement funding that will be used to purchase non-capital and capital equipment. These revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditures of these revenues are not prohibited by the budget law. AMENDMENT TO AGREEMENT FOR DONATION FROM THE ARIZONA PROPANE GAS ASSOCIATION (APGA) FOR THE PROPANE FIRE PIT PROGRAM Approve and authorize the Chairman to execute an Amendment 2 to the Agreement between the Maricopa County Air Quality Department (MCAQD) and the Arizona Propane Gas Association (APGA) for APGA to provide a restricted donation of matching funding to MCAQD for the Propane Fire Pit Program and accept the funds. This Agreement will provide for continued matching funds to support MCAQD’s Propane Fire Pit Program which encourages the exchange of wood burning fire pits for cleaner burning propane gas devices, to aid in the reduction of particulate matter 2.5 (PM 2.5) during the wood burning season. This program will be marketed to all County residents and will offer through e-mail a voucher which can be taken to select Home Depot stores within Maricopa County for a discount on a propane fire pit. There will be a $50.00 discount provided by the County and a $25.00 discount provided by the APGA, for a total of $75 per program participant. The term of this Amendment shall commence on the Effective Date and end no later than April 1, 2021. PM 2.5 is an EPA pollutant that is known to cause damaging health issues, including acute asthma symptoms leading to hospitalization and heart disease, as the tiny pollutant can deposit deep into the lungs and enter the blood stream. If PM 2.5 should exceed the EPA 24 hour or annual standard, this could lead to more stringent regulations and negative economic impact for Maricopa County. Donation revenue funds of $30,000 are deposited into Fund 504 as they are received. Donation funds are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. The approval of this action requested does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to ARS 42-17105. APPLICATION AND APPROPRIATION ADJUSTMENT FOR GRANT FUNDING FROM THE USC SCHWARZENEGGER INSTITUTE DEMOCRACY GRANTS FOR VOTING ACCESS AND ELECTION ADMINISTRATION Approve and authorize the Elections Department to submit an application for the USC Schwarzenegger Institute Democracy Grants for Voting Access and Election Administration, and authorize the Chairman to approve the receipt of any and all such funds awarded. In accordance with A.R.S.42-17106(B), approve a revenue and expenditure appropriation adjustment increasing the FY 20-21 Elections Department (210) Elections Grant Fund (248) Non-Recurring Non-Project (NRNP) in the amount of $41,857. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Election offices can use the funds to enhance CY 2020 mandated early voting services the department is required to perform. Due to increases in early ballot demand, Maricopa County is providing attended drive-thru drop boxes at 14 locations throughout the County, primarily located in well-known large Sporting venue parking lots. Voters will be able to return their ballot with confidence with the added benefit of convenience and limited public exposure. All locations will be staffed by a team of bipartisan poll workers who will be donning face masks, face shields, and gloves. The grant does not allow for indirect costs for which the County is eligible. The Maricopa County Elections Department composite indirect cost rate for FY 21 is 68% or $28,463. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $28,463. Non-recoverable indirect costs will be covered by the departmental general fund budget. This grant is non-competitive and does not require a match or on-going cash contributions after the grant period end date. The grant award is nonrecurring and has not been awarded to the department in past years. The total amount of funds requested is $28,463. The grant period will cover the periods November 1, 2020 through November 30, 2020. Maricopa County and the Elections Department are eligible to apply for and receive grant funding through various state agencies. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The Department will be recovering the allowable 10% de minimus rate based on the total direct charges, which totals $95,226. The grant award is reoccurring and has been awarded to the department for the past thirty (30) plus years. The department has a match requirement of $952,263 during the grant award period, the match for this grant comes from the General Fund (100-D150-1510), Palo Verde (100-D150-1510) and the Intergovernmental Agreements (100-D150-1510-CTIGA). Maricopa County does not have to fund any additional costs for the program. The grant award is a mandated function for emergency preparedness through the Robert T. Safford Act. This grant provides funds for recipients to build and maintain emergency management programs at the state and local level. AMENDMENT TO THE AGREEMENT WITH TRELLIS COMMUNITY DEVELOPMENT AND CITY OF AVONDALE Approve financial Amendment No. 1 to the Agreement between Maricopa County (“County”), administered by its Human Services Department, Trellis Community Development, a Community Housing Development Organization (“CHDO”), and the City of Avondale (“City”). The purpose of this Agreement is to establish the process for collaboration between the Parties to provide services to preschool children, including children with disabilities as defined in A.R.S. § 15-761, ages three years old to kindergarten-eligible five years old, in compliance with federal and state laws and regulations, and in accordance with District policies and the Improving Head Start for School Readiness Act of 2007 (42 U.S.C. §§ 9801, et seq.). The purpose of the Agreement is for the Developer to acquire and construct a new single-family home on the current vacant lot at 5332 East Calle Encinas, Guadalupe, Arizona, or another suitable site. The project will create a homeownership opportunity for a low-income household. The home buyer must qualify as low-income and maintain the housing as the principal residence throughout the period of affordability, which shall be a period of fifteen (15) years. The County shall provide the Developer with a HOME Investment Partnerships Grant (HOME) funds in the amount not-to-exceed $260,000 The Agreement term begins on November 18, 2020 and will expire August 31, 2024. Also request authorization for the Human Services Department Director to approve and execute Administrative Change Orders as identified in Section 2 (Special Provisions), Paragraph 18.0 (General Conditions). The Human Services Department Director may make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. ACCESS POINT AGREEMENTS Approve two substantially similar, non-financial Access Point Agreements “Agreements.” The Agreements shall be between Community-Based Organization (CBO) or with Government entities and Maricopa County administered by the Human Services Department Workforce Development Division, Arizona@Work – Maricopa County. The purpose of the Agreements is to establish a system by which the CBOs and the Government entities contract with Maricopa County to be recognized as Access Points locations where community members and residents have the opportunity to conduct job-search activities. The Workforce Development staff will work to identify local organizations that are willing to participate as a designated Access Point location. The Agreements shall be effective from date of full execution through June 30, 2023 with the option to renew for two additional two-year terms. The Agreements are subject to statutory language of A.R.S. §38-511 and incorporate the same by reference. Also request approval and authorization for the Human Services Department Director to sign the Access Point Agreements. The period of funding availability for Adult (AD), Dislocated Worker (DW) and Rapid Response (RR) activities is July 1, 2020 through June 30, 2022. Funding for Youth (YT) activities is April 1, 2020 through June 30, 2022. The Agreement term is retroactive to July 1, 2020. Maricopa County, exclusive of the City of Phoenix, is a designated Local Workforce Development Area (LWDA) under the federal WIOA. As a designated LWDA, services are administered by the Maricopa County Human Services Department Workforce Development Division ARIZONA@WORK - Maricopa County. WIOA services include career and training opportunities, to job seekers, youth, and employers to meet the needs of workforce development in the local area. DES contracts with the County on an annual reoccurring, non-competitive basis. Funding expenditure timeframes vary and are dependent upon the Catalog of Federal Domestic Assistance (CFDA) WIOA Title I assigned to the funding: Adult-CFDA 17.258 $5,723,577; Youth-CFDA 17.259 $6,415,735; Dislocated Worker/RR-CFDA 17.278 $7,239,575. The Human Services Department utilizes the provisional indirect rate of 22.2% by the U.S. Department of Health and Human Services FY2021 for salaries and employee related expenses. The total Amendment funds are $19,378,887 of which $8,415,550 is for salaries and benefits. The total estimated indirect costs are $1,868,252 and fully recoverable. Budget adjustments will be made when the Indirect rate costs has been fully negotiated and shall be retroactive to July 1, 2020. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and Therefore, expenditure of the revenues is not prohibited by the budget law. This Agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. Pursuant to Uniform Terms and Conditions, Provision (6) Contract Changes, (6.1) Amendments, Purchase Orders, and Change Orders, it is mutually agreed that the IGA referenced is amended as follows: 1.1 Scope of Work, Page Nineteen (19), Provision 4.12, VPD Outbreak and Pandemic Preparedness added items 4.12.3 and 4.12.4 that are hereby revised in this Amendment Four (4) to read: 4.12.3 Improve vaccine cold storage capacity to include purchase of storage units (refrigerator, freezer [NOT ultra-cold freezer]), generators, portable refrigeration units. These efforts are intended to help keep vaccines viable during the COVID-19 pandemic. 4.12.4 Increase capacity for data entry and reminder recall activities, to include but not limited to additional staffing, or purchase of hardware and software equipment to accomplish this task. These efforts are intended to help track immunization data during the COVID-19 pandemic. All other terms of this agreement remain unchanged. The term of this IGA is extended through June 30, 2024. The Department of Public Health’s indirect rate for FY20-21 is 18.8%. Indirect is estimated at $19,781, all of which is recoverable. The overall grant budget will be adjusted as necessary to accommodate this grant through a future reconciliation This grant award is reoccurring and has been awarded to the department since 1993. The grant does not require an in-kind match; indirect cost is fully recoverable; and ongoing cash contributions are not required. The grant award is a mandated function and provides a benefit to the citizens by ensuring that immunization coverage levels in the County’s child, adolescent, and adult populations improve for both public and private health care recipients. The grant award is not competitive. There are no costs that will need to be absorbed by the department’s operating budget. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. IGA WITH THE CITY OF AVONDALE FOR THE EXCHANGE OF SERVICES (ENTENTE) Approve the Intergovernmental Agreement (IGA) between Maricopa County and the City of Avondale for the exchange of services or reimbursement of services (Entente). This Agreement shall become effective as of the date it is approved by the Maricopa County Board of Supervisors and remain in full force and effect until either Party terminates it. Either Party may terminate this Agreement at any time before the expiration date of this Agreement by furnishing the other Party with a thirty (30) day written notice. The purpose of this Intergovernmental Agreement is to identify and define both Parties' respective roles in the execution of the responsibilities of specific maintenance tasks in areas that cross jurisdictional boundaries. The Agreement provides the opportunity to focus on specific maintenance tasks or emergency highway projects and the availability of the most economical resources by extending beyond jurisdictional or geographical boundaries. The Agreement's application will benefit areas in the County and the City where the other Party could complete specific types of routine maintenance or emergency highway project activities based on scheduled work within the area. Individual tasks performed by either Party will be executed upon completing a Letter of Agreement (LOA) approved and signed by the County Department of Transportation Director and the City Manager, or their designees. If the value of goods or services exchanged by the Parties is not of equal value, the total aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If no services are exchanged, there is no financial impact. IGA WITH THE CITY OF SURPRISE AND THE CITY OF GLENDALE FOR PEORIA AVENUE AND REEMS ROAD TRAFFIC SIGNALS Rescind the action taken by the Board of Supervisors (Board) on June 24, 2020 (C-64-20-204-M-00) whereby the Board approved an Intergovernmental Agreement between Maricopa County, the City of Surprise and the City of Glendale for the construction of traffic signals at Peoria Avenue and Reems Road; and approve a new version of the Intergovernmental Agreement between Maricopa County, the City of Surprise and the City of Glendale for the construction of the traffic signals at Peoria Avenue and Reems Road. Under this Intergovernmental Agreement and in coordination with the County and Glendale, Surprise will act as the lead agency for all aspects of the design and construction of the Project. Surprise has assessed the intersection of Peoria Avenue and Reems Road and determined that the intersection meets traffic signal warrants. Surprise has estimated the cost to complete the construction of the Project as $270,805 and will contribute 50% of the cost. Glendale will have an estimated financial contribution of $67,701. The County will have a financial contribution in an amount not to exceed $75,000. The funds are budgeted in FY2021 Transportation Department (640) Transportation Capital Project Fund (234) Five Year Program in the Transportation System Management Project, sub-project TT679. Construction is planned for fiscal year 2021. The terms of the agreement are in effect as of the Board of Supervisors approval and shall remain in full force and effect until all stipulations have been satisfied, except that it may be amended upon written agreement by all parties. The primary purpose of this Amendment is to advance construction of the Traffic Signal from FY 2022 to FY 2021 and to add left turn lanes to the project. The City of Goodyear shall act as the lead agency with respect to design, right-of-way acquisition, and construction. The Total Project Cost is currently estimated at $754,900. A developer contribution of $150,000 will be applied to the Total Project Cost resulting in a Net Project Cost of $604,900. This Policy applies to all employees of Maricopa County appointed departments as well as the Flood Control District of Maricopa County and the Maricopa County Library District (Special Districts). The Board of Supervisors is authorized to jointly adopt policies applying to the Special Districts under the Intergovernmental Agreement, C-06-18-393-6-00, approved on April 11, 2018. This Policy also applies to employees of County elected offices unless the elected official has implemented a similar policy specific to his or her office. IGA WITH MARICOPA COUNTY DEPARTMENT OF TRANSPORTATION FOR BUCKEYE YARD USAGE Adopt Intergovernmental Agreement (IGA) FCD 2020A016 for usage of Maricopa County’s Buckeye Yard, between the Flood Control District of Maricopa County (DISTRICT) and the Maricopa County Department of Transportation (COUNTY) regarding expenses incurred by the District. The DISTRICT requires facilities for storage, a work yard and office space in the West Valley of the County to support its Operation and Maintenance Division. The IGA shall become effective July 1, 2020 and remain in full force and effect until June 30, 2025. The County owns Assessor Parcel Number 401-87-001G (Buckeye Yard), as reflected in the attached Exhibit A. The Buckeye Yard has facilities that meet the needs of the District and have been previously used by the District pursuant to a lease that commenced May 1, 2015 and expired June 30, 2020. The lease document was signed by the District’s Chief Engineer and General Manager on March 31, 2015. (C-69-21-042-X-00)

106. RESOLUTION FOR THE 2020 FLOODPLAIN MANAGEMENT PLAN Approve Resolution FCD 2020R004 adopting the 2020 Floodplain Management Plan (FMP) for Unincorporated Maricopa County. The Flood Control District participates in the National Flood Insurance Program’s (NFIP) Community Rating System (CRS) on behalf of unincorporated Maricopa County. As a requirement of the CRS Program, the Flood Control District must update the FMP every five years. The 2020 update of the FMP was based upon input from a committee of staff from the Flood Control District, Planning & Development, other county departments, along with representatives from several incorporated communities, non-governmental organizations, the business community, and members of the public. The committee met five times during this process and announcements of each meeting were posted on the Flood Control District’s web site. Development of the FMP followed the process required by CRS: 1) review information and recommendations from the 2015 FMP, 2) update the assessment of the flood hazards and problems in unincorporated Maricopa County, 3) set Goals, 4) develop a program of possible activities, and 5) recommend a program of action items to be implemented. Two public open house meetings were held during the process. The first meeting informed the public and other stakeholders about the process and invited their input. The second meeting was to review the Draft version of the FMP and for the public and stakeholders to provide comments. The FMP has been available for review and comment on the Flood Control District’s web site, the formal review period was from 07/17/2020 to 8/7/2020. Funding for implementation of the FMP’s action items will be provided as resources permit under the Flood Control District’s operating and CIP budgets. The 2020 FMP will serve as a road map for addressing flooding issues in unincorporated Maricopa County for the next five years. The 2020 FMP’s action items can also be used with local communities, other agencies and entities throughout Maricopa County. This Agenda Item impacts all Supervisorial Districts. (C-69-21-045-X-00)
