The approval of this action does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. MCSO engaged the consulting firm of MGT of America to review the indirect overhead cost methodology used to calculate the annual Detention allocation between the General Fund and the Detention Fund, also known as "Maintenance of Effort." MGT recommended changes to the methodology that result in increases to the allocation percentage while significantly reducing the base upon which the rate is applied. The net effect is an $11 million reduction in the maintenance of effort transfer from the General Fund to the Detention Fund for indirect overhead allocations. (C-50-19-015-2-00)

Operating expenses will be paid from Sheriff's Office budgeted funds. These vehicles will be retired at the end of their useful lives with no funding from the general fund or detention fund for their replacement. K-9 vehicles routinely require servicing due to extreme heat conditions and the requirement that they always be running. The use of non-K-9 vehicles to transport K-9's on calls for service when K-9 vehicles are being repaired or having maintenance is not feasible. Approval of this item will allow MCSO to retain K-9 vehicles that are sufficient for intermittent use as needed. (C-50-19-016-V-00)

The previous US Department of Agriculture Forest Service (USDA) Special Use Permit (SUP) for the Aid Station was approved on December 13, 2002 and expired on December 31, 2012; however, the USDA has informed the County in writing that we can continue operations at the site while the USDA works through the backlog of SUPs that need to be renewed. Via the authorization that is the subject of this agenda item, the USDA is allowing the County to proceed with an expansion of our communications facilities at the site while we await our official SUP renewal. Funding for the construction, installation and start-up of wireless communication equipment at the Saguaro Lake Aid Station is part of the Radio System Infrastructure Upgrade Project previously approved by the Board of Supervisors on June 5, 2013, under agenda C-73-13-077-7-00. 74. AWARD CONTRACT FOR CONSTRUCTION ON NORTHERN PARKWAY - DYSART ROAD TO 111TH AVENUE Approve a contract to Pulice Construction, the lowest responsive bidder for construction which exceeded the Engineer’s estimate by greater than 10 percent. The lowest responsive bidder exceeded the Engineer’s estimate by 18 percent. Per the original Board approval to construct: “Award the contract to the lowest responsive bidder, provided that the lowest bidder does not exceed the Engineer’s estimate by more than ten percent" (July 26, 2017, C-64-17-135-5-00). The Engineer’s estimate was $36,297,172. The low bid was $43,045,078, a difference of $6,747,906. County staff and consultants have reviewed the lowest bidder (Pulice Construction) and have determined that the increase is due to increased concrete and steel costs and skilled labor costs. The unit costs in the low bid are comparable to other similar projects which have recently bid in the state; a similar ADOT project recently received a low bid over 30% of the Engineer’s estimate. This project will construct Northern Parkway from a point approximately one quarter mile west of Dysart Road to 111th Avenue, in partnership with the Cities of El Mirage, Glendale and Peoria in conformance with intergovernmental agreement C-91-09-081-M-00. The project is federally funded. Supervisory District No. 4 (C-64-17-135-5-01)

79. IGA WITH TOWN OF GILA BEND FOR THE EXCHANGE OF SERVICES (ENTENTE) Approve the Intergovernmental Agreement between Maricopa County and the Town of Gila Bend for the exchange of services or reimbursement of services (Entente). Either party may terminate this Agreement at any time by furnishing the other party with a thirty (30) day written notice. The purpose of this Intergovernmental Agreement is to identify and define both Parties’ respective roles in the execution of the responsibilities of specific maintenance tasks in areas that cross jurisdictional boundaries. The Agreement provides the opportunity to focus on routine maintenance tasks or emergency highway projects and the availability of the most economical resources by extending beyond jurisdictional or geographical boundaries. The application of the Agreement will benefit areas in the County and the Town where certain types of routine maintenance or emergency highway project activities could be completed by the other party based on scheduled work within the area. Individual tasks performed by either party will be executed upon completion of a Letter of Agreement (LOA) approved and signed by the County Department of Transportation Director and the Town Manager, or their designees. If the value of goods or services exchanged by the Parties is not of equal value, the total aggregate reimbursement to the respective Party will not exceed $250,000 per fiscal year. If no services are exchanged, there is no financial impact. An accounting mechanism will be utilized to track each LOA, as applicable, to identify specific tasks and services and to ensure the exchange of these services is of similar value. AQ-2013-001-RULE 316 (NONMETALLIC MINERAL PROCESSING) Pursuant to A.R.S. §49-479(b), set a public hearing for November 07, 2018 to solicit comments and consider the adoption of proposed amendments of Maricopa County Air Pollution Control Regulations Rule 316 (Nonmetallic Mineral Processing) and the associated proposed revision to the Arizona State Implementation Plan (SIP). Following the public hearing, the Board is requested to adopt the proposed amendments to the rule and to approve submission of the amended rule as a revision to the Arizona SIP. Upon Board approval, this item will become effective November 7, 2018. The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rule 316 (Nonmetallic Mineral Processing) and is proposing to submit the revised rule as a revision to the Arizona SIP. Rule 316 was adopted to control emissions of particulate matter from sand and gravel plants, hot mix asphalt plants, and concrete batch plants. Rule 316 requires compliance with emission limits and implementation of control measures. Rule 316 also includes requirements for training, monitoring, recordkeeping, and reporting. Rule 316 was adopted on July 6, 1993 and revised three times thereafter to incorporate requirements prescribed by the Clean Air Act and the Environmental Protection Agency (EPA). The MCAQD is proposing to revise Rule 316 for the following reasons: to clarify the applicability and several requirements of Rule 316; to consolidate applicable requirements for nonmetallic mineral processing and related operations in a single rule; to incorporate EPA approved alternative control measures and test methods; to ensure the rule applies equitably to similar operations; to correct a deficiency that was noted by the EPA when Rule 316 was approved; to update the compliance schedule for rumble grates; and to address safety concerns identified by stakeholders. Permit fees are not changing due to this action. (C-85-19-006-M-00)

90. AQ-2018-001-INCORPORATION BY REFERENCE 2017-2018 Pursuant to A.R.S. §49-479(b), set a public hearing for November 07, 2018 to solicit comments and consider the adoption of incorporating federal standards into Maricopa County Air Pollution Control Regulations: Rule 360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Following the public hearing, the Board is requested to adopt the incorporations into the Maricopa County Air Pollution Control Regulations. Upon Board approval, this item will become effective November 7, 2018. The Maricopa County Air Quality Department (MCAQD) is proposing to revise Rules 360, 370, 371, and Appendix G by incorporating federal regulations and documents promulgated by the U.S. Environmental Protection Agency (EPA): New Source Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The proposed action will include amending the incorporation by reference date from July 1, 2017, to July 1, 2018, in each of the rules and appendix to remain current with federal regulations. The adoption of the proposed amendments to Maricopa County Air Pollution Control Regulations Rules 360, 370, 371 and Appendix G is necessary prior to requesting the EPA’s delegation of authority to the MCAQD for the implementation and enforcement of the federal regulations and documents. These amendments should not have an economic impact on businesses in Maricopa County and should not impose additional costs on the regulated community, small businesses, political subdivisions, and members of the public beyond that already incurred by reason of federal or state rule or law. The costs of compliance with these rules have already occurred and were considered when the federal and state rules or laws were proposed and adopted. Permit fees are not changing due to this action. No written comments were received regarding this rulemaking. One phone inquiry was received requesting information on what NSPS and NESHAP subparts were incorporated in this rulemaking. The MCAQD verbally provided the specific information. A Notice of Final Rulemaking will be distributed per normal procedures once approved. (C-85-19-007-M-00)
