24. GRANT FUNDS FROM HEALTH SERVICES AND RESOURCES ADMINISTRATION FOR LIFE-SAVING MEDICAL AND SUPPORT SERVICES FOR PEOPLE LIVING WITH HIV/AIDS Approve the application and acceptance of grant funds from Health Services and Resources Administration (HRSA), (H89HA11478), in the not-to-exceed amount of $10,193,936 for the purpose of providing lifesaving medical and support services to people living with HIV/AIDS. The grant award begins on March 1, 2019 and ends on February 28, 2020. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant allows a 20.8% rate for indirect costs, which may be incurred by the Ryan White grant or Maricopa County for the administration of this grant. The Maricopa County Department of Finance has calculated the Ryan White grant composite indirect cost rate at 20.8%, or $223,841.06. The recoverable indirect cost of administering this grant is $223,841.06; the non-recoverable indirect cost is $0. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the funds is not prohibited by the budget law. Approval of this action does not alter the budget constraining the expenditure of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. Ryan White Part A program receives funds from Health Services & Resources Administration (HRSA), under Part A of the Ryan White Treatment Modernization Act of 2006, to provide services to people infected with, or affected by HIV/AIDS. The grant provides contracts with HIV and AIDS service organizations which deliver health related and support services for HIV positive/affected persons. These services include, but are not limited to, case management, counseling, outpatient health services, food and nutrition services, transportation and cost sharing. The total of this request is $10,193,936. The application amount is $9,818,936 plus $375,000 of carryover from the previous grant. Carryover may only be used for direct services. Pursuant to federal statue, at least 85% of the grant award must be passed through to contractors. HRSA’s allowable administration includes up to 10% of grant award for Administration and Planning Council Support and up to 5% may be allocated toward Clinical Quality Management. This grant year, $8,518,936 plus carryover of $375,000 totaling $8,893,936 is allocated toward direct services. Budget for Administration, Planning Council Support, and Clinical Quality Management will provide the infrastructure of the program administration in the amount of $1,300,000. The Ryan White Part A program serves up to 4,500 People Living with HIV/AIDS in Maricopa and Pinal Counties, and is the “Payer of Last Resort” for their primary medical care. The Ryan White Act requires that funding be provided to the county in each state that has the largest number of people diagnosed with HIV/AIDS living in an eligible metropolitan area. By providing continuity of care, people living with HIV/AIDS maintain a measurable lower viral load and are thus less likely to transmit the virus to other individuals. (C-95-18-013-3-00)

This Agreement is non-financial and is effective from July 1, 2018 until June 30, 2019. The Voluntary Vehicle Repair and Retrofit Program (VVRRP) was enacted (Laws 1998, Chapter 217, § 19) to provide assistance to the owners of vehicles that were 12 years old or older to help them comply with the requirement to successfully repair vehicles that had failed emissions inspections. Arizona law (A.R.S. §49-474.03) requires Maricopa County and Pima Counties to operate and administer a VVRRP in Area A and Area B (A.R.S. §49-541) and to coordinate the program with the Arizona Department of Environmental Quality (ADEQ) and the Arizona Department of Transportation (ADOT). The program is required to provide for quantifiable emission reductions based on actual emissions testing performed on the vehicle before and after repair. This Agreement will allow ADEQ to implement the VVRP on behalf of Maricopa County. The Agreement terminates June 30, 2019. (C-85-17-020-3-01)

The purpose of amendment no. 1 was to revise yearly AHCCCS rates for a twelve (12) month period ending September 30, 2017 and to add a Business Associate Agreement. Amendment no. 2 revises the AHCCCS agreement rates not to exceed $500,000 for a twelve (12) month period ending September 30, 2018. All other terms and conditions of the Intergovernmental Agreement not amended hereby remain in full force and effect as previously approved and amended. This is a retroactive approval request. Correctional Health Services did not receive the signed amendment from the State until April 2018. The main purpose of this IGA is to change language to an agreement that began in 2004 (C-26-05-009-2-00) to allow incarcerated individuals that are patients in an "off-ward" setting to be covered under AHCCCS. AHCCCS processes all outside provider claims incurred due to the inmate/patient population needing medical services from a health care provider outside of the jail system. These inmates/patients are currently booked into the jail population and under the care of CHS. 39. AGREEMENT FOR OUTPATIENT SAMPLE PROGRAM WITH JANSSEN PHARMACEUTICALS, INC Adopt a Resolution which authorizes an Agreement between Janssen Pharmaceuticals, Inc. and Maricopa County through the Department of Correctional Health Services, for the purpose of a free medication program for psychiatric patients. Approve and authorize, by Resolution, Maricopa County by and through its Department of Correctional Health Services (MCDCHS), to process an non-financial Outpatient Sample Program (OSP) form (1050041-SUS170114941) with Janssen Pharmaceuticals, Inc., for free samples of INVEGA SUSTENNA (paliperidone palmitate), up to six (6) units per dosage, 156 mg and 234 mg. This Agreement is non-financial and is effective from June 27, 2018 until June 27, 2023. Long acting injectable (LAI) antipsychotic medications are used frequently in the community for psychiatric conditions, including schizophrenia, schizoaffective disorder, and bipolar disorder. Given the large number of jail inmates with psychiatric conditions who get treated with LAI medications in the community, best practices dictate that these medications be continued in jail for patients who are stable and compliant on LAIs. The cost of LAIs is significant. On average, 200 patients per month are receiving injectable antipsychotic medications in Maricopa County Jails. This comprises 20% of the monthly pharmacy budget for a jail population of 7500. Fortunately, pharmaceutical companies understand the burden that LAIs have on county budgets and have programs designed specifically to provide medications, free of charge, to incarcerated populations. Creating a partnership with these companies will allow for continuity of care on patients, while in jail, who are stable and compliant in the community with LAI medications. (C-26-18-008-3-00)

The purpose of this policy is to serve as the frame work for employees to follow when applying for grants and negotiating the terms and conditions of the agreements and/or contracts to ensure the optimum financial and administrative arrangements for Maricopa County and Special Districts. This policy applies to all County Departments, Elected Officials, and Special Districts (Flood Control, Library District, and Stadium District). Maricopa County Policy A2505 Policy for Administering Grants was originally approved by the Board of Supervisors and issued February 1997. The most recent updates to the policy were approved May 2009 (see Agenda C-06-09-283-6-01) and minor updates were made in October 2017. These revisions update the requirements for County Departments when applying for grants. The major changes include no Board of Supervisors approval is needed to apply for grants if departments can pay for matching requirements, unrecoverable indirect costs, or ongoing contributions from the department’s operating budget appropriation. Otherwise, departments need Board of Supervisor approval to apply for grants. (C-18-18-014-6-00)
