10. ES-2019-001/MARICOPA COUNTY TRANSFER STATION FEE REVISIONS Pursuant to A.R.S. §11-251.13 and 36-184(B)(5), convene a public hearing to solicit comments and consider the adoption of proposed revisions to the Maricopa County Environmental Health Code to incorporate phased transfer station fee increases. Upon Board approval, this item will become effective 07/31/2019. The Maricopa County Board of Health (BOH) reviewed and discussed proposed revisions to transfer station fees (EROP Case ES-2019-001/Maricopa County Transfer Station Fee Revisions) at a public meeting held at 3:00 p.m. on Monday, April 22, 2019, at the Board of Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003. The Report to the BOH includes the fee changes and is accessible at https://www.maricopa.gov/3563/Active-Regulatory-Process. Transfer station operational expenses have increased as a result of additional citizen demand, which in turn has caused a revenue deficit for Maricopa County Waste Resources and Recycling (MCWRR). To maintain compliance with A.R.S § 49-741, which requires providing or ensuring solid waste public facility services are available for citizens, MCWRR fee changes are proposed. (C-88-19-009-2-00)

B. 2 of Modification #3. The reimbursement period will be retroactive to January 1, 2019 through December 31, 2019. The MCSO Indirect Rate is 16.30%. Total grant indirect costs for this funding is estimated to be $5,085, and none of this amount is recoverable. The unrecoverable amount of $5,085 will be absorbed within Sheriff’s General Fund operations. This grant award is non-competitive, multi-year and recurring. The Sheriff’s Office has been providing these services for more than 30 years. The award does not require a cash contribution, nor an in-kind contribution, and there are no future or ongoing contributions required following the grant period. This service is not mandated; however, it furthers the Sheriff’s public safety mandate. Funding is used to pay deputy overtime related to this grant agreement for MCSO during emergency fire suppression and fire severity situations in portions of the Tonto National Forest, located in Maricopa County. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. The funding component request for fire emergency (fire severity) has been included in previous years' agenda item requests for US Forest Service funding. Approval of this action corrects that oversight and authorizes acceptance of this funding in the event MCSO is called to assist with Fire Severity. (C-50-20-004-G-00)

66. AGREEMENT WITH ARIZONA PUBLIC SERVICE FOR THE APS ENERGY SUPPORT PROGRAM Approve a revenue Agreement between Arizona Public Service (APS) and Maricopa County, administered by its Human Services Department (MCHSD). The purpose of this Agreement is for APS to provide the County with funding for the enrollment of low-income residents in the APS Energy Support Program. The Agreement is effective from August 1, 2019 through July 31, 2020. The funding amount for the Agreement term is $131,000 for the provision of services. Receipt of funds under this Agreement is 1st time funding. APS reserves the right to extend or allow expiration of this Agreement into the future. APS selected to contract, through a non-competitive process, with the County because the Human Services Department Community Services Division provides utility assistance to low-income households. The Community Services Division is best situated to enroll households into the APS Energy Support Program which will assist with a reduction to utility costs. The Human Services Department approved provisional indirect rate for FY2020 is 22.2% from the U.S. Department of Health and Human Services for salaries and employee related expenses. The total Agreement amount is $131,000 of which $95,418 is for salaries and ERE. The total recovered allowable indirect is $21,183 and is fully recoverable. Receipt of the funds from APS does not require in-kind or match funds and no future or ongoing contribution by the County at the end of the Agreement term. The services provide under this Agreement are not a mandated function but provide a benefit to the citizens by providing eligible low-income residents with discount with their monthly utility bill. This Agreement does not contain County General funds. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of the funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. The overall grant budget will be adjusted as necessary to accommodate this grant through future budget reconciliation. Supervisory District: All (C-22-20-001-3-00)

COMPUTER SOFTWARE AGREEMENT WITH ARIZONA DEPARTMENT OF EDUCATION FOR CHILD AND ADULT CARE FOOD PROGRAM Approve a non-financial Computer Software Agreement with Arizona Department of Education (ADE) for the Child and Adult Care Food Program (CACFP). The Maricopa County Human Services Department Early Education Division - Head Start program administers CACFP. This Agreement allows the Head Start program to utilize the County purchased ChildPlus Management System to track the attendance of its participants and/or create meal counts to be claimed for reimbursement under CACFP. The Agreement shall be effective upon approval and signature by both parties and shall remain in place until terminated by either party. The County has had a permanent agreement (C-22-14-027-G-00) with Arizona Department of Education for receipt of CACFP funds since October 2013 and receives an annual allocation. Head Start program participants receive daily meals and snacks which meet a child’s 1/3 to 2/3 of the daily nutritional needs. The County requests reimbursement from ADE for the number of meals and snacks that are provided on a monthly basis. By utilizing ChildPlus as the software of record, the Head Start program will be able to connect participants’ attendance with the number of meals provided on a daily basis. Additionally, the IGA is modified as specified in the amendment 3. All other terms and conditions of the original contract and its amendments shall remain in full force and effect. Tobacco Use is the number one preventable cause of death and disease in Arizona. In 1993, there were over 70,000 middle and high school youth using tobacco. Cigarette smoking during pregnancy accounts for 20 – 30% of low birth weight babies, up to 14% of pre-term deliveries, and about 10% of all infant deaths. In 1995, as a result of the Tobacco Tax Initiative, the Arizona Legislatures authorized the Arizona Department of Health Services (ADHS) to develop and fund tobacco prevention and cessation programs. The Maricopa County Department of Public Health (MCDPH) is funded by ADHS to identify effective strategies and implement school-based tobacco use prevention services for Maricopa County as part of the MCDPH comprehensive tobacco control program. 113. FIRST AMENDMENT TO SINGLE SITE LICENSE AGREEMENT WITH CTI TOWERS ASSETS II, LLC Approve and authorize the Chairman to execute First Amendment to Single Site License Agreement (P-50256), with CTI Towers Assets II, LLC, a Delaware limited liability company, as the new tower owner and successor Licensor, to allow additional antennas on the communication tower located at 3103 E. Combs Road, Queen Creek, AZ 85242. This site is located in Pinal County. The First Amendment to Single Site License Agreement with CTI Towers Assets II, LLC (CTI), tower owner and successor (C-94-14-017-3-02), corrects the tower coordinates and allows the County to place additional antennas on the existing tower located at 3103 E. Combs Road, Queen Creek, AZ. The fee for the additional antennas is $1,000 per month for the first year of the term and will escalate 3% per year thereafter. In addition, this amendment acknowledges the ground lease between CTI and Mediacom, the owner of the land, and: (1) sets forth provisions for the County’s improvements to remain on the tower should CTI transfer, sell, or terminate the ground lease; and (2) modifies the definition of interference in the original license (C-94-14-017-3-01) (License), to add loss of line of sight as a reason the County can terminate their occupancy on the tower. All other terms and conditions of the License remain unchanged. Costs for the County’s Radio System Upgrade Project were approved by the Board of Supervisors under C-73-13-077-7-00. 114. SPECIAL LAND USE PERMIT WITH ARIZONA STATE LAND DEPARTMENT FOR EQUIPMENT STAGING AND LANDING AREA FOR WIRELESS COMUNICATION FACILITY Approve and authorize the Chairman to execute a Special Land Use Permit (SLUP) 23-119052 (P-50339), with Arizona State Land Department (ASLD), for equipment staging and landing area to support a wireless communication facility site at Table Mesa (south of Table Mesa Road and east of I-17) as well as authorize the Chairman to execute any additional documents related to the SLUP approved by Legal Counsel on behalf of Maricopa County. This item is located in Supervisorial District 3. The ASLD previously granted the County a one year SLUP in 2016 that was approved by the Board on December 7, 2016 (C-70-17-008-3-00). The SLUP commenced on October 28, 2016 and was set to expire on October 27, 2017; however, during the first year of use, the project team identified that this staging area would be needed for a longer term so the County applied for a renewal with ASLD and continued to pay the annual fee while the renewal was being processed. Rather than issue a renewal, ASLD approved a new SLUP for a ten year term that was retroactive to October 28, 2017 and will expire on October 27, 2027. As part of the County’s Radio System Upgrade Project, the subject SLUP with the ASLD will allow the County to continue to utilize an equipment staging, temporary parking, and landing area to support a wireless communications facility at Table Mesa (south of Table Mesa Road and east of I-17). The SLUP annual fee is $2,400 per year. Funding for the Special Land Use Permit is part of the Radio System Infrastructure Upgrade Project previously approved by the Board of Supervisors on June 5, 2013, under agenda C-73-13-077-7-00. 120. AMEND ACTION TO ESTABLISHED COUNTY POLICY FOR BRIDGE AND MINOR CONCRETE BOX CULVERT STRUCTURE SYSTEM CONDITION LEVELS Amend previous action to the established County policy for bridge system condition levels per the requirement of the Governmental Accounting Standards Board Statement No. 34 using the modified approach of accounting. Amend as follows: Bridge system – convert measurement scale for assessing bridge and minor concrete box culvert structure condition ratings from the numerical 0-100 scale (sufficiency rating) to the Federal Highway Administration (FHWA) National Bridge Inspection Standards scale (condition rating), which rates bridges in the following manner: Good = 7-9 Fair = 5-6 Poor = 0-4 Further, amend condition level requirements to maintain 90% of bridges and minor concrete box culvert structures with a condition rating of 5 or greater. The Department of Transportation is required to comply with the Governmental Accounting Standards Board Statement No. 34 (GASB 34) for reporting infrastructure assets (i.e. bridges). The Department of Transportation elected to use the modified approach upon implementation of GASB 34, which means infrastructure assets will not be depreciated as long as two requirements are met. First, the government manages the infrastructure assets using an asset management system. Second, the government documents that the infrastructure assets are being preserved approximately at (or above) a condition level established and disclosed by the Board of Supervisors. The condition levels established by the Board of Supervisors will be reported annually in the County’s Comprehensive Annual Financial Report (CAFR). This agenda item amends the previously established bridge sufficiency rating to follow the Federal Highway Administration (FHWA) rating system. The Department of Transportation is in compliance with these condition ratings and no additional funding will be required to maintain the current condition rating.
