8. ES-2017-001/PET GROOMERS & SHOPS PROPOSED REVISIONS TO CHAPTERS I AND XI OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE (MCEHC) Pursuant to A.R.S. §11-251.05 and A.R.S. §36-184(B)(5), convene the scheduled public hearing, to solicit comments and consider the adoption of proposed revisions to MCEHC Chapters I and XI (EROP Case ES-2017-001/Pet Groomers & Shops). Upon Board approval, this item will become effective 03/21/2018. The Maricopa County Board of Health (BOH) reviewed and approved revisions to MCEHC Chapters I and XI (ES-2017-001/Pet Groomers & Shops) as an EROP expedited case at a public meeting held on Friday, February 2, 2018, at the Board of Supervisors Auditorium, 205 West Jefferson Avenue, Phoenix, Arizona 85003. The report to the BOH outlines proposed revisions to the MCEHC and is accessible at https://www.maricopa.gov/3563/Active-Regulatory-Process. This proposal revises MCEHC Chapters I and XI by removing non-mandated animal related functions regarding kennels, pet shops, veterinary clinics, veterinary hospitals and pet groomers and two “odor” references. Revisions will increase opportunities for business owners while ensuring public health is maintained. Maricopa County Animal Care and Control issues kennel permits, and the Veterinary Medical Examining Board has the authority to investigate veterinary clinics and veterinary hospitals on a complaint basis. The Department does not have a record of a zoonotic disease occurring from a kennel, pet shop, veterinary clinic, veterinary hospital or groomer in Maricopa County. Pima, Coconino, and Pinal counties do not license groomers. In addition, the Department has not responded to “odor” related complaints since 2004 when Air Quality and Environmental Services were one department. (C-88-18-007-L-00)

26. INTERGOVERNMENTAL SERVICE AGREEMENT FOR DONATION FOR VOLUNTARY LAWN AND GARDEN EMISSIONS REDUCTION PROGRAM Approve an Intergovernmental Service Agreement (ISA) between Arizona Department of Environmental Quality and Maricopa County through the Air Quality Department, in the not-to-exceed amount of $375,000. The purpose of this Intergovernmental Agreement is to provide a restricted donation of funds to MCAQD for the Voluntary Lawn and Garden Emissions Reduction Program. This program will retire and recycle old gasoline and diesel polluting lawn mowers and provide them with a $150 voucher to be used towards the purchase of an electric lawn mower to mitigate Nitrogen Oxides (NOx) and Volatile Organic Compounds (VOC) emissions that can have a harmful impact on residents. This Intergovernmental Agreement is effective from 3/21/2018 until 6/30/2020. This Lawn and Garden Equipment Replacement Program (Program) was originally created in 1998 as a condition for the Carbon Monoxide (CO) State Implementation Plan (SIP) in accordance with A.R.S. §49-474.02. The statute specifies that a County with a population of more than five hundred thousand persons shall establish and coordinate a voluntary lawn and garden equipment emissions reduction program. This Program fulfilled its original intent by reducing CO emissions until the County achieved attainment of the CO standard. Currently, the County is in non-attainment for Ozone for which the precursors are NOx and VOC. Projected emission reductions for the replacement of 2,500 gasoline residential lawn mowers would result in an annual reduction of 20.9 tons of VOC and 0.2 tons of NOx, thereby, improving air quality. This ISA provides the initial funding to support MCAQD in revitalizing this Program and funds the FY 2018 Voluntary Lawn and Garden Emissions Reduction Program Work Plan. The ISA expires on June 30, 2020 and provides $375,000 in funding. A.R.S. §49-474.02 establishes that the Program can be funded from money appropriated by the legislature, political subdivisions, or gifts, grants, and donations. In addition to allowing for the retirement of residential lawn mowers, A.R.S. §49-474.02 also allows for the retirement of commercial lawn mowers and residential and commercial lawn and garden devices. Lawn and garden devices include leaf blowers, trimmers, edgers, and other similar equipment. In order to continue the Program, MCAQD intends to supplement with settlement funds and will work with other partners such as utilities, cities, and vendors. Donation revenue funds are deposited into the Air Quality Fee Fund (504), as they are received. Donation funds are not local revenues for the purpose of the constitutional expenditure limitation; therefore, expenditures of these revenues are not prohibited by the budget law. The approval of this action requested does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-85-18-016-3-00)

44. REQUEST FOR REVIEW OVER BASELINE Approve an exception to the FY 2019 Budgeting Guidelines and Priorities allowing the Budget Office to review the following Medical Examiner’s requests over Baseline for the General Fund totaling $100,000: 1. $100,000 in Fund 100 (General Fund) Non-Recurring 2. Review of the following one-time item is requested: The OME will use this funding to purchase Laboratory Information Management System (LIMS) software. This can allow a transfer of information among laboratory equipment and the existing case management system, providing for a more efficient and streamlined process. A LIMS will reduce the time involved in what is currently a manual process with multiple possibilities for transcription errors. The software provides case and sample tracking; barcode labeling and scanning; instrument interface; and workflow and data tracking support, thereby offering an audit trail. The overall laboratory testing process is made more efficient, with more secure data storage, reduced data entry error, and reduced use of paper in a more electronic environment. Approval of this action will allow the Budget Office to review this Medical Examiner's request. (C-29-18-007-2-00)

45. RESOLUTION TO DELEGATE TO THE DIRECTOR OF PARKS AND RECREATION AUTHORITY TO EXECUTE COMMERCIAL MANAGEMENT CONCESSIONAIRE AGREEMENTS Adopt a Resolution to Delegate to the Director of Maricopa County Parks and Recreation Department (Director) the authority to enter into Commercial Management Concessionaire Agreements, template attached hereto (CMCA), on behalf of Maricopa County, that are approved “as to form” by the County Attorney’s Office, with properly licensed and insured entities, as necessary, to provide mobile services and goods throughout the Maricopa County Regional Parks and Maricopa Trails (County Park System). This delegation also allows the Director to make certain administrative revisions to the CMCA as well as alter the term, the timing of payments and the nature of the product or service being offered, and terminate the CMCA. CMCAs have no formal solicitation process and are available on a “first-come, first-serve” basis upon request from a concessionaire and approval of the Director. CMCAs do not grant land rights or an exclusive right to use a specific site within the County Park System. Examples of CMCA concessions are food vendors, hiking/biking tours, fishing expeditions and equestrian rides. This delegation of authority is part of an effort to streamline the process for the private sector entering into CMCAs and to expedite offering new and enhanced services for park visitors.
